Library Policies

Bulletin Board/Pamphlet Table Display Policy

The Flagler County Public Library (FCPL) provides space for dissemination of information of interest to the Flagler County Community. Priority will be given to materials relating to the Library, Friends of the Library and the Flagler County government. As space allows, public notices and announcements of upcoming meetings, civic, cultural, educational and recreational events sponsored by nonprofit organizations may be posted with permission of the Library Administration.

All materials are to be reviewed by Library Administration before being posted. The brochures, hand-outs and flyers will be displayed under the following guidelines.

  1. The community bulletin board and brochure/handout displays are provided as a public service to publicize local groups, meetings, cultural events, non-partisan political events, fundraising events for nonprofit organizations, educational opportunities or other services of a nonprofit nature.
  2. Items will be signed and dated when posted on the community bulletin board. Items will be displayed for one month or until the date of the event, whichever occurs first. The library will not be responsible for saving meeting notices or posters.
  3. Campaign literature, announcements of religious activities, and personal notices will not be posted.
  4. Advertisements, newspapers, or commercial notices by a for-profit organization will not be posted.
  5. Notices promoting political parties, candidates, those advocating the election of any candidate, or a stand on any issue on an election ballot, will not be displayed.
  6. Posters, petitions, etc., that advocate a position on a public issue will not be displayed.
  7. All items for community bulletin boards and brochure/handout displays must be approved by Library Administration. Items for consideration may be left with a staff member, to be delivered to library administration for approval.
  8. Display items must be of reasonable size in relation to the space available and may be rejected if they detract from the effective use of the provided space.
  9. The use of the library’s bulletin boards and or display does not constitute an endorsement of any organization’s policies or beliefs.
  10. All items selected for display are at the discretion of the Library Administration of the Flagler County Public Library. These decisions of the Library Administration may be appealed in writing to the Library Board of Trustees.

Collection Development Policy

Roles of the Flagler County Public Library include the following:

Independent Education Center

Customers can pursue self-determined and self-paced study on various subjects through use of library collections, resources and services. The library supports an educated, self-reliant and productive citizenry.

Formal Education Support Center

The library research and instruction staff assists all users in meeting educational objectives through a varied curriculum of services, resources, classes and workshops.

Stimulate Imagination

Library collections, resources, and classes provide a curriculum to excite the imagination by featuring high demand, high interest materials for all ages.

Engaging and Enlightening Experiences

Through use of cultural and community center concepts, events, and partnerships the library will provide a comfortable place to visit, enlightening experiences, and an engaging/skilled staff to assist and instruct.

Policy Objective

The Collection Development Policy is intended for use by library staff as a guide, and for use by customers as information, on the selection and deselection of materials offered by the Flagler County Public Library. This policy is guided by the vision and mission statements and the roles of the library system to show that the library is dedicated to providing materials that reflect the needs and demographics of the community it serves. In addition, the library shall strive to maintain a collection that reflects the “Outcomes and Standards for Florida Public Libraries, 2015” set forth by the Florida Library Association.

Budget and Acquisitions Statement

The library materials budget is evaluated on an annual basis and revisions are made using the circulation statistics. The budget does not allocate specific amounts to the individual subject areas but instead allocates funds based on the major collections including Adult, Juvenile, Young Adult, Audio. DVD/Blu-Ray, and Digital Media. A majority of library materials are purchased from an approved library vendor for reasons of economy, consistency and expediency. As needed, an item may be purchased direct from the publisher.

Responsibility for Material Selection

Library Administration, working within the policies and guidelines set forth by the Library Board of Trustees and the Flagler County Board of County Commissioners, oversee materials selection for the Flagler County Public Library. Library Administration will delegate this responsibility to qualified library staff who, because of their education, training, or experience, have the knowledge to select items and will act in accordance with library policy.

The selection of items for inclusion in the library collection is an informed and interpretive process, involving a general knowledge of the subject and its important literature, a familiarity with materials in the collection, awareness of the bibliographies of the subject, and recognition of the needs of the community.

Tools used in selection include professional journals, trade journals, subject bibliographies, publisher’s catalogs and promotional materials, reviews from reputable sources, lists of recommended titles, and sales representatives for specific materials. Customer recommendations/requests are also an important source and are given consideration.

Customer Recommendations/Requests

Library customers may request that the library purchase items for the collection by submitting a Materials Suggestion for Purchase form, located in-person at the Customer Service Desks or online through the library website (www.flaglerlibrary.org). This form is not a commitment for purchase by the library. Consideration for purchase will be based on library industry standards of evaluating information, publication date, availability, cost, demand for the item, its capacity to fulfill a need within the library collection and any budget limitations. If an item is selected for purchase, the requesting customer will be notified when the item becomes available.

If the library is unable to fulfill a material suggestion request, the customer will be notified and given the option to request the item through Interlibrary Loan. Interlibrary loans allow the library to request an item that we do not own from another library that also participates in the program. There is a processing fee of $2.00 per item requested. Although the Library has an almost 95% fill rate there is no guarantee and the fee is non-refundable. Depending on the nature of the item requested, some limitations may apply. Donations/Gifts

The library accepts material donations based upon the availability of donation volunteers. Please call the library at (386)446-6763 for the days/times donations are accepted. We are unable to accept items in poor condition, textbooks, encyclopedias, and unauthorized copies of DVD’s and VHS tapes. Once an item is donated it becomes property of Flagler County and will be used as deemed appropriate. Donated items may be added to the collection, sold in the library bookstore and book sales, or discarded. Customers who wish to make a monetary donation to the library may do so by completing the Monetary Donation Form and designate how they would like those funds used. Monetary donations can also be made to the Friends of the Library of Flagler County by seeing a library staff member or mailing to the Friends of the Library, P.O. Box 353344, Palm Coast, FL 32135-3344.

*Library volunteers are not qualified to appraise items and set a value. Please see the Internal Revenue Service (IRS) Publication 561 “Determining the Value of Donated Property” for guidance.

Censorship Policy

The Flagler County Public Library and the Library Board of Trustees act in accordance with the statements on material selection as expressed in the American Library Association’s Library Bill of Rights and on Intellectual Freedom. The library recognizes that library materials may be offensive or controversial to some customers. The library expects each user to determine the appropriateness of the materials they select for personal use. Parents and legal guardians have the ultimate responsibility for what materials their children check out. Library staff, volunteers, and constituents will not act in loco
parentis.

If a customer would like to challenge an item that is available at the library, they may do so by completing a Request for Reconsideration of Library Material form, available at the Customer Service Desk. All inquires are taken seriously and will be carefully reviewed. For more information, please refer to the Materials Complaint Process for Customers Policy, located on the library website or by inquiring at the Customer Service Desk.

Weeding, Repair and Discarding Materials

The public library’s role is to provide our community with the best quality and most current collections. This means that annually some of our collections must be withdrawn or discarded. The professionally accepted rule of thumb is to weed out 5% of the collection annually. This allows turnover of the collection every twenty years. Our library staff makes decisions as good stewards of the taxpayer dollar using methods consistent with library industry standards to ensure that our collection will remain relevant, clean and up to date. Materials that no longer meet the stated objectives of the library (including items that have become damaged or obsolete) will be systematically withdrawn according to the accepted professional practices as described in the publication, “CREW: A Weeding Manual for Modern Libraries”(Continuous, Review, Evaluation and Weeding). This method has been professionally accepted for more than 30 years as the guidelines for evaluating and weeding any public library’s collection.

In keeping with this method, the physical and electronic materials in the Flagler County Public Library collection may be weeded using specific criteria including but not limited to the following:

  1. Misleading
  2. Ugly or Physical condition
  3. Superseded or outdated
  4. Trivial
  5. Irrelevant
  6. Elsewhere
  7. Suitability to the community
  8. Quality of content/accuracy
  9. Multiple copies no longer needed
  10. Space constraints
  11. Change in technology or format
  12. Publisher restrictions
  13. Usage statistics

Exceptions to the weeding criteria may be made for material of local/historical significance, materials with gift plates, or standard titles that are out of print or for other reasons cannot be replaced. Physical materials removed from the collection will either be repaired, replaced or discarded after careful review
by designated library staff.

Repair: The library does not have a budget to use a commercial bindery service for repairs, nor do we have staff or supplies to handle major bindery functions. As a result of these limitations, the library uses volunteers to do simple repairs to the binding of books that have become unglued or worn and uses a special repair machine for compact discs with minor scratches that prevent the disc from playing.

Replace: Withdrawn items are not automatically replaced. Replacement is considered in relation to adequate coverage in a specific subject area, availability of a more current or quality content title, suitability according to selection criteria and demand for the title. If it is determined a title should be replaced either with the same title, a newer edition, or an equivalent title from the same subject area, the information will be given to a library staff member for inclusion in a future order for purchase as budget allows.

Discarded: Physical material that has been removed from the collection and is not eligible for repair, meets the above criteria, and has been reviewed by a designated library staff member will be discarded according to the Flagler County Purchasing Department rules and regulations which may include any of the following:

  1. Sell
  2. Donate
  3. Recycle
  4. Destroy

The method of disposal of the material will depend on condition, accuracy, quality of content, and popularity.

Collection Development Guidelines

Criteria for Material Selection

Materials are considered for acquisition using the library industry standard criteria including but not limited to the following.

  1. Literary, historic, artistic or authoritative value
  2. Current interest or permanent value to the community
  3. Popular appeal or public demand
  4. Relevance of subject, format, and reading level for the intended audience
  5. Competence of the author and accuracy of content
  6. Reviews from reputable professional resources and mainstream media sources
  7. Availability of material through other resources
  8. Annual budgeted amount for the collection category
  9. Availability from standard publishers and vendors
  10. Format, changing technology
  11. Number of pending hold requests

Material Types and Selection Procedures:

Newspapers and Magazines

The newspaper collection is developed to provide an assortment of local, national, and financial news that will best meet the needs of our customers. These newspapers are selected based on authoritative content, quality of news presented, and popularity within the library’s service area. Current editions of national newspapers are kept at the customer service desk until the next edition is received. Customers can access these materials by presenting their library card or ID to a staff member at the customer service desk. Newspapers may not be removed from library property.

The library provides print and online access to a general selection of magazines that are popular, in demand or meet the informational or recreational needs of the community. Subscriptions and usage statistics are reviewed annually by library administration.

