1. Introduction, Scope of Services & Platform Overview

Welcome to Hasster, a global digital communication, social networking, and content distribution platform designed to enable users to create, share, discover, and interact with content, communities, and services across a unified ecosystem. Hasster provides a suite of integrated services including but not limited to messaging systems, social feeds, livestreaming, group creation tools, business pages, recommendation systems, advertising services, application programming interfaces (APIs), developer tools, plugins, and embedded widgets (collectively, the "Hasster Services").

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Crambo Tech Private Limited, together with its subsidiaries, affiliates, successors, and assigns (collectively, "Hasster", "we", "us", or "our"). These Terms govern your access to, registration with, and use of all Hasster Services, including mobile applications, web platforms, APIs, SDKs, software integrations, machine learning systems, and any future technological extensions or derivative services.

Hasster’s mission is to enable global connectivity, digital expression, and community formation through advanced technologies including artificial intelligence systems, machine learning-based personalization engines, augmented reality features, content ranking systems, and safety enforcement technologies designed to improve relevance, integrity, and user experience.

By accessing, browsing, registering an account, or interacting with any Hasster Service, you acknowledge and agree that:

  • You have read, understood, and accepted these Terms in full;
  • You agree to be bound by our Privacy Policy, Community Guidelines, Advertising Policies, and any additional incorporated policies;
  • Your continued use constitutes ongoing acceptance of updated versions of these Terms;
  • If you do not agree, you must immediately discontinue use of all Hasster Services.

These Terms also describe how Hasster Services are funded, primarily through advertising and sponsored content, and you expressly acknowledge that while advertising may be personalized based on user data signals, Hasster does not sell your personally identifiable information to third-party advertisers.

2. Eligibility, Account Registration & Identity Requirements

Access to Hasster Services is conditional upon your eligibility and continued compliance with these Terms. By creating or maintaining an account, you represent, warrant, and covenant that:

  • You are at least 13 years of age or the minimum legal age of digital consent in your jurisdiction, whichever is higher;
  • You are not prohibited from using the Services under applicable law or prior enforcement action;
  • You are not a convicted sex offender or subject to legal restrictions preventing platform access;
  • All information provided during registration is true, accurate, complete, and continuously updated;
  • You will maintain only one personal account unless explicitly authorized for business or enterprise use;
  • You are solely responsible for maintaining the confidentiality and security of your login credentials;
  • You will not access or create accounts using automated systems, bots, scripts, scraping tools, or unauthorized third-party mechanisms;
  • You will not impersonate any individual, organization, or entity.

Hasster reserves the right, where permitted by applicable law, to verify identity and request additional authentication data, which may include government-issued identification (such as passport, national ID, driver’s license, or equivalent documentation), especially in cases involving suspected fraud, regulatory compliance, or account recovery procedures. Where applicable, additional verification requirements may apply for business, creator, or organizational accounts under separate Commercial Terms.

Hasster further reserves the right to refuse registration, suspend access of accounts where eligibility requirements are not met or where misuse, fraud, or policy violations are reasonably suspected.

3. User Content Ownership, Global License & Platform Rights

3.1 Ownership of Content.
You retain all intellectual property rights, including copyright and related proprietary rights, in the content you create, upload, transmit, or otherwise make available on or through Hasster Services ("User Content"). Nothing in these Terms transfers ownership of your original content to Hasster.

3.2 Comprehensive License Grant to Hasster.
By submitting or making available User Content on Hasster Services, you hereby grant Hasster and its affiliates an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable, and assignable license to use, host, store, reproduce, adapt, modify, translate, distribute, publish, publicly perform, publicly display, communicate, and otherwise exploit such User Content in any media formats and through any distribution channels now known or later developed.

This license expressly includes, without limitation:

  • Technical processing, compression, formatting, and optimization of content;
  • Creation of derivative works including thumbnails, previews, compilations, clips, excerpts, and summaries;
  • Use in recommendation systems, ranking algorithms, personalization engines, and content discovery systems;
  • Use in trust, safety, integrity, and abuse detection systems;
  • Use in advertising systems, including contextual and personalized advertising;
  • Use in machine learning, artificial intelligence training, model evaluation, and system improvement;
  • Internal analytics, research, product development, and service optimization;
  • Distribution across affiliated platforms, integrated services, and successor technologies.

You acknowledge that due to the technical nature of distributed systems, backups, caching layers, and machine learning pipelines, certain uses of your content may continue even after deletion of your account or content, including where required for system integrity, legal compliance, or safety enforcement. The license terminates only upon complete removal from active systems, subject to reasonable retention in backup archives, disaster recovery systems, or legally mandated storage environments.

