The best of the swamp in Pennsylvania. A lesson in ballot harvesting and following the playbook of Joe Biden. More than half the ballots were cast before Fetterman even came up out of the basement. His stroke occurred a few days before the primary. Voting started in September.

Oz – Fetterman Debate – The Ultimate Train Wreck

 

A train wreck is far too kind for those who took the time and could bear the suffering of Fetterman as he continued to decline throughout the debate.

There are those who wonder why the Fetterman Oz contest should be of interest to those who live outside of Pennsylvania. If someone as incompetent as Fetterman can be elected then we are indeed doomed. Sadly 635,000 mail-in ballots have already been turned in. Another reason to cut out weeks of early voting.

 

Fracking

There have been no ads in my TV market covering the fracking issue. Pennsylvania is second only to Texas in Natural Gas drilling. Tens of thousands of jobs are involved. Finally we get the topic out in the light. For most of rural America its a big deal. A really big deal.

This is how the debate started out and it didn’t get any better.

You know you have lost when even CNN cannot muster a positive review of the spectacle. Fetterman and his family and friends should be ashamed of what they have supported in this candidacy. 

Frankly I found it enjoyable after all those attacks on the NBC gal Dasha Burns who did the Fetterman interview, and was honest to state the obvious that she wasn’t sure he understood the preinterview back and forth conversation. Her redemption is sweet revenge.

‘Special Needs’ PA Dem Candidate Fetterman Interview -‘He had a hard time understanding our conversation’

Fetterman is running against Republican nominee Dr. Mehmet Oz in the 2022 US Senate race in Pennsylvania. It was a shock to hear MSNBC actually acknowledge what those of us who live in the PA Capital TV market know so very well. Fetterman cannot string two sentences together.

He acknowledges that he requires monitor captioning of questions. Just how does he expect this to work in the senate for him?  How does he function at hearings to which he is assigned?  His constituents?

Where will be the soaring rhetoric and debating that one would hope the ideal candidate would have?

Worse, he is far far left. What has not been covered is his anti-fracking position. Amazingly the race with Oz is supposedly neck and neck and I would think so. Millions upon millions of dollars have been poured in attacking Oz endlessly.

In fairness, Oz is no prize candidate. There are plenty of forgettable comments he has made through the years and there are years of TV programs to find the jewels. He has boxed himself in on the abortion issue with a hard stand against it. He squirms trying to evade which doesn’t help him.

The Dems are counting on the abortion issue apparently to see them through the close elections. We shall see how women voters react to it.

I am sure he expected a softball interview and never figured that the comments he made prior to the “official” interview would be reported. His new strategy apparently is the sympathy vote for his medical condition. That is his strength now that the truth is seeping out. Our sympathy for him ends at the ballot box.

And the control of the senate may be determined by this race. Wonderful.

PA Senate Candidate John Fetterman Forgets Who He is Running Against

 

But John Fetterman PA candidate for Senate is not running against John Toomey. Toomey is the outgoing Senator. He is running against Dr. Mehmet Oz. Fetterman claims Toomey was “not nice to me.” I hate to tell you John, there will be a lot of people not nice to you when you arrive in D.C. Another Biden 2.0 who is hiding out in his basement and won’t debate.

The ad money being spent on behalf of Fetterman is unbelievable in my district. None stop on YouTube and TV among other sources. His ads make horrendous charges and effective against Oz. They are professional and no doubt have been edited in such a way that does not convey his limited speech. There are few if any ads supporting Oz and the ones done are not helpful to him and are counter mocked.

Unless the GOP steps up we will lose PA. Topping it off, our PA corrupt election system has not been corrected. There were major primary voting issues as well as in the past General. The Democrat Tom Wolf Governor vetoed corrective legislation. Worse the Federal Courts stepped in. More on that after the clips. Here is a sample of a past problem:

Fetterman mentions a Doctor and is no doubt thinking about Dr. Oz.  Wegman’s is a high end grocery outlet.