Reference Materials

A limited selection of reference materials are provided for all ages. These include a broad overview of all subject areas such as encyclopedias, dictionaries, atlases, directories, handbooks, indexes, almanacs and community information and referral resources. All reference resources are for in-library use only.
Other items considered part of the reference collection and do not circulate can include local history and genealogy materials. A majority of the local history and genealogy materials are received through donations and are then reviewed by a professional library staff member for inclusion into the collection based on but not limited to the following criteria:

  1. Physical condition
  2. Merit or authoritative value
  3. Importance of the subject matter to the demographics
  4. Reputation and qualifications of the creators, producer, publisher and/or author
Electronic Resources

The library provides access to electronic resources in order to supplement the print collections, to provide K-12 homework support, and to meet the informational needs of the general public.

  1. The Internet (see Internet and Computer Use Policy)
  2. Library computer use of word processing, spreadsheet and related software
  3. Technologies for saving, printing, scanning and faxing data
  4. State funded Florida Electronic Library
  5. Flagler County Public Library subscription databases
Foreign Language Selection

The Foreign Language collection is developed to reflect the diverse community that the Flagler County Public Library System serves. The library’s collection currently houses materials written in Russian, Spanish, Polish, and German. Due to budget constraints, and low demand, a limited selection of foreign language materials may be purchased annually.

Audiovisual Material

The library purchases and maintains current AV materials for use by the general public. The purpose of this collection is to provide customers of the library with access to DVDs/Blu-rays that are culturally relevant, entertaining, educational, and meet the informational needs of the community.
Collection coverage may include but is not limited to:

  1. Major American and foreign award-winning feature films
  2. Selected non-fiction documentary films
  3. Popular new releases
  4. General films with appeal to the community
  5. Non-fiction subjects such as exercise, travel, home improvement and cooking
  6. Customer requests that satisfy a general appeal criteria
  7. Professional training and continuing education resources
Fiction

All fiction materials, including adult, young adult, and children’s materials, are selected for the collection based on popularity, demand, and appropriateness for the collection. Titles from bestselling authors are on standing order through an Automatically Yours program, which ships new titles to the library as they become available. Library staff determines which authors will be acquired through this system.

Items are also chosen using professional book reviews including Publishers Weekly, BookPage, and the Library Journal. Other sources include the New York Times bestsellers list, Amazon’s top 100 bestsellers list, and customer submitted requests. Youth and Young Adult materials are purchased in a variety of formats and for appropriate grade levels. Preference is given to award winning titles including, but not limited to, Caldecott and Newbery award winners, the Sunshine State Young Readers Award program, and materials that appear on the reading lists of area schools. The library does its best, within budget constraints, to accommodate requests for school reading materials, however, the Flagler County Public Library is not responsible for purchasing all titles that are considered required school reading.

Non-fiction

The non-fiction collection is developed to provide quality, factual resources in all fields of knowledge to meet the informational and cultural interests and leisure needs for all ages. Materials are chosen based on accuracy and authenticity of factual material presented; currency and timeliness of the material; quality of writing; diversity of viewpoints and opinions; award winning and bestselling titles; current circulation of materials in the various subject areas; quality of illustrations; and quantity owned in a subject area. The library’s non-fiction collection provides, but is not limited to the following:

  1. Current medical, health, legal, test preparation, travel, business, and technology
  2. Popular biographies, American and world history, music, architecture and the arts
  3. General self-help books in psychology, parenting, cooking and crafts
  4. Florida related materials (gardening, travel, history, etc.)

Local government documents

Large Print

Many of our fiction and non-fiction titles are offered in Large Print. Depending on availability, Large Print selection is largely based on what titles are currently popular in regular print. The Automatically Yours program is also utilized to acquire bestselling titles in Large Print.

Audio Books

The library purchases audio books on compact disc and downloadable format for all ages. Items on compact disc are chosen based on popularity, customer requests, and to provide audio books in a variety of genres to best fulfill the needs of the community. Due to demand, most titles purchased are fiction, however, popular non-fiction items are also considered. As new technologies and formats become available, the library will consider purchases based on ease of use by public, licensing restrictions, remote or in-library access, cost, and space constraints.

eBooks/eAudiobooks

The library provides downloadable eBook collections accessible through a variety of apps and devices. Currently available apps that offer eBooks and eAudiobooks can be found online through the library website or by asking a customer service staff member for assistance. Selection is based on local criteria including, but not limited to, popularity, customer requests, price, demand, and availability.

Browsing Paperbacks

The library utilizes paperback book donations to provide browsing paperbacks. These are paperback novels that do not require a library card for borrowing. Customers are required to inform circulation personnel of how many items they have selected, and although no time limit is specified, they are requested to bring them back when they are finished. Browsing paperbacks are shelved separately from the main collection and are identified by stickers on the spine of the item. The library budget is not used to purchase browsing paperbacks.

Law Collection

The County’s law collection is housed at the Palm Coast Branch of the Flagler County Public Library System. A majority of law materials are now available through a legal database. The Flagler County Public Library annually subscribes to legal databases to provide the most up to date and current legal information. All print law materials are considered reference items and may not be removed from library property. Collection development is determined based on the needs of the legal community and average layperson. Continuous publications are kept current as updates become available and the collection is reviewed annually.

Self-Published Books

The library receives numerous requests from local authors to add their books which they have self-published or published at their own expense. Often, these books do not meet the requirements as outlined in the criteria for material selection and have not been reviewed by any professional or peer reviewed source. Although the library wishes to support local authors while maintaining a standard needed for the collection, due to budget constraints and the volume of self-published/print-on-demand titles available, the library does not purchase self-published books for the collection. However, a local author may donate a copy for consideration.

Items excluded from the collection

Certain items and item formats are excluded from the library collection but may be added at the discretion of library administration. These materials include rare books, textbooks, slides, 16mm films, filmstrips, records, artwork, sculpture, highly technical and specialized materials, audiocassettes, VHS, and any other format that will not hold up to repeated use by the public. Although we do not purchase Microfilm or Microform products, we do own a small collection located in the Palm Coast Branch Library. This collection is for in-library use only.

Customer Service and Access Guidelines

Customer Service and Access Guidelines

Policy Statement: The Flagler County Public Library is committed to offering excellent library service to all, which includes helpful and knowledgeable staff, quality facilities, and access to relevant informational resources and community services. Customer Service is a top priority of the library with library staff acting as the bridge between the public and access to materials and information. In essence, staff will treat all library customers with the same level of fairness and respect.

Objectives:

  • The Flagler County Public Library will provide equal access to all library resources, services and its collections.
  • Staff members will enable successful library use by assisting customers with the library’s resources and equipment as needed and on a first come, first served basis.
  • Each staff member will provide the highest quality customer service and ensure the best customer experience possible.
  • Staff will make every attempt to provide an alternative if they are unable to comply with a customer request.
  • Staff members should greet every customer who comes to the library in a friendly manner and make every effort to help meet their needs.
  • Staff should be knowledgeable about library services, resources, policies and procedures and be able to explain these to the customer.
  • Per Florida Statute 257.261, staff will maintain the confidentiality of all customer library registration and circulation records.

Exam Proctoring

Policy Title: Exam Proctoring
Effective Date: March 10, 2025

As a public service and as part of our effort to support the goal of lifelong learning, the Flagler County Public Library provides exam proctoring, subject to staff availability, and in accordance with the following conditions:

Contacting the Library

A minimum of one-week advance notice is required before any tests will be proctored. Students who need a test proctored at the library should direct the testing institution to contact the Research Department at 386-446-6763, option 2. All telephone inquiries from a student or testing institution must be followed by a written request and proctor agreement including all restrictions and requirements. The library will then inform the institution if we are able to meet those restrictions and requirements. The library reserves the right to deny this service.

Scheduling the Exam

If the library agrees to proctor the exam, the student must contact us at 386-446-6763, option 2 to schedule a time. Exams will be administered during the library’s normal operating hours but must be completed 30 minutes before the library closes. The student and/or institution should be advised that the exam will be proctored by whichever research desk staff member is currently on duty at the time the exam is taken. We do not assign specific staff to proctor exams. If for some reason the staff member must leave prior to completion of the test, he or she may designate another staff member to sign any required documentation. The library reserves the right to cancel or change the date of any proctored test due to inclement weather, computer malfunctions, etc.

Online Exams

Online exams may be completed using library computers. The library cannot guarantee the speed of its internet connection, or that the internet connection will not be interrupted during the test. It is the students’ responsibility to ensure library computers are adequate for their test taking requirements. Students may bring their own laptops and connect to our wireless network, but library staff will not advise or assist in configuring personal laptops or software.

Supervision

Prior to administering the exam, the proctor will verify identity of the student through a valid photo ID and the name on the identification must match the name on the testing materials. The proctor will read and follow all instructions from the testing institution. The student will be seated within sight of the Research Desk. Due to daily business demands of a public library, the library staff cannot ensure a quiet environment; nor can we ensure that staff will closely observe the student during the entire exam. The student is responsible for following all instructions and keeping track of his/her own time. All supplies needed for the exam must be brought by the student or supplied by the testing institution.

Returning the Exam to Testing Institution

The library will not pay for postage or other shipping charges. If library staff is required to mail completed exam back to the testing institution, the student or testing institution must provide the envelope or package as well as postage or tracking number if such is required by the student and/or testing institution. If the testing institution allows return via fax, that information should be included in the original instruction packet. The library cannot assume responsibility for completed tests that are not received by the testing institution. The student must contact the institution to determine if the completed test was received.

Fees

Exam proctoring fees will be set at $15.00 per exam. Requests for exams in series will be treated as separate requests. All fees are payable in cash or credit/debit card only and must be paid prior to administering the exam. There is an additional fee associated with the use of a credit/debit card. The library charges $0.15 per page to photocopy and $1.00 per page to fax/scan.

General Limitations

Due to legal and ethical matters, the proctor will not sign a proctoring statement that attests to more than they are able to do. The proctor will not enter his/her personal information (Social Security number, driver’s license, home phone number, home address, etc.) on the proctoring materials.

Facility Rules and Code of Conduct

The Flagler County Public Library encourages people of all ages to visit and utilize its resources
in a safe and comfortable environment that is appropriate to the mission of the library.

