1. Introduction & About These Terms

These Support‑A‑Creator Program Terms ("Terms") are a contract between Hypixel Studios Canada Inc. ("Hypixel Studios," "we," "us") and the creator who applies to and is approved for the Hytale Support‑A‑Creator affiliate program (the "Program"). By accepting these Terms during the Program signup process and, upon our approval of your application, participating in the Program, you agree to be bound by these Terms as of the date of approval.

These Terms incorporate by reference the Hytale Terms of Service ("ToS"), End User License Agreement ("EULA"), and Privacy Policy (together, the "Hytale Policies"). If there is a conflict, these Terms govern for the Program and the Hytale Policies govern generally. Dispute resolution, including binding individual arbitration, class‑action waiver, small‑claims option, and opt‑out, is as stated in the ToS Section 16.

These Terms are separate from any Hytale Marketplace or other creator/program terms.

2. Eligibility

To join and remain in the Program, you must:

  • Be a legal adult (18+) with capacity to contract. Enterprises must be represented by an authorized individual.
  • Hold a Hytale account in good standing and comply with the Hytale Policies.
  • Own and operate eligible, in‑good‑standing platform accounts (YouTube, Twitch, and/or TikTok). Followers must be genuine (no bots, bought/automated growth, or manipulations).
  • Create Hytale‑related content on eligible platforms and comply with all platform rules.
  • Create and maintain a valid Tebex Creator Wallet to receive payouts. Hypixel Studios does not collect, store, or process payment information; all payment data is held by Tebex.
  • Reside in a location where Tebex supports payouts and are not subject to applicable sanctions or restrictions.
  • Not be a Hypixel Studios employee, agent, representative, or an immediate family member of one.

Application. Submit your application through a form provided by Hypixel Studios. We may approve or reject applications at our discretion and may require additional information. Approval will be communicated via email or a direct message on a reliable service (e.g., Twitter, Discord). The contract begins once approval is given. There are no application or participation fees.

3. Program Terms (Codes, Attribution, Qualifying Purchases, Commission)

Creator Code. If approved, we assign you a unique creator code. We may reject or change codes that are offensive, infringing, misleading, or otherwise inappropriate.

Attribution. Users enter creator codes during the checkout process. A code remains attributed to the applicable creator until Hypixel Studios revokes or changes the attribution. We set and may update technical rules for attribution.

Qualifying Purchases. You earn on purchases made while your code is actively attributed, including the Hytale base game (if applicable), in‑game virtual currency, virtual items, and DLC/expansions ("Qualifying Purchases"). Excluded: (a) refunds and chargebacks; (b) fraudulent or abusive transactions; (c) your own purchases or those by your immediate family or your Enterprise's controlled accounts; (d) purchases outside Hytale; (e) any transaction made while you are suspended or after termination.

Commission. The commission rate varies by creator and will be specified in your approval communication (or subsequent written notice from us). Commissions are calculated on the gross Qualifying Purchase amount unless we specify otherwise.

Promotion & Disclosures. You must (i) follow platform rules and advertising laws (e.g., U.S. FTC guidelines) and (ii) clearly disclose your material connection with Hypixel Studios (that you can receive commissions) when promoting your code/content. You are solely responsible for implementing appropriate disclosures; Hypixel Studios does not provide disclosure templates or guidance.

4. Payouts

Tebex Payouts. Payouts are processed through Tebex, our third‑party payouts partner. You must create and maintain a Tebex Creator Wallet and comply with Tebex's terms and policies to receive payouts. Hypixel Studios does not collect, store, or process any payment information; all payment data is handled by Tebex. Direct any payment‑related questions to Tebex or look at their documentation at docs.tebex.io/creators/tebex-control-panel/engagement/creator-codes.

5. Your Content & Conduct

Rules. Your content and conduct must comply with the Hytale ToS and EULA and the rules of eligible platforms (e.g., YouTube, Twitch, TikTok). Content must be original to you or properly licensed; do not infringe others' rights. Content eligible for the Program must relate to Hytale.

Disclosures. You are solely responsible for complying with all applicable advertising and disclosure laws in your jurisdiction, including but not limited to the U.S. Federal Trade Commission (FTC) guidelines on endorsements and testimonials. When promoting Hytale or your creator code, you must make clear, conspicuous disclosures of your material connection with Hypixel Studios in accordance with these laws (e.g., on video pages, descriptions, overlays, captions, spoken on‑stream as appropriate).

Prohibited Content/Conduct. Without limitation: no inappropriate or offensive material; no impersonation of Hypixel Studios or others; no deception, spam, or fraud; no promotion of cheats, exploits, hacks, or other violations of the ToS or EULA; no infringement of third‑party IP; no self‑dealing or purchase manipulation (including using or coordinating use of your own code to earn commissions); no selling/trading codes or attempts to circumvent attribution systems.

Removal. You may remove your content at any time. We may request removal or take action under Section 7 if content violates these Terms, the ToS, or the EULA. Removing content does not erase prior violations.