3.3 Moral Rights Waiver (Where Permitted).
To the maximum extent permitted under applicable law, including but not limited to the Indian Copyright Act, 1957 and equivalent international statutes, you irrevocably waive any moral rights or similar rights you may have in and to your User Content, solely to the extent necessary to allow Hasster to fully exercise the rights granted under these Terms.

3.4 Identity, Likeness & Social Graph Usage Rights.
You expressly grant Hasster permission to use your name, username, profile information, profile image, likeness, and actions (including likes, shares, follows, reactions, and engagement history) in connection with:

  • Personalized and non-personalized advertising systems;
  • Sponsored content and commercial promotions;
  • Content recommendation and discovery features;
  • Social graph interactions visible within your privacy settings;
  • System-generated notifications and engagement summaries.

Such usage shall occur only in accordance with your privacy settings and applicable law, and does not entitle you to compensation unless expressly required by mandatory legislation.

4. User Conduct, Community Standards & Platform Integrity

Hasster is committed to maintaining a safe, secure, authentic, and lawful digital environment. By using Hasster Services, you agree to comply with these Terms, our Community Guidelines, and all applicable laws and regulations. You further agree not to engage in, facilitate, or assist any prohibited conduct, including but not limited to the following:

  • Illegal or Harmful Content: Posting, sharing, transmitting, or distributing content that is unlawful, infringing, defamatory, obscene, pornographic (where prohibited), threatening, abusive, harassing, hateful, or that incites violence, discrimination, or illegal activity.
  • Abuse, Harassment & Safety Violations: Engaging in stalking, bullying, coordinated harassment, impersonation, doxxing, or any behavior intended to intimidate, harm, or mislead others.
  • Platform Manipulation & Inauthentic Behavior: Creating or using fake accounts, bots, automated scripts, engagement manipulation tools, view/follower farms, artificial amplification systems, or any other mechanisms designed to distort engagement metrics, recommendations, or platform integrity.
  • Security Violations: Uploading malware, spyware, ransomware, phishing links, exploit code, or any content intended to disrupt, damage, or gain unauthorized access to systems, networks, or user data.
  • Data Scraping & Unauthorized Access: Accessing, collecting, harvesting, crawling, or scraping data from Hasster Services using automated tools, bots, or unauthorized methods without prior express written permission.
  • Reverse Engineering & System Interference: Attempting to decompile, disassemble, reverse engineer, extract source code, bypass security mechanisms, or interfere with platform functionality, algorithms, or recommendation systems.
  • Regulatory Violations: Violating applicable laws, including but not limited to the Information Technology Act, 2000, IT Rules 2021, export control laws, sanctions regimes, or other applicable local or international regulations.
  • Abuse of Platform Systems: Misusing reporting, appeal, moderation, or enforcement mechanisms by submitting false, fraudulent, repetitive, or bad-faith complaints or engaging in coordinated reporting attacks.

Hasster enforces these rules through a combination of automated systems, artificial intelligence models, machine learning classifiers, behavioral analysis systems, and human moderation review teams. Enforcement decisions may include, without limitation:

  • Content removal or suppression from feeds and recommendation systems;
  • Reduction in visibility or distribution (including ranking demotion or “shadow limiting”);
  • Temporary feature restrictions (e.g., messaging, posting, livestreaming);
  • Account suspension or permanent termination;
  • Referral to law enforcement or regulatory authorities where required or permitted by law.

Enforcement actions may be taken with or without prior notice where necessary to protect platform integrity, user safety, legal compliance, or system security.

5. Advertising, Monetization & Data-Driven Services Model

Hasster Services are provided primarily on a free-to-use basis and are financially supported through a multi-layered advertising and commercial content ecosystem, including personalized advertising, sponsored content, branded integrations, and performance-based promotional services.

By accessing or using Hasster Services, you acknowledge and agree that Hasster may display advertisements, sponsored posts, and commercial content that are selected, ranked, and delivered based on signals derived from user activity, including but not limited to:

  • Content engagement (likes, shares, comments, watch time, clicks);
  • Device and technical data (browser type, device identifiers, IP-based signals);
  • Platform interactions and inferred interests;
  • Social graph relationships and content affinity modeling;
  • Contextual and behavioral analysis generated through machine learning systems.

Advertisers and commercial partners provide targeting parameters such as demographic ranges, interest categories, geographic regions, and campaign objectives. Hasster’s systems automatically match such campaigns to users without disclosing personally identifiable information (such as your name, email address, or direct contact details) to advertisers unless you explicitly choose to engage with or provide such information through the relevant advertisement or third-party interface.

Hasster does not sell your personally identifiable information. However, we may share aggregated, anonymized, or pseudonymized insights and performance metrics with advertisers, including impressions, engagement rates, conversion signals, and audience composition analytics for the purpose of measuring advertising effectiveness and improving campaign performance.

