Schedule 1: Web Hosting & Domain Terms


EFFECTIVE DATE: 13th April 2026

This Service Schedule ("Schedule") governs the provision of web hosting, domain registration, and related services by BatchHeader Ltd t/a EncodeDotHost ("EncodeDotHost"). This Schedule is incorporated into and governed by the Master Services Agreement (MSA).

In the event of any conflict between this Schedule and the MSA, the terms of this Schedule shall prevail specifically regarding hosting and domain services.

  1. Service Provision & Resource Usage 

    1. Service Standard: EncodeDotHost shall use reasonable endeavours to provide the Services in accordance with the published Service Level Agreement (SLA). In the event of Downtime, the Customer's sole and exclusive remedy is the receipt of Service Credits as defined in the SLA. 1.2
      1. Temporarily throttle or suspend the account to preserve overall server stability.
      2. Require the Customer to upgrade to a Virtual Private Server (VPS) or Dedicated Server.
    2. Bandwidth: If the Customer exceeds the monthly data transfer limit specified in their Order, EncodeDotHost reserves the right to suspend the account until the next billing cycle or until the Customer upgrades their package.
  2. Backups & Data Management

    1. Provider Backups: EncodeDotHost performs automated backups of shared hosting environments strictly for disaster recovery purposes only (e.g., in the event of total server hardware failure).

    2. Customer Responsibility: The Customer accepts that they are solely responsible for maintaining their own independent backups of all websites, databases, and emails. EncodeDotHost accepts no liability for data loss or corruption.

    3. Email Housekeeping: To maintain server performance and storage efficiency, EncodeDotHost reserves the right to delete any email mailbox on a shared hosting plan that has not been accessed via IMAP, POP3, or Webmail for a period of 100 consecutive days.

  3. Security & Acceptable Use

    1. Account Security: The Customer is fully responsible for keeping all passwords and access credentials secure. The Customer is liable for all activities that occur under their account, including compromises due to weak passwords or outdated CMS software (e.g., unpatched WordPress plugins).

    2. Acceptable Use Policy (AUP): The Customer must strictly adhere to the standalone Acceptable Use Policy (AUP) incorporated into the MSA. This includes prohibitions on spam, malware distribution, and illegal content.

    3. Online Safety Act 2023: EncodeDotHost reserves the right to report any content suspected of breaching the Online Safety Act to the relevant authorities (e.g., the NCA) and to remove or suspend such content immediately without prior notice to the Customer.

  4. Domain Names

    1. Registration: A domain name is not officially registered until it appears in the relevant WHOIS registry. EncodeDotHost is not liable for the unavailability of a domain name prior to successful registration, even if payment has been processed.

    2. Registry Terms: Many Top-Level Domains (TLDs) carry their own terms and conditions provided by their underlying registries (e.g., Nominet for .UK domains, ICANN for .COM). By registering a domain, the Customer agrees to be bound by the respective registry's policies.

    3. Renewals: It is the Customer's responsibility to ensure domain renewal fees are paid on time. EncodeDotHost accepts no liability for the loss of a domain due to non-payment.

    4. Unpaid Domains & Expiry:

      1. Suspension: If a domain renewal fee is unpaid by the due date, EncodeDotHost reserves the right to immediately suspend the domain (causing associated websites and emails to stop functioning).

      2. Disposal: If payment is not received within 5 days of the due date, EncodeDotHost reserves the right to mark the domain for deletion or auction, subject always to the mandatory redemption periods and policies of the relevant Registry.

      3. Redemption Fees: The Customer acknowledges that once a domain enters a registry's "Redemption Grace Period," significantly higher recovery fees will apply to restore it.

  5. IP Addresses

    1. Control and Ownership: EncodeDotHost shall maintain control and ownership of any IP address assigned to the Customer as part of the Services. The Customer has no right, title, or interest in any such IP address.

    2. Right to Change: EncodeDotHost reserves the right, at its sole discretion, to change or remove any IP addresses, provided it uses reasonable endeavours to minimise disruption to the Customer.

  6. Cancellations & Refunds

    1. Auto-Renewal: To ensure continuity of service, subscription Services automatically renew at the end of each billing period. For annual plans, EncodeDotHost will send a renewal reminder email prior to the renewal date.

    2. Cancellation Notice: The Customer may cancel the Services at any time via the Client Portal. Cancellation requests must be received at least 72 hours before the next renewal date to avoid being charged for the subsequent period.
    3. 30-Day Money-Back Guarantee: Shared hosting fees are fully refundable if claimed within 30 days of the initial Order. This guarantee is limited to one claim per customer.
    4. Non-Refundable Items: Fees for domain registrations, domain transfers, SSL certificates, and dedicated servers are strictly non-refundable once the service has been provisioned. No pro-rata refunds are issued for yearly services cancelled part-way through the term after the initial 30-day period.
    5. Migration Assistance: If the Customer cancels their hosting and requests technical assistance to migrate their website, database, or emails to a third-party provider, EncodeDotHost reserves the right to charge for this service at our standard hourly rate.
