Hiro LLC is a U.S. entity located at 2601 S. Minnesota Ave Ste 105-308, Sioux Falls SD 57105 USA. We operate Hiro, a platform where podcast listeners can support podcasters and get access to premium content. These Terms of Use apply to all users of the Hiro website, mobile apps, APIs, integrations, and services.
“We,” “our,” or “us” refers to Hiro LLC. “Hiro” refers to this website and all associated services we offer. By using Hiro, you agree to these Terms, our Privacy Policy, Refund Policy, Data Processing Agreement (if applicable), and any other policies we post. Continued use of Hiro after any updates means you accept the new terms. You acknowledge that you have read and understood these terms. You also agree to our privacy policy and any other policies we post on Hiro.
If you are a content creator, you also agree to our data processing agreement. Hiro is a platform. We are not responsible for the quality, timing or legality of content.We may sometimes make changes to these terms. If we make material changes that adversely affect your rights under these terms, then we will let you know by posting an announcement on the site or sending you an email prior to the changes coming into effect. Continuing to use Hiro after a change to these terms means you accept the new terms.
Acceptance of Terms
By accessing or using any part of Hiro.fm—including its web or mobile application, integrations (e.g., Stripe, Postmark, Telnyx, WhatsApp, or others), APIs, or support services—you agree to comply with these Terms and our Privacy Policy.
You must be at least 18 years of age to use Hiro.fm. If you use Hiro.fm on behalf of a company, organization, or other entity, you represent that you have the authority to bind them to these Terms.
Account Creation
You must:
Provide accurate and current information when registering.
Be at least 13 years old to use Hiro.
Be 18 years old (or have guardian permission) to purchase or offer subscriptions.
Maintain the confidentiality of your login credentials.
If you don’t provide us with accurate information then we may not be able to assist you with accessing your account.
You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. If you believe your account is compromised, you must contact us by emailing [email protected] immediately.
Services Provided
Hiro.fm is a Software-as-a-Service (SaaS) platform that allows users to:
Create and distribute private audio content (courses, podcasts, trainings, etc.)
Send automated communications via email, SMS, and WhatsApp
Build no-code sales pages and opt-in funnels
Integrate gamified features and audience engagement tools
Track listener activity and segment contacts
The platform includes tools for lead generation, course delivery, automation, and monetization. We provide core hosting, content distribution, analytics, and messaging features that may integrate with third-party APIs and services.
We reserve the right to improve, modify, limit, or discontinue any part of our services at any time.
User Conduct
You are responsible for maintaining the security and confidentiality of your account login credentials. You agree not to share access with unauthorized users.
If we detect suspicious activity or multiple logins from conflicting IP addresses, we may temporarily restrict access, investigate, or suspend the account.
You must notify us immediately if you suspect your account has been compromised.
For starters
- Reward Sharing – Don’t support a podcaster and then share their podcast subscriber-only content without permission from the podcaster.
- Data Mining – Don’t crawl, scrape or otherwise index information on Hiro. If you are doing this to create a useful feature then we may allow it, but you must check with us first.
- Service Degradation – Don’t degrade others’ use of Hiro.
- Malware – Don’t use Hiro to host or distribute, malicious or destructive software
- Spam – Don’t spam others or distribute unsolicited advertising material.
- Intellectual Property – Don’t infringe on others’ intellectual property rights.
- Impersonation – Don’t impersonate anyone. Don’t use another’s account, or allow others to use your account.
- Fraud – Don’t post information that is false or otherwise misleading.
- Personal Information – Don’t distribute others’ personal information or otherwise abuse it. Podcasters with access to their podcast subscribers’ personal information should not use it for anything unrelated to Hiro.
- Abuse – Don’t harass or bully others, or promote violence or hatred towards others.
- Illegal Activities – Don’t break the law or encourage others to break the law.
- Endorsement – Don’t claim endorsement by Hiro without our prior written approval.
- Reverse Engineering – Don’t take apart Hiro to figure out our copyright protected secret sauce.
These guidelines are not meant to be exhaustive. We reserve the right to take action against harmful behavior. If you find a new and creative way to hurt Hiro or our users we reserve the right to take action to prevent it.
All About Being a Purchaser of a Show Sold Directly From Hiro.fm
To purchase a show, simply select the show and your preferred payment method (either credit card or Apple Pay, or Android Pay) and buy access to any creator.
If you support a creator on a per month basis, then you are charged on behalf of the creator immediately at the time of the subscription for the full amount of the subscription. Renewals are billed on the same date of the month that you originally subscribed to the podcast on an ongoing basis.
