Who has to ensure accessibility under the new Accessibility Strengthening Act (BFSG) – and who is exempt from it?

Before everyone takes immediate action: the new Accessibility Strengthening Act (BFSG) aims to protect the end consumer. This means that companies in the B2C sector in particular are obliged to ensure accessibility.

Affected:

This includes online shops and service providers such as doctors and hairdressers who, for example, offer appointment bookings or contact forms online.

B2B companies are only exempt if it is clearly evident that their offer is aimed exclusively at companies and not at end consumers.

The law makes no distinction between sectors: e-commerce companies, banks, passenger transport providers and media services are also obliged to ensure accessibility.

Yes, there are: Micro-enterprises are exempt from the BFSG. These include companies with fewer than 10 employees and an annual turnover or balance sheet total of no more than 2 million euros. Please note: If just one of these requirements - either the number of employees or turnover or balance sheet total - is exceeded, there is an obligation to design the online presence in a barrier-free manner, regardless of whether the services offered fall under the BFSG.
