Please read these Terms of Use before using members.rustyquill.com. by accessing members.rustyquill.com you agree to be bound by these Terms of Use and you agree to the terms of members.rustyquill.com’s Privacy Policy which describes how Rusty Quill and others may collect and use information when you use members.rustyquill.com.
We may modify, add or delete portions of these Terms of Use at any time by notifying you of the change in writing (including by posting the modified Terms of Use listed here and updating the date listed above). Please check these Terms of Use and the Privacy Policy frequently for updates. Your continued use of members.rustyquill.com following the posting of updated Terms of use here means that you agree to those changes and to abide by the Terms of Use.
Please note that these Terms of Use are separate and distinct from the terms of use and privacy policies governing the sites, applications, platforms and services of Rusty Quill’s affiliates and partners, our primary rustyquill.com website, applications, platforms and any other, applications, newsletters, platforms and services where Rusty Quill Ltd. content is provided, reposted or republished and any third parties that may link to or that are currently linked to by rustyquill.com or may in the future be linked to from members.rustyquill.com.
BEING A SUBSCRIBER OF MEMBERS.RUSTYQUILL.COM
To summarize: A Subscriber be they a Rusty Knight or a Rusty Noble is someone who subscribes and/or makes a purchase on members.rustyquill.com, which comes with special membership benefits.
As a subscriber, you’re supporting Rusty Quill and will receive special benefits like exclusive content, early access, and ad free access to content. You pay on a one-time or automatically-renewing subscription on basis as specified; Supporting Cast is the billing entity that is associated with this charge.
The timing and amount of each subscription or offering depends on the type of subscription or offering you select. You can see the details prior to purchasing the offering.
To become a subscriber you can subscribe on members.rustyquill.com by purchasing or subscribing to a paid subscription. Subject to these terms and full payment of all applicable charges, to the extent a subscription or offering includes access to one or more of pieces of Rusty Quill content you will receive a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and view those creations for your own private, personal, non-promotional, non-commercial use. Content you gain access to in this manner will generally continue to be available to you, but may become unavailable at any time as described below.
Members.rustyquill.com offer automatically renewing subscriptions including a monthly subscription where you pay per month and an annual subscription, where you pay for a year of access up front, typically at a discounted rate.
Each type of paid subscription automatically renews monthly (for monthly) or annually (for annual memberships) until you cancel via your membership/ account settings. If your subscription includes a free trial, then, unless you cancel before your free trial ends, you will be charged for the first time after the specified free trial period ends and you’ll start an automatically renewing paid subscription to members.rustyquill.com of the type you selected be that monthly or annual. Your recurring charge date may be earlier than the date you first subscribed for reasons including, for example, differences between your timezone and the timezone in which Supporting Casts billing systems operate and your most recent previous charge date being earlier due to variances in the length of the length of calendar months. The amount you are charged for a membership subscription may increase with notice to you. Rusty Quill ltd. does not control the applicable tax that you may be charged and this amount may increase without notice to you.
You may cancel your free trial or recurring payments at any time. For monthly and annual memberships, cancelling or lowering the tier of support of your membership will impact your next recurring charge. Annual memberships may be cancelled or increased, but not lowered, and increasing your payment to a higher tier level in an annual membership may go into effect in the current payment term. When you increase your payment during the current payment term, you may (but are not guaranteed to) be credited for any payment already made in that term. For example, if you upgrade from a monthly membership to an annual membership, then the amount you already paid for that particular month may be credited toward, and thereby reduce the first year cost of, the annual membership.
Cancelling your membership or lowering the tier support below the applicable threshold may result in your loss of access to membership subscription benefits, including exclusive posts and other benefits. You may also lose access to offerings you’ve purchased and membership subscription benefits if, for example and as applicable, your payment method fails, Rusty Quill Ltd. or our partner at Supporting Cast terminate your account, Rusty Quill Ltd. block you, Rusty Quill Ltd. stop making offerings and/or memberships available on members.rustyquill.com, Rusty Quill Ltd. delete members.rustyquill.com, Rusty Quill Ltd. change who has access to an offering and/or membership, Rusty Quill Ltd. remove a post or offering from our account. We are not required to allow you to access membership.rustyquill.com, we are not required to allow you to be a supporter of, or to otherwise interact with any part of members.rustyquill.com.
If you are located in a jurisdiction in which our partners at Supporting Cast are required to charge and collect tax, for example VAT or sales tax, then this tax is added to the total charge. Except in circumstances beyond the control of Rusty Quill Ltd. this tax is shown to you when starting a paid subscription. Supporting Cast remits all tax collected to the applicable taxing authority. As tax is largely dependent on your location, you agree to keep your location complete and up to date on your account in order to enable accurate collection of taxes.