Advertising delivery may involve automated decision-making systems, including real-time bidding (RTB), ranking algorithms, and predictive modeling systems designed to optimize relevance, performance, and user experience.

User Controls & Rights: You may manage your advertising preferences through account settings, including the ability to:

  • Adjust personalization preferences where technically and legally supported;
  • Limit or opt out of interest-based advertising in accordance with applicable laws (including GDPR, CCPA/CPRA, LGPD, and similar frameworks);
  • Request information regarding data usage and ad personalization, subject to verification requirements.

Where required under applicable law, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 in India, Hasster shall provide reasonable mechanisms for users to withdraw consent from behavioral or personalized advertising practices.

6. Privacy, Data Protection, Cross-Border Transfers & Global Data Governance Framework

Hasster operates a globally distributed digital infrastructure that necessitates the collection, transmission, processing, storage, and synchronization of user data across multiple jurisdictions. Your use of Hasster Services constitutes explicit acknowledgment that your personal data may be processed in countries outside your jurisdiction of residence, including jurisdictions that may not provide the same level of data protection as your local laws.

Such processing may occur in, but is not limited to, infrastructure regions and operational hubs located in India, the United States, the European Union, the United Kingdom, Singapore, Brazil, the United Arab Emirates, and other jurisdictions where Hasster, its affiliates, subprocessors, cloud service providers, content delivery networks, or security vendors maintain operational facilities.

Hasster implements internationally recognized cross-border transfer safeguards where required by applicable law, including Standard Contractual Clauses (SCCs), Data Processing Agreements (DPAs), adequacy frameworks, binding corporate rules where applicable, and supplementary technical, contractual, and organizational measures to ensure appropriate protection of personal data.

Depending on jurisdiction, Hasster processes personal data under applicable lawful bases including contractual necessity, legitimate interest balancing tests, user consent, compliance with legal obligations, fraud prevention, system integrity, safety enforcement, and service improvement purposes.

Hasster applies a layered data governance model consisting of:

  • Data Collection Layer: User-provided, device-generated, behavioral, contextual, and inferred data signals;
  • Processing Layer: Ranking systems, recommendation engines, personalization systems, and safety classifiers;
  • Storage Layer: Distributed databases, encrypted backups, and geographically redundant systems;
  • Inference Layer: Machine learning-based behavioral and interest prediction models;
  • Security Layer: Threat detection systems, anomaly detection, and fraud prevention frameworks.

Subject to applicable law, you may exercise data subject rights including access, correction, deletion, restriction of processing, objection to profiling, and data portability. Requests may be submitted to [email protected] and may require identity verification to prevent unauthorized disclosure or fraud.

Hasster may refuse or restrict requests where permitted under law, including where data retention is required for legal compliance, security purposes, dispute resolution, system integrity, or prevention of abuse.

📌 REGIONAL DATA PROTECTION RIGHTS FRAMEWORK (EXPANDED COMPLIANCE MATRIX)

European Union / United Kingdom (GDPR / UK GDPR):
Includes rights under Articles 12–22 GDPR including access, rectification, erasure, restriction, portability, objection to processing, and safeguards against solely automated decision-making producing legal or similarly significant effects (Article 22). Users may also lodge complaints with supervisory authorities.

California (CCPA/CPRA):
Includes rights to know categories and sources of data collected, delete personal information, correct inaccurate data, opt-out of sale or sharing of personal information, and limit use of sensitive personal information for cross-context behavioral advertising. Users may exercise rights without discrimination under CPRA.

Brazil (LGPD):
Includes rights to confirmation of processing, access, correction, anonymization, blocking, deletion, portability, information about public and private entities with which data is shared, and revocation of consent where applicable.

United Arab Emirates (UAE PDPL):
Includes rights to access, correction, deletion, restriction of processing, and data portability, subject to lawful processing conditions and regulatory limitations.

India (Digital Personal Data Protection Act, 2023):
Includes rights to access information, correction and erasure, grievance redressal through designated grievance officers, nomination rights for data access continuity, and withdrawal of consent subject to statutory retention obligations and lawful exemptions.

7. Off-Platform Data Collection, Cross-Device Tracking, Attribution Systems & Measurement Infrastructure

Hasster may collect, receive, or infer data regarding user interactions that occur outside the Hasster Services (“Off-Platform Data”) where such data is obtained through authorized integrations, including but not limited to embedded Hasster plugins, login authentication systems, SDKs, application programming interfaces (APIs), conversion tracking pixels, and third-party analytics or advertising integrations.

Off-platform signals may include, subject to applicable legal requirements, browsing behavior, page interactions, purchase events, ad impressions, referral sources, session metadata, device identifiers, and probabilistic or deterministic attribution signals. Such information may be linked to your Hasster account using cookies, pixel tags, device fingerprinting techniques, hashed identifiers, or secure authentication tokens.

