The decisions you make in the hours and days following an accident can significantly affect your ability to recover compensation. Here’s what we recommend:
1. Make sure everyone is safe and call 911. Stay at the scene. Check on other people involved. Even if injuries seem minor, get emergency services on the way. A police report creates an official record of the accident, which matters when you file a claim.
2. Document everything you can. Take photos of both vehicles, your injuries, the road conditions, any skid marks, and anything else relevant at the scene. Get the names and contact information of any witnesses. Don’t admit fault or apologize, even if you think you might have contributed to the crash.
3. See a doctor, even if you feel okay. Some injuries, especially whiplash and concussions, don’t always show up immediately. Getting checked out right away protects your health and creates a medical record that connects your injuries to the accident. Follow all your doctor’s instructions and keep records of every appointment.
4. File an accident report. Georgia law requires you to report any accident involving injury, death, or property damage over $500. You can file a report through the Georgia Department of Transportation’s crash reporting portal.
5. Notify your insurance company. Let your insurer know what happened, but don’t give a recorded statement to the other driver’s insurance company without speaking with an attorney first. Adjusters are trained to get information that can be used to reduce your payout.
6. Preserve your evidence and stay off social media. Keep all receipts related to the accident, medical bills, prescription costs, car rentals, and anything. And avoid posting about the accident on social media. What you say online can and will be used against you.
7. Talk to a car accident lawyer as soon as possible. The earlier you get legal help, the better your chances of protecting your rights.
Insurance companies have lawyers working for them from day one. You should too.
When you hire Murphy Law, we get to work immediately. That means requesting the police report and any available traffic camera or surveillance footage, reviewing the other driver’s cell phone records when distracted driving is suspected, and pulling vehicle data recorder information, sometimes called a “black box”, that can show speed, braking, and other critical details at the time of the crash.
We interview witnesses while memories are fresh, and we work with accident reconstruction experts when the facts of how a crash happened are in dispute. On the medical side, we coordinate with your doctors to make sure your injuries are thoroughly documented, and we calculate both your current losses and any long-term impact on your ability to work and enjoy your life.
When it comes to dealing with the insurance company, we handle all the communication. We know their tactics, the lowball offers, the pressure to settle quickly, and the requests for recorded statements, and we know how to respond. If the insurance company won’t offer a fair settlement, we’re prepared to take your case to court.
Economic Damages These are the losses you can add up: medical bills (current and future), physical therapy and rehabilitation costs, lost wages if you missed work, reduced earning capacity if your injuries affect your ability to work long-term, and property damage, including vehicle repair or replacement.
Non-Economic Damages. These are harder to put a number on, but no less real: pain and suffering, emotional distress, loss of enjoyment of daily activities, and disfigurement. Georgia law allows injured victims to seek compensation for these losses, and an experienced attorney can help make sure they’re included in your claim.
Punitive Damages. In cases involving particularly reckless conduct, a drunk driver, for example, or someone who was texting at highway speeds, Georgia courts may award punitive damages. These are meant to punish the at-fault party and deter similar behavior, and they are separate from the other damages described above.
The value of your case depends on a range of factors: how serious your injuries are, whether you’ll have ongoing medical needs, how clearly the other driver was at fault, and what insurance coverage is available. We’ll walk through all of this with you during your free consultation.
In a straightforward accident, the other driver is the liable party. But sometimes more than one party contributed to what happened.
If the at-fault driver was working at the time of the crash, making a delivery, driving a company vehicle, or traveling for business, their employer may share liability. If someone borrowed a car and caused an accident, the vehicle’s owner may be on the hook as well. In accidents involving a defective tire, faulty brakes, or a flawed vehicle component, the manufacturer may bear responsibility. And if a bar served alcohol to someone who was visibly intoxicated and that person later caused a crash, Georgia’s dram shop law may extend liability to the establishment.
Government agencies responsible for road design and maintenance can also be named in certain cases, for things like missing guardrails, confusing signage, or road surfaces that haven’t been properly maintained.
Identifying every potentially liable party is one of the ways a good attorney can make a meaningful difference in your case.
