1. Acceptance of Terms
By accessing or using Pentito, you confirm that you are at least 16 years old and agree to be bound by these Terms and Conditions, our Privacy Policy, Ingame Rules and all applicable laws and regulations. If you do not meet the age requirement or do not agree with these terms, you must not use the game or its services.
2. Purpose of the Game
Pentito is a browser-based online game designed purely for entertainment. Your participation is voluntary, and no legal rights, ownership, or financial claims can be derived from your presence or activity within the game.
3. Guest Access
You participate in Pentito as a guest. Access may be modified, restricted, or revoked at any time without prior notice. We reserve the right to suspend or terminate any account that violates these terms or disrupts the game experience for others. We may suspend or terminate access at our sole discretion, with or without reason.
4. Language of Agreement
The official language of Pentito is English. By accepting these Terms, you confirm that you understand and agree to all conditions, policies, and rules as written in English. No translations carry legal weight or serve as substitutes for the English version.
5. User Conduct
Cheating, exploiting, exploitation of bugs, impersonation of Pentito Staff, harassment, or any other form of abuse is strictly prohibited. We reserve the right to log user activity for the purpose of identifying suspicious behavior and enforcing fair play rules. Violations may lead to immediate suspension or permanent banning.
6. Account Security
You are responsible for the confidentiality and security of your login credentials. We are not liable for any damage or loss resulting from unauthorized access to your account. We reserve the right to lock or suspend accounts in case of suspected compromise.
7. Intellectual Property
All game content, graphics, code, and assets are the property of the Pentito developers. You may not reproduce, distribute, or use any part of the game for commercial purposes without written permission.
8. Data and Privacy
All personal data is handled in accordance with the Privacy Policy and in compliance with the General Data Protection Regulation (GDPR - EU 2016/679). We only collect and store what is necessary to provide and secure the game.
9. Limitation of Liability
Pentito is provided "as is" without warranties of any kind. We are not responsible for loss of data, service interruptions, or any indirect damages resulting from the use of the game. We disclaim any liability to the fullest extent permitted under Dutch and EU law. You acknowledge and agree that your use of the game is at your own risk.
10. Modifications to Terms
We may update these Terms at any time. You will be deemed to have accepted changes by continuing to use the game. We encourage you to review the Terms regularly.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any legal disputes shall be submitted to the competent courts in the Netherlands.
Regardless of your location, this agreement is governed exclusively by Dutch law. Any conflicting local regulations do not alter this jurisdiction.
12. Payments and In-Game Items
All payments made to Pentito are final and non-refundable. This includes, but is not limited to, payments made for in-game currency, credits, features, or digital items.
In-game assets, whether acquired through gameplay or purchased with real money, hold no real-world value. They are non-transferable, non-exchangeable, and may not be sold, traded, or converted to any form of compensation or ownership claim outside of the game.
Pentito is not liable for loss, theft, or deletion of in-game assets. We reserve the unconditional right to remove, modify, revoke, or reset any in-game item, currency, or account status, at any time, without prior notice, explanation, or compensation.
We may dispute any chargeback or payment reversal where digital content has already been delivered. By making a payment, you agree not to initiate a chargeback without contacting us first to attempt resolution.
Initiating a chargeback without valid grounds may be considered a breach of these Terms. In such cases, your account may be suspended or permanently banned, and all associated data and progress may be deleted without further notice.
13. Volunteer Staff & Bugs
Pentito is maintained and moderated by a team of volunteers. These individuals act on behalf of the game's interest but carry no legal responsibility for their actions. By using the game, you agree that neither Pentito nor its volunteers can be held liable for any decisions made, including - but not limited to - account bans, suspensions, administrative actions (such as admin kills), or the removal of in-game assets.
Even in the case of an unjust or mistaken action, no compensation, explanation, or appeal is guaranteed. All administrative decisions are final unless explicitly reversed by the core development team.
Pentito is a living online game that may experience bugs, technical problems, or other unintended behavior. In such cases, we reserve the full right to revert actions, remove items or currency, and correct data without notice. We offer no warranties and accept no liability for any disruption, loss, or consequences resulting from such issues.
14. Copyright Infringement
If you believe any content on Pentito infringes your copyright, please notify us at [email protected] with relevant details. We will review and, if necessary, remove infringing content promptly.
15. Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, war, internet outages, or acts of government.
16. Entire Agreement
These Terms & Conditions, together with the Privacy Policy and Ingame Rules, constitute the entire agreement between you and Pentito regarding your use of the game. Any failure to enforce a provision is not a waiver of our rights.
