Welcome to TryLoom. We provide the website tryloom.toolteek.com and develop the Virtual Try-On plugin for WooCommerce (the “Plugin”) .
By accessing our website, purchasing our Plugin, or installing our software, you agree to be bound by these Terms and Conditions (“Terms”) . If you do not accept these Terms, you must not use our services or software .
1. Definitions
To ensure clarity in this agreement:
“Customer” or “Merchant”: Refers to you – the business or individual who purchases and installs our Plugin on a WooCommerce website .
“End User”: Refers to the visitors of the Merchant’s website who use the Try-On feature (e.g., the shoppers uploading photos) .
“Service”: Encompasses our sales website, the Plugin files, TryLoom keys, and support services .
2. TryLoom Keys and Access Rights
2.1 The Plugin (GPL License)
The WordPress Plugin software itself is licensed under the GNU General Public License (GPL). You are free to use, modify, and redistribute the PHP code of the Plugin in accordance with the GPL.
2.2 The Platform Service (Paid Access)
While the Plugin code is free, the “Virtual Try-On” functionality relies on our proprietary cloud-based API (the “Service”) to process images.
TryLoom Key: To remove trial limits or access higher usage tiers, you must purchase a TryLoom Key.
Access Grant: Purchasing a TryLoom Key grants you a non-exclusive, revocable right to access our API Service, subject to your subscription plan or credit limit.
No Resale of Service: You may not resell, sublicense, or redistribute access to our API Service (e.g., you cannot sell your API Key to others) without our written permission.
2.3 Free Trial
We provide a limited Free Trial of the Service (e.g., a set number of try-ons) included with the Plugin installation.
The Free Trial is provided “AS IS” without warranty.
We reserve the right to modify trial limits without notice.
3. AI Service Disclaimer (Critical)
Our Plugin utilizes advanced Third-Party Artificial Intelligence (AI) to generate virtual try-on images . By using this Product, you acknowledge and agree to the following:
No Guarantee of Accuracy: The images generated are AI simulations. They are approximations and may not perfectly reflect how a product will fit physically in real life . We do not guarantee 100% photorealism or anatomical accuracy in every generation .
Variability: Results may vary significantly based on the quality of the photo uploaded by the End User and the lighting/quality of your product image .
Service Dependence: The Try-On functionality relies on third-party API providers. While we strive for uptime, we cannot guarantee uninterrupted service if the third-party provider experiences an outage .
4. Data Protection and Responsibilities
4.1 Your Role as Data Controller
As the Merchant installing the Plugin, you are the Data Controller for any user images and personal data collected on your website . You are responsible for:
Ensuring you have lawful grounds (e.g., consent) to collect images from your End Users .
Providing an up-to-date Privacy Policy on your own site explaining to your users how their photos are processed .
Configuring the Plugin settings regarding whether user images are saved to your server or deleted immediately .
4.2 Our Role and “No Storage” Policy
We act as a service provider. We adhere to a strict “No Retention” policy:
We do not retain, store, or archive End User photos or generated results on our servers after the processing is complete .
Images are processed transiently solely to generate the preview .
5. Payment, Fees, and Refunds
5.1 Payments
Prices are listed on our website and are subject to change without notice . Payments are processed by secure third-party provider. We do not store your full credit card or payment information .
5.2 Refund Policy
Digital Nature: Due to the digital nature of the product (downloadable software), refunds are generally not provided once the file has been downloaded or the TryLoom key activated .
Exceptions: We may offer a refund within 14 Days if the Plugin is technically defective and our support team is unable to resolve the issue .
EU Consumers: We comply with applicable consumer laws regarding cooling-off periods where legally required, provided the digital content has not been accessed or used .
6. Support and Maintenance
- Support Scope: We provide technical support for the Plugin as described in your purchase agreement .
- Exclusions: We are not responsible for issues caused by:
Your web hosting environment or server configuration .
Conflicts with third-party themes or other plugins installed on your site .
Modifications you make to the Plugin code .
7. Limitation of Liability
To the maximum extent permitted by applicable law:
The Plugin and Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including fitness for a particular purpose .
Damages: We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business goodwill, arising from your use of the Plugin .
Liability Cap: Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim .
8. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, liabilities, or expenses arising out of:
Your breach of these Terms .
Any claims related to User Content (photos) uploaded by your End Users .
Your failure to comply with data privacy laws (e.g., GDPR/CCPA) on your own website .
9. Termination
We may suspend or terminate your TryLoom Key and access to the Service immediately if you breach these Terms . Upon termination, you must cease all use of the Plugin and remove it from your website
10. Governing Law
These Terms are governed by the laws of Sri Lanka, without regard to conflict of laws principles . Any disputes shall be resolved in the courts of Sri Lanka .