Hasster uses Off-Platform Data strictly for the following enterprise-grade operational purposes:

  • Advertising attribution, measurement, and conversion analytics;
  • Optimization of content ranking and recommendation systems;
  • Detection and prevention of fraud, spam, invalid traffic, and coordinated inauthentic behavior;
  • Security enforcement, abuse prevention, and platform integrity monitoring;
  • Improvement of machine learning models used for personalization and safety systems;
  • Cross-device and cross-session user experience continuity (where permitted by law).

Hasster may employ deterministic matching (e.g., login-based identifiers) and probabilistic modeling techniques to associate off-platform activity with user accounts. Where required by applicable law, such processing shall be subject to user consent and/or opt-out mechanisms.

Users may manage or restrict the collection and use of Off-Platform Data through account-level privacy settings, including: Settings → Privacy Controls → Off-Platform Activity Management.

Disabling Off-Platform Data usage may reduce personalization, advertising relevance, and measurement accuracy, but will not impact core platform functionality.

8. Artificial Intelligence Systems, Machine Learning Infrastructure & Model Training Authorization

Hasster operates advanced artificial intelligence systems, machine learning pipelines, natural language processing models, computer vision systems, recommendation engines, ranking algorithms, generative AI systems, and automated moderation and safety frameworks (collectively, “AI Systems”).

These AI Systems are integral to the operation, optimization, personalization, security, and evolution of Hasster Services, and may be continuously trained, updated, evaluated, and refined using large-scale datasets derived from platform activity.

By using Hasster Services, you expressly grant Hasster a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable, and assignable license to collect, process, store, transform, reproduce, analyze, and derive statistical, behavioral, and semantic insights from User Content for the purposes of:

  • Training, fine-tuning, validating, and deploying machine learning and artificial intelligence models;
  • Developing and improving generative AI systems, including text, image, audio, and multimodal systems;
  • Building recommendation, ranking, search, and personalization algorithms;
  • Enhancing content moderation, safety detection, and policy enforcement systems;
  • Creating aggregated, anonymized, or synthetic datasets for research and model evaluation;
  • Improving system reliability, scalability, and predictive performance.

You acknowledge and agree that AI Systems may generate derived representations, embeddings, weights, parameters, and learned statistical structures that cannot be practically or technically reversed, isolated, or deleted on an individual content basis once training has occurred.

Accordingly, deletion of User Content does not necessarily result in removal of such content from trained models, inferred datasets, or aggregated system-level representations, where such removal is technically infeasible or would materially impair system integrity.

Where required by applicable law, Hasster may provide users with the ability to opt out of future use of their content for AI training purposes by contacting [email protected]. Such opt-out shall apply only prospectively and shall not:

  • Retroactively remove previously trained models or outputs;
  • Affect system-level safety models or fraud prevention systems;
  • Require re-training or rollback of deployed AI Systems;
  • Impact anonymized, aggregated, or derived datasets.

Hasster reserves the right to determine, at its sole discretion, whether AI Systems require retraining, recalibration, or updates in response to data removal requests, regulatory requirements, or system optimization needs.

9. Intellectual Property Rights, Copyright Enforcement, DMCA Procedure & Counter-Notice Framework

Hasster respects intellectual property rights and operates a copyright compliance and enforcement framework designed to meet applicable safe harbor requirements under relevant copyright laws, including the Digital Millennium Copyright Act (DMCA), as well as equivalent international notice-and-takedown regimes.

If you believe that any content available on or through Hasster Services infringes your copyright or other intellectual property rights, you may submit a formal takedown notice to [email protected]. Such notice must include, at minimum:

  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and its location (URL or in-app reference);
  • Your full legal name, address, telephone number, and valid contact information;
  • A statement of good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;
  • A statement, made under penalty of perjury (or equivalent under applicable law), that the information provided is accurate and that you are authorized to act on behalf of the rights holder;
  • An electronic or physical signature of the rights holder or authorized representative.

Upon receipt of a valid notice, Hasster may, at its discretion and in compliance with applicable law, remove or disable access to the allegedly infringing content within a reasonable timeframe, typically within 48 business hours, subject to verification, technical feasibility, and legal requirements.

Counter-Notification Procedure:
If you believe that content removed pursuant to a copyright complaint was removed in error or due to misidentification, you may submit a counter-notification to the same contact address. A valid counter-notification must include:

  • Identification of the material that has been removed and its prior location;
  • A statement under penalty of perjury that you believe the content was removed due to mistake or misidentification;
  • Your consent to the jurisdiction of the competent courts in Lucknow, India (or another applicable jurisdiction designated by Hasster based on account region);
  • Your contact information and physical or electronic signature.

