This fixes the test failure, it was randomness returning the same policy rather than a new one. Switched to use `randomValueOtherThan`. Resolves elastic#51377

This fixes the test failure, it was randomness returning the same policy rather than a new one. Switched to use `randomValueOtherThan`. Resolves #51377