Flashback:

(Again, this is PA) – Last election:Chris Varney, Judge of Elections says they were initially under the impression that it was a problem with all ballots, but then determined it was only a problem with Republican ballots. Varney says he was unaware of which specific precincts were dealing with the same issue, but that this same issue was happening in numerous locations across Fayette County.

The solution provided by Fayette County officials was to collect ballots from voters and store them in the back of voting machines — but not to scan any of them to ensure the process was handled in a fair manner.

We’ve heard different variations of this story ever since November 3, 2020, when voting machines seemed to switch votes from Republicans to Democrats. At the heart of the scandal during the big election were Dominion Voting Machines. Certainly they’re not at the heart of this particular voter “challenges” story as well, right?

Just GOP ballots wouldn’t you know? The old “coding error.” And PA still has drop boxes..

Federal Appeals Court Steps into PA Election Count, Overrules State Courts

Federal appeals court says undated Pa. mail ballots should be counted, a decision that breaks with state courts and could have immediate impact. So reads the headline. Earlier I reported of the problems with certain ballots unable to be read by machine. The so called “Printing errors” on ballots. 

Now we learn that the Federal courts steps into the midst of the counting of ballots with a ruling. Meanwhile different voting districts were handling the situation in different ways. 

The ruling could open a new fight immediately, as David McCormick and Mehmet Oz head toward a recount.

Pennsylvania mail ballots submitted without a date on the envelope last year should be counted, a federal appeals court said Friday, a ruling that could mean thousands more votes get counted in elections moving forward — starting with this past Tuesday’s primary.

The ruling will also almost certainly reignite the smoldering political fight over undated mail ballots; create new questions and pressure for county elections officials as they continue to count votes from this week’s primary; and create another potential opening for county-by-county legal challenges as the Senate Republican primary heads toward a likely recount.

The full extent of the decision’s impact is unclear, because the court issued a judgment and said an opinion would come later. But based on the order, lawyers from both parties said, the path was suddenly cleared for counties to count the undated mail ballots they had been preparing to reject this election

…But throwing out those votes violates the federal Civil Rights Act, the ACLU argued, because the date isn’t actually used in determining the legitimacy of a vote.

The handwritten dates are required even though mail-in ballots are usually postmarked and routinely stamped when received by county elections offices.

The trailing candidate, Zac Cohen, lost a state lawsuit over the signature requirement earlier this year and the Pennsylvania Supreme Court declined to take the appeal.

Five voters whose ballots were thrown out in that election, represented by the American Civil Liberties Union, then filed a federal lawsuit. They lost at the district court level before the appeals judges overturned that decision on Friday.

Then what? Meanwhile there are tens of thousands of mail ballots yet to be counted though as I write this I cannot find any source as to the exact number. And the chain of custody?

Returning to our original problem that Bunker previously posted regarding Lancaster County PA:

PA 21,000 Mail Ballots to be ‘Hand Marked’ Due to Printing Error

A novel approach to correct this was to ask on the local Lancaster TV station for volunteers to come down and replace the ballots unreadable with new marked ballots. The chain of custody was meager as best after hours. There certain was no hurry in completing the process. Ballots were processed from 9 am to 6 pm and last I heard were completed for this county on Saturday. What happened to ballots the other hours is unknown and no one has asked.

 

The glitch will force election workers to hand-mark fresh ballots, a process expected to take several days. Officials in the county, the state’s sixth most populous, pledged that all the ballots will be counted eventually. But by whom? How about the local candidates where a few votes can make all the difference.

Here is how Lancaster is going. It took until Saturday to fix the ballots.

The GOP has done nothing to correct these outstanding issues by going to court and once again we will wind up questioning the results.  Federal interference should have made this a Federal case all the way to the Supremes.

Storm Clouds Thunder over PA Primary Senate Race – Supreme Alito Pauses Lower Ruling

 

UPDATE: McCormick concedes. This needs to be adjudicated otherwise this will be an issue in the fall or worse in 2024.

Does a Federal Judge have the right to make a ruling on a State election three days after an election while the ballots are still being counted? At stake the PA Senate race between McCormick and Oz. A ruling that could change the outcome. What precedent does that set for future elections if this decision is upheld? Now the ultimate. The Federal Supreme Court now weighs in. Less than a thousand votes separate Oz and McCormick with Oz in the lead.