Upon receipt of a valid counter-notification, Hasster may forward it to the original complainant. Unless the complainant initiates legal proceedings within fourteen (14) business days, Hasster may, at its discretion, restore the content.

Repeat Infringer Policy:
Hasster maintains a repeat infringement enforcement policy consistent with platform safe harbor requirements. Accounts that accumulate three (3) valid copyright infringement notices within a rolling one hundred eighty (180) day period may be subject to permanent termination. Hasster reserves the right to apply stricter enforcement measures in cases involving egregious, commercial-scale, or malicious infringement activity.

10. Third-Party Services, External Links & Developer/API Integration Framework

Hasster Services may contain links, integrations, embedded content, or interoperability features that connect to third-party websites, applications, platforms, SDKs, APIs, or services that are not owned, controlled, or operated by Hasster.

Hasster does not endorse, verify, guarantee, or assume responsibility for any third-party content, services, data practices, security policies, or operational practices. Your access to and use of third-party services is governed exclusively by the terms and policies of those third parties, and you access such services at your own risk.

Hasster may provide application programming interfaces (APIs), software development kits (SDKs), plugins, widgets, or other developer tools (“Developer Services”) to enable integration with the Hasster ecosystem. Use of Developer Services is subject to additional Developer Policies, including but not limited to:

  • Data usage and retention restrictions;
  • Security and authentication requirements;
  • Rate limiting and usage quotas;
  • Prohibitions on scraping, data reselling, or unauthorized aggregation;
  • Compliance with applicable privacy, security, and consumer protection laws.

Hasster reserves the right to monitor, throttle, suspend, restrict, or permanently revoke API or Developer access at any time, with or without notice, where necessary to protect platform integrity, security, or compliance obligations.

11. Content Moderation System, Enforcement Strikes, Risk Scoring & Appeals Process

Hasster operates a hybrid content governance system combining automated machine learning classifiers, artificial intelligence-based detection models, behavioral analytics systems, and human review processes to enforce compliance with these Terms, Community Guidelines, and applicable law.

Enforcement decisions may be based on content-level violations, account-level risk signals, coordinated inauthentic behavior detection, or system integrity assessments. Hasster may assign enforcement actions based on a graduated strike-based system designed to ensure proportionality and repeat-offender accountability.

Enforcement Strike System:

  • Warning (0 Strikes): First-time or low-severity violations may result in content removal and a formal warning without account-level restriction.
  • Strike 1: Temporary feature limitation including restricted posting, commenting, or engagement capabilities for a period of up to seven (7) days.
  • Strike 2: Enhanced enforcement action including restriction of core account functionalities such as posting, messaging, or livestreaming for up to thirty (30) days.
  • Strike 3: Permanent account suspension or termination, including removal of access to all associated Services, subject to applicable law and appeal rights.

Hasster may, in cases involving severe or repeated violations, bypass the standard strike system in accordance with applicable law and platform safety requirements.

Appeals & Review Process:
Users may submit an appeal for content removal decisions, account strikes, or enforcement actions through the in-platform appeal mechanism within thirty (30) days of the enforcement action. Appeals are reviewed by automated systems and/or trained human reviewers depending on case complexity.

Hasster aims to complete appeal reviews within fourteen (14) business days, although timelines may vary depending on volume, case complexity, or regulatory requirements. All appeal decisions are final unless otherwise required by applicable law.

Transparency & Accountability Reporting:
Hasster may publish periodic Transparency Reports, typically on a biannual basis, detailing enforcement statistics, content removal volumes, government requests, copyright takedown metrics, and platform safety actions. Such reports may be made available at /transparency or other designated disclosure portals.

12. Platform Access Rights, Discretionary Account Controls & Service Integrity Authority

⚠️ PLATFORM CONTROL AUTHORITY (DISCRETIONARY RIGHT OF ACCESS MANAGEMENT):

Hasster will exercise its rights under these Terms in a manner that is reasonable, proportionate, and consistent with applicable law, including applicable consumer protection, data protection, and contract fairness principles.

Hasster may restrict, suspend access to any account or feature where Hasster, acting in good faith and on the basis of reasonable assessment, determines such action is necessary for one or more of the following legitimate purposes: compliance with applicable law or regulatory obligations; enforcement of these Terms or Community Guidelines; prevention, detection, or mitigation of fraud, abuse, security threats, or illegal activity; protection of users, third parties, or the integrity, stability, or security of the Services; or addressing material technical, operational, or system integrity issues affecting the platform.

Where reasonably practicable, Hasster will provide prior notice and/or explanation; however, immediate action may be taken where necessary to comply with applicable law, enforce these Terms, or address urgent risks to platform integrity, users, or third parties.

Hasster may also take proportionate enforcement actions, including restriction, suspension, or termination of access, where continued access presents a reasonably foreseeable risk of harm, misuse, or violation of applicable obligations.