You may cancel your subscription at any time. You will not be billed for any future months going forward, but you will not receive a refund for any previous payment periods.
We may grant refunds at our sole discretion in exceptional circumstances.
Depending on your location, some banks may charge you a foreign transaction fee for your subscription, which will be assessed in addition to the subscription amount. Hiro does not control this charge. Please contact your bank for information.
In certain situations you may lose access to a podcaster’s podcast subscriber-only content. These include when you cancel your subscription, your payment method fails, the podcaster blocks you, or the podcaster deletes their account.
We have no control over the quality, timing or legality of content. We do not grant refunds for failure to deliver content. We do attempt to screen for fraudulent podcaster pages, but cannot guarantee the identity of podcasters or the validity of any claims they make. We appreciate your help reporting suspicious podcaster pages by emailing us at [email protected] so we can improve Hiro.
About Purchasing a Show Sold Directly From a Hiro.fm Creator
When you purchase access to a show, course, or product on Hiro.fm, you are entering into a direct agreement with the Creator of that content. Hiro.fm is a software platform that enables Creators to deliver audio-based experiences, sales pages, and messaging automations — but we do not sell or distribute the content ourselves.
Payment Processing
All payments made through Hiro.fm go directly to the Creator’s connected payment processor, such as Stripe or PayPal. Hiro.fm does not collect or hold your payment, issue receipts, or control any billing processes. If you have questions about a charge or need a refund, you must contact the Creator directly.
Because the funds never pass through Hiro.fm, we cannot provide refunds, receipts, or transaction confirmations. The Creator is solely responsible for managing their pricing, promotions, refunds, and customer support.
Access and Delivery
Access to the content you purchase is determined and delivered by the Creator. Hiro.fm provides the platform tools to enable delivery (such as private podcast feeds, unlock links, or automated messages), but we do not control when or how the Creator releases their content.
If you have questions about missing content, delivery timing, or access problems, please reach out to the Creator directly using their listed contact method.
Responsibility and Disputes
By completing a purchase on Hiro.fm, you acknowledge that your transaction is with the Creator, not with Hiro.fm. We are not responsible for any part of the Creator’s product, service, or communication. This includes but is not limited to:
Delays or failure to deliver content
Disagreements over pricing or terms
Refunds or cancellations
Support or follow-up after purchase
If you believe a Creator has acted fraudulently or in violation of our platform policies, you may report the issue to us at [email protected]. We will review the report and take appropriate platform-level action if necessary.
Taxes
You are responsible for any taxes related to your purchase. The Creator is responsible for collecting and reporting those taxes as required by law. Hiro.fm does not collect or remit taxes on purchases made through the platform.
All About Being a Creator
As a Creator on Hiro.fm, you are responsible for the content you publish, the customers you serve, and the compliance of your business. Hiro.fm provides a platform to help you host, deliver, and automate your audio content and customer experiences — but you are the one doing business with your audience.
By using Hiro.fm, you agree to the following responsibilities:
1. Content Ownership and Responsibility
You are solely responsible for all content you upload, publish, or distribute using Hiro.fm. This includes:
Audio shows, podcasts, courses, messages, and media files
Sales pages, show descriptions, and pricing information
Customer-facing messages via email, SMS, or WhatsApp
You represent and warrant that you own all rights to your content, or have obtained proper licenses or permissions, and that your content does not violate any law, regulation, or third-party rights.
2. Compliance with Laws
You agree to comply with all applicable laws and regulations, including (but not limited to):
Consumer protection laws
Tax obligations
Data privacy regulations (such as GDPR or CCPA)
Messaging compliance (including SMS and email regulations, such as CAN-SPAM, TCPA, and WhatsApp’s commerce policy)
You are solely responsible for ensuring your use of Hiro.fm complies with these laws and that your customer communications are lawful, permission-based, and transparent.
3. Use of Email, SMS, and WhatsApp Features
Hiro.fm enables you to send messages to your customers via email, SMS, and WhatsApp. You are responsible for:
Obtaining valid consent from each recipient before sending messages
Honoring opt-out requests promptly
Avoiding misleading, spammy, or deceptive messaging practices
Ensuring message content and frequency comply with relevant carrier and platform rules
Abuse of messaging features may result in message blocking, suspension of your account, or platform-level enforcement.
