Knowledge Network Corporation (“we” or the “Knowledge Network”) is committed to protecting your privacy and Personal Information. As a public body, we may collect, use and/or disclose your Personal Information in accordance with the British Columbia Freedom of Information and Protection of Privacy Act, and we only collect Personal Information which relates directly to, and is necessary for the administration of, our programs and activities.

What do we mean by “Personal Information”?

Personal Information” means any information which may be unique to, or which may be used to identify, an individual. Examples of Personal Information include but are not limited to: your name; your address; your birth date; your e-mail address; your phone number; your credit card information; and your Internet Protocol (IP) address.

Use and Retention of Personal Information

What do we do with your Personal Information?

We maintain server logs, web logs, and other industry-standard technologies which automatically collect and store your Personal Information while you access Knowledge Network’s website(s), streaming platform(s) and/or application(s) (each, a “Website”).

Except for the limited circumstances outlined below, we only use your Personal Information to deliver Knowledge Network’s public broadcasting service and fundraising programs. For example, we may use your Personal Information to (a) respond to your enquiries, (b) process your donations, (c) notify you about our programs, events and fundraising initiatives, (d) conduct Website maintenance, (e) determine the availability of content or service in your region, and/or (f) conduct internal analysis for management purposes (e.g. generate geographic-related statistics), but we will NOT sell, rent, trade or freely distribute your Personal Information.

In limited circumstances of criminal activity or other malfeasance, or where necessary to protect the security and integrity of our Website, we may share your Personal Information with appropriate investigative bodies who may use it to trace and identify individuals.

Our Website uses “cookies” and/or other industry-standard technologies that install information on your computer in order to track how you use the Website. If your browser allows, you may choose to decline “cookies”, but doing so may affect your ability to access certain features of the Website.

Security

How do we keep your Personal Information Safe?

We use technical and administrative security measures and controls (collectively, our “Personal Information Safeguards”) to safeguard the Personal Information that we collect. Roles, permissions and access controls are in place so that Knowledge Network employees and contractors are only granted access to the Personal Information that they require to perform their job duties or carryout their services. Additionally, we send any credit card information that you provide us directly to a PCI Level 1-compliant payment processor for processing.

Our Personal Information Safeguards are reviewed regularly, as industry standards for data protection and network security evolve.

We take the responsibility of protecting your Personal Information very seriously, however Knowledge Network, its parents, subsidiaries, affiliates, agents, representatives, principals, employees and their successors, licensees and assigns are not responsible for any damages resulting from data breaches, or the negligence or misconduct of third parties, including our contractors. 

A Note About Other Websites

The Website may contain links to third party websites; however, we are not responsible for the content or privacy practices of any such third party websites. In other words, our standard Personal Information Safeguards do not protect any Personal Information collected by any website that is not Knowledge.ca.

A Note About Social Media

Knowledge Network uses third-party social media platforms to promote our programming and initiatives as well as interact and engage with our viewers. Unfortunately, we cannot control how those social media platforms collect, store and/or use your Personal Information. In other words, our standard Personal Information Safeguards do not necessarily protect any Personal Information posted on, or collected by, any social media platform. Because of this, we encourage you to read the privacy policy of each social media platform you use. To protect your own privacy, and the privacy of others, we also ask that you do not include anyone’s Personal Information, including phone numbers, email addresses and pictures, in the body of any comments you leave on our social media pages or posts.

Consent

How do I consent to Knowledge Network’s collection, retention and use of my Personal Information?

Your use of the Website confirms your receipt and acceptance of the terms of this Privacy Policy, including those related to our collection, retention and use of your Personal Information in accordance with this Privacy Policy.

If you would like to correct or update any Personal Information that we may have collected from you, please feel free to reach out to us.

If you do not consent to the terms of this Privacy Policy, please immediately exit the Website and refrain from future use of the Website.

Knowledge Network Corporate Website – Terms of Use

Knowledge Network Corporation (“we” or the “Knowledge Network”) is glad to provide you with access to Knowledge.ca (the “Website”), subject to these Terms of Use (the “Terms of Use”).

Acceptance of the Terms of Use

By continuing to use the Website, you confirm your acceptance of the Terms of Use, as we may amend or update from time to time. We may add to, modify or delete the Terms of Use at any time, without notice. Because of this, we strongly encourage you to review the Terms of Use regularly.

If you do not accept the Terms of Use, please immediately exit the Website and refrain from any future use of the Website.

