ForumSpark Terms of Service, Privacy Policy & Legal Framework

PART I — TERMS OF SERVICE
1. Definitions
For the purposes of these Terms of Service, the following definitions shall apply. These definitions shall have the same meaning whether used in the singular or plural form and shall apply throughout this Legal Framework.
"ForumSpark", "Company", "We", "Us", or "Our" refers to ForumSpark, a platform operated from Belgium, including its owners, operators, affiliates, contractors, employees, and authorized service providers.
"Service" refers to the ForumSpark platform in its entirety, including but not limited to hosted forums, websites, applications, software, infrastructure, APIs, databases, moderation tools, administrative controls, billing systems, and any related services or functionality made available by the Company.
"User" means any individual or legal entity who accesses, browses, views, or otherwise uses the Service, whether registered or unregistered.
"Member" means a registered User who has created an Account for the purpose of accessing and participating in the Service.
"Account" means a registered profile associated with a username, email address, and related personal and technical data created for the use of the Service.
"Forum Owner" means the Account that creates, manages, and exercises administrative control over a hosted forum within the Service.
"Content" means any data, information, material, or submission made available through the Service, including but not limited to posts, comments, private messages, uploads, files, images, usernames, links, metadata, forum configurations, and other user-generated materials.
"Paid Services" means any subscription plan, premium feature, paid enhancement, add-on, or monetized functionality offered by ForumSpark.
"Illegal Content" means Content that constitutes a criminal offence under applicable law, including but not limited to the laws of Belgium, the European Union, the United Kingdom, or any other jurisdiction in which the Service operates.
2. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you and ForumSpark governing your access to and use of the Service.
By accessing, browsing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy and any additional policies referenced herein.
If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Service.
You represent and warrant that you are at least eighteen (18) years of age, or that you have reached the legal age of majority in your jurisdiction. ForumSpark does not knowingly permit accounts for individuals under the age of eighteen (18).
Your use of the Service must comply with all applicable laws, regulations, and legal obligations.
3. The Service
ForumSpark provides hosted forum software and related services designed to allow Users to create, manage, and participate in online communities.
The Service may include, without limitation:
- Forum hosting and infrastructure
- Administrative and moderation tools
- User management systems
- Content storage functionality
- Paid upgrades and customization options
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
ForumSpark reserves the right, at its sole discretion and without liability, to:
- Modify, suspend, or discontinue any part of the Service
- Impose limitations on storage capacity, bandwidth, or usage
- Change pricing, subscription plans, or service structures
- Remove or restrict Content
- Restrict, suspend, or terminate Accounts
ForumSpark does not guarantee uninterrupted availability, error-free operation, permanent data preservation, or compatibility with all devices and systems.
The Service is not intended for the storage of mission-critical, legally sensitive, or irreplaceable data. Forum Owners are solely responsible for maintaining independent backups of their forums and Content.
4. Accounts & Security
You are responsible for maintaining the confidentiality and security of your Account credentials.
You agree to:
- Use secure passwords
- Not share login credentials with unauthorized parties
- Notify ForumSpark promptly of suspected unauthorized access
- Ensure that all activity under your Account complies with these Terms
You must provide accurate and complete information when creating an Account.
ForumSpark reserves the right to suspend or terminate Accounts that:
- Provide false or misleading information
- Impersonate another person or entity
- Violate these Terms
- Pose security, operational, or legal risks to the Service
ForumSpark shall not be liable for any loss or damage arising from unauthorized access resulting from your failure to secure your Account.
5. User Content
5.1 Ownership
You retain ownership of the Content you create and submit to the Service. Nothing in these Terms transfers ownership of your intellectual property to ForumSpark.
5.2 License to ForumSpark
By submitting Content to the Service, you grant ForumSpark a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and technically modify such Content for the purposes of operating, maintaining, improving, promoting, and providing the Service.
This license shall remain in effect for as long as the Content remains on the Service and for any reasonable period required for backup, archival, or legal compliance purposes.
5.3 Responsibility
You are solely responsible for the Content you post.
ForumSpark does not endorse, verify, or guarantee the accuracy, legality, or reliability of user-generated Content.
Any reliance on Content posted by other Users is at your own risk.
6. Prohibited Content
You agree not to post, upload, transmit, or otherwise make available Content that:
- Violates any applicable law or regulation
- Infringes intellectual property rights
- Is defamatory, abusive, threatening, hateful, or discriminatory
- Contains explicit sexual material
- Promotes terrorism, violence, or extremism
- Distributes malware, viruses, or harmful code
- Facilitates hacking, fraud, piracy, or illegal conduct
- Invades privacy or impersonates another person
- Constitutes Illegal Content
ForumSpark reserves the right to remove prohibited Content without prior notice.
Repeat copyright infringers will have their Accounts permanently terminated.
7. Prohibited Behavior
You may not:
- Attempt unauthorized access to systems or Accounts
- Reverse engineer or exploit the Service
- Scrape or harvest data using automated systems
- Use Content for AI training without express written permission
- Abuse reporting or support systems
- Circumvent payment mechanisms
- Initiate fraudulent chargebacks
- Resell or sublicense access to the Service
Violation may result in immediate suspension or termination.
8. Reporting & Moderation
Users may report Content believed to violate these Terms via platform tools or by contacting support.
ForumSpark may, at its sole discretion:
- Review reported Content
- Remove or restrict Content
- Suspend or terminate Accounts
- Ban IP addresses
Illegal Content, including content constituting a criminal offence under UK law, will be removed or restricted upon identification.
ForumSpark is not obligated to monitor all Content but reserves the right to do so.
9. Law Enforcement Cooperation
ForumSpark may preserve, access, and disclose Account information or Content when required to:
- Comply with legal obligations
- Respond to lawful governmental requests
- Protect users or the public
- Investigate fraud or illegal conduct
- Enforce these Terms
10. Paid Services & Billing
Fees for Paid Services are due in advance.
Subscriptions renew automatically unless cancelled prior to renewal.
Payments are non-refundable except where required by law.
Chargebacks or payment disputes may result in immediate suspension of the associated Account.
Failure to pay applicable fees may result in suspension, termination, or deletion of data.
11. Data Retention & Inactivity
ForumSpark may delete inactive Accounts or forums after extended periods of inactivity.
Backups may be retained for up to ninety (90) days following deletion.
ForumSpark does not guarantee permanent storage of Content.
12. Intellectual Property
All software, branding, logos, and platform components remain the exclusive property of ForumSpark.
You may not copy, reproduce, distribute, sell, license, or create derivative works without prior written consent.
13. Indemnification
You agree to indemnify and hold harmless ForumSpark from any claims, damages, liabilities, or expenses arising from:
- Your Content
- Your use of the Service
- Your violation of law
- Your breach of these Terms
14. Disclaimer of Warranties
The Service is provided without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, ForumSpark disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
ForumSpark shall not be liable for indirect, incidental, consequential, or special damages including loss of profits, data, or business interruption.
Total liability shall not exceed the greater of:
- The amount paid by you in the previous twelve (12) months OR
- One hundred euros (€100) if no payment was made.
16. Force Majeure
ForumSpark shall not be liable for delays or failures resulting from causes beyond its reasonable control, including cyber attacks, infrastructure failures, natural disasters, governmental actions, or third-party service disruptions.
17. Governing Law
These Terms are governed by the laws of Belgium.
Disputes shall be subject to the exclusive jurisdiction of Belgian courts.
EU consumers retain mandatory protections under their local laws.
Any claim must be filed within one (1) year of the event giving rise to the claim.
18. Changes
ForumSpark reserves the right to modify these Terms at any time.
Continued use of the Service following such changes constitutes acceptance of the revised Terms.
PART II — COPYRIGHT & DMCA POLICY
ForumSpark respects the intellectual property rights of others and expects Users to do the same.
If you believe that Content hosted on the Service infringes your copyright, you may submit a written notice including:
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location (URL)
- Your contact information
- A statement of good faith belief that use is unauthorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
Notices should be sent to:

Upon receipt of a valid notice, ForumSpark may remove or disable access to the material in question.
Users may submit a counter-notification if they believe removal was made in error.
Repeat copyright infringers will have their Accounts terminated.
PART III — PRIVACY POLICY (GDPR-Compliant)

ForumSpark acts as Data Controller for personal data collected in connection with the Service.
2. Data Collected
We may collect and process:
- Account registration information (username, email)
- IP addresses and device information
- Log data and usage data
- Content you post
- Billing and transaction data
- Cookie and analytics data
Data is collected only to the extent necessary to provide and improve the Service.
3. Legal Basis (GDPR Article 6)
Personal data is processed on the following bases:
- Performance of a contract
- Legitimate interests (security, fraud prevention, service improvement)
- Compliance with legal obligations
- Consent where required
4. Data Retention
Active Accounts are retained while active.
Security logs are retained for up to twelve (12) months.
Backups may be retained for up to ninety (90) days after deletion.
Data may be retained longer where required by law.
5. Your Rights
You have the right to:
- Access your personal data
- Rectify inaccurate data
- Request erasure
- Restrict processing
- Request data portability
- Object to processing
- Lodge a complaint with a Data Protection Authority

6. Processors

7. International Transfers
Where data is transferred outside the EU/EEA, we rely on:

We implement reasonable technical and organizational measures including encryption in transit, access controls, and monitoring systems to protect personal data.

PART IV — UK ONLINE SAFETY ACT COMPLIANCE STATEMENT
ForumSpark operates as a user-to-user content service.
We are committed to complying with the UK Online Safety Act.
We:
- Provide mechanisms to report illegal content
- Remove illegal content upon identification
- Maintain moderation systems and internal recordkeeping
- Restrict accounts to users 18+
- Cooperate with lawful UK authorities
