DMCA Policy

Introduction

Spotify Mod respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, Spotify Mod has adopted a policy to respond promptly to claims of copyright infringement committed using our services or platforms.

This policy outlines the procedures for submitting a proper DMCA takedown notice and the process for submitting a counter-notification if you believe your content was wrongly removed or disabled.

Copyright Infringement Policy

Spotify Mod does not authorize or permit the use of its service to infringe upon the copyrights of others. Any user content that violates copyright laws may be removed or disabled without prior notice. Repeat offenders or accounts repeatedly involved in copyright violations may have their access suspended or terminated.

How to File a DMCA Takedown Notice

If you believe that your copyrighted work has been copied, distributed, or displayed using Spotify Mod in a way that constitutes copyright infringement, you may submit a DMCA takedown notice. To be effective, your notice must include all of the following elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including enough information for us to locate the material.
  4. Sufficient contact information to allow us to reach you, such as your name and relevant contact details.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Notices failing to comply substantially with these requirements may not be processed.

Counter-Notification Process

If you believe that material you posted was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must include the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and a statement that you consent to the jurisdiction of the appropriate court for your location, and will accept service of process from the person who provided the DMCA notice or their agent.

Once a valid counter-notification is received, Spotify Mod may restore the removed content unless the original copyright claimant files a court action seeking to restrict the content.

Repeat Infringers

Spotify Mod reserves the right to terminate accounts or restrict access for users who are found to be repeat infringers of copyrighted material, consistent with applicable law and the terms of this policy.

Misrepresentations

Any person who knowingly misrepresents material as infringing, or who knowingly files a false counter-notification, may be liable for damages under Section 512(f) of the DMCA.

Policy Updates

Spotify Mod may revise and update this DMCA Policy from time to time. Continued use of the service after any such updates constitutes acceptance of the current policy. Users are encouraged to review this page regularly for any changes.