If you pay in a currency that is different from the currency associated with your payment instrument, then the financial institution associated with that payment instrument may charge you a foreign transaction fee for that payment. Rusty Quill Ltd. And our partners at Supporting Cast are not applying this fee and have no control over it, have no knowledge of whether the fee is applied, and do not receive any of the funds from that fee.
Even if you pay in the same currency as the currency associated with your payment instrument, when your payment is processed in a country different from the one associated with your payment instrument, then the financial institution associated with that payment instrument may charge you a foreign transaction fee for that payment. Rusty Quill Ltd. And our partners at Supporting Cast are not applying this fee, have no knowledge of whether the fee is applied, and do not receive any of the funds from that fee.
REFUNDS
Rusty Quill Ltds. policy is not to provide refunds, including if you lose access to offerings and/or membership subscription benefits as described above, though we may allow for some exceptions where refunds are granted at our sole discretion.
COPYRIGHT
The content available on members.rustyquill.com are protected by the UK and international copyright laws. The contents of members.rustyquill.com are owned by or licensed to Rusty Quill ltd. If you submit "User Materials" (as defined below in the "User Materials" section of these Terms of Use, you are a Content Provider that provides content to Rusty Quill Ltd. You may not reproduce, distribute, republish, upload, transmit, display, prepare commercial derivative works of, scrape for the purposes of replicating or republishing (by you or by third parties) publicly perform, sell, transfer, assign, license or use for commercial purposes any copyrighted material on members.rustyquill.com without the prior written consent of Rusty Quill Ltd., except as provided in these Terms of Use. You may not use, or enable others to use, any content, information, or other exclusive content on members.rustyquill.com to build or train large language models, machine learning tools, or artificial intelligence (AI) systems without the prior written consent of Rusty Quill Ltd. All rights not expressly granted in these Terms of Use are reserved to Rusty Quill ltd..
You may copy, download copies on your personal devices, and print a limited amount of content for your personal, noncommercial use only, provided that (a) you include without modification all copyright and other proprietary notices contained in the content, (b) you do not modify the content, (c) you do not use the content in a manner that suggests RUSTY QUILL promotes or endorses your, or any third party's, causes, ideas, products, sites, applications, platforms or services, (d) you do not use the content in any way that is unlawful or harmful, (e) you do not scrape any content to replicate or republish the content, and (f) you do not use the content to build or train large language models, machine learning tools, or artificial intelligence (AI) systems.
You may use the content feeds, APIs, podcasts, media players, and other features of the members.rustyquill.com, and content accessed therefrom, only as expressly permitted in these Terms of Use, including the "Use of Content: Conditions and Acknowledgments".

USER MATERIALS
Users of the members.rustyquill.com may post, upload, transmit and otherwise submit (“Submit”) comments, messages, recommendations, photos, images, and materials ("User Materials") on or through the social networking features of members.rustyquill.com. You acknowledge that User Materials may be routed through the servers of our partners at Supporting Cast, the servers of one or more third parties, and the Internet, and may be viewed by Rusty Quill employees and on members.rustyquill.com by the general public. You acknowledge that the members.rustyquill.com, including the social networking features, discussions, and other features of the members.rustyquill.com are for generally public and not private communications.
We reserve the right to screen, refuse to post, remove or edit User Materials at any time and for any reason.
You retain the copyright and other ownership rights in any User Materials that you Submit on the members.rustyquill.com. However, by Submitting User Materials on members.rustyquill.com, you grant Rusty Quill Ltd., other Content Providers and their respective licensees a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, publicly perform, display (including framing), create derivative works of, host, index, cache, tag, encode, and/or adapt your User Materials in any and all media formats, channels or platforms, whether now known or hereafter devised through the known universe, including without limitation the members.rustyquill.com, Rusty Quill Ltd. platforms and services, third-party licensee sites, applications, platforms and services, podcasts, and other applications and services, without payment and without further notice to you or request for consent. You further grant Rusty Quill ltd., and their partners and licensees the right to contact you in connection with your User Materials and to use your name, location and other information that you have provided in connection with the User Materials.
For any User Materials you Submit on members.rustyquill.com, you agree to abide by the following rules for Submitting User Material:
You may not Submit any User Materials under a false name (beyond screenname) or a false email address. You may not impersonate another user or provide any false information about yourself.
You may not Submit any User Materials or links to material that is libelous, defamatory, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law, harmful to children, in violation of third-party privacy rights, or that constitutes hate speech or a personal attack.
