Payment Policy
- Discovery Meetings: We are pleased to offer complimentary Discovery Meetings to help define the scope, goals, and expectations for your project. These initial consultations are provided at no charge to ensure we fully understand your needs before proceeding. Once the scope of work is agreed upon, a project proposal and payment schedule will be provided by printed document or email.
- Agreement: By making the initial payment or paying the full project price, you acknowledge and agree to all terms outlined in our policies. These policies govern the scope of work, timelines, payment terms, and responsibilities for both parties.
- Final Sales: All sales are final; no refunds for purchased products or projects.
- Payment Methods: We accept major credit cards. All transactions are processed securely through SSL encryption. Payments may also be made through cash or check.
- Ongoing Maintenance for Website Projects: To ensure seamless service and timely processing, we require prepayment for the full year or a payment authorization on file for ACH or Credit Card, which will be billed on a monthly basis for all website maintenance services. We are unable to accept monthly payments via check or cash for maintenance agreements. Website maintenance services must be paid for a minimum period of one (1) year from the date of the website’s official launch.
- Late Payments: Failure to pay invoices on time may result in project delays, website suspension, or additional fees. Returned checks incur a $36 fee. Reinstating a suspended website will incur additional costs.
Client Responsibilities
- Content Submission: Clients must provide website text, images, or other materials on time unless they opt for additional services (e.g., content writing or photography).
- Prompt Feedback: To keep projects on schedule, clients must provide timely approvals and revisions.
- Point of Contact: Clients must designate a central contact who will be the sole person to handle all Deliverables and communications between you and us.
- Payments: Payments must be made upon deliverable acceptance, as outlined in your project proposal or email schedule.
Cancellation Policy
Notice Requirements:
- 30-Day Notice: For website maintenance, large projects, and wedding photography.
- 7-Day Notice: For family and drone photography sessions.
Non-Refundable Payments: Deposits and progress payments are non-refundable but may apply toward rescheduling for emergencies.
Rescheduling: One photoshoot or filming day reschedule is allowed at no additional charge if due to emergencies. Additional reschedules will be $55 per reschedule.
Logo Services
Upon completion of a logo assignment and upon receipt of full payment by the Client, myheartcreative grants the Client ownership of the final packaged graphic logo files.
Print Services
Upon completion of a print assignment and upon receipt of full payment by the Client, myheartcreative will provide a print-ready .pdf. myheartcreative does not grant the Client ownership of any print graphics files.
Website Services
Project Schedule
Client delays in excess of 3 months from the delivery of the development link or Clients requesting the launch of any under-construction / coming soon web pages will incur standard monthly maintenance fees due to allocated storage and hosting of the development site on our server network.
Ownership
Upon final payment, clients own the website content and custom design files. myheartcreative retains ownership of server code, plugins, and tools. The client will make no claims of ownership of myheartcreative’s content management system. myheartcreative will not provide the client with any server access, developer plugins, or development files.
Website Compatibility
- Websites are tested on the latest versions of Chrome, Firefox, Safari, and Edge.
- Support for outdated browsers (e.g., Internet Explorer) is not guaranteed.
Warranty Period
We provide 30 days of free technical support post-launch. This covers troubleshooting but not new features or major revisions.
Website Training
We offer a one-hour web training session designed to provide you with the essential knowledge needed to effectively update your website and access data from form/order entries. We also offer a thirty-minute follow-up training session. These trainings ensure you have the tools to manage your website confidently while maintaining its functionality and performance.
For more advanced or technical inquiries, additional support may be available through our maintenance plans or hourly services.
Ongoing Maintenance
Our maintenance plans ensure your website remains functional and secure.
- Plans include general updates (troubleshooting, support, content updates, photo sizing/updates, or general maintenance) and may not include tasks considered beyond general updates (DNS transfers, DNS or email troubleshooting, additional training(s), transferring content, coding/development, integration of client-provided databases, SEO, photoshop editing, and design).
- Hours exceeding the selected package in your project proposal will be billed at our current hourly rate. If no package is selected in your project proposal, we automatically provide you with our 1-hour package.
- If the hosting space required for the project exceeds the amount outlined in the project proposal, the client will be notified in writing. The notification will include details of the additional hosting space required and the associated increase in monthly fees. The adjusted fees will take effect following the notification.
Digital Marketing Services
SEO Services
We focus on on-page optimization, keyword research, and content strategy to improve your visibility. Due to changing search engine algorithms, specific results or rankings cannot be guaranteed.
Keywords
- Approved keywords for services are locked in for a minimum term and can only be adjusted during the designated modification periods: at the six-month mark or during the annual renewal period.