The following is prohibited:

  1. Loud and disruptive noise. All conversations, electronic equipment and cell phones must be kept at low volume.
  2. Leaving personal items unattended. Personal items found unattended will be discarded. The library is not responsible for personal items left on library property.
  3. Activities or behaviors which are likely to result in injury or harm to others, including visitors or employees.
  4. Activities or behaviors which are likely to result in damage to county property.
  5. Tampering with or unauthorized use of interior/exterior facility systems or devices. This includes but is not limited to electrical, plumbing, locks, doors, or cameras.
  6. Engaging in behavior that is disruptive, harassing, or threatening in nature to library patrons or staff. This includes stalking, prolonged staring at or following another with the intent to annoy, or intentionally behaving in a manner that could reasonably annoy or disturb.
  7. Remaining on library property after the posted hours of operation with intention to camp or sleep. This is prohibited per Flagler County Code of Ordinances: Chapter 20, Article I, Section 20-2.
  8. Disruptive or unsafe behavior that intentionally interferes with employees in the performance of their duties or with the proper use of the facility by others.
  9. Possessing, selling, distributing or consuming any alcoholic beverage, except as allowed for an approved event.
  10. Blocking access to the building, including doorways, walkways, ramps, or parking access.
  11. Sleeping within the building or outside areas including entrances, exits, benches, and sidewalks.
  12. Panhandling or unauthorized Solicitation. (See Petition & Solicitation Policy)
  13. Refusing to respond and/or comply with direction from Library Staff.
  14. Bringing animals into the building, except for service animals and those approved for Library programming.
  15. Eating and/or drinking outside of designated areas.
  16. Entering the Youth Services areas unless accompanied by a youth, or without the need to access youth materials.
  17. Inappropriate displays of public affection.
  18. Being under the influence of any controlled substance, intoxicating liquor or beverage.
  19. Smoking, other forms of tobacco, vaping and/or electronic cigarette use within the building is strictly prohibited. All other areas including entrances, exits, and sidewalks, are smoke-free.
  20. Improper clothing being worn in/on library property. Patrons are required to wear clothing and shoes at all times while in the library. Bathing suits are not permitted.
  21. Engaging in any activity prohibited by law.
  22. Unreasonable use of rest rooms, including laundering, bathing, shaving etc., is prohibited.
  23. Violations of the Flagler County Internet Access Policy and the Safe Child Policy
  24. Possessing weapons except those authorized by law
  25. Littering.
  26. Bodily hygiene that constitutes a nuisance to other persons.

The Library reserves the right to require anyone violating the Facility Rules and Code of Conduct to leave the Library for the remainder of the day. Serious or repeated misconduct may lead to the revoking of Library privileges or the involvement of law enforcement.

I. Purpose

The purpose of this policy is to maximize usage of meeting spaces at the Flagler County Public Library System and to establish equitable fees to be collected from users of such library spaces.

The Flagler County Public Library System is an information center for the community. The primary function of library spaces is for library activities, including programs presented by library staff, Friends of the Library, Flagler County Government and other organizations affiliated with the library. The library will reserve the right to review the meeting agenda if it is not clear as to whether the usage meets the room guidelines.

II. Who May Use

The Flagler County Public Library @ Nexus offers the Innovation Lab and Podcast Booth for the use by non-profit businesses, organizations, groups and citizens to engage in civic, educational, cultural, recreational, charitable or government interest activities. Use of the Innovation Lab and Podcast Booth are available when they are not required for library programming, with such usage being on a first-come, first-served basis. Library Administration reserves the right to reschedule confirmed reservations to accommodate Library-sponsored programs and events or reject a reservation request if the anticipated meeting is likely to be unreasonably disruptive to regular Library functions. An attempt will be made to provide forty-eight hours’ advance notice if cancellation becomes necessary.

III. Limitations

  1. All meetings and programs in the Innovation Lab must be open to the public. No partisan political activities, social or private gatherings such as showers or birthday parties are allowed (see Community Room for these activities). The Innovation Lab is not to be used as a headquarters for any organization or the sole and/or primary location to conduct regular business operations. Dues and/or Admission fees may not be charged nor sales made. Promotion of products or services, or donations solicited except in conjunction with a library or Friends of the Library program is not permitted. However, a fee for resource materials, books, or payment for a program speaker may be collected upon approval of Library Administration. Library-related fund-raising activities are allowed. As such, Library Administration reserves the right to review all meeting agendas to ensure the usage meets these guidelines. Granting permission for use of the rooms does not imply endorsement of the aims, policies or activities of any group by the Flagler County Public Library or Flagler County.

IV. Equipment

With the exception of the equipment made available by the Flagler County Public Library, the library will not provide electronic or other meeting support materials such as markers, paper, etc. Meeting organizers are permitted to bring their own equipment, but library staff are not allowed to support its operation.

The library makes every effort to ensure that the equipment is in good working condition and performs regular equipment checks to ensure working condition. General knowledge and use of equipment is required. No special training and/or staff intervention will be provided. If damage occurs to equipment, replacement of equipment or full reimbursement of cost associated with repairing or replacing equipment must be remitted.

  1. Innovation Lab: presentation access with 65” television and DVD player.
  2. Podcast Booth: RØDECaster Duo Compact All-in-One Audio Production Solution for Podcasting, Streaming, Music Production and Content Creation, Microphones (2) with stands, and Headphones (2).

Definitions

  1. Library Space Definitions and Uses
    1. Innovation Lab: Bunnell Library @ Nexus classroom style room.
    2. Podcast Booth:
    3. Outdoor Areas: Such outdoor areas shall include, but not limited to, Library patios, and parking lots. Designation also includes open space and land owned by the library department.
    4. Youth Services Program Room: This is a multi-function room used only for library activities, for programs presented by library staff.
    5. Community Room: See separate policy and procedures.
  2. Non-Profit Group or Entity
    1. Exempt from taxation under any subsection of Section 501(c) of the Internal Revenue Code.
    2. Civic Groups/Associations include but are not limited to property owners’ associations, hobbyists’ clubs, collectors’ clubs, garden clubs, car clubs and all other similar clubs, groups or organizations. The primary focus of these groups is inward toward the group’s members.
  3. Partisan Political Activities
    Specific solicitation of political campaign contributions; political meetings not open to the public.

VI. Fees

All fees must be paid on the day and time of the meeting. The forms of payment accepted are cash or credit/debit card. If a credit/debit card is used a convenience fee will apply.

  1. Innovation Lab: No charge.
  2. Podcast Booth: No charge for up to two hours per day. There is a $25/hour charge after the first two hours.

VII. Room Capacity

Per order of the Fire Official the maximum attendance for programs or meetings in the Innovation Lab is one hundred nineteen people. The Innovation Lab has chairs/stools and approximately 9 six-foot long tables available for use. Attendance at the meetings must be limited to the capacity of the room. Meetings are to be held during library hours and must adjourn 15 minutes prior to the scheduled closing of the library. Maximum Capacity is 60 for the Innovation lab and 2 for the Podcast Booth.

VIII. Reservations

  1. The library reserves the right to limit the number of reservations by any organization so that all groups may have a fair opportunity to use the rooms. Meetings held in the Innovation lab must have at least 10 people in attendance for use, but no more than the assigned maximum room capacity. Meetings will not be scheduled more than once per month, but Library Administration may waive enforcement of this aspect provided such waiver does not interfere with the primary function of this room.
  2. Library Administration reserves the right to reject a reservation request to accommodate library-related programs. The library makes no guarantee that the date and time requested will be available and will provide alternate dates and times as necessary.
  3. Reservations may be made by phone or in person through calling the Bunnell Library @ Nexus. No reservation is confirmed until you receive an email confirmation from the library along with a list of dates and times the room is reserved.
  4. All organizations, groups or individuals using the Innovation Lab must complete, sign and at the request of the library staff, update a Room Application. The application shall incorporate by reference this Policy and the Facility Rules and Code of Conduct and shall recite that the applicant group has received a copy of this policy and the rules of conduct and agrees to abide by the terms and conditions of both.
  5. Applications for use of library space must be submitted by a Flagler County Public Library Card Holder in good standing (defined as a zero balance) and who is at least 18 years of age. The applicant must be present when the meeting is held and take full responsibility ensuring that all attendees follow the Policy and Facility Rules and Code of Conduct. The person signing the application assumes complete financial responsibility for any damage to the room or any furniture and/or equipment used.
  6. Organizations/Groups or Individuals must notify the library at least 48 hours in advance if a reservation is cancelled. A maximum of (3) three cancellations is allowed per fiscal year. Repeated failures to notify the library of cancellations will result in privileges being revoked.
  7. Annual requests will be accepted in November for the following year. All other requests should be submitted at least seven days prior to the meeting date in order to allow sufficient time to process the application.
  8. When requesting a reservation please allot enough time for your group/organization to set-up and clean at the end of the meeting within the requested timeframe. No organizations, groups or Individuals will be allowed access to the room prior to their scheduled time. Scheduled time will include no more than 30 minutes for set-up and 30 minutes for clean up. Any organization, group or individual interfering or requesting another user to relinquish or shorten their time may have their privileges revoked.
  9. Any request to access the room at a date and time not listed on a previously approved & confirmed application may be denied use whether or not another group already occupies the room.