You may only Submit User Materials for which you have the copyright or other necessary rights and permissions to distribute electronically. You may not plagiarize content or violate or infringe on the rights of third parties, including copyright, patent, trademark, trade secret, privacy, personal, publicity, moral or proprietary rights. You promise and represent that you own or have all necessary rights and permissions to use, distribute and authorize Rusty Quill ltd. And their partners their respective licensees, and users of the members.rustyquill.com (to the extent permitted by these Terms of Use and the members.rustyquill.com privacy policy), to use and distribute any User Materials. By Submitting any User Materials on members.rustyquill.com, you grant to Rusty Quill and their partners, other Content Providers, their licensees, and users of members.rustyquill.com (to the extent permitted by these Terms of Use and the members.rustyquill.com privacy policy) the licenses to use such User Materials.
You may not Submit any material containing any solicitation of funds, advertising, promotion, solicitation for goods and services, or recruiting.
You are solely responsible for any User Materials Submitted using your account. Rusty Quill does not necessarily and cannot necessarily review all User Materials Submitted by you or others and is not responsible for any User Materials submitted by you or others on or through the members.rustyquill.com. However, Rusty Quill Ltd and it’s employees has the right (but not the obligation) to review, screen, delete, edit or move any User Materials at any time that it deems, in its sole discretion, to be in violation of the Rules for Use of the Service or these Terms of Use, or for any other reason, as determined in Rusty Quill’s sole discretion.
You further agree to the representations and warranties, and indemnification obligations, set forth in the "Representations” and “Indemnity" section of these Terms of Use.
USE OF CONTENT: CONDITIONS AND ACKNOWLEDGEMENTS
To access Content on members.rustyquill.com, and our ad free and bonus content and podcast feeds, or to Submit User Materials, you agree to the following conditions and acknowledgments:
1. the content may be used only for personal non-commercial use.
2. your use is for non-promotional purposes only, including, blog posts, widgets, and applications, but excluding e-newsletters;
3. you shall not use the content in any way that is unlawful or harmful;
4. you shall not modify, copy, translate, create a derivative work of, sell, distribute, or sublicense any exclusive content on the members.rustyquill.com platform.
SUBSCRIPTION TERM AND AUTOMATIC RENEWALS
If you elect to subscribe to a Subscription Service then, in exchange for payment of the applicable fee, you will have access to members.rustyquill.com for the period of time indicated during the subscription sign-up process and which automatically renews as standard on either a monthly or annual basis. The period of time during which you may access content on members.rustyquill.com.
Your ability to access and use a members.rustyquill.com will commence on the date we make such Subscription Service available to you following your payment of the applicable fee and will continue until the end of the applicable Subscription Term. Unless otherwise terminated by Rusty Quill Ltd. for any reason and at any time. Though under these circumstances subscribers in good standing would be refunded for the remainder of their term.
If you have elected to subscribe to members.rustyquill.com with a subscription that renews automatically (as disclosed to you during the subscription sign-up process) then, unless you affirmatively cancel your subscription before the end of the then-current Subscription Term, your subscription will automatically renew for subsequent period of the same duration whether monthly or annual and will automatically charge the applicable Fee for each unique subscription to the payment method you have provided, and you hereby consent to this renewal. If you affirmatively cancel your subscription, your subscription will expire, and your access to the Subscription Service will cease, at the end of the then-current subscription.
To continue to access members.rustyquill.com after your subscription has expired, you will need to purchase a new subscription. You are required to maintain accurate and up-to-date payment information. Rusty Quill Ltd. assumes no responsibility or liability if your subscription fails to renew or otherwise expires because of outdated or incorrect payment information. You should maintain an up-to-date email account to receive communications about subscriptions.
We will not provide any full or partial refund (except where the law requires us to provide a refund) or prorate Fees for Subscription Services.
PROMOTIONS AND TRAILS
From time to time, Rusty Quill or others on our behalf may offer a promotional offer, code or discount, for subscriptions to members.rustyquill.com including pursuant to a trial offer for a specified time period without payment or at a reduced rate. We may determine your eligibility for a trial or other promotion, and may withdraw or modify any such promotion at any time without prior notice and with no liability, to the extent permitted under applicable law. If you sign up to members.rustyquill.com through a promotional offer, code or discount, you may also be bound by additional or different terms communicated to you at sign up or otherwise in connection with the applicable offer. You agree to comply with those terms.
For some trials or other promotional offers, we will require you to provide your payment details to start the trial or otherwise access the promotion. By providing such details for a promotional or trial offer and accepting the applicable offer, you agree that we may automatically begin charging your payment method on the first day following the end of the trial or discounted promotional period at the regular price for such subscription and on a recurring monthly or annual basis. If you do not want to pay these charges, you must cancel the applicable Subscription Service before the end of the applicable trial or promotion period.