Age Restrictions

Certain services offered through the Website are subject to age restrictions (the “Age Restrictions”). In particular:

  • you must be nineteen (19) years of age or older to register or create an account for any Website services that require registration or account creation. If you are younger than nineteen (19) years of age, then you are prohibited from registering for any services through the Website; and
  • you must be fifteen (15) years of age or older to use any Communication Services (see the Use of Communication Services section below), and if you are fifteen (15) years of age or older, but younger than nineteen (19) years of age, you may only use the Communication Services with your parent or guardian’s consent and their acceptance of the Terms of Use on your behalf. If you are younger than fifteen (15) years of age, then you are prohibited from using the Communication Services.

Ownership

Knowledge Network owns or licences all of the content that it publishes on the Website, including but not limited to the text, graphics, articles, photographs, images, illustrations, audio recordings, videos, HTML and software (collectively, the “Content”). In addition, Knowledge Network or other entities own all trademarks, trade names, logos, designs and service marks (collectively, the “Marks”) referenced or featured on the Website.

Accessing the Website does not give you an ownership interest in the Content or the Marks. In other words, your unauthorized use of the Content or Marks may violate copyright, trademark and other laws.

License to Download Content

As a Website user, we grant you a revocable licence to access the Content for personal, non-commercial, temporary viewing only (the “Licence”). The Licence is non-transferable and does not give you any ownership interest in the Content. Additionally, the License does not give you the right to:

  • republish, distribute, perform, display, translate, retransmit, broadcast, sublicense, copy, adapt, modify or distribute the Content;
  • use the Content for any commercial purpose, or for any public display (whether commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained in the Website;
  • remove any copyright or other proprietary notations from the Content; or
  • use any Content for any unlawful purpose.

The Licence may be terminated by Knowledge Network at any time for any reason, and the Licence will automatically terminate if you breach any of the Terms of Use. Upon termination of the Licence, you must destroy all Content in your possession. 

No Linking, Framing, Mirroring, Scraping or Data Mining

Linking to the Website and framing, mirroring, scraping or data mining of the Website or Content in any form and by any method is prohibited. To request permission to link to the Website, please contact Knowledge Network at [email protected].

All information, resources and links (collectively, “Resources”) found on the Website are for informational purposes only and should not be relied upon without consulting a qualified professional. The Resources and Content are provided “as is”, “as available” and without warranties or conditions of any kind.

The Website may contain links to third party websites. These sites are not controlled or endorsed by Knowledge Network, nor are they governed by these Terms of Use. We encourage you to review the applicable terms of use and privacy policies before using any third party websites.

No Unlawful or Prohibited Use

You may not use the Website for any unlawful activity or in any manner which could damage, alter, disable, overburden or impair the Website or any other person’s use and enjoyment of the Website.

Use of Communication Services

The Website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, user content platforms, and/or message or communication facilities designed to enable you to communicate with the public at large or with a group (each a “Communication Service”, collectively “Communication Services”). When using the Communication Services, you will be subject to the Age Restrictions, the Terms of Use (including the Submissions section below), and Knowledge Network’s Code of Conduct.

You acknowledge and agree that you are personally liable for the content that you publish and distribute while using the Communication Services. We may, in our sole discretion, review, remove and/or edit any materials posted to a Communication Service. We may also terminate your access to any or all of the Communication Services at any time without notice for any reason.

Producer Submissions

We only accept proposals, pitches, materials, suggestions, notes, scripts, storylines, text, screenplays, articles, formats, treatments, fiction, videos, literary materials, compositions, characters, drawings, artwork, concepts, ideas and/or any other materials relating to any existing, developing or proposed television, film or other audio-visual projects (each a “Proposal”) through our Producers Portal and we only review proposals upon receiving a signed Submission Release from the person or entity that submitted the Proposal (the “Submission Release”).

Any unsolicited proposal not accompanied by a signed Submissions Release and/or submitted via email, a Communication Service, or any means other than the Producers Portal may be destroyed, deleted or returned without review. Such unsolicited proposals shall nonetheless be subject to these Terms of Use.

