20 Armed IRS & ATF Agents Raid Gun Store & Take Customer’s Gun Purchase Records.

Twenty heavily armed federal agents pulled in behind Montana’s Highwood Creek Outfitters’ owner Tom Van Hoose as he arrived at his shop Wednesday morning, KRTV reported.

“We have a reputation of dotting all the i’s and crossing all the t’s because there’s so much legal fun to be had,” said Van Hoose. “It’s just not worth doing things that are going to get you in trouble.”

The IRS CID troops took ten hours to copy the information on his computers and download his point of sale software information. But what Van Hoose says really concerns him is the fact that in addition to his accounting and sales records, the agents confiscated 13 years of 4473 forms and copied his firearm acquisition and disposition book.

Anyone who’s ever completed a 4473 form knows there’s no revenue or financial data there. That form is a record of a firearm purchase transaction used to facilitate a NICS background check and potentially trace a gun’s ownership down the road if it’s used in a crime. Gun dealers are required to keep those forms for at least 20 years.

The question then is, why would the IRS want customer transaction information? Van Hoose says the 4473 forms were not included on the list of financial records specifically listed on the warrant the IRS agents served him during the raid. Yet they took them anyway.

According to a news release from U.S. Representative Matt Rosenadale (R-MT), the IRS confiscated all the 4473 forms from the store. According to the Bureau of Alcohol, Tobacco, and Firearms website, generally, the forms must be completed at licensed business premises when a firearm is transferred.

So here we go….. OMB sticking their finger in gun control. Thank the House GOP. The Office of Management and Budget has provided emergency authorization to ATF to immediately use the revised Form 4473. ATF will be publishing the Revised Form for Notice and Comment Review in the coming months.

Due to new statutory requirements set forth in both the NICS Denial Notification Act and the Bipartisan Safer Community Act (BSCA), and to reflect the implementation of ATF Final Rule 2021R-05F, ATF Form 4473 has been revised.  Because the new statutory requirements are designed to enhance public safety, and to ensure compliance with these provisions and Final Rule 2021R-05F, the Office of Management and Budget has provided emergency authorization to ATF to immediately use the revised Form 4473. ATF will be publishing the Revised Form for Notice and Comment Review in the coming months.

ATF encourages all federal firearms licensees (FFLs) to begin using the Revised Form immediately. The Revised Form is available on ATF’s website, and can be downloaded and printed for immediate use. Please note that the entire Form, including instructions, must be printed, and stored together.  Hard copies of the Revised Form will be available through the ATF Distribution Center beginning February 1, 2023. The ATF eForm 4473 application is also being revised and notification will be sent when it is ready for use.

IRS agents confiscated background check forms from the store that contained sensitive personal information about all customers who ever purchased a gun at the shop. The forms do not include financial information, Rosendale said, calling the act an “egregious breach of privacy” that “showed no regard for federal law.”

The danger of federal agents taking this information was not lost on AG Knudsen, who told Breitbart News, “I spoke with the shop owner who told me that 20 heavily armed IRS agents from multiple states in our region served a warrant before his business opened.

They took dozens of boxes full of 4473s — more than a decade’s worth. This is extremely concerning because it seemingly exceeds the search warrant which limited the scope of the search to financial records. These aren’t financial records, they’re records of lawful firearm purchases. What the hell does the IRS need with 4473s? We know the ATF in Washington, DC is trying to scoop up as many of these purchase records as possible, and that’s what it looks like they’re trying to do here.”

“There is no circumstance in which 4473s would be necessary in an investigation spearheaded by the IRS,” Rosendale said in a letter addressed to ATF Director Steven Dettelbach and IRS Commissioner Daniel Werfel.

Flashback: It’s Hillary Clinton & Democrats that deploy tanks that kill Americans

 

Hillary Clinton and her fellow democrats are offended at the sight of a tank? It was she it was reported that ordered tanks and poisonous gas turned onto her fellow citizens in a little town called Waco, Texas.