There is a lot more to this story than ballots that did not have a date placed on the outside of the envelope by the voter as required by law. It is the State Versus the Federal government and has far reaching consequences that go far beyond Pennsylvania. I am fortunate to live in the PA State Capitol’s news Market otherwise I would not have known anything about this clown show that has been ravaging the election boards and the court system for weeks. 

 

 

Here is the Cliff Notes edition:

A Judge at the District Court level rules that certain ballots cannot be counted, as legislated by the Pennsylvania government, that dates must be on the outside of the envelope.

The Federal Third Court of Appeals overrules. Federal appeals court say undated PA mail ballots should be counted, a decision that breaks with state courts and could have immediate impact. The old Civil Rights violation they say.

The PA State Supreme Court refuses to make an expedited ruling on the matter and decides that the case must wind its way through the lower courts. This of course throws the election into chaos.

Enter Justice Samuel Alito who pauses a lower-court ruling. The high court’s action, called an administrative stay, freezes the matter until the court can give it further consideration.

Enter the State Courts:  One David Ritter from Allentown PA:

A candidate in a tight race for a Lehigh County judge seat is taking his fight to court.

David Ritter is reportedly challenging the election board’s decision to count 260 mail-in ballots that didn’t have dates on the outer envelopes.

An attorney for Cohen says the votes should be counted because they were from registered voters who signed their ballots and submitted them on time.

Ritter tells us he’s disappointed in the election board’s decision to count the votes.

It’s his position that the law says the ballots can’t be counted because they were “previously disqualified.”

Meanwhile the Federal Supremes step in:

Enter the Supreme Court of the United States.

WASHINGTON (AP) – The Supreme Court is temporarily blocking the counting of some mail-in ballots in Pennsylvania.

The order Tuesday could affect the tight Republican Senate primary between former hedge fund CEO David McCormick and celebrity heart surgeon Dr. Mehmet Oz.

The order from Justice Samuel Alito pauses a lower-court ruling in a lawsuit over a disputed 2021 court election in Lehigh County that would have allowed the counting of mail-in ballots that lack a handwritten date.

The 3rd U.S. Circuit Court of Appeals in Philadelphia had ruled that the state election law’s requirement of a date next to the voter’s signature on the outside of return envelopes was “immaterial.”

Based on that ruling, the state had advised counties to count those ballots in the race between McCormick and Oz.

As McCormick scrounges for ballots to make up the gap with Oz, Alito’s order also could freeze a separate federal lawsuit in Pennsylvania in which McCormick is fighting to force counties to count the ballots.

The state law requires voters to write a date on the envelope in which they mail in their ballots. However, the envelope is postmarked by the post office and timestamped by counties when they receive it. (Usually as we now learn.)

The lower court ruling involved 257 disputed mail-in ballots in the November 2021 race for commonwealth judge in Lehigh County. Fewer than 75 votes separate Republican David Ritter and Democrat Zachary Cohen for the final spot for Court of Common Pleas judge in that race.

Almost concurrently with Alito’s stay, the Pennsylvania state Supreme Court dealt another blow to McCormick. There, the court declined to exercise its “King’s Bench Powers” to hear the case directly, instead of having it wind its way through the lower court system.

It was a rapid change of direction from just early afternoon yesterday, where a lower state court heard arguments from the campaigns about counting the undated ballots. In questioning attorneys for both candidates and the Department of State, Commonwealth Court Judge Renee Cohn Jubelirer seemed at times receptive to the argument that the undated ballots should be counted.

No one will be happy with the ending to this circus.  Various election boards have been making different decisions about the ballots. Some claim envelopes have been thrown away so that to separate them now is not possible. Better yet? The recount continues. And what about the chain of custody of these ballots since the election? Don’t ask.

Certainly everyone can appreciate the chaos to our election system if one judge from one court can make a ruling that is not timely, after an election has already occurred and the count is in progress.
