Copyright Dispute Policy

In accordance with the Digital Millennium Copyright Act (DMCA), Chocominty has adopted the following policy regarding copyright infringement. Chocominty reserves the right to:

  1. Block access to or remove material that it believes, in good faith, constitutes copyrighted content that has been unlawfully copied and distributed by advertisers, affiliates, content providers, members, or users; and

  2. Remove and discontinue services to repeat offenders.

Please note that your use of Chocominty’s services is at all times subject to our Terms of Use, which incorporates this Copyright Dispute Policy. Any terms used but not defined herein shall have the meanings given to them in the Terms of Use.

Procedure for Reporting Copyright Infringements

If you believe that material residing on, or accessible through, our Services infringes your copyright (or the copyright of someone you are authorized to act on behalf of), you must send a written notice of copyright infringement containing the following information to Chocominty’s Designated Agent (contact details listed below):

(a) A physical or electronic signature of a person authorized to act on behalf of the copyright owner whose rights have allegedly been infringed;

(b) Identification of the copyrighted work(s) or material(s) claimed to have been infringed;

(c) Identification of the material that is claimed to be infringing, including information sufficient to locate the material on the Services, so that Chocominty can find and verify its existence;

(d) Contact information of the notifier, including full name, address, telephone number, and email address (if available);

(e) A statement that the notifier has a good faith belief that the material identified in (c) is not authorized by the copyright owner, its agent, or the law; and

(f) A statement, made under penalty of perjury, that the information provided is accurate and that the notifier is authorized to act on behalf of the copyright owner.

Response to Proper Infringement Notifications

Upon receipt of a valid DMCA notice, Chocominty reserves the right to:

(a) Remove or disable access to the allegedly infringing material;
(b) Notify the content provider accused of infringement that the material has been removed or access has been disabled; and
(c) Terminate the content provider’s access to the Services if they are determined to be a repeat infringer.

Procedure for Submitting a Counter-Notice

If a content provider believes that material was removed or disabled by mistake or misidentification, the provider may send a written counter-notice to Chocominty’s Designated Agent containing the following:

(a) A physical or electronic signature of the content provider;

(b) Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal or disablement;

(c) A statement that the content provider has a good faith belief that the material was removed or disabled due to mistake or misidentification; and

(d) The content provider’s name, address, telephone number, and email address (if available), along with a statement that the content provider consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or, if outside the United States, to any judicial district in which Chocominty is located. The provider must also state that they will accept service of process from the party who submitted the original infringement notice.

If a valid counter-notice is received, Chocominty may, at its sole discretion, forward a copy to the original complaining party to notify them that the removed material may be reinstated or access restored within 10 business days. Unless the copyright owner initiates legal action seeking a court order, the removed material may be reinstated or access restored within 10 to 14 business days or more after receipt of the counter-notice, at Chocominty’s sole discretion.
