Processing Purchases and License Management via Freemius

We use the services of Freemius to sell our digital product (the “The Studio Player” plugin), handle payment processing, and manage licenses.

Merchant of Record & Contractual Partner:
Freemius acts as our “Merchant of Record”; consequently, the license agreement is concluded directly between you and Freemius Inc. We are the technical provider and support partner for “The Studio Player”.

Data Processing for Contract Performance:
We receive the data necessary for contract performance from Freemius (e.g. name, email address, license type). Freemius processes your payment data and sends all transaction-related emails (order confirmations, invoices, license keys).

Legal Basis:
The processing is necessary for the performance of a contract and pre-contractual measures (Art. 6(1)(b) GDPR).

Abandoned Cart Recovery (Optional):
If you provide your express consent prior to the purchase process, Freemius processes your email address and cart information on our behalf in order to send you reminder emails regarding your abandoned purchase of “The Studio Player”.

Legal Basis:
Your express consent in accordance with Art. 6(1)(a) GDPR.

Withdrawal of Consent:
You can withdraw your consent at any time via the unsubscribe link in every reminder email. The withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

Service Provider & Data Transfer Details:
Provider: Freemius Inc., 4023 Kennett Pike, Wilmington, DE 19807, USA.
Website: https://freemius.com/
Privacy Policy: https://freemius.com/privacy/

Third-Country Data Transfers (EU to USA):
Data may be transferred to the USA when using Freemius. The transfer is based on the European Commission’s Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR, supplemented by additional technical and organizational measures implemented by Freemius.

Depending on the specific processing activity, Freemius acts either as an independent controller (e.g. for payment processing and compliance with its own legal obligations) or as our processor (e.g. for abandoned cart recovery emails).

Newsletter Subscription (via MailPoet)

We offer a free email newsletter to inform customers and interested parties about updates, new features of the “The Studio Player” plugin, and other relevant news.

Data Processing & Purpose:
When you subscribe to our newsletter, we process the data you provide in the registration form (primarily your email address and, optionally, your name for a personalized salutation). This processing serves the sole purpose of sending you the requested newsletter and documenting your consent.

Double Opt-In (DOI) Procedure:
To ensure your express consent and prevent misuse, we use the Double Opt-In procedure. After registration, you will receive a confirmation email asking you to click a link to finalize your subscription. The registration and confirmation times are logged as evidence of your consent.

Legal Basis:
Your express, voluntary consent in accordance with Art. 6(1)(a) GDPR.

Service Provider (Processor):
We use the MailPoet plugin and its associated sending service (provided by Automattic) for newsletter management, delivery, and analysis.

Processor:
MailPoet, a service of Automattic Inc., San Francisco, CA, USA.

Data Processing Agreement (DPA):
We have concluded a Data Processing Agreement with MailPoet/Automattic as required by Art. 28 GDPR.

Privacy Policy:
https://automattic.com/privacy/

Third-Country Data Transfers (EU to USA):
As MailPoet is part of Automattic Inc. (a US company), data may be transferred to the USA. The transfer is based on the European Commission’s Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR and Automattic’s robust data protection and security measures.

Your Rights & Withdrawal of Consent:
You can withdraw your consent to receive the newsletter and the associated data processing at any time with effect for the future. Every newsletter contains a clear, instant unsubscribe link in the footer. The withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

Support Channel (Forum)

If you participate in our community forum (powered by wpForo), we collect and process certain personal data to ensure the technical functionality, stability, and security of our services.

Scope of Data Collection:
Our community forum allows guest contributions without requiring account creation. However, to publish a post, users must provide a name and a valid email address. Upon submission, this data, along with the user’s Client IP address, is automatically recorded and securely stored in our database.

Purpose and Legal Basis:
The continuous collection and retention of IP addresses and contact data is strictly necessary to maintain IT security, prevent automated spam, and ensure legal accountability for published content. The processing is based on our legitimate interest pursuant to Art. 6 (1) lit. f GDPR.

Mandatory Consent & Checkbox Requirement:
By checking the mandatory consent box prior to submission, you explicitly agree to the processing and storage of the aforementioned data. Due to technical and security constraints, forum usage is strictly conditioned upon this consent; if the checkbox is not selected, submission is blocked.

Spam Protection (Google reCAPTCHA):
To ensure data integrity and safeguard our systems against malicious bots, this forum employs Google reCAPTCHA. Your submission behavior and device telemetry may be analyzed by Google for risk assessment, in accordance with applicable data privacy regulations.

When you follow a purchase link to the Freemius checkout, Freemius sets essential cookies for secure payment processing, fraud prevention, and license fulfillment. These cookies are required for the transaction and do not require prior consent. Details: https://freemius.com/privacy/cookies/

– MailPoet (Newsletter):
The newsletter subscription form uses essential cookies only where necessary for its functionality; no analytics cookies are used. Sending occurs server-side via MailPoet/Automattic.

Legal Basis under TTDSG:
The use of technically necessary cookies is based on Section 25(2) no. 2 TTDSG. The subsequent processing of personal data in this context is based on the performance of a contract (Art. 6(1)(b) GDPR) and/or our legitimate interest in providing and operating our website (Art. 6(1)(f) GDPR).
