References to services on the Website may include current and future services offered by NEUROGLOW PC, including psychiatric care, telehealth, ketamine therapy, Spravato®, wellness services, and other healthcare services as permitted by applicable law.

2. Relationship Between These Terms and Patient Agreements

These Terms govern your use of the Website. In the event of any conflict between these Terms and any patient consent forms, treatment agreements, financial agreements, privacy notices, or other clinical documentation, the clinical documentation controls with respect to patient care and treatment.

3. Not Medical Advice; No Provider-Patient Relationship

The Website provides general information about our services and about mental health and related conditions and treatments. This information is for general educational purposes only. It is not medical advice, is not a substitute for professional medical care, and should not be relied on to diagnose or treat any condition.

Using the Website, reading its content, submitting a contact or consultation request, or otherwise communicating with us through the Website does not create a provider-patient relationship. A provider-patient relationship is established only after you complete our intake and consent process and are accepted as a patient. Always seek the advice of a qualified health provider with any questions you have about a medical condition, and never disregard professional medical advice or delay seeking it because of something you read on the Website.

Information regarding ketamine therapy, Spravato®, psychiatric services, wellness services, or other treatments is provided for educational purposes only. References to potential outcomes or patient experiences do not constitute guarantees of clinical results. Individual outcomes vary, and no specific medical, psychological, or therapeutic result is promised.

4. Medical Emergencies

The Website and our online tools are not monitored continuously and must not be used for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. If you are experiencing a mental health crisis or thoughts of suicide or self-harm, call or text 988 to reach the Suicide and Crisis Lifeline, available 24 hours a day. The Website is intended for adults age 18 and older located in the United States. Our clinical services, including any telehealth services, are available only to individuals who are physically located in a state where our providers are licensed at the time of service, currently Texas. Where care is provided by telehealth, you are responsible for being physically present in an eligible location and for having the connectivity needed for your appointment.

You are responsible for accurately disclosing your physical location at the time of any telehealth encounter. We reserve the right to decline, reschedule, or terminate services if we cannot verify that you are physically located in a jurisdiction where our providers are authorized to practice.

Nothing contained on the Website shall be interpreted as a solicitation, advertisement, or offer of medical services in any jurisdiction where such services cannot legally be provided.

6. Appointments, Communications, and Text Messaging

You may request a consultation or appointment through the Website. Submitting a request does not guarantee an appointment, which is subject to confirmation and clinical eligibility. Appointment scheduling, cancellation, no-show, payment, and financing policies are provided to patients during intake and form part of your patient agreements.

When you provide your contact information and opt in, we may contact you by phone, email, and text message, as described in our Privacy Policy. Marketing communications are optional and are not a condition of receiving care. For text messages, message frequency varies, message and data rates may apply, and you may reply STOP to opt out or HELP for assistance at any time.

You agree to indemnify and hold harmless NEUROGLOW PC and its officers, employees, and agents from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Website or your violation of these Terms or applicable law.

15. Force Majeure

You and NEUROGLOW PC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

TO THE EXTENT PERMITTED BY LAW, YOU AND NEUROGLOW PC WAIVE ANY RIGHT TO A TRIAL BY JURY AND ANY RIGHT TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION WITH RESPECT TO DISPUTES COVERED BY THIS SECTION.

This arbitration agreement applies to Website-related disputes only. It does not apply to, and you do not waive any rights with respect to, any claim relating to the professional healthcare services we provide, which are governed by your treatment consent forms, applicable law, and any separate dispute-resolution terms in your patient agreements.

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and us regarding the Website and supersede any prior agreements regarding the Website.

18. Changes to These Terms

We reserve the right to change these Terms at any time. When we make changes, we will post the updated Terms on this page and update the “Last Updated” date above. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