- In the circumstances requiring the removal of a keyword, the client may notify myheartcreative, and the keyword will be removed promptly; however, its replacement will occur only during the six-month adjustment window or at the annual renewal time.
- This policy ensures consistency and the effectiveness of the services provided. For questions or further clarification, please contact us directly.
Social Media Management
We create, schedule, and manage content based on client feedback. All posts are considered approved unless revisions are requested 1 week prior to the post date. Social videos do not include revisions.
Automatic Renewal: Upon contract completion, SEO, Social Media, Retargeting, or Google Ad plans will transition to month-to-month services unless canceled.
Photography Policy
What to Expect
- The work will be similar to the look and style on the myheartcreative website. The photographer has creative control during the photoshoot and editing process. Photographs will represent the photoshoot.
- Photoshoots included in website packages are valid for 180 days from the project proposal date.
- Location: Photoshoots will be conducted at a mutually agreed upon location (in the OKC Metro unless otherwise noted in your project proposal), date, and time.
- Travel Fees: Costs apply for locations more than 70 miles from Oklahoma City.
- Scheduled Photoshoots: Photoshoots will begin promptly at the agreed-upon time and location. myheartcreative is not responsible for missed shots due to uncommunicated preferences, scheduling conflicts, absent individuals, or undisclosed location restrictions. myheartcreative is entitled to necessary restroom breaks. If the shooting schedule requires 4 hours or more of photography in one day, myheartcreative may need a 45-minute meal break, which may be taken off-site if needed.
- Photographer/Filmmaker Policy: Other photographers or filmmakers are not permitted without prior notification to myheartcreative.
- Delivery: A minimum of 10–20 edited images per 1-hour session. Raw, unedited files are not provided. The images will be delivered online.
- Family and Wedding Photo Ownership: myheartcreative retains copyrights but grants clients usage rights for personal purposes.
- Commercial Photo Ownership: myheartcreative retains copyrights but grants clients usage rights for commercial purposes in their marketing materials.
Cancellations
- Rescheduling: Allowed once at no additional charge.
- Drone: Inclement weather, wind, FAA approvals, or other unforeseen events may necessitate canceling the drone portion of the photoshoot.
Videography Policy
- Filming Locations: The Client must provide access to all filming locations, parking, and share any location restrictions or “house rules” in advance. These rules may affect myheartcreative’s ability to complete the planned shot list.
- Travel Fees: Costs apply for locations more than 70 miles from Oklahoma City.
- Scheduled Filming: Filming will begin promptly at the agreed-upon time and location. myheartcreative is not responsible for missed shots due to uncommunicated preferences, scheduling conflicts, absent individuals, or undisclosed location restrictions. myheartcreative is entitled to necessary restroom breaks. If the filming schedule requires 4 hours or more of filming in one day, myheartcreative may need a 45-minute meal break, which may be taken off-site if needed.
- Attendee Cooperation: The Client must ensure all attendees cooperate and avoid interfering with filming.
- Lighting Arrangements: If location rules restrict lighting, the Client is responsible for arranging adequate lighting, either natural or approved for the location.
- Photographer/Filmmaker Policy: Other photographers or filmmakers are not permitted without prior notification to myheartcreative.
Revisions & Delivery
- Two rounds of edits are included. Additional revisions incur an extra charge at our hourly video production rate.
- Final videos are delivered online. Raw footage is not provided.
Copyright
myheartcreative retains copyright. Videos may be used for promotional purposes unless agreed otherwise.
Additional Costs
Travel and meal expenses apply for projects more than 70 miles outside Oklahoma City.
Video Recording Room
By submitting a booking request, you agree to the following:
Bookings & Payments
- All bookings must be made through the official booking form.
- Full payment is required to confirm and reserve your date.
- Cancellations must be submitted at least 72 hours in advance to receive a partial refund (75%). Cancellations made within 72 hours are non-refundable.
- Time slots include setup and teardown. Exceeding the reserved time may result in additional charges.
Studio Use & Conduct
- Clients must arrive and leave at the designated booking times. Additional time will incur fees.
- Only the reserved equipment and amenities may be used. Do not operate or relocate any non-approved equipment.
- Clients are responsible for the conduct of all individuals they bring into the studio. myheartcreative is not responsible for any third-party actions.
- No food or drinks are allowed near equipment or inside the studio area unless pre-approved.
- Smoking, vaping, and illegal substances are strictly prohibited on the premises.
Equipment Use & Liability
- Equipment included with Standard or Full Access packages, or rented individually, must be returned in the same condition as received.
- The Client assumes full financial responsibility for any damage to or loss of equipment, furniture, or studio property caused during the rental period.