To the maximum extent permitted by law, Hasster shall have no liability arising from or related to any such access restriction, suspension, or termination decision, including any loss of data, content, followers, communications, or platform-related value, and no such action shall give rise to any right of restoration or compensation except where required by applicable law.

Account access and content availability are provided on a revocable basis, and continued use of the Services constitutes acknowledgment that access is conditional upon ongoing compliance with these Terms.

13. Termination, Suspension, Data Retention & Post-Account Effects

Users may terminate their account at any time through platform settings, subject to applicable technical and legal limitations. Upon user-initiated deletion, Hasster will initiate a structured deactivation and deletion workflow designed to remove personal data within a commercially reasonable timeframe, typically not exceeding ninety (90) days, unless extended retention is required or permitted by law.

Hasster may suspend or ban the accounts immediately, with or without prior notice where required, for any reason permitted under applicable law, including violations of these Terms, legal obligations, security risks, or operational necessity.:

  • Material or repeated violations of these Terms or related policies;
  • Suspected fraud, identity abuse, or security compromise;
  • Legal or regulatory obligations requiring account restriction;
  • Prolonged inactivity exceeding twenty-four (24) months;
  • Risk to platform safety, infrastructure integrity, or user trust;
  • Abuse of systems, moderation processes, or reporting mechanisms.

Upon termination or suspension, all rights granted to the user to access or use Hasster Services shall immediately cease. However, certain provisions of these Terms shall survive termination, including but not limited to intellectual property licenses granted to Hasster, indemnification obligations, limitation of liability, dispute resolution clauses, and data retention rights as required by law or legitimate business purposes.

Hasster may retain certain data following account termination for purposes including legal compliance, dispute resolution, enforcement of agreements, fraud prevention, security auditing, and system integrity maintenance.

Where applicable, content previously shared with or by other users, or content incorporated into system-level backups, logs, or AI training datasets, may persist in anonymized, aggregated, or system-integrated forms.

14. Warranty Disclaimers, Risk Allocation & Limitation of Liability

⚠️ DISCLAIMER OF WARRANTIES:

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE HASSTER SERVICES ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

Hasster expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement;
  • Warranties arising from course of dealing, usage, or trade practice;
  • Warranties that the Services will be uninterrupted, error-free, secure, or free of harmful components;
  • Warranties regarding accuracy, reliability, completeness, or timeliness of content or data;
  • Warranties that defects or errors will be corrected.

Limitation of Liability:

To the fullest extent permitted by applicable law, Hasster, including its affiliates, directors, officers, employees, contractors, licensors, and agents, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of data, revenue, profits, or goodwill;
  • Business interruption or operational disruption;
  • Loss of digital content, followers, or platform access;
  • Unauthorized access or alteration of transmissions or data;
  • Errors, bugs, or system failures.

In no event shall the aggregate liability of Hasster arising out of or relating to these Terms or the use of the Services exceed the greater of:

  • ₹500 INR (or equivalent local currency); or
  • The total amount paid by you to Hasster in the twelve (12) months preceding the claim.

Nothing in this disclaimer excludes liability where such exclusion is prohibited under applicable law, including statutory consumer rights that cannot be waived.

15. Indemnification, Defense Obligations & User Liability Allocation

You agree to defend, indemnify, and hold harmless Hasster and its affiliates, subsidiaries, directors, officers, employees, contractors, licensors, and agents from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and legal costs) arising out of or relating to:

  • Your access to or use of Hasster Services;
  • Your User Content or data submissions;
  • Your violation of these Terms, Community Guidelines, or applicable laws;
  • Your infringement or misappropriation of any third-party rights, including intellectual property, privacy, or publicity rights;
  • Your misuse of the Services, including fraudulent, abusive, or unlawful conduct;
  • Any dispute between you and another user or third party arising from your use of the platform.

Hasster reserves the right, at its sole discretion and expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Hasster in asserting any available defenses.

This indemnification obligation shall survive termination or expiration of your account and continued or discontinued use of the Services.

16. Dispute Resolution Framework: Mandatory Binding Arbitration (Seat: Lucknow, India)

To the maximum extent permitted by applicable law, any dispute, claim, controversy, or disagreement arising out of or relating to these Terms, the Hasster Services, or the relationship between you and Hasster (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory) shall be resolved exclusively through final and binding arbitration.

Such arbitration shall be administered by the Indian Council of Arbitration (ICA) in accordance with its then-applicable rules, and governed by the Arbitration and Conciliation Act, 1996 (as amended). The seat and legal place of arbitration shall be Lucknow, Uttar Pradesh, India, and the proceedings shall be conducted in the English language unless otherwise agreed by the parties.

