Federal Cases
Federal Extortion — Complete Acquittal
Charges: Federal extortion and conspiracy
Result: NOT GUILTY verdicts on all counts
In a high-profile Teamsters Local 25 “Top Chef” extortion trial, the government brought the full weight of the Department of Justice against union members, alleging federal extortion and conspiracy. As part of the defense team, we secured not guilty verdicts on all counts by successfully proving that our clients were fighting for legitimate labor jobs, and drawing the line between employees advocating for real jobs and criminal extortion.
Federal Gun Charges — Case Dismissed
Charges: Prohibited possession and making false statements during firearm purchase
Result: All charges dismissed
My client was charged in federal court with being a prohibited possessor and making false statements during a firearm purchase. The government’s case relied heavily on statements my client made during a SWAT raid at his home and a later interrogation at the police station. I filed a motion to protect my client’s right to remain silent after the police interviewed him twice but failed to tell him he had the right to a lawyer and the right to remain silent until the second interview. The Court agreed that my client’s rights were violated and ruled the statements could not be used as evidence. The government was forced to dismiss the charges.
Mail Fraud & Conspiracy — Probation Instead of Prison
Charges: Multi-state mail fraud and conspiracy to defraud a federally-funded program
Result: Probation (no jail time)
My client was charged, along with a group of individuals, with engaging in a multi-state scheme to defraud a federally-funded program. The prosecutor alleged that the group fabricated a magazine to obtain reimbursement proceeds from a government program. Following a lengthy jury trial lasting nearly three weeks, my client was convicted; however, despite the government’s adamant recommendation for a prison sentence, I was able to successfully convince the judge to give my client probation instead.
False Statement to Federal Auditor — Probation
Charges: Making false statements to a federal auditor regarding nonprofit grant funds
Result: Probation
My client ran a nonprofit organization and was charged with misleading a federal auditor in order to allegedly conceal over $100,000 of federal grant funds. The government’s theory was that my client purchased real estate with federal grant money at inflated property prices, and later received a donation from the seller, which they labeled as a kickback. Although the indictment detailed serious fraud allegations and the government sought prison time, the legal proceedings concluded with a successful defense outcome of probation.
State Cases
Aggravated Assault — Complete Acquittal
Charges: Aggravated assault (shooting at a police officer)
Result: Complete acquittal
My client was wrongfully charged with shooting at a police officer outside of a strip club. During four days of trial, we showed that the identification was unreliable and that the police officer provided misleading information regarding some pretty critical details. The jury returned a verdict of not guilty on all counts.