On April 19, 1993, the F.B.I. finished off its siege of the Branch Davidians’ home just outside Waco, Texas, by pumping poisonous and flammable C.S. gas into a room filled with women and children, driving a tank through the wall, throwing incendiary devices at the survivors.

Surly there was a better way than to slaughter men, women and children- more than 80. And the Clinton’s managed to get by without any MSM condemnation, blaming it all on his Attorney General who got by without a nick and later ran for Governor of Florida.

The Waco siege was a siege of a compound belonging to the religious group Branch Davidians by American federal and Texas state law enforcement and military between February 28 and April 19, 1993.

The group was suspected of weapons violations and a search and arrest warrant was obtained by the ATF. The incident began when the ATF attempted to raid the ranch. An intense gun battle erupted, resulting in the deaths of four agents and six Branch Davidians.

Upon the ATF’s failure to raid the compound, a siege was initiated by the Federal Bureau of Investigation (FBI), the standoff lasting 51 days. Eventually, the FBI launched an assault and initiated a tear gas attack in an attempt to force the Branch Davidians out. During the attack, a fire engulfed Mount Carmel Center and 76 people.

According to Linda Tripp it was Hillary and not Bill Clinton who directed the final assault on Waco.

Mrs Clinton grew more and more impatient as the Waco stand-off came to dominate the headlines during the early months of the Clinton administration, said Bell. It was she, according to Bell’s sources, who pressured a reluctant Janet Reno to act.

“Give me a reason not to do this,” Reno is said to have begged aides shortly before orders were issued for the final assault.

During an interview in early February 2001 the former White House aide alleged that Hillary Clinton pressured the late Vincent Foster to resolve the Waco standoff. As a result more than eighty men, women and children were killed. Appearing on CNN’s “Larry King Live” Tripp suggested that Foster, at Mrs Clinton’s direction, transmitted the order to move on the Branch Davidian’s Waco compound, which culminated in a military style attack on the wooden building.

Her accusations lend weight to charges made previously by Special Forces expert and Waco investigator, Steve Barry. According to the former Special Forces member, Hillary set up a special “crises centre” in the White House to deal with Waco.

Serving with her in the centre was Vincent Foster who, according to his widow was subsequently: “fueled by horror at the carnage at Waco for which the White House had ultimately been responsible.”

Foster himself was found dead, from a gun-shot wound to the head, in a Virginia park three months later. Could he have known too much about Waco?

Journalist Ambrose Evans-Pritchard maintains that Foster had been “drafting a letter involving Waco” on the very day of his death. Moreover Evans-Pritchard says that Foster kept a Waco file in a locked cabinet that was off limits to everyone, including his secretary.

Prior to Waco, Foster was “dignified, decent, caring, smart” says Linda Tripp; in its aftermath though, she said: “…Vince was falling apart.”

She was with the former White House deputy counsel when the news about Waco broke on television. “A special bulletin came on showing the atrocity at Waco and the children. And his face, his whole body slumped, and his face turned white, and he was absolutely crushed – knowing the part he had played.”

“And he had played the part at Mrs Clinton direction,” said Tripp.

Moreover there was a marked contrast between Foster’s heartfelt emotion at the Waco tragedy and Hillary Clinton’s, Tripp insists: “Her reaction was heartless”.

Her accusations give further weight to allegations first levelled in the 1999 documentary on the deadly confrontation, “Waco: A New Revelation.” The film featured the account of former House Waco investigator T. March Bell.

“One of the interesting things that happens in an investigation is that you get anonymous phone calls,” Bell explained in the film. “And we in fact received anonymous phone calls from Justice Department managers and attorneys who believe that pressure was placed on Janet Reno by Webb Hubbel, pressure that came from the first lady of the United States.”

U.S. government poisoned alcohol during Prohibition with deadly consequences

Quite frankly I am weary of Gun stories as well as the fiscal cliff. Either way, blogging goes on and when I caught this story, it was almost as bad. In the name of government and law enforcement so much can go so terribly wrong. While many of us are targeted as right-wing loonies for reporting these events,  our government has a storied past that we should learn from. The steps the government will go to achieve their end. So here we go:

THE CHEMIST’S WAR: The little-told story of how the U.S. government poisoned alcohol during Prohibition with deadly consequences.

