Softcell
By using our Internet services you agree to comply with our Terms of Service (TOS), Acceptable Use Policy (AUP) and other related policy statements published from time to time and posted at Softcell Internet Services – TOS.
This document is published here to serve as a general guideline and is intended to (a) ensure reliable service to our esteemed customers (b) comply with existing laws (c) encourage responsible use of the Internet resources and discourage activities which reduce the usability and value of Internet services and (d) help us be a responsible service provider. Non-adherence to any clause(s) mentioned below will be acted upon with immediate effect and zero tolerance; we reserve the right to terminate or limit the service(s) with no notice in such cases.
Terms of service
- Softcell reserves the right to remove communities and chats that advocate or encourage expressions of violence, bigotry, racism, hatred, or profanity.
- Customer shall not violate any copyright directly or indirectly.
- Customer shall not allow any illegal activities. Customer shall not use the Services to publish, post, distribute, or disseminate defamatory, infringing, obscene, or other unlawful material or information, specifically, but not limited to, child pornography, bestiality and incest. Also, these services shall not be used for chats or communication relating to illegal drugs, money laundering, acts of or acts aiding/abetting terrorism.
- Customer shall not use any of the Services for the purpose of linking to external sites that violate this agreement or Code of Conduct as may be modified by Softcell from time to time to keep it in tune with existing laws as they may be modified from time to time.
- Customer shall not upload files or post messages that contain photos, music, software or other material protected by intellectual property laws, rights of privacy or publicity or any other applicable law unless Customers own or control the rights thereto or have received all necessary, permissions, licenses or consents. Softcell is not responsible for any use of anything Customer says or post.
- Customer shall not post/load any materials/applications (including software and other information) that could harm (or is designed to harm) other users in the data centre or on the Internet (or virtual private net work hosted on / connected to the Internet) or would allow others to inappropriately access software or Internet services sites.
- Softcell shall not tolerate disruptive activity online, postings or statements that incite others to violate this Code of Conduct or participate in illegal activities.
- Softcell shall not allow the posting of destructive features, use of computer programs that contain such features, or access to any content that contains destructive features such as: viruses, worms, Trojan horses, or bots for the use of scrolling, showing multiple screens, and other activities that can be disruptive to online communication or Internet system or services.
- Falsely impersonating a Softcell employee, agent, manager, host, or any other person with the intent to mislead or cause harm to others is forbidden.
- Customer shall not do or omit to do any act by which Customer becomes a party (by allowing use of services provided by Softcell knowingly or unknowingly) to the “theft of data”, “information” or “Intellectual Property” from, by or through the use of the services.
Antispam Policy
- Spamming or the sending of unsolicited e-mail, from Softcell’s server(s) or network resources or using an email address or domain that is maintained on a Softcell machine as reference is STRICTLY prohibited. Softcell will be the sole arbiter as to what constitutes a violation of this provision.
- Under no circumstances can any domain account hosted with us be used for mass unsolicited e-mailings (spamming). If spamming is reported and verified, the account shall be removed from our servers without any notice.
- Sending unsolicited email prompting the recipient to go to a web address or using a return email address that is hosted on the Softcell’s network is strictly prohibited, even if the message does not originate on our network. If the message advertises, solicits visits to, or promotes a domain we host, it will be terminated.
- The antispam policy also applies to mailing lists or mailing services. An acceptable mailing list will be focused at a targeted audience that has voluntarily signed up (opted in) or has made their e-mail address available for distribution of information from you. The list must also allow for automatic removal by all end Customers with non-distribution in the future. Mailing lists cannot be used to distribute unsolicited email. Any disregard to the above mentioned policy would attract immediate termination of the service.
Acceptable Use Policy (AUP)
- To protect and maintain high availability of all shared resources (hosts &/or network elements), activities designed to cause harm to or monopolise the resources within the Softcell network is expressly prohibited. This includes but is not limited to, the use of programs that consume excessive CPU time, use of server space beyond the subscribed limits of an account, use of any provided mail services other than for the customer’s own account, resale of disk space without an appropriate reseller agreement, use of servers to engage in any malicious or illegal activity, including unauthorized access to remote systems or providing the means for such access or engaging in any activity that can be used as a means to begin remote system penetration, distribution of viruses, worms, or any other electronic destructive resource; or maintaining or creating any free for all type sites.
- Excessive use or abuse of shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination or suspension of service without notice.
- You are prohibited from excessive consumption of resources, including but not limited to, CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of our systems or network resources. Softcell reserves the right to terminate or limit such activities.
Third Party accountability:
You will be held responsible and accountable for any activity by third parties, using your account, that violates guidelines created within the various sections of our policy as documented on this page. Such third-parties may without limitation, include known people like friends, family members, guests, colleagues, etc., with access to your service account.
