At the risk of sounding alarmist, this sounds like another nail in the coffin for Article I. If SCOTUS doesn't act to limit the President's tariff powers, and the President can just ignore the expired spending legislation, then why do you need Congress?

To keep the WIC program running during the shutdown, "the administration will transfer funding derived from tariff revenue." I am shocked - shocked! - that, far from paying off the debt, tariffs are now just a magical, legally-suspect slush fund for Trump's political priorities

CBO didn't exist before 1974, so there's no point in questioning whether they were right or not in the '30s or the '60s. Also, Laffer Curve logic should shape how you think about tariffs and other tax hikes that shrink that tax base (Sec. 899).