6. Licenses & IP

Brand Usage. While you participate in the Program, we grant you a limited, revocable, non‑exclusive, non‑transferable, non‑sublicensable license to use the "Hytale" name and approved brand assets solely to identify and promote your participation in the Program, subject to our brand guidelines. This license ends when you leave the Program.

Spotlights & Promotion. You grant Hypixel Studios and its affiliates a non‑exclusive, worldwide, royalty‑free, sublicensable license to use your name, handle, likeness, and brand features to operate, promote, and publicize the Program and Hytale (e.g., in "creator spotlights," listings, and marketing materials).

Ownership. You retain ownership of your content. Hypixel Studios and its licensors own Hytale and all related IP. Except as expressly provided, no rights are transferred.

7. Violations, Enforcement, Suspension, Termination

We may, in our discretion and consistent with law, take one or more actions for violations of these Terms, the ToS, the EULA, or applicable law: (a) suspend eligibility to participate; (b) request content removal or impose distribution limits; (c) remove you from the Program; (d) take enforcement against your Hytale account under the ToS; and/or (e) pursue legal remedies. Serious violations (e.g., fraud, CSAM, major IP infringement) may result in immediate termination and referral to authorities where required by law.

Notice & Appeals. We will use reasonable efforts to notify you of actions taken and how to appeal, unless we believe notice would violate law, compromise an investigation, or risk harm. You may appeal within 30 days with supporting information. Final decisions are at our discretion.

Program Changes & Termination. We may modify these Terms (material changes typically with 30 days' notice) and may terminate the Program with 30 days' notice. You may terminate your participation at any time on 15 days' notice. Upon any termination: (i) your license to use Hytale brand assets ends; (ii) stop referencing or using your creator code; (iii) any payouts are handled by Tebex in accordance with its terms; and (iv) provisions that by their nature should survive (e.g., IP, indemnity, limitations of liability, dispute resolution) survive.

8. Representations, Warranties, and Indemnity

You represent and warrant that: (a) you have full authority to enter these Terms; (b) you meet and will maintain eligibility; (c) your content is original to you or properly licensed and does not infringe or violate third‑party rights; and (d) your statements about Hytale are not misleading and comply with applicable laws and platform policies.

You will indemnify, defend, and hold harmless Hypixel Studios, its affiliates, and their directors, officers, employees, and agents from and against any third‑party claims, damages, losses, liabilities, costs, and expenses (including reasonable outside attorneys' fees) arising out of or related to: (i) your content; (ii) your breach of these Terms or the Hytale Policies; (iii) your violation of law or third‑party rights; or (iv) your gross negligence or willful misconduct.

Program "AS IS". To the maximum extent permitted by law, the Program is provided "as is" and "as available," without warranties of any kind, except as required by consumer protection laws.

9. Limitations of Liability

To the maximum extent permitted by law, Hypixel Studios will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to these Terms or the Program, even if advised of the possibility. Our aggregate liability for all claims will not exceed the greater of (a) the amounts paid to you under the Program in the 12 months before the claim or (b) $500 USD. Nothing excludes or limits liability that cannot be excluded or limited by law (e.g., fraud, willful misconduct, death or bodily injury). Mandatory consumer protections (e.g., Quebec, EU/UK) apply.

10. Dispute Resolution, Governing Law, and General

Disputes. Dispute resolution (binding individual arbitration, class‑action waiver, small‑claims option, opt‑out process, confidentiality, rules, and seat) is governed by the ToS Section 16. Before filing, send a written notice to [email protected] and attempt informal resolution for 30 days.

Governing Law & Venue. These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, subject to mandatory protections where you live. Subject to arbitration, exclusive venue is the provincial or federal courts in Montreal, Quebec, unless consumer law gives you a right to local courts.

General. You may not assign these Terms without our written consent; we may assign them (e.g., merger, acquisition, sale of assets). These Terms, together with the Hytale Policies incorporated by reference, are the entire agreement regarding the Program and supersede prior program terms. If any provision is unenforceable, the remainder remains in effect. No failure to enforce is a waiver. Notices may be provided via email.

11. Definitions

  • Application: the information and materials you submit to apply to the Program.
  • Brand Features: a party's names, logos, trademarks, service marks, domain names, and other branding.
  • Creator: an approved participant in the Program.
  • Creator Code: the unique code assigned to a Creator for attribution.
  • Hytale Policies: the ToS, EULA, and Privacy Policy at hytale.com/legal.
  • Payout Award: the commission payable to a Creator under these Terms (at the rate specified in the approval).
  • Tebex: Tebex Limited, our third‑party payouts partner.
  • Tebex Creator Wallet: the Creator's account with Tebex for receiving Payout Awards.
  • Program: the Hytale Support‑A‑Creator affiliate program.
  • Qualifying Purchases: purchases defined in Section 3 that count toward commissions.
  • User: a natural person or entity interacting with Hytale under the Hytale Policies.