By submitting a Proposal to Knowledge Network, via the Producers Portal or otherwise, you:

  • declare that you own or control the rights in and to the Proposal, including all intellectual property rights in that Proposal and all elements of that Proposal, and that no other person or entity has any right, title or interest in the Proposal which is inconsistent with your right to develop and/or licence the Proposal;
  • declare that the Proposal is not defamatory and does not infringe upon or violate the rights of any third party, including any privacy rights, copyrights, trademarks, publicity rights, or other intellectual property or proprietary rights of any third party;
  • grant Knowledge Network an irrevocable non-exclusive worldwide license to use, edit, modify, delete, reproduce, publish, distribute, translate, adapt, communicate, perform in public, archive or index the Proposal;
  • waive any moral rights you may assert related to the integrity of the Proposal;
  • understand that the Knowledge Network has no obligation of confidentiality towards the Proposal and that Knowledge Network will not be liable for any use or disclosure the Proposal;
  • understand that Knowledge Network has no obligation to provide you with compensation in connection with the Proposal;
  • understand that Knowledge Network has no obligation to review, acknowledge, use or return your Proposal;
  • understand that Knowledge Network may, in the future, receive or independently develop materials that are similar to the Proposal, and that you will have no right or recourse against Knowledge Network for use of such materials; and
  • irrevocably waive the right to make any claim against Knowledge Network related to any Proposal, including, without limitation, for unfair competition, copyright infringement, breach of implied contract or breach of confidentiality.

The above rights and licences granted to Knowledge Network are perpetual and non-revocable, and are applicable to all media, including without limitation, all print media and digital or electronic media now known or hereafter created.

Limitation of Liability

While we consistently strive to provide a positive user experience, we cannot always guarantee that the Website will run seamlessly.

By continuing to use the Website, you confirm that you understand and agree that:

  • Knowledge Network is not liable for any defamatory, offensive or illegal conduct of any third party;
  • Knowledge Network is not liable for any materials posted by Website by third parties which are inaccurate, illegal or incompliant with intellectual property laws;
  • The content available on the Website may vary depending on where you are located, and Knowledge Network does not guarantee that all of the Website’s content will be available worldwide or in Canadian provinces and territories outside of British Columbia; 
  • Knowledge Network does not guarantee the quality of service on your individual device, and is not responsible for your internet access and bandwidth; and
  • Knowledge Network is not liable for any loss of use, loss of data, loss of opportunity, loss of income or profit, loss of or damage to property or data, or for any damages of any kind or character arising out of or in any way connected with the use of, or the delay in use or inability to use, the Website, the contents of the Website or any website or contents linked to the Website, even if Knowledge Network has been advised of the possibility of such damages or losses.

Indemnity and Release

By using the Website you agree to indemnify Knowledge Network and its subsidiaries, affiliates, officers, volunteers and employees, and to hold them harmless from any and all loss, liability, damages, claims and expenses, including legal fees, arising from your violation of these Terms of Use, your use of the Website, and/or your breach or alleged breach of the copyright, trade-mark, proprietary or other rights of Knowledge Network or third parties.

By accessing the Website you are agreeing to release Knowledge Network and its subsidiaries, affiliates, officers, volunteers and employees from any and all claims, demands, debts, obligations, damages (actual or consequential), costs and expenses of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that you may have against them arising out of or in any way related to your use of the Website or the products or services offered at or associated with the Website.

Governing Law and Jurisdiction

These Terms of Use, your use of the Website, and all related matters will be governed solely by the laws of the Province of British Columbia, Canada and the applicable federal laws of Canada therein, without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of British Columbia in connection with all disputes arising from or related to these Terms of Use, your use of the Website and any related matters.

No Waiver

If Knowledge Network fails to exercise one if its rights or privileges under these Terms of Use, that does not mean that we cannot exercise that, or any other, right or privilege in the future.

Severability

If any provisions of these Terms of Use are found to be invalid or unenforceable, then such invalid provisions will be replaced with provisions that most closely match the intent of the original provisions while still being valid and enforceable, and the rest of the Terms of Use will continue to be in effect.

Entire Agreement

These Terms of Use constitute the entire agreement between you and Knowledge Network with respect to your use of the Website. If you previously entered into an agreement with Knowledge Network with respect to the use of the Website, that prior agreement is now deemed to be cancelled and these Terms of Use shall apply instead.

Enurement

These Terms of Use are binding upon and apply to both you and Knowledge Network. If someone else, such as an as heir, executor, or administrator, takes over your obligations or Knowledge Network’s responsibilities under these Terms of Use, the Terms of Use will be binding upon that person as well.

Compliance with Laws

Nothing in these Terms of Use prohibits the Knowledge Network from complying with applicable laws, governmental regulations and requests from law enforcement relating to your use of the Website or the information you provide to Knowledge Network through the Website.

Language of these Terms of Use

It is the express will of the parties that these Terms of Use and all related documents have been drawn up in English. C’est la volonté expresse des parties que la présente Terms of Use ainsi que les documents qui s’y rattachent soient rédigés en anglais.
