Huge decision holding that CEQ never had authority to issue the National Environmental Policy Act regulations that have been used for nearly half a century
In other news, this seems like an enormous NEPA decision from the DC circuit today, which rules that the Council on Environmental Quality *lacks the statutory authority to issue binding NEPA regulations.* A BFD which I'm still not sure what to make of. media.cadc.uscourts.gov/opinions/docs/…

When you realize how few know the difference between a million & a trillion, policy coverage makes so much more sense that it's almost consoling.

The “Unleashing American Energy” executive order includes this paragraph on electric vehicles, suggesting “terminating, where appropriate, state emissions waivers that function to limit sales of gasoline-powered automobiles” and “considering the elimination of unfair subsidies”

"To tap the potential of renewable energy, the United States needs to dramatically expand the electric grid between places with abundant wind and sunshine and places where people live and work." @nytimes highlighting my research on how to speed-up clean energy deployment

Very glad to see the NYT editorial board recognize that NEPA is doing more harm than good in its current form. We’ve come a long way since @elidourado first started talking about this years ago… nytimes.com/2023/05/04/opi…

“Of the major sectors, the highest litigation rate is in solar energy projects, nearly two-thirds of which are litigated. Light Rail Transit projects are litigated at nearly twice the rate of new highway projects and 2.5x the rate of highway improvement projects.”

Yes, as Mario says, the Supreme Court now has an opportunity to make the same decision, and we urge it to seize the day! x.com/mario_a_loyola…
James @EnergyLawProf is too modest to mention that he and I (and Richard Epstein) took exactly this position in our recent amicus brief for SCOTUS in the unrelated Seven Counties case.

The U.S. oil boom happening now is the biggest commodity boom ever—far bigger than every previous gold rush and ~7x as big as the biggest previous oil boom, which was in Saudi Arabia in the early 1970s.

Thrilled to announce I'll be coming to Minnesota in fall 2024! Bittersweet because I love my colleagues @SMULawSchool so much, and am so excited for what we're building here in Dallas. But it's a dream to be joining the tremendous faculty @UofMNLawSchool in my home state!

Puzzle: Why has Texas been so dominant in clean energy deployment—3x as much wind as any other state, installing 3x as much solar—when it doesn’t use many conventional “clean energy” policies?

President pauses approval of liquefied natural gas exports. 1) Unlike most U.S. exports, there have already been government studies of the climate impact of LNG exports. They suggest U.S. LNG lowers global carbon emissions. energy.gov/sites/prod/fil…
FULL STATEMENT: And it's official. The White House announces a "temporary pause" on pending approvals of American LNG export terminals. The statement is below, and links here to the comuniqué itself: whitehouse.gov/briefing-room/… and a White House factsheet: whitehouse.gov/briefing-room/…