Although mostly forgotten today, the “chemist’s war of Prohibition” remains one of the strangest and most deadly decisions in American law-enforcement history. As one of its most outspoken opponents, Charles Norris, the chief medical examiner of New York City during the 1920s, liked to say, it was “our national experiment in extermination.”

… remember the U.S. government’s controversial decision in the 1970s to spray Mexican marijuana fields with Paraquat, an herbicide. Its use was primarily intended to destroy crops, but government officials also insisted that awareness of the toxin would deter marijuana smokers.

By mid-1927, the new denaturing formulas included some notable poisons—kerosene and brucine (a plant alkaloid closely related to strychnine), gasoline, benzene, cadmium, iodine, zinc, mercury salts, nicotine, ether, formaldehyde, chloroform, camphor, carbolic acid, quinine, and acetone. The Treasury Department also demanded more methyl alcohol be added—up to 10 percent of total product. It was the last that proved most deadly.

Frustrated that people continued to consume so much alcohol even after it was banned, federal officials had decided to try a different kind of enforcement. They ordered the poisoning of industrial alcohols manufactured in the United States, products regularly stolen by bootleggers and resold as drinkable spirits. The idea was to scare people into giving up illicit drinking. Instead, by the time Prohibition ended in 1933, the federal poisoning program, by some estimates, had killed at least 10,000 people.” H/T: Instapundit

ATF head threatens anyone thinking about whistle blowing -Video

America’s Watchtower  has been on the trail of the ATF “fast and furious” ,”Gun walking”  story for months and brings us the latest update. On Thursday night, Senator Issa was on Greta’s show, and played a piece of video that should put shivers down everyone’s spine. In typical Chicago syle, threats are clearly made to anyone thinking about being a whistle blower. So here is his piece, and I have added the video.

In the wake of the Fast and Furious scandal which led to the deaths of hundreds of Mexicans and two Americans Todd Jones was brought into the ATF as acting head of the embattled agency under the premise that he would reform the ATF. Apparently his idea of reforming the agency is actually helping the ATF hide its involvement in the deadly scandal because he released a video to his agents entitled “Choices and Consequences” which certainly sounds threatening to anyone in the agency who thinks about blowing the whistle on this deadly scandal.

New gun reporting rules appealed by industry

We sure saw this one coming didn’t we? Why just a couple of border States? Yes, indeed, after we send over thousands of guns to Mexico via Fast and Furious, we now need to crack down on dealers. Just another chip in the attempt to control sales of guns.

Dealers must report within five business days a sale of two or more semiautomatic rifles to the same person. That includes rifles with a caliber greater than .22 and with the ability to accept a detachable magazine.

The ATF issued the reporting requirements as part of a stepped-up effort to clamp down on the weapons flowing across the border to drug cartels in Mexico. The rules affect more than 8,000 gun dealers in Texas, Arizona, New Mexico and California.

 

The gun industry on Monday appealed a U.S. judge’s decision to uphold new Obama administration regulations requiring gun dealers in four states bordering Mexico to report the sales of multiple semi-automatic rifles.

Judge Rosemary Collyer of the U.S. District Court for the District of Columbia ruled on Friday the reporting requirements ordered by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) last year were sufficiently narrowly tailored.

Because the reporting demand “was limited to only certain sales of certain guns in certain states, ATF did not exceed its authority,” she wrote in a 21-page ruling. Now that seems logical and Costitutional doesn’t it??

Gun dealers backed by the National Rifle Association, a powerful lobbying group, and the National Shooting Sports Foundation, challenged the requirements, arguing they would effectively require national registration of firearms sales, which they said the ATF was not authorized to do. ATF says ‘no guns’ if using medical marijuana

One would think that the ATF had created enough havoc in our society. But no, if there is a chance to beat up on the gun dealers, and citizens as well, they will not let it pass. So it looks like the gun dealers will get a chance to play cop and check out the buyer and his medical marijuana. What about privacy laws?Time for the ATF to leave the folks alone. Here tis:

While some citizens may have won the right to use medical marijuana, winning one right may come at the expense of another. 