4. Sales, Subscriptions, and Refunds
You are the seller of record for all customer purchases made through your Hiro.fm sales pages. You agree to:
Connect your own Stripe and/or PayPal accounts to receive payments directly
Set and manage your own pricing and refund policies
Clearly communicate your refund policy to customers
Fulfill your product or service as promised
Hiro.fm does not handle or distribute your funds and does not mediate refund requests between you and your customers.
5. Customer Support
You are responsible for providing customer support for your own shows, offers, and subscriptions. This includes:
Responding to questions about access, pricing, or delivery
Issuing refunds (if applicable) according to your own policy
Troubleshooting customer experience issues related to your content
Hiro.fm does not provide customer service on your behalf and is not a party to your transactions.
6. Platform Fair Use
Hiro.fm is designed to support responsible and professional content delivery. We reserve the right to investigate and take action, including suspension or termination, if your account:
Causes technical disruptions or abuse of platform infrastructure
Sends spam or abusive messages
Violates legal or ethical guidelines
Encourages fraud, hate, violence, or other prohibited conduct
We also reserve the right to enforce platform limits for storage, messaging, and usage in line with your plan level.
Intellectual Property
All Hiro content and technology is protected by copyright, trademark, and trade secrets.
You may not copy, clone, or modify Hiro software or branding without our written permission.
You retain rights to your own content, but grant us a license to host and deliver it.
Hiro.fm Agency Plan Resale & Usage Policy
To maintain the integrity of our pricing structure and ensure fairness for all customers, we have implemented the following resale and usage policies for the Agency plan.
1. Prohibited Resale of Agency Plan Sub-Accounts
The Hiro.fm Agency plan includes five (5) sub-accounts that are intended for use within a single business or organization. **Reselling, leasing, or transferring sub-accounts to third parties outside of your organization is strictly prohibited.**
2. Ownership & Usage Restrictions
– The Agency plan owner is responsible for all sub-accounts and their usage.
– All sub-accounts must be used within the Agency owner’s business, team, or organization.
– Sub-accounts cannot be rebranded, sold, or marketed as standalone Hiro.fm accounts.
– Hiro.fm customer support is only available to the primary Agency account owner, and sub-account holders must go through the Agency owner for any support inquiries.
3. Account Monitoring & Compliance
To enforce this policy, Hiro.fm may monitor account activity, including:
– Login locations and patterns to identify unauthorized access.
– Associated email domains to ensure sub-accounts belong to the same business entity.
– Unusual account transfers or multiple unrelated users under one Agency account.
If we identify resale activity, we reserve the right to:
– Suspend or terminate accounts violating this policy without refund.
– Charge a per-account transfer fee of $99 for legitimate ownership changes (subject to approval).
– Pursue legal action for unauthorized resale or commercial exploitation of our service.
4. Reporting Violations
If you encounter unauthorized resales of Hiro.fm Agency accounts, please report them to [[email protected]] with relevant details.
By purchasing the Agency plan, you agree to these terms and acknowledge that violating them may result in immediate account termination without refund.
Do Not Impersonate Hiro.fm: You are strictly prohibited from misrepresenting yourself as a Hiro.fm employee or implying any association with Hiro.fm when reselling access to the Platform. You may not direct your customers to contact Hiro.fm for any reason, including Platform support.
Suspension and Termination: We maintain the right to suspend or terminate your ability to resell access to the Platform at our sole discretion, with or without notice, for violations of the MAP Policy, these Terms, or any other reason we deem appropriate in our sole and absolute discretion.
We restrict some types of content and rewards. You cannot:
- Use raffles, or any prizes based on chance, as a reward.
- Create any content or reward with nudity, or realistic depictions of sexual or violent acts, unless you flag the page as Adult Content and make the content only available to podcast subscribers.
- Create any content or rewards with real people engaging in sexual or violent acts.
- Create content or rewards using others’ intellectual property, unless you have written permission to use it, or your use is protected by fair use.
If your potential podcast subscribers are under the age of 18, please remind them that they need permission to subscribe. Anyone under the age of 13 cannot have an account. We are not party to the agreement between podcasters and podcast subscribers. If a podcast subscriber requests a refund from us, we only grant it in exceptional situations. We deduct the refunded amount from future payments to you.
Hiro’s Role
Content we create is protected by copyright, trademark and trade secret laws. Some examples of our content are the text on the site, our logo, and our codebase. We grant you a license to use our logo and other copyrights or trademarks to promote your Hiro page. You may not otherwise use, reproduce, distribute, perform, publicly display or prepare derivative works of our content unless we give you permission in writing. Please ask if you have any questions.

