TL;DR: Use WPPulse responsibly. Your data is yours. We do our best to keep the service running but can't guarantee perfection. Either side can walk away at any time.

2. Acceptance of Terms

By creating an account or using WPPulse, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service. These terms constitute a legally binding agreement between you and Fizteq Solutions SRL.

3. Account Registration

When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and API keys.
  • Accept responsibility for all activity that occurs under your account.
  • Be at least 16 years of age, or have the consent and supervision of a parent or legal guardian.
  • Notify us immediately of any unauthorized use of your account.

4. Service Description

WPPulse is a WordPress site monitoring platform that provides error tracking, uptime monitoring, plugin lifecycle alerts, and security notifications. The service consists of:

  • A central dashboard for viewing alerts and site health data.
  • A WordPress plugin installed on monitored sites that reports events to the dashboard.
  • Notification delivery via email, Telegram, Discord, and Slack.

While we strive for high availability, we do not guarantee 100% uptime or uninterrupted service. Monitoring data is provided on a best-effort basis and should not be relied upon as the sole source of truth for site health.

5. Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose.
  • Abuse, overload, or deliberately disrupt the API or monitoring infrastructure.
  • Attempt to bypass rate limits, authentication mechanisms, or access controls.
  • Use the service to monitor sites you do not own or have authorization to monitor.
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform.
  • Transmit any malicious code, viruses, or harmful data through the service.

Violation of these terms may result in immediate account suspension or termination.

6. Your Data and GDPR

Your use of WPPulse is governed by our Privacy Policy. By using the service, you acknowledge and agree to the data practices described therein.

Your responsibility as a data controller: When you install the WPPulse plugin on your WordPress site, error reports may include personal data from your site's visitors (such as IP addresses or request context). You are the data controller for this data under GDPR. It is your responsibility to:

  • Ensure you have a lawful basis for collecting and transmitting this data to WPPulse.
  • Update your own site's privacy policy to disclose the use of WPPulse as a data processor.
  • Configure the plugin's sensitive data filtering to suit your requirements.

A Data Processing Agreement (DPA) is available at wppulse.app/dpa for customers who require one.

7. Intellectual Property

The WPPulse platform, including its code, brand, user interface, documentation, and design, is the intellectual property of Fizteq Solutions SRL. You may not copy, modify, or distribute any part of the platform without prior written consent.

Your data remains your property. We claim no ownership over the monitoring data, error logs, or site information you submit through the service.

8. Payment Terms

WPPulse offers both free and paid plans. For paid plans:

  • Payments are processed securely via Lemon Squeezy, which handles billing, invoicing, and EU VAT compliance.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Prices may change with at least 30 days' notice via email. Continued use after the notice period constitutes acceptance of the new pricing.
  • Refunds are handled on a case-by-case basis. Contact us at wppulse@fizteq.com for refund requests.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • WPPulse is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • We are not liable for losses resulting from monitoring failures, missed alerts, service downtime, or data loss.
  • Our total liability for any claim related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct.

10. Termination

Either party may terminate this agreement at any time:

  • By you: Delete your account from Account Settings at any time. Active paid subscriptions should be cancelled first.
  • By us: We may suspend or terminate your account for violation of these terms, abuse of the service, or non-payment. We will provide reasonable notice where possible.

Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing obligations under these terms caused by events beyond reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, power outages, internet disruptions, government actions, or third-party service failures.

12. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of Romania and applicable European Union regulations, including the General Data Protection Regulation (GDPR).

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania. This does not affect your statutory rights as a consumer under the laws of your country of residence, including the right to bring proceedings in your local courts.

13. Dispute Resolution

Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. You may contact us at wppulse@fizteq.com to begin a resolution process.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email at the address associated with your account at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes your acceptance of the updated terms.

15. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms of Service, together with the Privacy Policy, Cookie Policy, and, where applicable, the Data Processing Agreement, constitute the entire agreement between you and Fizteq Solutions SRL regarding the use of WPPulse. They supersede any prior agreements or understandings.