In a letter to firearms dealers across the country, federal authorities are being clear that firearms should not be sold to medical marijuana users.

The Alcohol, Tobacco, and Firearms agency (ATF) is sending a letter to gun dealers warning them it is illegal to sell the weapons to people who admit smoking medical marijuana and have a medical marijuana card — something the card holders are unimpressed about.

This developing action is something to follow. The Michigan Militia on their website indicates they are not involved. One of the beliefs of the Hutaree, reported, is their concern about an “Anti-Christ”.  Any group that supports violence gives those who would take away gun rights an open door to the MSM and the condemnation of gun ownership. Time will tell the story.

The FBI said Sunday that it had conducted raids in the three states, resulting in at least three arrests. Federal warrants were sealed, but a federal law enforcement official speaking on condition of anonymity said some of those arrested face gun charges and officials are pursuing other suspects. Some of the suspects were expected in court Monday.

It wasn’t clear what prompted the raids, but Michael Lackomar, a spokesman for the Southeast Michigan Volunteer Militia, said one of his team leaders got a frantic phone call Saturday evening from members of Hutaree, a Christian militia group. They said their property in southeast Michigan was being raided by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Lackomar said.

States Rights Asserted in Gun Control Within Borders

Lets get this before the Supreme Court before Potus stacks the court with his picks. 5-4 decisions now, we cannot afford to wait.

A fifth state – South Dakota – has decided that guns made, sold and used within its borders no longer are subject to the whims of the federal government through its rule-making arm in the Bureau of Alcohol, Tobacco and Firearms, and two supporters of the growing groundswell say they hope Washington soon will be taking note.

As the federal government has radically overstepped is constitutional limitations in the past year or so, an explosion of states have begun re-asserting their rights not only with regard to firearms, but also in shielding themselves against government health care, cap and trade global warming taxes, and more,” the report said.

South Dakota Gov. Mike Rounds has signed into law his state’s version of a Firearms Freedom Act that first was launched in Montana. It already is law there, in Tennessee, Utah and Wyoming, which took the unusual step of specifying criminal penalties – including both fines and jail time – for federal agents attempting to enforce a federal law on a “personal firearm” in the Cowboy State.

According to a report in the Dakota Voice, the new South Dakota law addresses the “rights of states which have been carelessly trampled by the federal government for decades.”

ATF Seizes 30 Dangerous BB Guns

Now this is a story for Comrade Lockandload: “With minimal work it could be converted to a machine gun,” Crenshaw said. BB Guns turned into machine guns. Ah, let me think about this for…one second. First they come for the BB guns, then??

A local business owner is flabbergasted after a shipment of 30 toy guns for his store was confiscated by ATF agents in Tacoma.

Brad Martin and his son, Ben, sell the Airsoft BB guns from their store in Cornelius where they’ve been in business for seven years.

The Martins said they buy their stock from Taiwan because the merchandise is less expensive. But the Bureau of Alcohol, Tobacco, Firearms and Explosives seized a shipment of 30 in October. That shipment is worth around $12,000 and the ATF is promising to destroy the entire shipment.

Special Agent Kelvin Crenshaw said the toys can be easily retro-fitted into dangerous weapons.

Brad Martin is furious about the loss of money, for sure, but also in what he now thinks as a loss of his time and the use of government agents to seize toy guns.

“All this manpower, all this time, all this taxpayer money, [it is] wasting my time and my profitability,” Martin said. “[Just] to seize 30 toy guns!”

Ben Martin disagrees that the toy guns could ever be considered dangerous.

“To say these are readily convertible to machine guns is absolutely preposterous,” he said. “The round wouldn’t go into the firing chamber and even if the firing pin did strike the primer the gun would basically blow up in your face.”

“With minimal work it could be converted to a machine gun,” Crenshaw said.