ACCESS RESTRICTIONS
You are not authorized to access subscriber benefits of members.rustyquill.com unless you have created an account and paid the applicable Fee. You may not assist anyone else in accessing any members.rustyquill.com on an unauthorized basis, including by sharing any access credentials we provide to you or providing any content or other materials that you obtained through members.rustyquill.com to third parties. If we require that you use a password to protect your subscription account, please keep your password confidential. You are responsible for maintaining the confidentiality of your access credentials and for all usage or activity that occurs on your unique account. Such responsibility includes any purchases made, or other charges incurred, in connection with your use (or an authorized third party's use) of the Subscription Services. You will be responsible for all charges and all purchasing activity that occurs within your account. We may turn off your access to members.rustyquill.com without notice, and without providing any refund, if we identify that access credentials have been shared.
AGE AND BILLING AUTHORIZATION
By subscribing to a Subscription Service, you confirm that you are at least 16 years of age, that all information submitted by you is true and correct (including all credit card information), and that you are the authorized holder of the payment instrument used with your subscription account.
FEES
You agree to pay all Fees and other charges applicable to your Subscription Services accounts, including any applicable taxes. Rusty Quill reserves the right to change the amount of, or the basis for determining, any Fees for the subscription to members.rustyquill.com and to institute new subscription Fees with prior notice to you. Any such changes will be effective on the first day of the next term of our subscription whether monthly or annual unless we specify a different effective date in our notice to you. You accept such Fee changes by continuing to subscribe to the Subscription Service after the Fee change has taken effect. If you do not wish to agree to any such Fee change(s), you must cancel the applicable subscription before the effective date of the applicable change.
SUSPENSION OR TERMINATION
We may suspend or terminate your access to members.rustyquill.com at any time, for any reason, without notice to you. If we do so, we may provide a partial refund to you, and you will not be responsible for Fees associated with such Subscription/s after the termination becomes effective, unless you have breached or violated any of these Terms of Use.
CANCELLATION
You may cancel your subscription to a members.rustyquill.com at any time by logging into the your account and adjusting your subscription.
If you are unable to locate the cancellation procedures for members.rustyquill.com, you can contact us at mail@rustyquill.com . Requests to cancel subscriptions will be effective once the Subscription Term in which we received the cancellation concludes.
TERRITORIAL LIMITATIONS
Some members.rustyquill.com benefits may not be accessible for use in every jurisdiction. You can contact our partners at Supporting Cast for information about where members.rustyquill.com are accessible.
ACCOUNT DELETION
You can delete your account. We can terminate or disable your account at our sole discretion.
We can terminate or suspend your account at any time at our sole discretion. We can also cancel any membership subscriptions and remove any descriptions, posts, offerings, or benefits at our sole discretion. You may not bring a claim against us for suspending or terminating your or another person’s account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including any legals fees and costs. These terms remain in effect even if you no longer have an account.
RULES FOR USE OF SERVICE
By using members.rustyquill.com you agree to the following rules:
You must be at least 16 years of age to submit any User Materials or personal information, create a public profile, participate in any online contests, or register with members.rustyquill.com.
You may not submit any software or other material which contains any virus, trap door, back door, worm, Trojan horse or other harmful computer code, files, scripts, agents, programs, adware, device or other features that may access, alter, delete, damage or disable any hardware, software, information or other property of Rusty Quill, Content Providers, or users of the RUSTY QUILL Services. You may not use the RUSTY QUILL Services to distribute spam, or duplicative or unsolicited messages in violation of applicable laws, or to gather usernames and/or email addresses for the purpose of sending unsolicited email or other communications to other users of members.rustyquill.com.
You may not interfere with or disrupt the integrity or performance of members.rustyquill.com, any portion or contents thereof, or related systems or networks, or use the members.rustyquill.com in any way that degrades their reliability, speed or operation, or their underlying hardware or software. In addition, you may not attempt to gain unauthorized access to the members.rustyquill.com or related systems or networks.
You acknowledge that Rusty Quill has the right to limit or terminate your, or any other person's, access to or registration in the members.rustyquill.com platform for any reason and at any time, in its sole discretion, including violation of these Terms of Use.