Georgia roads see a full range of accident types, and we have experience with all of them:
Rear-end collisions are the most common type of crash in Georgia and frequently cause whiplash, back injuries, and more serious spinal damage than people initially realize.
T-bone and side-impact crashes often happen at intersections and can cause severe injuries to drivers and passengers on the side of the impact.
Head-on collisions, while less common, are among the most deadly accidents on the road.
Multi-vehicle pile-ups, particularly on metro Atlanta interstates and highways, can involve complex questions of liability when multiple drivers share fault.
Rollover accidents frequently involve SUVs and pickup trucks and often result in serious head and spinal cord injuries.
Rideshare and delivery vehicle accidents involving Uber, Lyft, DoorDash, and similar services can raise complicated insurance questions about which policy applies at the time of the crash.
Common causes include speeding, distracted driving (particularly texting), driving under the influence, drowsy driving, aggressive driving, failure to yield, and vehicle defects. According to the Governor’s Office of Highway Safety in Georgia, the state regularly sees over 1,500 traffic fatalities per year, making safe driving and proper legal protection after a crash critically important.
The injuries that follow a car accident can range from those that heal in a few weeks to those that change the course of a person’s life permanently. Common injuries we see include:
Whiplash and soft tissue injuries are frequently dismissed as minor, but they can cause months of pain and limited mobility. They also tend to be undervalued by insurance companies.
Broken bones and fractures can require surgery, extended recovery, and physical therapy.
Traumatic brain injuries (TBIs), including concussions, may not be immediately apparent but can affect memory, concentration, mood, and daily functioning long after the accident.
Spinal cord injuries can range from herniated discs that cause chronic pain to injuries that result in partial or complete paralysis.
Internal organ damage is serious and life-threatening, and symptoms are not always obvious at the scene.
Burns and lacerations can result in scarring and disfigurement that carry long-term physical and psychological effects.
Amputations, in the most serious crashes, may be necessary and have life-altering consequences.
Medical documentation is essential to your legal claim. The more thoroughly your injuries are diagnosed and recorded, the stronger your case for fair compensation.
Do I need a lawyer for a minor accident? Not every minor accident requires an attorney, but it’s worth making a call before you decide. What seems like a small injury at the scene can turn out to be more serious. Once you settle with an insurance company and sign a release, you generally can’t go back for more. A free consultation costs you nothing and gives you real information to make that decision.
What if I were partly at fault? You may still be able to recover compensation. Under Georgia’s modified comparative negligence rule, you can recover damages as long as you were less than 50% at fault. Your recovery will be reduced by your percentage of fault. Don’t assume you can’t make a claim just because you think you contributed to the accident; talk to us first.
How long do I have to file a claim? Generally, two years from the date of the accident for a personal injury claim in Georgia. The clock can start sooner in cases involving government entities. The sooner you contact an attorney, the better, as evidence gets harder to preserve over time.
What if the other driver was uninsured or underinsured? This is more common in Georgia than most people realize. Your own uninsured/underinsured motorist coverage may apply, and we can help you work through what options are available.
How are legal fees handled? Murphy Law works on a contingency fee basis. You pay nothing up front. Our fee comes out of the settlement or verdict we win for you. If we don’t recover money for you, you don’t owe us anything.
What if I was hurt by a rideshare or delivery driver? These cases involve additional layers of insurance coverage, the driver’s personal policy, the company’s commercial policy, and how the driver was classified at the time of the accident. We’ve handled these cases and know how to navigate them.
Will making a claim raise my insurance rates? Making a claim against the at-fault driver’s insurance should not affect your rates. If you use your own uninsured motorist coverage, the effect on your rates can vary. It’s worth asking your insurer directly, but don’t let that concern stop you from pursuing the compensation you’re owed.
How long will my case take? It depends on the complexity of the case and how cooperative the insurance company is. Some cases settle in a few months. Others, particularly those involving serious injuries or disputed liability, take longer. We’ll give you an honest assessment of the timeline once we’ve reviewed your situation.