- myheartcreative reserves the right to inspect equipment post-use. Any damage, tampering, or misuse will result in repair/replacement charges.
Technical Support & Assistance
- Basic and Standard packages do not include technical support. Clients must be prepared to operate all rented equipment themselves.
- Full Access includes light assistance and setup support. myheartcreative does not guarantee full production crew support unless the “Collaborate With Us” add-ons are selected.
- The Client must not attempt to repair, modify, or troubleshoot any equipment without written approval.
Collaborative Support Team
- Professionals provided under “Collaborate With Us” are billed at $700/day each.
- Clients must respect the creative direction, timelines, and input of the hired team.
- Prior notice is required to book professional support personnel.
Studio Condition & Clean-Up
- The studio must be left clean and orderly. All trash must be disposed of in designated bins.
- Paper background changes (other than black) must be pre-arranged and paid for in advance.
- Damaged backgrounds may result in additional charges.
- Any significant mess, damage, or required post-session cleaning will incur a minimum $100 fee.
Content Liability
- The Client retains rights to their content but must ensure all recordings comply with local laws, copyright regulations, community standards, and content guidelines.
- myheartcreative is not liable for any legal or personal disputes arising from content created in the studio.
Sound & Environment
- While the studio is acoustically treated, it is not 100% soundproof. myheartcreative is not responsible for external noise interference.
- Clients should account for environmental conditions when planning their production.
Security & Surveillance
- The studio is monitored by security cameras in all public-access areas for safety and liability purposes. No recording occurs inside restrooms or dressing areas.
- By booking the studio, you consent to this policy.
Agreement to Terms
By checking the box on the booking form, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full. Failure to comply may result in booking termination without refund and potential legal action for damages incurred.
Creativity
Collaboration
While we use proven processes, timelines may vary due to the collaborative nature of our projects.
- Project schedules in our project proposals and/or emails are approximate and may change as we work together.
- No timeline is guaranteed.
We appreciate your partnership and look forward to creating great results together.
Originality
Unless previously agreed upon in writing, our methods, processes, and expertise are proprietary to myheartcreative. We do not disclose, teach, or share our professional practices, techniques, or tools used in the delivery of our services. This ensures the quality and integrity of our work remain exclusive to myheartcreative.
To our knowledge, the Deliverables are original and not previously published unless permission to use them has been obtained.
- Third-party work used in the Deliverables is either original or utilized with proper consent.
- myheartcreative confirms it has the authority to enter into this agreement and to the best of our knowledge the work does not include scandalous, defamatory, or illegal content.
- The Client agrees that myheartcreative shall not be held liable for any legal issues arising from Deliverables or assets provided. The Client assumes full responsibility for ensuring the appropriate and lawful use of all Deliverables and assets.
Client and Asset Responsibility
- myheartcreative is not liable for copyright infringements or legal claims resulting from b-roll footage, script content, website content, photos, or other assets provided by the Client.
- The Client guarantees that all materials provided, including b-roll footage, are free of third-party claims and that they hold the necessary rights, licenses, or permissions for their use.
- The Client is responsible for ensuring compliance with copyright laws and obtaining required licenses for all assets used in the project.
Licensing and Limitations
- myheartcreative will make reasonable efforts to adhere to copyright laws and secure appropriate licensing for assets it provides.
- If the Client requests licensed assets but declines to approve associated costs, myheartcreative cannot include those assets in the project.
- The Client agrees to protect myheartcreative from legal issues arising from the misuse of Deliverables or assets.
Promotion
We may showcase your project in our portfolio for promotional purposes, including the URL, trade name, and visuals like designs, photos, or videos. These may appear on our website, social media, or YouTube. Additionally, we will include a credit at the bottom of your website pages stating, “Website designed by myheartcreative,” and/or “Website managed by myheartcreative,” with a link to our website.
Model Release
By booking a project with myheartcreative, the Client agrees to a model release, allowing the publication of the Client and attendee photos/videos for lawful purposes, including, but not limited to, publicity, illustration, advertising, video assets, and web connections. myheartcreative may display photos/videos as examples of work, and in print and online portfolios myheartcreative may submit/display photos/videos in competitions. The Client releases a claim on any profits.
Accessibility
We offer an accessibility tool (“Website Accessibility Plugin”) to help make your website more user-friendly and compliant.
- By not contracting us to add the Website Accessibility Plugin to your website or failing to notify us of your intent to hire us for accessibility services, you are choosing to opt out of these services.
- By opting out, you acknowledge and agree that you are solely responsible for your website’s accessibility compliance and release us from any related liability.

Content Guidelines
We reserve the right to refuse projects that:
- Contain explicit, offensive, or illegal content.
- Violate intellectual property rights.