REPRESENTATIONS; INDEMNITY
You represent and warrant that if you Submit any User Materials or personal information on or through members.rustyquill.com, (a) you are at least 16 years of age, (b) you have obtained all clearances, releases, licenses and rights to any User Materials you Submit on or through the members.rustyquill.com that may be necessary for their use as contemplated by members.rustyquill.com, the members.rustyquill.com Privacy Policy and these Terms of Use, (c) there are no encumbrances or restrictions on the User Materials or their use as contemplated by members.rustyquill.com and these Terms of Use, (d) the User Materials, and their use by Rusty Quill ltd. their licensees, and users of the members.rustyquill.com,(pursuant to these Terms of Use and the Members.rustyquill.com Privacy Policy) does not and will not libel any person or entity, or violate or infringe upon the copyright, trademark, patent, trade secret, privacy, reputation, creative or other rights of any person or entity or violate these Terms of Use, and (e) your use of the members.rustyquill.com complies with these Terms of Use. You agree that you will indemnify and hold harmless Rusty Quill ltd, and its directors, officers, employees, members, and licensees and assignees from any and all claims, liabilities, costs or expenses, including reasonable legal fees, arising from (1) your breach of any of the above representations and warranties, (2) your use of the members.rustyquill.com, (3) the User Materials you have Submitted on or through members.rustyquill.com, or (4) Rusty Quill’s publication, distribution or use of such User Materials, or the authorized publication, distribution or use of your User Materials by Rusty Quill’s partners, licensees, or users of the members.rustyquill.com.
DISCLAIMER
Rusty Quill Ltd. is not responsible or liable for any User Materials Submitted by you or a third party, including any User Materials, on or through the members.rustyquill.com and Rusty Quill ltd. cannot verify the accuracy of statements that users make or place on or through the members.rustyquill.com, and does not guarantee that any User Materials have been submitted with the permission of the copyright or proprietary owner or are otherwise in compliance with the Rules for Use of the Service or these Terms of Use.
THE MEMBERS.RUSTYQUILL.COM PLATFORM AND ANY CONTENT, MATERIALS, USER MATERIALS, FEATURES OR PRODUCTS AVAILABLE OR SOLD ON OR THROUGH THE MEMBERS.RUSTYQUILL.COM ARE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES, INCLUDING WITHOUT LIMITATION THE OPERATION OF THE SERVICES OR THE INFORMATION, MATERIALS, GOODS, OR SERVICES APPEARING OR OFFERED ON MEMBERS.RUSTYQUILL.COM OR WITH RESPECT TO ANY WEBSITES OR SERVICES LINKED FROM THE SERVICES. WE DISCLAIM ALL WARRANTIES, EXPRESS, STATUTORY OR IMPLIED, INCLUDING BUT NOT LIMITED TO (I) THE WARRANTIES OF TITLE, QUIET ENJOYMENT, NO LIENS AND NO ENCUMBRANCES; (II) THE WARRANTIES AGAINST INFRINGEMENT, MISAPPROPRIATION OR VIOLATION OF ANY INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS OF ANY PERSON; (III) THE WARRANTIES RELATING TO THE ACCURACY, RELIABILITY, CORRECTNESS, OR COMPLETENESS OF DATA OR CONTENT MADE AVAILABLE ON THE SERVICES OR OTHERWISE BY RUSTY QUILL LTD. DOES NOT WARRANT THAT MEMBERS.RUSTYQUILL.COM, INCLUDING WITHOUT LIMITATION THE ORIGINAL CONTENT, FUNCTIONS OR MATERIALS CONTAINED THEREIN, WILL BE TIMELY, SECURE, ACCURATE, COMPLETE, UP-TO-DATE, FREE OF VIRUSES, UNINTERRUPTED OR ERROR-FREE. RUSTY QUILL LTD DOES NOT MAKE ANY WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF MEMBERS.RUSTYQUILL.COM OR ENDORSE, RECOMMEND, OR MAKE ANY WARRANTIES AS TO THE CONTENT, INFORMATION, MATERIALS, USER MATERIALS, FEATURES, SERVICES, PRODUCTS, OPINIONS, OR STATEMENTS AVAILABLE ON OR THROUGH MEMBERS.RUSTYQUILL.COM OR THROUGH LINKS ON MEMBERS.RUSTYQUILL.COM. RUSTY QUILL LTD. MAKES NO REPRESENTATION THAT THE SERVICES ARE APPROPRIATE OR AVAILABLE FOR USE OUTSIDE OF THE UNITED KINGDOM. NO ORAL OR WRITTEN INFORMATION MADE AVAILABLE BY OR ON BEHALF OF RUSTY QUILL LTD. SHALL CREATE ANY WARRANTY. USE OF MEMBERS.RUSTYQUILL.COM IS ENTIRELY AT YOUR OWN RISK.
IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED OR STATUTORY WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO YOU TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
LIMITATION OF LIABILITY