IX. General Guidelines and Regulations

  1. Liability
    The Organization, Group and/or INDIVIDUAL agrees to indemnify and hold the County and its officers, agents, and employees harmless from any and all liability, damage, actions, claims, demands, expenses, judgments, fees and costs of whatever kind or character, arising from, by reason of, or in connection with the use of the facilities described herein.
    It is the intention of the Organization, Group and/or INDIVIDUAL that the COUNTY and its officers, agents and employees shall not be liable or in any way responsible for injury, damage, liability, loss or expense resulting to the user and those it brings onto the premises due to accidents, mishaps, misconduct, negligence or injuries either in person or property.
    The Organization, Group and/or INDIVIDUAL expressly assumes full responsibility for any and all damage or injuries which may result to any person or property by reason of or in connection with the use of the facilities pursuant to this agreement and agrees to pay the COUNTY for all damages caused to the facilities resulting from the user’s activities hereunder.
    The Organization, Group and/or INDIVIDUAL represents that its activities pursuant to this agreement will be supervised by adequately trained personnel, and that the user will observe, and cause the participants in the activity to observe, all safety rules for the facility and the activity. The Organization, Group and/or INDIVIDUAL acknowledge that the COUNTY has no duty to and will not provide supervision during the activity.
  2. Use and Care of Facilities and Equipment
    The library is not responsible for any equipment, supplies, exhibits or other materials owned by the group and used in the library. The library does not provide storage space for any groups other than the Friends of the Library.
      1. Materials or signs/posters may not be affixed to the walls, ceilings, doors or windows. Egress routes may not be obstructed in any way and exit signs must remain clearly visible. Limited decoration is allowed but certain types are prohibited. Restrictions include but are not limited to items which make cleaning and vacuuming difficult, burning candles, incense or any type of open flame.
      2. Chairs instead of stools are available but the group is not allowed to alter the room configuration for their meetings. Library staff will not provide assistance in setting up or cleaning library spaces.
      3. Organizations, groups and/or Individuals using any library spaces must follow the Facility Rules and Code of Conduct, which include no smoking and no consumption of alcoholic beverages.
      4. Accidents must be reported immediately to a member of the staff, and an incident report must be filled out.

    X. Rules of Marketing or Room Reservations

    No notices, press releases, posters, flyers or other materials promoting or announcing events held in Library spaces may be distributed without prior approval of Library Administration. Use of library spaces does not constitute endorsement. Any advertisement or announcement implying or specifically stating such endorsement is prohibited. The following rules apply to materials and/or methods used to advertise, promote or encourage attendance at any event, class, or other program held in the library:
    1. Applicants are solely responsible for marketing any event held in the library Innovation Lab or Podcast Booth.
    2. Any printed, electronic, social media posts or other marketing materials that include the library’s name and address must include the disclaimer: “This event is not sponsored or endorsed by the Flagler County Public Library or Flagler County.” Any material published by an applicant that does not include the disclaimer may disqualify the applicant from future use of the library’s meeting room.
    3. Usage of the library phone number as a contact phone number on marketing materials of any type, including but not limited to, print, verbal, or digital, is prohibited. The library and its staff will not serve as a point of information for patrons who may have questions regarding the content of the program. By completing an application, the applicant agrees that the library can refer any patrons to the applicant for more information using the contact information supplied on the application.
    4. Applicants must not attempt to solicit attendance from library patrons by distributing marketing materials or verbally requesting their attendance within or immediately outside of the library facility.

    XI. Use of the Meeting Room/Library Spaces is a privilege.

    Any violation of these rules as determined by Library Administration may result in cancellation of the group’s future meeting privilege as well as financial assessment of damages incurred. Library Administration will provide written notice to the organization, group and/or individual of the decision to deny use or assess fees. If the organization, group and/or individual choose to appeal the decision, they must provide written notice within 15 days of the date of the letter to the Library Board of Trustees. The Board of Trustees will address the grievance at the next scheduled meeting following receipt of the complaint and will render a decision as it deems appropriate.

Internet Access and Computer Use Policy

Policy Statement:

The Flagler County Public Library System provides access to a broad range of information resources, including those available through the Internet. This access is part of our vision to serve as a gateway to an ever-changing world of knowledge and to improve quality of life through supporting the love of reading, the joy of learning and the search for information.

Flagler County Public Library Board of Trustees subscribes to the principles set forth in the American Library Association’s Library Bill of Rights Freedom to Read and Freedom to View Statements. These rights apply to all regardless of age and without restriction of access to all constitutionally protected materials unless otherwise prohibited by law.

Filtering:

The Flagler County Public Library system, starting in November 2009, complies with the requirements of the Children’s Internet Protection Act (CIPA) by providing “Technology Protection Measures” (TPMs) on each computer used to access the Internet. The library will disable the technology protection measure when unfiltered access is requested by an adult age 18+. Library staff can and should request age identification when appropriate.

Disclaimer:

The Flagler County Public Library makes no warranties of any kind, either expressed or implied for the Internet Access provided. Users should be cautioned that filtering software does not block all material that users might find objectionable and may block sites that contain needed information. As with other library materials, parents or legal guardians, not the library staff and volunteers, are responsible for their minor children’s Internet use. Flagler County Public Library cannot guarantee confidentiality over the Internet, monitor or control the information available or accessed through the Internet. Also, due to scheduling, knowledgeable staff may not always be available. As a result, the library is not responsible for the accuracy, nature or quality of information gathered through the library provided Internet access.

In consideration of the Flagler County Public Library providing users with access to the Internet, users agree to hold the library harmless and agree to indemnify the library from any and all liability issues arising out the user’s use of the Internet. The library is not responsible for any loss of data due to service  interruptions and/or any commercial transactions a user engages in while on a library public Internet access computer or via Wi-Fi. It is the responsibility of the library user to check all computer files and software retrieved via the Internet for viruses before loading them onto his or her personal computer system. The Library’s public computer workstations are not private or secure.

Library users, including minors, must comply with federal, state, and county laws, and with library policies while using library materials and equipment.  These include but are not limited to, laws and policies addressing privacy, copyright, obscenity, child pornography, computer hacking, unauthorized access to computers or networks, damage to computers or networks, and installing or spreading computer virus programs. Persons, including minors, who violate any law or policy, will be treated in accordance with the Library’s Code of Conduct.

Acceptable Use:

  • Users must be registered in the Library’s computer database and have a valid library card in good standing, or an authorized guest pass issued via a staff member at the service desk.
  • All users must sign in to a public access computer with their library card or authorized guest pass. Customers will be assigned a  computer on a first-come first-serve basis and should wait in the computer area to expedite seating.
  • Internet computers may only be used for legal and ethical purposes.
  • The Internet computer equipment and software must be used as installed.
  • All users are granted sixty (60) minutes per session and up to a total of one hundred-twenty (120) minutes per day. Users should see a staff member at the Research Desk if they need more time.
  • Use is limited to two (2) persons per computer to reduce noise and congestion in the computer area.
  • All computers will be shut down 15 minutes before closing regardless of time remaining in a session.
  • Users must comply with all copyright and licensing laws.
  • Saving to a portable storage device (floppy disk or USB/flash Drive) is optional, but the library cannot guarantee that the information you save will be free of viruses. Therefore, the patron assumes all risk and liability for issues arising from use of library equipment.

Unacceptable Use: (include but are not limited to)

  • Viewing material that violates federal, state or local laws or regulations, including those regarding accessing, viewing and distributing obscenity or child pornography. (Florida Statutes 847.001, 847.0133, 847.0135; Title 18, United States Code, Section 2252).
  • Violation of copyright or licensing laws. All responsibility or consequences resulting from copyright infringement lies with the user, the library expressly disclaims any liability from such use.
  • Committing any offense listed in Florida Statute Chapter 815 (Florida Computer Crimes Act)
  • Unauthorized entry or attempts to enter the Flagler County Public Library network or any other computer or networks.
  • Attempting to modify or gain access to files, passwords, accounts or data belonging to the library or other users.
  • Damaging or destroying equipment, or software belonging to the library or other users.
  • Deliberate propagation of computer worms or viruses.
  • Using Internet access to transmit or display obscene, threatening or harassing materials or unsolicited e-mail, i.e. SPAM.
  • Committing illegal or unethical activities on the Internet.
  • Use of electronic gambling, betting and wagering transactions.
  • Using and downloading personal software on library computers.
  • Modifications to hardware of any functions which interfere with the security software being used.
  • Violating the Flagler County Public Library Code of Conduct.
  • Individuals may not request a current user to relinquish or shorten their time.
  • Persons assigned to a computer may not give up or relinquish their remaining time to another individual.
  • Reservation of a public computer using a non valid library card number or an unauthorized guest pass.
  • Failing to comply with time limits and refusing or ignoring staff request to give up a computer.

Cost:

  • Printing will be charged at $ .15 per page for B&W or $ .40 per page for color to include blank pages and duplicates. Printed copies can be picked up and payment made at the Print Release Station or by seeing a staff member at the service desk. Only Library provided paper will be used in the public printers.
  • You may also scan and save your documents to a flash drive/email address for $1.00 per page or fax documents for $2.00 per page.
  • A Computer Guest Pass for visitors, non residents and/or residents without a library card can be obtained at the reference desk for $5.00 per day for two (2) one hour sessions. A Guest Pass is only good for the day of purchase. All rules and restrictions apply to the guest pass. A resident of Flagler County with a valid library card in good standing may request in person a “free” Guest Pass for an out of state visitor. This policy also applies to wireless users. See Library Card and Borrowing Policy for other options.

Age 15 and under:

  • Flagler County Public Library affirms the right and responsibility of parents or legal guardians to determine and monitor their minor child’s use of library resources including the Internet. Parents or guardians may wish to review “Rules of Online Safety on the Internet” published by the National Center for Missing and Exploited Children. Use of the Internet by children is the decision and responsibility of a parent and/or legal guardian.
  • As such, written parental consent and a library card is required for all children 15 and under in order to use a computer.

  • In keeping with our Safe Child Policy, all children 9 years or younger need to have their parent/caregiver in the immediate vicinity.
  • Due to high demand and limited public computers, all children under the age of 12 are required to use the computers located in the Children’s Room.
  • Parents accompanying their children may use the computers located in the Children’s Room. Children under the age of 12 have priority for use, therefore, adults may be asked to vacate a computer regardless of time used in their session.

Wireless Policy:

The Flagler County Public Library provides wireless internet access as a free public service subject to the terms and conditions of use as follows:

  • All users agree to accept this service with no guarantee and no warranty.
  • It is the patron’s sole responsibility to protect his/her information from all risks associated with the utilization of the library’s wireless internet access. Please remember it is not a secure or private network.
  • In using the free wireless Internet access, the patron agrees to release and holds harmless the Flagler County Public Library and its employees from any damages incurred as a result of using the wireless network.
  • Wireless users agree to abide by all local, State and Federal laws, rules and regulations that apply to use of the Internet.
  • Users are responsible for their own configuration in order to access the wireless network.
  • The library is not responsible for loss of personal laptops or other computer equipment due to theft or other illegal activity.
  • All audio output must be muted by headphones.
  • Wireless users are required to discontinue use 15 minutes prior to closing.
  • The Flagler County Public Library disclaimer is applicable to those using the wireless network.
  • For public safety, ensure all cords and bags are out of walk areas.
  • Printing is available for your device through our mobile printing service. See cost section above for charges that apply.

