1. About these Terms
These Terms of Use (“Terms”) govern your access to and use of polartintfranchise.com (the “Site”), operated by Polar Tint LLC, a Nevada limited liability company with its principal office at 799 Middlegate Road, Henderson, NV 89011 (“Polar Tint,” “we,” or “us”). By using the Site you accept these Terms. If you do not accept them, do not use the Site.
2. Informational purpose — not a franchise offer
This Site is for informational purposes only. Nothing on the Site, including any pages, downloads, emails, videos, calculators, or messages, constitutes a franchise offering or the sale of a franchise. A franchise offering can only be made through a current Franchise Disclosure Document (FDD), delivered to a prospective franchisee in accordance with the FTC Franchise Rule (16 C.F.R. Part 436) and any applicable state franchise registration and disclosure laws.
Polar Tint franchises are not offered in any state where Polar Tint LLC is not registered (or otherwise exempt or legally permitted) to offer or sell franchises. The registration states currently include California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, and Wisconsin. They are not promises. Actual results vary based on operator execution, local market conditions, real estate, financing terms, and many other factors. The financial performance representations in Item 19 of our FDD — not statements on this Site — are the authoritative source.
4. License to use the Site
Subject to your compliance with these Terms, Polar Tint grants you a limited, revocable, non-exclusive, non-transferable license to access the Site for personal, non-commercial use, and (if you are evaluating the franchise opportunity) for the purpose of that evaluation. You may not:
- Copy, reproduce, republish, or redistribute Site content other than the FDD as required by law
- Scrape, mirror, or extract data from the Site by automated means
- Reverse engineer, decompile, or disassemble any portion of the Site
- Use the Site to send spam, malware, or any unlawful content
- Misrepresent your identity or financial qualifications
- Use the Site in any way that could damage, disable, or impair it
5. Intellectual property
The Site, including its design, text, photographs, graphics, logos, videos, FAQs, glossary, comparison content, and franchise opportunity copy, is the property of Polar Tint LLC, its affiliates (including Glacier Manufacturing), or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws. “Polar Tint,” the Polar Tint mark, and the iceberg logo are trademarks of Polar Tint LLC.
6. Submissions and forms
When you submit a franchise inquiry, application, message, or file through the Site you represent that the information is accurate and that you have the right to submit it. We treat submitted information under our Privacy Policy. By submitting, you grant Polar Tint a worldwide, royalty-free license to use the information for the franchise-development purposes described in the Privacy Policy.
7. Third-party links and services
The Site links to third-party sites (LinkedIn, YouTube, Glacier Manufacturing at glaciermfg.com, the SBA, IFA, FTC, state franchise registries, and others). Those sites are independently operated and we do not control them. We are not responsible for their content or practices.
8. Disclaimers
The Site is provided “as is” and “as available.” To the maximum extent permitted by law, Polar Tint disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, error-free, or secure. Polar Tint does not warrant the accuracy, completeness, or currency of any information on the Site. Investment values, build-out costs, financing terms, and operating economics are estimates subject to change.
9. Limitation of liability
To the maximum extent permitted by law, in no event will Polar Tint, its affiliates, members, managers, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising from or related to your use of the Site, even if Polar Tint has been advised of the possibility of those damages. Polar Tint’s total aggregate liability arising from or related to the Site will not exceed one hundred dollars (US $100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Polar Tint, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you submit through the Site.
11. Governing law & venue
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. The choice of Nevada law does not deprive you of the protection of any non-waivable consumer-protection law of your state of residence.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we revise the “Last updated” date at the top of the page. Material changes will be highlighted on the home page. Continued use of the Site after the effective date constitutes acceptance.
13. Severability & entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and (if applicable to you) the FDD and the executed franchise agreement, constitute the entire agreement between you and Polar Tint relating to your use of the Site.
