1. Scope of Application

These General Terms and Conditions apply to all orders placed through our online shop at usoncloud.com, which is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional activities. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

2. Contractual Partner, Formation of Contract, and Order Corrections

The purchase contract is concluded with Essentials Gbr.

By placing products in our online shop, we make a binding offer to conclude a purchase contract for these items. You may add products to your shopping cart without obligation and review or correct your entries at any time before submitting your binding order using the correction tools provided during checkout.

The contract is concluded once you confirm your order by clicking the final order button. An order confirmation email will be sent immediately after your order is placed.

Returns are not accepted for sale items or gift cards. Exchanges may be permitted. The same conditions apply to pre-order items, as these are produced specifically for each individual order.

3. Contract Language and Storage

The language available for concluding the contract is German.

We store the contract text and send you the order details and these General Terms and Conditions in text form via email. You may also access the contract text through your customer account.

4. Delivery Conditions

Additional shipping costs may apply and will be clearly displayed during the checkout process.

Delivery is carried out exclusively by mail. Self-collection is not available. We do not deliver to packing stations. Return shipping costs are borne by the customer unless otherwise stated.

5. Payment Methods

The following payment methods are available in our online shop:

Credit Card

By submitting your order, you provide your credit card details. After successful verification, the payment is processed automatically, and your card is charged.

PayPal / PayPal Express

You will be redirected to the PayPal website during checkout. After logging in and confirming the payment details, PayPal processes the transaction automatically.

Apple Pay

Apple Pay is available through the Safari browser with Apple Pay enabled. The payment is completed immediately after order confirmation.

Google Pay

To use Google Pay, you must have an active Google Pay account. The payment is processed immediately after authentication and confirmation.

7. Retention of Title

All goods remain the property of Palace Skatesboard until full payment has been received.

8. Transport Damage

If your order arrives with visible transport damage, please report it immediately to the delivery carrier and contact us without delay at  [email protected]

Failure to report transport damage does not affect your statutory rights but assists us in pursuing claims against shipping providers or insurers.

9. Warranty and Guarantees

Unless expressly stated otherwise, statutory warranty provisions apply.

For used goods, warranty claims are excluded if defects arise more than one year after delivery. Defects discovered within one year of delivery may be asserted within the statutory limitation period of two years.

These limitations do not apply in cases involving:

  • Injury to life, body, or health
  • Intentional or grossly negligent misconduct
  • Breach of essential contractual obligations
  • Fraud or agreed guarantees
  • Claims under the Product Liability Act

10. Liability

We accept unlimited liability for damages caused by us, our legal representatives, or agents in cases of:

  • Injury to life, body, or health
  • Intentional or grossly negligent breaches of duty

In cases of slight negligence involving essential contractual obligations, liability is limited to foreseeable damages typical for the contract type at the time of agreement.