Any violation of Federal, State or Local laws will result in immediate loss of computer privileges. The consequences for violation of any unacceptable use as determined by library staff are as follows:

  • First violation – verbal warning.
  • Second violation – computer privileges suspended for a period of time as designated by the library staff.
  • Third violation – computer privileges revoked for an indefinite amount of time.

Additional penalties may include suspension of or revoking library privileges, and civil or criminal
charges if warranted.

*A member of the public may appeal an action or administrative decision by the library staff to the Library Director. The Director will make every effort to make a decision within 3 business days after investigating the grievance. If the patron is still unsatisfied they may appeal in writing to the Library Board of Trustees. The Board of Trustees will address the grievance at the next scheduled meeting following receipt of the complaint and will render a decision as it deems appropriate. The decision of the Library Board of Trustees can then be appealed in writing to the Flagler County Board of County Commissioners. All decisions of the Board of County Commissioners are final.

Library Card & Borrowing Policy

Obtaining a Library Card:

How to Apply for a New Library Card:
  1. In person – Fill out a registration form, provide a picture ID and proof of residency (see below).
  2. Via the Library Online Catalog, select “My Account” then “Register” to BEGIN the registration process and place a hold on 1 item only. To complete the registration process and receive a library card, come in person to either the Palm Coast or Bunnell locations and present a picture ID and proof of residency (see below). *NEW E-Cards are available to access eBooks, eAudiobooks, eMagazines, and online databases ONLY. Begin the registration process via the Library Online Catalog as described above, then send an image of your picture ID and proof of residency (see below) to CardRenewals@flaglercounty.org. Please allow 48 hours for a response that will include your E Card information.
How to Renew My Card:
  1. In person Renewals – Provide a picture ID, proof of residency (see below) and current library card.
  2. Virtual Renewals – Card renewals are accepted via email by sending an image of your current library card, picture ID and proof of residency (see below) to CardRenewals@flaglercounty.org. Please allow 48 hours for a response. Virtual renewals are still subject to the restrictions as set above for all unresolved fines, fees and other claims.
Registration:

The Flagler County Public Library registers, both residents and non-residents, without regard to race, creed, color, national origin, religious affiliation, sex, disability or economic status.

All registration and lending records of the system, except statistical reports of registration and circulation are confidential information. No staff member will, under any circumstances, divulge this information. This policy is in accordance with Florida Statute 257.261. Requests for lending or customer information from law enforcement officials should be referred to the Director.

Library cards are eligible for an annual renewal at which time all fines, charges or unresolved claims must be paid in full. Personal information will be updated at this time. At the time of renewal, identification and residency must be re-verified as if you were applying for a new card.

Eligibility:

New Resident Library cards are free to applicants meeting any one of the criteria below:

  1. Permanent or legal resident of Flagler County.
  2. Property owner in Flagler County.
  3. Flagler County employee.
  4. Student attending school in Flagler County.
Reciprocal Borrower Cards:

A resident of the State of Florida who resides in the service area or county with which Flagler County has established a formal borrowing agreement, and has been issued an FCPL borrower’s card in accordance with this policy. Currently only St. John’s County and Volusia County have reciprocal borrowing agreements with Flagler County.

Registration Requirements:

In order to obtain a library card:

  • Full-time residents must present his or her completed registration form, photo I.D. and proof of residency (print or electronic format accepted) to include any of the following: Valid Florida’s Driver’s License, Florida State ID, voter’s registration/voter card, military ID, current rent receipt, checks imprinted with local address, legal mail, state ID, tax receipt, tax bill, property deed, utility bill, mortgage or lease agreement, vehicle registration, county employment ID, local college or high school ID, or Library card from reciprocal counties.
  • Part-time residents must complete the registration form, present a photo I.D., plus proof of residency. Part-time is a resident of Flagler County with a short-term rental agreement that is at least 6 months in length. The card will be valid for the length of the agreement or lease.
  • Non-Resident Cards: A non-resident is an individual who neither owns real property nor resides in Flagler County on a permanent or continual basis. Individuals with non-resident status may obtain a temporary library card for a fee. Applicants must show a Valid Driver’s License or State ID and provide local mailing information as well as permanent address information. Military personnel and their families who are stationed in the State of Florida are eligible for a free card with Military ID. Fees for non-resident cards are as follows:
    • 1 month $10.00
    • 3 months $15.00
    • 6 months $30.00
    • 1 year $50.00
Age Requirements

All individuals 16 or older may apply for a library card with a photo ID and proof of residency. Proof of age may also be required to establish eligibility as an adult. Cards will be issued for children from birth to age 15 with written consent of the parent or legal guardian. The responsible parent/legal guardian and child must both be present and the adult must provide proof of residency. Their signature indicates acceptance of responsibility for all materials borrowed against the library card.

Replacement Cards:

Lost or stolen cards must be replaced at a cost of $3.00 per card. Proper ID must be shown in order to replace a library card. Caution: If your card is lost or stolen please report it immediately. Customers are responsible for all materials checked out on their card until a loss is reported.

Forgotten Cards:

If you forget to bring your valid Flagler County Public Library Card and want to borrow items or use a computer we will accommodate your request for a fee of $.50 per transaction. (A valid photo I.D. is required.)

Disabled/Homebound Patrons:

Disabled/Homebound customers may designate a person to represent them at the library. This person will be authorized to check out materials only using the library card of the homebound person. The name of the designated person will be listed in the customer file of the homebound person. The disabled/homebound person retains the responsibility for all materials checked out on the card.

Borrowing Library Materials:

Checkout

Customers are required to have their library card in hand or scanned to a mobile device in order to borrow all materials, including items borrowed through Interlibrary Loan. Library Cards are non-transferrable with one exception: Only items on hold/reserve may be picked by another person providing they have the borrower’s library card. Non-receipt of the material does not exempt the borrower from responsibility. Persons who allow friends or family members to use their library cards do so at their own risk.

Loan Period

All print materials and audiobooks will be checked out for a loan period of two (2) weeks. DVD and Blu-Ray movies will be checked out for a loan period of one (1) week. There is a maximum of twenty (20) items per library card, however only five (5) of these items can be DVDs or Blu-Rays. At the customer’s request, longer loan periods for residents who are traveling may be available for audiobooks only. A maximum of four (4) audiobooks, excluding those marked “NEW,” for a total of four (4) weeks is allowed.

Renewals

Borrowed items, with the exception of items on reserve for another customer, may be renewed up to a maximum of three (3) times. The library card account must be current and in good standing. This can be done in person, by phone, or online by logging in to your account. If renewing by phone, customers MUST call during normal business hours, have their library card number available, and speak with a staff member. Voicemail requests will NOT be accepted. *Items may Auto-Renew up to three (3) times to prevent fines from accruing, as long as the item isn’t on reserve.

Holds/Reserves

Holds/Reserves may be placed on *any item currently in the collection with the exception of reference materials and the most current issue of any magazine subscription. Items currently on shelf can take up to 48 hours to process. When a hold/reserve item is available for pickup customers will be contacted either by phone, text or email as per their preference. We will hold the item/items for three (3) business days. If the item/items are not picked up in that time frame, it/they will be moved on to the next patron or re-shelved. The library isn’t responsible for messages not received when left by voice mail or with other household members.

*Due to the limited supply of items in the Bunnell Branch collection, all holds/reserves for these items must be picked up at the Bunnell Branch.

Returns

All items can be returned to the Main Library and Bunnell Branch in person during operating hours. Both the Main Library and the Bunnell Branch have an after-hours drop-off area located near the main entrance of each facility.

Interlibrary Loan

Flagler County Public Library card holders may use the services of our Interlibrary Loan Department (ILL) for items which we do not own. We will accept ILL request forms in person during normal operating hours. There is a processing fee of $2.00 per item requested. Patrons can also initiate their own ILL requests over the internet using Florida ILL Navigator – payment for these items is due at the time of pickup. Although the Library has an almost 100% fill rate there is no guarantee and the fee is non-refundable. All items lost or damaged are the responsibility of the patron. Customers will be assessed replacement cost plus any other fees as established by the lending library. Borrowing privileges will be suspended until compensation is made.

Items published within the last six (6) months, DVD’s, CD’s, or other audio visual materials cannot be borrowed from other libraries. Customers will be notified when items are ready for pickup and will have a three (3) day time frame for pickup unless other arrangements are made with the ILL department.

Reference Materials

Reference materials may not be borrowed or removed from the building. Customers are free to use them in the building and copy what is needed using the public copy machines.

Late, lost or damaged materials

Customers agree to be responsible for all borrowed materials on their library card. A fine of $.15 per day per print and audio book material and a fine of $.50 per day per DVD, Blu-Ray or Video will be assessed after the 3 day grace period.

Maximum fine accrued per item is $5.00. When fines/fees on one card exceed $4.99 or five or more overdue items are checked out to that card, the account is blocked and borrowing/renewing/reserving privileges are suspended until the materials are returned or the fine is paid in full or at least below the maximum fine of $5.00. Furthermore, cards issued to minors 15 and under will be suspended when the parent/legal guardian designated as “responsible” owes the maximum fines/fees or has exceeded the maximum number of overdue materials allowed. The reverse is also true, when a minor 15 and under owes the maximum fines/fees and/or the number of overdue materials has exceeded the maximum allowed then the card issued to the parent/legal guardian designated as “responsible” will also be suspended. When an adult library card holder 16 and over is suspended, all cards he/she is designated as “responsible” for will also be suspended. Once fines/fees are below the maximum or paid in full and overdue materials are returned, all library card privileges will be reinstated at that time.

Customers will be assessed replacement costs on all lost or damaged items plus a $2.00 processing fee per item.

Refunds – Customers must present the receipt along with the material to receive a refund of the cost of the material. Processing fees are not refundable. Refunds must be requested within 90 calendar days of the payment for the lost item. Refunds are processed/issued by Flagler County, not the Flagler County Public Library and may take four to six weeks to receive a refund.

Issuance of overdue notices to borrowers is not a legal requirement. Non-receipt of a notice does not eliminate liability for outstanding materials or fines.

