ONLINE GAMING RULES AND REGULATIONS IN INDIA

The regulation of casino games is made under State-wise anti-gambling laws in the constitution of India(Present under the name “Gaming Enactments”). Under most of the stated enactments, casino games are seen to be a part of gambling activities. Therefore, the government prohibits such activities in India. This rule is applicable for both online as well as offline casinos. However, an exception has been made by the Sikkim Government by enacting a certain license regime which offers online gaming using the internet within the state of Sikkim. It is a part of the act called “The Sikkim Online Gaming Regulation Act (2008)”. Several games such as casino brag, forms of roulette, and blackjack come under the license. Coming to Poker, only Nagaland offers regulation of the online games of skill. An act of 2016 puts poker under the category as a game of skill, leading to its legality in the state of Nagaland. The prime authority for licensing in the state of Nagaland is the Commissioner of Finance. Another form of a casino-based game, Bingo, is prohibited in most Indian States. Depending on the precise format of Bingo, it can either come inside the category of a lottery or under the general definition of gambling, as Bingo is described as a game of chance. If the game falls under the category of a game based on luck, it will be prohibited mostly everywhere. Similarly, if betting falls under the category of a game of chance, it is prohibited in most of the Indian states.