The arbitration shall be conducted by a single independent and neutral arbitrator appointed in accordance with ICA rules. The arbitrator shall have exclusive authority to resolve all disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any questions of arbitrability.

Class Action Waiver:
You expressly agree that any dispute resolution proceedings shall be conducted only on an individual basis. You waive any right to participate in or bring class actions, collective actions, representative proceedings, or consolidated claims against Hasster to the fullest extent permitted by law.

Small Claims Exception:
Notwithstanding the foregoing, either party may elect to bring an individual claim in a competent small claims court in Lucknow, Uttar Pradesh, India, provided that the claim falls within the jurisdictional monetary threshold of ₹1,00,000 INR (or such amount as may be permitted under applicable law).

Arbitration Opt-Out Right:
You retain the right to opt out of this arbitration agreement within thirty (30) days of first accepting these Terms. To exercise this right, you must send a written notice containing your full name, registered email address, and a clear statement of intent to opt out of arbitration to the designated postal address of Hasster in Lucknow. Failure to opt out within the prescribed period shall constitute irrevocable acceptance of this arbitration provision.

Judgment on any arbitral award may be entered and enforced in any court of competent jurisdiction.

17. Governing Law, Jurisdictional Hierarchy & Conflict of Laws Framework

These Terms, and any dispute or claim not subject to arbitration, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Applicable legal framework shall include, without limitation:

  • The Indian Contract Act, 1872;
  • The Information Technology Act, 2000 and applicable IT Rules;
  • The Digital Personal Data Protection Act, 2023;
  • Any applicable rules, regulations, or delegated legislation issued under Indian law.

Subject to the arbitration clause, the courts located in Lucknow, Uttar Pradesh, India shall have exclusive jurisdiction over any judicial proceedings arising from or related to these Terms, including enforcement of arbitration awards, interim relief, or challenges to arbitral decisions.

Where Users access Hasster Services from outside India, such access is voluntary and at the User’s own initiative. While Hasster may comply with mandatory consumer protection or data protection laws applicable in other jurisdictions, such compliance shall not be interpreted as submission to jurisdiction outside India, unless explicitly required by law.

In the event of a conflict between local law and these Terms, applicable mandatory consumer protection provisions of the User’s jurisdiction shall apply only to the extent they cannot be waived by contract, and all other provisions shall remain governed by Indian law.

18. Force Majeure, System Failures & Operational Disruption Exclusion

Hasster shall not be held liable for any failure, delay, suspension, interruption, or degradation in performance of the Services resulting from causes beyond its reasonable control, whether foreseeable or unforeseeable.

Such events include, without limitation:

  • Natural disasters (including earthquakes, floods, cyclones, fires, pandemics, or epidemics);
  • War, terrorism, civil unrest, or armed conflict;
  • Governmental actions, regulatory orders, or judicial directives, including takedown orders under Section 69A of the Information Technology Act, 2000;
  • Internet backbone failures, ISP outages, or global connectivity disruptions;
  • Cyberattacks, distributed denial-of-service (DDoS) attacks, malware outbreaks, or infrastructure compromise;
  • Cloud service provider failures, data center outages, or third-party vendor disruptions;
  • Power failures, hardware malfunctions, or large-scale system degradation;
  • Labor disputes, strikes, or workforce disruptions.

During such events, Hasster’s obligations shall be suspended for the duration of the force majeure condition, and any affected performance timelines shall be extended for a reasonable period corresponding to the duration and impact of the disruption.

Hasster shall make commercially reasonable efforts to mitigate the effects of such events; however, it shall not be required to restore services within any specific timeframe if doing so is not technically, operationally, or legally feasible.

Nothing in this clause shall be interpreted as requiring Hasster to assume liability for third-party infrastructure providers, telecommunications networks, or cloud hosting services.

19. Modifications, Regulatory Updates, Version Control & Adaptive Compliance Framework

Hasster reserves the unrestricted right to update, modify, revise, supplement, or replace these Terms at any time, in whole or in part, to reflect, without limitation: changes in product functionality, technological evolution, security requirements, commercial needs, legal interpretations, regulatory guidance, or emerging industry standards.

You acknowledge that digital platforms operate in rapidly evolving legal, technological, and regulatory environments across multiple jurisdictions. Accordingly, Hasster may implement immediate or prospective modifications where necessary to ensure compliance with:

  • Existing or amended national or international laws;
  • Judicial precedents or regulatory interpretations;
  • Governmental directives, emergency orders, or policy frameworks;
  • Industry-wide safety or security standards;
  • Platform integrity, risk mitigation, or fraud prevention needs.

Where a change is deemed material in nature, Hasster shall provide reasonable advance notice where commercially and legally practicable, including notification via in-app communication, email, or system alerts. Continued access or use of the Services after the effective date of such changes constitutes binding acceptance.