Library Initiated Programs and Displays Policy

The Flagler County Public Library (FCPL) provides library-initiated programs and displays to support the mission of the library by providing users with additional opportunities for accessing information, educational opportunities, exploring civic engagement, and to stimulate the imagination.

Programs:

  • Library-initiated programs include, but are not limited to the following:
    • Lectures, exhibits, community forums, performing and visual arts, participatory workshops, technology programming, creative learning programs, wellness programs, story times, continuing education, fairs, conventions, book clubs, presentations for social, cultural, educational, or entertainment purposes.
  • Library-initiated programs utilize librarian and support staff expertise for community
    interest, education and entertainment purposes.
  • The library may participate in cooperative or joint programs with other agencies, organizations, clubs, other local government departments, educational institutions or individuals to facilitate access to information
  • Library-initiated programs may take place onsite at the library, off-site at other locations or online and may be presented by library staff, volunteers or third-party presenters.
  • If a program is held off-site the library will assure that the space is accessible to all users.
  • The library will actively seek to include a variety of programming options representing diversity of genres, formats, ideas and expressions with a multitude of viewpoints and cultural perspectives that reflect the diversity in the community.
  • Programs will not be canceled because of the ideas or topics of the program, or the views expressed by the participants or speakers.
  • Library sponsorship of a program does not constitute endorsement of the resources
    content or it’s creator’s views.
  • The library creates programs for an intended age group or audience based on educational suitability and audience interest; however, restrictions on participation based solely on gender, chronological age, or educational level of users violate a person’s rights as stated in the American Library Association’s Library Bill of Rights and will only be enforced when not doing so would adversely impact the safety of the participants or interfere with the intended purpose of the program.
  • Parents and guardians may restrict their own children’s access to library programs, but no person or organization can interfere in other’s  access and participation.
  • The library will not deny access to a library initiated program as a result of a fine or fee owed by a patron.

Displays:

  • Library-initiated displays may be a creation of librarians or support staff on a variety of topics using materials in the library collection. These ideas and topics have a foundation in marketing the library’s resources and creating awareness and excitement and drawing the eye of the visitors. These displays may include, but are not limited to the following:
    • Annual library related celebrations or promotional events; daily, weekly or monthly holiday or other thematic topics, health and wellness, informational, other displays to encourage literacy, create awareness and stimulate the imagination.
  • The library display cases and areas are primarily to be used for library displays, or library sponsored displays, such as those of the Friends of the Library or other community partners.
  • Library-initiated or library sponsored displays may utilize librarian, support staff, volunteers, or community partners expertise for community interest, education, engagement and awareness purposes.
  • Library-initiated displays are to promote and increase awareness of the programs, resources and services provided to the community.
  • Library-initiated displays will represent a diversity of genres, formats, ideas, viewpoints and cultural perspectives.
  • Library staff will not remove, or censor displays because someone does not agree with the content.
  • Library sponsorship of a display by an outside organization, or club does not constitute an endorsement by the library or Flagler County, of its content or views expressed, any more than the purchase of resources for the library collection or curation of a display constitutes an endorsement of the resources content or its creator’s views.

Concerns, questions or complaints about library initiated programs and displays are handled according to the same written policy and procedures that govern reconsiderations of library materials. If a customer would like to challenge a library-initiated or library-sponsored program or display, they may do so by completing a Citizen’s Request for Reconsideration of a Library-Initiated Program or Display, available at the Research Desk. All inquiries are taken seriously and will be carefully reviewed.   5. The Director and pertinent staff will evaluate the display or review the program in question and in accordance with the Library’s Policy and make a decision as to whether or not the library will add/delete or make a modification.
  6. A response letter from the Director will be mailed within the specified time frame indicating his/her decision.
  7. If you are dissatisfied with the Director’s decision you may appeal the decision to the Flagler County Public Library Board of Trustees by asking that your Request for Reconsideration of a library-initiated program or display, be added to the agenda of the next scheduled Board Meeting in which you are able to attend. The Board will listen to your request and respond in writing with a decision.

*The library recognizes that some materials are controversial and that any given item may offend some patrons. Selection of materials for display will not be made on the basis of anticipated approval or disapproval but solely on the basis of principles set forth in the American Library Association’s Library Bill of Rights.

*Responsibility for attending programs or viewing display material and the use of the library by children rests with their parents or legal guardians. At no time will library staff act in loco parentis. Selection of library programs or display materials will not be  inhibited by the possibility that children may attend the program or view the material displayed.

Materials Complaint Process for Customers Policy

The Flagler County Public Library takes all our residents’ concerns seriously, especially those involving selective materials. While most requests are to remove items from the collection, we also allow requests to retain an item at any time during this process. The following is our process for re-evaluating materials:

  1.  You must be a resident of Flagler County in order to initiate a request.
  2. Call (386) 446-6763 option 2, to have a Request for Reconsideration of Library Material form sent to you physically or electronically. While at the library, you may pick up a copy at the Research Desk.
  3. Fill out the request form. This form and all written appeals may be given to any service desk, emailed to reference@flaglercounty.gov or mailed to:

  5. Library staff will send you an acknowledgement that they received the Request for Reconsideration Form and will indicate the time frame within which you should expect a written response from the review committee.
  6. The review committee, comprised of professional library staff, will evaluate the item in accordance with the Library’s Collection Development Policy and make a decision regarding the request.
  7. A response letter from the review committee will be mailed and/or emailed indicating their decision with the director dually notified.
  8. If you are dissatisfied with the review committee’s decision you may appeal this decision to the Library Director by sending a written request of appeal.
  9. The Library Director will then evaluate the item in accordance with the Library’s Collection Development Policy and make a decision to accept the review committee’s decision or to reverse their decision.
  10. A response letter from the Library Director will be mailed and/or emailed 30 days from receipt of the appeal, indicating his/her decision with the Library Board of Trustees dually notified.
  11. If you are still dissatisfied with the decision made by the Library Director, you may mail/email a written appeal to the Library Board of Trustees. This item will be added to the agenda of the next scheduled Board Meeting which you are able to attend. The Board will listen to your request, evaluate the item in question and respond in writing with a decision.