- A description of the content that was removed and the exact location of the content on Hiro before it was removed.
- Your electronic or physical signature.
- If your content has been removed because of a DMCA notice, but you believe the content was not infringing on another’s copyrights, then you may send a written counter-notice to have the content restored. Your counter-notice should include the following information:
- A statement by you that: a) you believe in good faith that the use of the content that you claim to infringe your copyright is not authorized by law, the copyright owner, or the owner’s agent, b) all information contained in your copyright notice is accurate, and c) under penalty of perjury, you are either the copyright owner, or authorized to act on their behalf.
- A description of the exact location on Hiro of the content that you claim is infringing. This description must allow us to find and identify the content. Your name, address, telephone number and email address.
- A description of the copyrighted work that you claim has been infringed.
- A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which you are located, or if you are outside the U.S., the Northern District of California, and that you will accept service of process from the party that originally sent us the DMCA notice.
- A statement under penalty of perjury that you believe in good faith that the content was removed by mistake or misidentification.
In appropriate circumstances we may also terminate the accounts of repeat infringers.
Indemnity
If we are sued because of you, you have to help pay for it.You will indemnify us from all losses and liabilities, including legal fees, that arise from these terms or relate to your use of Hiro. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense.Your obligation to indemnify under this clause also applies to our affiliates, officers, directors, employees, agents and third party service providers.
Warranty Disclaimer
We do our best to make sure Hiro works as expected, but stuff happens.Hiro is provided “as is” and without warranty of any kind. Any warranty of merchantability, fitness for a particular purpose, non-infringement, and any other warranty is excluded to the greatest extent permitted by law.The disclaimers of warranty under this clause also apply to our affiliates and third party service providers.
Hiro Software Subscription Refund Policy
Software & Platform Access: No refunds once accessed, downloaded, or used
Courses & Trainings: No refunds after delivery or access begins
Chargebacks: Filing false disputes after usage is strictly prohibited
We reserve the right to contest chargebacks using access logs, email opens, IPs, and payment records.
Video and Audio Course Refunds
Because the Programs and trainings immediately made available to Customer upon authorization of payment, no refunds are permitted. Customer agrees to the no refund policy and acknowledges and agrees that chargebacks shall not be permitted
Limited Liability
If you lose money as a result of using Hiro, any payment to you is limited to how much you have paid us, and we don’t have to pay you if your loss is unexpected.To the extent permitted by law, we are not liable to you for any incidental, consequential or punitive damages arising out of these terms, or your use or attempted use of Hiro. To the extent permitted by law, our liability for damages is limited to the amount of money we have earned through your use of Hiro. We are specifically not liable for loss associated with failure to deliver rewards and from losses caused by conflicting contractual agreements.For this clause “we” and “our” is defined to include our affiliates, officers, directors, employees, agents and third party service providers.
Dispute Resolution
If you have a problem please talk to us, but you are limited in how you can resolve disputes. You waive your right to trial by jury and your right to participate in a class action proceeding.We encourage you to contact us if you have an issue. If a dispute does arise out of these terms or related to your use of Hiro, and it cannot be resolved after you talk with us, then it must be resolved by arbitration. This arbitration must be administered by JAMS under the JAMS Streamlined Arbitration Rules & Procedures. Judgment on the arbitration award may be entered in any court with jurisdiction. Arbitrations may only take place on an individual basis. No class arbitrations or other grouping of parties is allowed. By agreeing to these terms you are waiving your right to trial by jury or to participate in a class action or representative proceeding, we are also waiving these rights.We follow the JAMS Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards of Procedural Fairness for all arbitrations done under these terms. If any portion of these terms do not follow that standard, that portion is severed from these terms.This clause does not limit either party’s ability to seek injunctive or other equitable relief for disputes relating to intellectual property or proprietary data.
Governing Law
Any disputes with us must be resolved in Minnehaha County under South Dakota law.South Dakota law, excluding its conflict of law provisions, governs these terms and all other Hiro policies. If a lawsuit does arise, both parties consent to the exclusive jurisdiction and venue of the courts located in Minnehaha County, South Dakota.
Everything Else
These terms are the final word on Hiro’s policies.
These terms and any referenced policies are the entire agreement between you and us, and supersede all prior agreements. If any provision of these terms is held to be
unenforceable, that provision is modified to the extent necessary to enforce it. If a provision cannot be modified, it is severed from these terms, and all other provisions remain in force. If either party fails to enforce a right provided by these terms, it does not waive the ability to enforce any rights in the future.