Non-material modifications, including formatting, clarifications, bug-related updates, security patches, or administrative refinements, may be implemented without prior notice.

Future Regulatory Adaptation Clause (Unforeseen Law Coverage):
You expressly acknowledge and agree that laws, regulations, judicial interpretations, and governmental requirements may evolve in ways that are unforeseeable at the time of your acceptance of these Terms. Accordingly, Hasster retains the right to interpret, supplement, or adapt these Terms in good faith to ensure compliance with any future legal, regulatory, or quasi-regulatory obligations, even if such obligations:

  • Do not currently exist at the time of agreement;
  • Are issued by new or previously non-existent regulatory authorities;
  • Arise from cross-border conflicts of law or international harmonization frameworks;
  • Impose obligations inconsistent with prior platform operations.

In such circumstances, Hasster may implement interim compliance measures, including temporary restrictions, feature modifications, or service adjustments, without liability to users, to the extent required for lawful operation.

20. General Legal Provisions, Interpretation Hierarchy & Contractual Integrity Framework

These Terms constitute a unified legal framework governing access to and use of Hasster Services. In the event of ambiguity, conflict, or interpretive inconsistency, the provisions shall be interpreted in accordance with the following hierarchy:

  • Mandatory applicable law (highest priority);
  • Arbitration and dispute resolution provisions;
  • Platform safety, security, and integrity provisions;
  • Core service, licensing, and content provisions;
  • Supplementary policies and guidelines.

Severability & Reformation:
If any provision is found to be invalid, unlawful, or unenforceable in any jurisdiction, such provision shall be modified or reinterpreted to the minimum extent necessary to make it enforceable. If modification is not possible, it shall be severed without affecting the validity of the remaining provisions.

No Waiver:
Failure by Hasster to enforce any provision shall not constitute a waiver of future enforcement of that or any other provision.

Assignment & Corporate Restructuring:
Hasster may assign, transfer, sublicense, or delegate its rights and obligations under these Terms, in whole or in part, without restriction, including in connection with mergers, acquisitions, asset transfers, corporate reorganizations, or regulatory restructurings. Users may not assign their rights without prior written consent.

No Third-Party Beneficiaries:
These Terms do not create any enforceable rights for any third party except where explicitly required by law.

Feedback License:
Any feedback, suggestions, ideas, or improvements submitted by users may be used by Hasster indefinitely, worldwide, and without restriction, attribution, or compensation.

Entire Agreement:
These Terms, together with all incorporated policies, constitute the complete and exclusive agreement between you and Hasster, superseding all prior agreements, representations, or understandings.

Hasster shall comply with lawful orders issued by competent courts, tribunals, or government authorities, including but not limited to content blocking, data disclosure, or access restriction directives under Section 69A of the Information Technology Act, 2000, or any successor provision.

Hasster may also retain, preserve, or disclose data where required to comply with international legal obligations, cross-border requests, or mutual legal assistance treaties (MLATs), subject to applicable law.

22. Survival of Obligations, Continuity Doctrine & Post-Term Effectiveness

These Terms constitute a binding and continuing legal agreement that may survive termination, suspension, discontinuation, or cessation of user access or platform services.

The following provisions shall survive indefinitely or for the maximum duration permitted under applicable law:

  • Intellectual property and content licensing rights;
  • Advertising, monetization, and data usage provisions;
  • Artificial intelligence and machine learning training rights;
  • Dispute resolution and arbitration provisions;
  • Indemnification obligations;
  • Limitation of liability and disclaimers;
  • Regulatory cooperation and lawful disclosure obligations;
  • Any provision intended by its nature to survive termination.

You acknowledge that certain obligations, including data retention, security logging, fraud prevention, and system integrity measures, may continue beyond account termination as required for legal compliance, operational necessity, or legitimate business interests.

23. Global Legal Adaptation & Unforeseen Circumstances Clause (Future-Proofing Provision)

To the maximum extent permitted by applicable law, you acknowledge and agree that digital services operate within an evolving global legal, regulatory, technological, and geopolitical environment. Accordingly, these Terms shall be interpreted and applied in a manner that permits reasonable adaptation to unforeseen circumstances, including but not limited to:

  • Emergence of new laws, regulations, or regulatory bodies;
  • Introduction of novel data protection, AI governance, or digital safety regimes;
  • Conflicting legal obligations across jurisdictions;
  • Technological developments that materially affect service operation;
  • National security directives, emergency legislation, or international compliance obligations.

In such cases, Hasster may adopt interim, emergency, or transitional compliance measures necessary to ensure continued lawful operation, even if such measures temporarily restrict, modify, or suspend certain features or rights under these Terms.

You expressly agree that such measures shall not constitute breach of contract, provided they are implemented in good faith and consistent with applicable law and platform safety obligations.