Meeting Room Policies & Procedures

  1. Purpose
    The purpose of this policy is to maximize usage of the meeting room at the Flagler County Public Library System and to establish equitable fees to be collected from users of such Library spaces.
    The Flagler County Public Library System is an information center for the community. The primary function of Library spaces is for Library activities, including programs presented by Library staff, Friends of the Library, Flagler County Government and other organizations affiliated with the Library. The Library will reserve the right to review the meeting agenda if it is not clear as to whether the usage meets the meeting room guidelines.
  2. Who May Use
    The Flagler County Public Library offers the Meeting Room space for the use by non-profit organizations, groups and citizens to engage in civic, educational, cultural, recreational, charitable or government interest activities. Use of the meeting room is available when they are not required for Library programming, with such usage being on a first-come, first-served basis. The Library reserves the right to reschedule confirmed meeting room reservations to accommodate Library-sponsored programs and events or reject a reservation request if the anticipated meeting is likely to be unreasonably disruptive to regular Library functions. An attempt will be made to provide forty-eight hours advance notice if cancellation becomes necessary.
  3. Limitations
    All meetings and programs are open to the public. The meeting room is not to be used for personal or private profit, advertising or commercial uses (see section X for details). No partisan political activities, social or private gatherings such as showers or birthday parties are allowed. The meeting room is not to be used as a headquarters for any organization or the sole and/or primary location to conduct regular business operations. Dues and/or Admission fees may not be charged nor sales made. Promotion of products or services, or donations solicited except in conjunction with a library or Friends of the Library program is not permitted. However, a fee for resource materials, books, or payment for a program speaker may be collected upon approval of the Library Director. Library-related fundraising activities are allowed. As such the Library reserves the right to review all meeting agendas to ensure the usage meets the meeting room guidelines. Granting permission for use of the rooms does not imply Library endorsement of the aims, policies or activities of any group.
  4. Equipment
    With the exception of the equipment made available by the Flagler County Public Library, the Library will not provide electronic or other meeting support materials such as markers, paper, etc. Meeting organizers are permitted to bring their own equipment, but Library staff is not allowed to support its operation.
    The Library makes every effort to ensure that the equipment is in good working condition and performs regular equipment checks to ensure working condition. Equipment is rented as is and no refunds will be given on equipment rented but unused by the group. General knowledge and use of equipment is required. No special training and/or staff intervention will be provided. If damage occurs to equipment, replacement of equipment or full reimbursement of cost associated with repairing or replacing equipment must be remitted. Equipment available: LCD Projector with speakers (mobile unit); DVD player; Projection Screen
  5. Definitions
    1. Library Space Definitions and Uses
      1. Meeting Rooms: Main Library Meeting Room.
      2. Outdoor Areas: Such outdoor areas shall include, but not limited to, Library patios, and parking lots. Designation also includes open space and land owned by the Library department.
      3. Doug Cisney/Garden Room: This is a multi-function room used only for library activities, including programs presented by library staff and Friends of the Library.
      4. Programs: For activities that are instructional, educational or entertainment for preschool, youth, adult, senior or special populations.
    2. Non-Profit Group or Entity
      1. Exempt from taxation under any subsection of Section 501(c) of the Internal Revenue Code.
      2. Civic Groups/Associations includes but not limited to, property owners’ associations, hobbyists’ clubs, collectors’ clubs, garden clubs, car clubs and all other similar clubs, groups or organizations. The primary focus of these groups is inward toward the group’s members.
    3. Partisan Political Activities
      Specific solicitation of political campaign contributions; political meetings not open to the public.
  6. Fees
    All fees must be paid at day and time of the meeting. The forms of payment accepted is cash or credit/debit card. If a credit/debit card is used a convenience fee will apply.
    1. LCD Projector User Fee: All entities with the exception of programs presented or sponsored by Library staff, Friends of the Library or Flagler County Government will be charged a nonrefundable $10.00 fee per use.
    2. Refreshment fee and/or use of Kitchen Facilities: All entities with the exception of programs presented or sponsored by Library staff, Friends of the Library or Flagler County Government using the kitchen and/or serving food and refreshments will be required to provide a $25.00 nonrefundable fee per use. See General Guidelines and Regulations for cleaning requirements.
  7. Room Capacity
    Per order of the Fire Official the maximum attendance for programs or meetings in the Library’s Meeting Room is one hundred nineteen people (without tables and chairs). The meeting room has chairs and approximately 12 five-foot long tables available for use. Attendance at the meetings must be limited to the capacity of the room. Meetings are to be held during library hours and must adjourn 30 minutes prior to the scheduled closing of the Library.
    1. Standing Room Only: 119
    2. Chairs Only: 75
    3. Tables and Chairs: 45
  8. Reservations
    1. The Library reserves the right to limit the number of reservations by any organization so that all groups may have a fair opportunity to use the rooms. Meetings held in the meeting room must have at least 10 people in attendance for use, but no more than the assigned maximum room capacity. Meetings will not be scheduled more than once per month but the Library Director, or designee may waive enforcement of this aspect provided such waiver does not interfere with the primary function of this room.
    2. The Library Director or his/her designee reserves the right to reject a reservation request to accommodate library related programs. The Library makes no guarantee that the date and time requested will be available and will provide alternate dates and times as necessary.
    3. Reservations may be made by phone or in person through the Administration Office at the Flagler County Public Library. No reservation is confirmed until you receive a signed confirmation from the Library along with a list of dates and times the room is reserved.
    4. All organizations, groups or individuals using the Meeting Room must complete, sign and at the request of the Library staff, update a Meeting Room Application. The application shall incorporate by reference this Meeting Room Policy and the Facility Rules and Code of Conduct, and shall recite that the applicant group has received a copy of this policy and the rules of conduct and agrees to abide by the terms and conditions of both.
    5. Applications for use of library space must be submitted by a Flagler County Public Library Card Holder in good standing (defined as a zero balance) and who is at least 18 years of age. The applicant must be present when the meeting is held and take full responsibility ensuring that all attendees follow the Meeting Room Policy, and Facility Rules and Code of Conduct. The person signing the application assumes complete financial responsibility for any damages to the room or any furniture and/or equipment used.
    6. Organizations/Groups or Individuals must notify the Library at least 48 hours in advance if a reservation will be cancelled. A maximum of (3) three cancellations is allowed per fiscal year. Repeated failure to notify the Library of cancellations will result in privileges being revoked.
    7. Annual reservation requests will be accepted in November for the following calendar year. All other requests should be submitted at least seven days prior to the meeting date in order to allow sufficient time to process the application.
    8. When requesting a reservation please allot enough time for set-up and cleaning at the end of the meeting within the requested timeframe. No organizations, groups or Individuals will be allowed access to the Meeting Room prior to their scheduled time. Scheduled time will include no more than 30 minutes for set-up and 30 minutes for clean up. Any organization, group or individual interfering or requesting another user to relinquish or shorten their time may have their privileges revoked.
    9. Any request to access the Meeting Room at a date and time not listed on a previously approved & confirmed application may be denied use whether or not another group already occupies the room.
  9. General Guidelines and Regulations
    1. Liability
      The Organization, Group and/or INDIVIDUAL agrees to indemnify and hold the County and its officers, agents, and employees harmless from any and all liability, damages, actions, claims, demands, expenses, judgments, fees and costs of whatever kind or character, arising from, by reason of, or in connection with the use of the facilities described herein.
      It is the intention of the Organization, Group and/or INDIVIDUAL that the COUNTY and its officers, agents and employees shall not be liable or in any way responsible for injury, damage, liability, loss or expense resulting to the user and those it brings onto the premises due to accidents, mishaps, misconduct, negligence or injuries either in person or property.
      The Organization, Group and/or INDIVIDUAL expressly assumes full responsibility for any and all damages or injuries which may result to any person or property by reason of or in connection with the use of the facilities pursuant to this agreement, and agrees to pay the COUNTY for all damages caused to the facilities resulting from the user’s activities hereunder.
      The Organization, Group and/or INDIVIDUAL represents that its activities pursuant to this agreement will be supervised by adequately trained personnel, and that the user will observe, and cause the participants in the activity to observe, all safety rules for the facility and the activity. The Organization, Group and/or INDIVIDUAL acknowledge that the COUNTY has no duty to and will not provide supervision during the activity.
    2. Use and Care of Facilities and Equipment
      The Library is not responsible for any equipment, supplies, exhibits or other materials owned by the group and used in the library. The library does not provide storage space for any groups other than the Friends of the Library.
      1. Materials or signs/posters may not be affixed to the walls, ceilings, doors or windows. Egress routes may not be obstructed in any way and exit signs must remain clearly visible. Limited decorating is allowed but certain types are prohibited. Restrictions include but are not limited to items which make cleaning and vacuuming difficult, burning candles, incense or any type of open flame.
      2. Tables and chairs are available but the group is responsible for arrangement of the furniture for their meetings. Library staff will not provide assistance in setting up or cleaning the Meeting Room. Users are responsible for returning all furniture to the required original arrangement per the diagrams on the meeting room wall. If the room is not left in its original configuration, there may be a charge of up to $25. A diagram of the original room configuration is posted in the room.
      3. Electrical outlets in the meeting room may be used, but safety covers must be placed back in the outlet upon discontinued use of the outlet.
      4. Upon prior request and payment of fees the kitchen may be used and/or light refreshments or food may be served. A refrigerator, microwave oven and a coffee maker are available for use. Refreshments may not be taken out of the Meeting Room. The library will provide basic housekeeping services as part of the regular daily custodial services. Any additional cleaning or repair required beyond normal library maintenance will be billed at an hourly rate and all materials required for repair will be billed to the user. All groups/organizations are responsible to clean the room after use which includes but not limited to:
        wiping down tables and chairs, throwing away napkins and other paper items, vacuuming, wiping down counters, cleaning all kitchen items used, sweeping and/or washing kitchen floor as necessary, all leftover food and refreshments are to be removed, and garbage prepared for removal.
      5. Organizations, groups and/or Individuals using the Meeting Room must follow the Facility Rules and Code of Conduct, which include no smoking and no consumption of alcoholic beverages.
      6. When the meeting room is used as a voting precinct, and an election is scheduled, it will preempt all other scheduled meetings. During use as a voting precinct all election rules and regulations will be overseen and enforced by the Supervisor of Elections’ staff.
      7. Accidents must be reported immediately to a member of the staff and an incident report must be filled out.
  10. Rules for Commercial Use
    Acceptable uses of the library meeting room by commercial businesses are limited to staff training and peer to peer networking. The library meeting room is not be used by commercial businesses to make a profit, conduct business, or solicit customers in any way. Therefore, usage of the library meeting room is prohibited for the following purposes:
    1. Product deliveries or product usage instruction.
    2. Recruitment or hiring events.
    3. Meetings with potential or current customers.
    4. Speaking engagements, classes, or seminars intended to educate attendees about a product or service offered by a commercial business in order to encourage attendees to become customers.
    5. Any other type of event or meeting that is solely focused on profiting from or purchasing the products or services of a commercial business whether the reservation was made by the business or the potential or current customer. Any other event where library staff, in their sole discretion, deems that a commercial business may be using the meeting rooms to make a profit, conduct business, or solicit customers.
  11. Rules of Marketing or Room Reservations
    No notices, press releases, posters, flyers or other materials promoting or announcing events held in Library spaces may be distributed without prior approval of the Library Director. Use of the library meeting room does not constitute endorsement. Any advertisement or announcement implying or specifically stating such endorsement is prohibited. The following rules apply to materials and/or method used to advertise, promote or encourage attendance at any event, class, or other program held in the library:
    1. Applicants are solely responsible for marketing any event held in the library meeting room.
    2. Any printed, electronic, social media posts or other marketing materials that include the library’s name and address must include the disclaimer: “This event is not sponsored or endorsed by the Flagler County Public Library or Flagler County.” Any material published by an applicant that does not include the disclaimer may disqualify the applicant from future use of the library’s meeting room.
    3. Usage of the library phone number as a contact phone number on marketing materials of any type, including but not limited to, print, verbal, or digital, is prohibited. The library and its staff will not serve as a point of information for patrons who may have questions regarding the content of the program. By completing a meeting room application, the applicant agrees that the library can refer any patrons to the applicant for more information using the contact information supplied on the application.
    4. Any notices, flyers or any type of written announcement is allowed to be posted on the library bulletin board only and must meet specifications as required by the library bulletin board policy.
    5. Applicants must not attempt to solicit attendance from library patrons by distributing marketing materials or verbally requesting their attendance within or immediately outside of the library facility.
  12. Use of the Meeting Room/Library Spaces is a privilege. Any violation of these rules as determined by the Library Director may result in cancellation of the group’s future meeting privilege as well as financial assessment for damages incurred. The Director will provide written notice to the organization, group and/or individual of the decision to deny use or assess fees. If the organization, group and/or individual choose to appeal the decision of the Director, they must provide written notice within 15 days of the date of the letter to the Library Board of Trustees. The Board of Trustees will address the grievance at the next scheduled meeting following receipt of the complaint and will render a decision as it deems appropriate.

Patriot Act - Privacy Policy

Effective Date: February 14, 2022

“In a library (physical or virtual), the right to privacy is the right to open inquiry without having the subject of one’s interest examined or scrutinized by others. Confidentiality exists when a library is in possession of personally identifiable information about users and keeps that information private on their behalf. Confidentiality extends to “information sought or received and resources consulted, borrowed, acquired or transmitted” (ALA Code of Ethics), including, but not limited to: database search records, reference questions and interviews, circulation records, interlibrary loan records, information about materials downloaded or placed on “hold” or “reserve,” and other personally identifiable information about uses of library materials, programs, facilities, or services.” Adopted June 19, 2002, by the ALA Council; amended on July 1, 2014

Definitions:

  • Privacy is your right to seek information through Library resources without having the subject of your interest known or examined by others.
  • Confidentiality exists when the Library possesses personally identifiable information about you and keeps that information private on your behalf.
  • Personally identifiable information (PII) covers a greater range than “personal identification,” such as an individual’s name, address, telephone number, social security number, driver’s license number, e-mail address, etc. PII connects you to what you bought with your credit card, what you checked out with your library card, and what Web sites you visited. More than simple identification, PII can build up a picture of your tastes and interests.

