1. Acceptance of Terms

By accessing or using SubLearn (the "Service"), operated by SubLearn ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and SubLearn. By creating an account, accessing any content, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

You must be at least 16 years old to create an account and use the Service. If you are between 16 and 18 years old, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you must create an account by providing accurate and complete information. You may register using your email address or through a third-party authentication provider (Google, GitHub, Discord, or Facebook).

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Keeping your account information accurate and up to date

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

4. Subscription Plans & Billing

SubLearn offers the following plans:

  • Free — Access to basic features at no cost, with usage limits on AI-powered features.
  • Plus ($6.99/month) — Expanded access including unlimited AI features, advanced vocabulary tools, and priority support.
  • Pro ($12.99/month) — Full access to all features including premium content, unlimited exports, and dedicated support.

Paid subscriptions are billed through our payment processor, Lemon Squeezy. By subscribing to a paid plan, you authorize us to charge your selected payment method on a recurring basis. Prices are in USD and may be subject to applicable taxes.

You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Downgrades and cancellations take effect at the end of the current billing period.

5. Free Plan & Refunds

The Free plan provides access to core features at no charge and does not require a credit card. You may use the Free plan indefinitely.

For paid subscriptions, we offer a 14-day refund period from the date of initial purchase. If you are not satisfied with the Service, you may request a full refund within this period by contacting us at [email protected]. After the 14-day period, refunds are not available for the current billing cycle. For full details, see our Refund Policy.

6. Acceptable Use

You agree to use the Service only for lawful purposes related to language learning. You may not:

  • Upload, share, or distribute content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Use automated tools, bots, or scripts to access the Service without our written consent
  • Use the Service to distribute malware, spam, or harmful content
  • Interfere with or disrupt the Service or servers connected to it
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute access to the Service
  • Use the Service in any way that violates applicable laws or regulations

We reserve the right to investigate and take action against any violations, including suspending or terminating your account.

7. User Content

You retain ownership of any content you create or upload to the Service ("User Content"), including vocabulary lists, notes, and custom study materials. By uploading User Content, you grant SubLearn a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and for ensuring that it does not violate any third-party rights or applicable laws. We do not monitor User Content proactively but reserve the right to remove content that violates these Terms.

8. YouTube Content

The Service allows you to watch and learn from YouTube videos with interactive subtitles. All YouTube content is accessed and displayed in accordance with the YouTube Terms of Service and YouTube API Terms of Service. SubLearn does not host, store, or redistribute YouTube video files.

By using YouTube content through our Service, you also agree to be bound by YouTube Terms of Service and Google Privacy Policy.

9. AI-Generated Content

SubLearn uses artificial intelligence (including models from Google, OpenAI, and Anthropic) to generate exercises, explanations, translations, and other learning materials. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or inconsistencies.

AI-generated content is provided for educational purposes only and should not be relied upon as the sole source of information. We make no warranties regarding the accuracy, completeness, or reliability of AI-generated content. You should verify important information with authoritative language resources.

10. Intellectual Property

The SubLearn platform — including its design, features, code, logos, trademarks, and original content — is owned by SubLearn and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

Your learning data, progress, and personal study materials belong to you. You may export your data at any time through your account settings.

11. Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Third-Party Services

The Service integrates with third-party services including YouTube, Google, GitHub, Discord, Facebook, Lemon Squeezy, and various AI providers. These services are governed by their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

We may include links to third-party websites or services. These links are provided for convenience only and do not constitute an endorsement.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee any specific learning outcomes from using the Service.

14. Limitation of Liability

To the maximum extent permitted by applicable law, SubLearn and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service.

Our total aggregate liability for all claims arising from or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless SubLearn and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

16. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to the Service, other users, or third parties.

You may delete your account at any time through your profile settings. Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Our servers are located in Germany and operated in compliance with European Union regulations, including the General Data Protection Regulation (GDPR).

18. Dispute Resolution

In the event of a dispute arising from these Terms or your use of the Service, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. If a dispute cannot be resolved informally within 30 days, it shall be submitted to the competent courts in Germany.

If you are a consumer residing in the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

19. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or applicable laws. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. For significant changes, we may also send you an email notification.

Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

20. General Provisions

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and SubLearn regarding the Service.
