Who is eligible for compensation?

Survivor Class Members

A Survivor Class Member is someone who attended or lived in residence at the Île-à-la-Crosse School between January 1, 1860, and December 31, 1976. Survivor Class Members are eligible to receive compensation. This lawsuit and these settlements do not include anything that happened at the Rossignol School that has been run by the Île-à-la-Crosse School Board since 1975-76.

Survivor Class Members may be eligible for:

  • Experience Payments
    • Up to $10,000 for Survivors who attended the school for up to four years; OR
    • Up to $15,000 for Survivors who attended the school for 5 or more school years
  • Separate Abuse Compensation Payments of up to $50,000–$235,000 for Survivors who experienced sexual abuse or serious physical abuse
  • Possible extra Experience Payments for residence students if funds remain
  • Supports from projects funded by the Legacy Fund

Class members who have passed away

An Estate Representative or eligible heir may submit a claim for a Survivor Class Member who passed away on or after December 9, 2003. Someone acting for the estate, such as an executor, administrator, or heir, can submit the claim form on the deceased Survivor’s behalf.

Personal Representative

If a Survivor is a Person Under Disability and unable to manage their own finances, a Personal Representative may complete and submit the claim form on their behalf.

Family Class Members

Family Class Members are close family members of a Survivor Class Member, such as a spouse, parent, child, grandchild, or sibling. The Family Class does not include aunts, uncles, cousins, or stepparents. Family Class Members are not eligible for compensation for themselves.

Family Class Members can benefit from the Legacy Fund. The Legacy Fund will be used to support language, cultural, wellness, and community projects for Survivors and their families.