Flagler County Public Library is committed to protecting the privacy and confidentiality of patrons at our library or using our website.

  • Confidentiality extends not only to materials consulted or borrowed, but also to a patron’s identity as a library user, information sought or received, database search records, reference interviews, interlibrary loan records, and other personally identifiable uses of library materials, facilities, or services.
  • Privacy is the right to seek information through library resources without having the subject of your interest known or examined by others. Confidentiality exists when a library is in possession of personally identifiable information about individuals and keeps that information private on their behalf
  • Personally identifiable information may consist of, among other things, a patron’s: name, address phone number, library card number and e-mail address.
  • The courts have upheld the right to privacy based on the Bill of Rights of the U.S. Constitution. This library’s privacy and confidentiality policies are in compliance with applicable federal, state, and local laws.
  • With technology changes, increased incidence of identity theft and the US Patriot Act, we feel that you have the right to know when any library transaction creates a record of personally identifiable information, and how such information is used and its confidentiality protected. Our library will not share data on individuals unless required by law.

Relevant Laws

USA Patriot Act (Public Law 107-56):

Although the Library makes every effort to protect your privacy through compliance with state law and through local practice, under the federal USA Patriot Act, records of your library activities (including materials you borrow and your computer workstation usage) may be obtained by federal agents. That federal law prohibits Library staff from informing you or anyone else if federal agents have obtained records about you. Additional information is available from the American Library Association website.

Confidentiality of Registration and Circulation Records — Florida Statutes Section 257.261:
  1. All registration and circulation records of every public library, except statistical reports of registration and circulation, are confidential and exempt from the provisions of s. 119.07(1) and from s. 24(a) of Art. I of the State Constitution.
  2. As used in this section, the term “registration records” includes any information that a library requires a customer to provide in order to become eligible to borrow books and other materials, and the term “circulation records” includes all information that identifies the Customers who borrow particular books and other materials.
  3. (a) Except in accordance with a proper judicial order, a person may not make known in any manner any information contained in records made confidential and exempt by this section, except as otherwise provided in this section.
    (b) A library or any business operating jointly with the library may, only for the purpose of collecting fines or recovering overdue books, documents, films, or other items or materials owned or otherwise belonging to the library, disclose information made confidential and exempt by this section to the following:
    1. The library patron named in the records;
    2. In the case of a library customer less than 16 years of age, the parent or guardian of that customer named in the records;
    3. Any entity that collects fines on behalf of a library, unless the customer is less than 16 years of age, in which case only information identifying the customer ‘s parent or guardian may be released;
    4. Municipal or county law enforcement officials, unless the customer is 16 years of age, in which case only information identifying the customer ‘s parent or guardian may be released; or
    5. Judicial officials.
    6. Any person who violates this section commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Legal Protections & Exceptions

Privacy of library registration and circulation records is protected under Florida Statutes Section 257.261, above. This information is used when you choose to request or borrow materials or services, or to authenticate eligibility for access to Library public access computers. The Library is committed to only permitting authorized staff to see personally identifiable information stored in the Library’s files and computer systems.

Some of your personally identifiable information may not remain confidential if fines, charges, or fee transactions must be forwarded to an agency for collection, or if the Library is processing your request for items or services from another library or provider. The Library does not give, share, sell or transfer any personally identifiable information to third parties except with your specific consent, to conduct Library business, or unless required to do so by law. (See USA
Patriot Act, above.)

Customer Information Collected

When you choose to provide personally identifiable information to us in order to conduct a library transaction, we collect only the minimum amount of personal information required to process your request. Elements of this information, with the personal links stripped out, may be used to develop internal statistical reports. Examples of personally identifiable information which may be required to process a Library transaction include:

  • Full Legal Name
  • Mailing address – (If P.O. Box is mailing address then a physical address is required for proof of residency)
  • Telephone number
  • Birthdate
  • Library card number
  • Email address (optional)
  • Driver’s License Number (A picture ID is required if customer does not have a Driver’s License)

Library Website

The Library website is governed by this Privacy Policy and our Internet Use Policy. We collect non-personal information from visitors to the website for statistical analysis only.

Our website contains links to external websites and licensed databases. The Library is not responsible for the privacy practices, security or content of these external sites. We recommend that you familiarize yourself with the privacy and security information for any site you visit.

Petitions & Solicitation

The Flagler County Public Library as a “limited public forum” has the authority to make reasonable rules that are universally applicable regarding the allowed use of the library buildings and property, including content-neutral restriction of conduct involving passing out literature. The public sidewalks around the library property are a traditional public forum subject to reasonable time, place and manner restrictions on those wishing to use them for purposes protected by the First Amendment. As such, the Library allows people to circulate petitions outside our facilities.

  1. Persons circulating petitions for signatures or leafleting may stand on Library property, however, they may not engage in collecting signatures or distributing leaflets inside the Library building.
  2. This person shall not block, hinder, interfere or otherwise impede patrons and staff wishing to exit or enter the building, nor seek to intimidate patrons or staff into signing a petition or accepting a leaflet.
  3. Persons circulating petitions or leafleting are not allowed to place or erect signs on Library property.
  4. No leafleting or distribution of literature, or solicitation is permitted for the purposes of selling items, merchandise, tickets, or other for profit activities.
  5. Not-for-profit fundraising activities are not  permitted in the Library building or on the Library property by any person or organization when the purpose is to benefit a group or organization other than the Library or the Friends of the Library of Flagler County.
  6. The Library staff, Friends of the Library of Flagler County and members of the Library Board of Trustees are exempt from the above constraints in promoting Library activities and issues.

*Any person or group who does not abide by the conditions stated above or creates a nuisance such that the regular business of the Library is disrupted shall be required to immediately cease all activities relating to solicitation for a petition or leafleting and to leave the Library property.

Safe Child Policy

Policy Title: Safe Child Policy
Effective Date: January 13, 2025

The Flagler County Public Library is dedicated to providing a warm, welcoming, and safe environment for
people of all ages. To facilitate this environment, everyone must follow the Library’s Facility Rules and Code of Conduct adopted by the Library Board of Trustees and posted around the library and on the library’s website.

Children are encouraged to use library facilities and services; however, the safety of children left alone in a
public building is a serious concern. The responsibility for the safety and behavior of children in the library rests with the parent/caregiver and not with library personnel.

To provide for the general welfare of all library patrons and the general safety of children, The Board of Trustees of the Flagler County Public Library has adopted the following rules:

  1. All children 9 years or younger must have a parent/caregiver in the immediate vicinity of and in visual contact with the child. The assigned caregiver must be at least 13 years old and must carry emergency contact information. The parent/caregiver must stay with the child and actively supervise the child during all library story classes and other programs unless otherwise specified by library staff. When a child 9 years or younger appears to be lost or unattended, library staff will immediately try to locate the parent/caregiver and inform her/him of the policy. A staff member will stay with the child while the search is in process. If the parent/caregiver cannot be located within 10 minutes, the Flagler County Sheriff’s Department will be called to pick up the child.
  2. Children 10 years and older may use the library unattended, subject to the rules and regulations of the library. However, children of any age with mental, physical, or emotional concerns which require supervision must be accompanied by their parent/caregiver at all times.
  3. Parents should not view the library as an alternative to day care or after-school programs. Parents are advised that if the conduct of their child is inappropriate, the child may be instructed to leave the library. Even in the parent’s absence, they are legally responsible for the behavior of their children. All children must have the telephone number of someone who can assist them in an emergency.
  4. Closing Procedures: Fifteen minutes prior to closing time staff will ask unattended children if they need to call for a ride home. When a child age 12 or under is unattended at closing time, staff will immediately attempt to contact the parent/caregiver. If parent/caregiver has been contacted and a ride is “on the way,” two staff members will remain with the child for up to 15 minutes after closing time. After 15 minutes, the Sheriff’s Department will be notified to pick up the child. Under no circumstances will a staff member transport a child home or to any other destination.
  5. Teens/Tween Spaces: The dedicated teen/tween space is intended for use by customers 12-18 years old. This is to ensure appropriate acceptable use to make teens/tweens feel welcome and safe while using the library.

Video Surveillance Policy

Policy Title: Video Surveillance Policy
Effective Date: January 13, 2025

  1. Purpose of Security Cameras
    This policy sets out the framework within which the Flagler County Public Library will use security cameras. The library will use security cameras to enhance the safety and security of library users, staff, property, while protecting the individuals’ right to privacy.The security camera installation consists of dedicated cameras providing real-time surveillance. The primary use of security cameras is to discourage inappropriate and illegal behavior and to enhance the opportunity to apprehend offenders. Video monitoring of public areas will be limited to uses that do not violate the reasonable expectation of privacy as defined by law. Information obtained will be used exclusively for law and/or policy enforcement.
  2. Signage
    The library will post signs in relevant areas to read:
    “Attention: This area is under video surveillance. All activity is recorded.”The cameras are positioned only to record those areas specified by the Library Director
    and Flagler County Innovation Technology Department which will complement other
    measures to maintain a safe and secure environment.
  3. Camera Locations
    In general, cameras are positioned to view high traffic areas, service desks, exits, and areas prone to activities in violation of library policy. Cameras are installed in the following locations:

  4. Use/Disclosure of Video Records:
    Video data is recorded and stored on a secure server. Normal retention period for recordings is up to thirty calendar days, per Florida Department of State Record Retention Schedule for Surveillance Recordings, then automatically erased unless required for evidence. Records required for evidence are saved and stored in a secure environment. Such records will be destroyed when no longer required for evidence.Access to camera monitoring is limited to Flagler County Innovative Technology Department. Access to video records shall be limited to authorized employees, who shall only access such records during the course of their regular duties to:

     

    1. Identify the person or persons responsible for library policy violations, criminal activity, or actions considered disruptive to normal library operations.

    2. Assist law enforcement agencies in accordance with applicable state and federal laws upon receipt of a subpoena. The requirement of a subpoena may, however, be waived by authorized employees when appropriate.

Security camera footage is exempt from disclosure requirements of the public records laws. This is pursuant to Fla. Stat. s. 119.071(3)(a). In all other respects, footage will be accorded the same level of confidentiality and protection provided to library users by Florida State Law and Flagler County Public Library policies, while adhering to the Protection of Privacy Act and the Freedom of Information Act.
