Terms of Service
These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions for the use of Brawl Insights (hereinafter referred to as "the Service"). All individuals who use the Service (hereinafter referred to as "Users") shall use the Service in accordance with these Terms after agreeing to them.
Article 1 (Agreement to these Terms and Scope of Application)
1. These Terms shall apply to all relationships concerning the use of the Service between Users and the developer of the Service (hereinafter referred to as "the Developer"). The Service includes the website, application software, and all related services provided by the Developer.
2. By using the Service, Users are deemed to have agreed to all provisions of these Terms.
3. Any rules regarding the use of the Service posted by the Developer on the Service shall constitute a part of these Terms.
4. In the event of any conflict between the provisions of these Terms and the rules set forth in the preceding paragraph or any other descriptions of the Service outside of these Terms, the provisions of these Terms shall prevail.
5. Even if these Terms are translated into languages other than Japanese, the Japanese version of these Terms shall be the official text. Translated versions are provided for reference purposes only.
Article 2 (Account Registration)
1. Account registration may be required to use some functions of the Service. Account registration is not mandatory.
2. Individuals wishing to register for an account (hereinafter referred to as "Registration Applicants") may apply for account registration by agreeing to these Terms and providing certain information specified by the Developer in the manner prescribed by the Developer.
3. The Developer may choose not to approve an account registration application if the Developer determines that any of the following reasons apply to the Registration Applicant, and the Developer shall not be obligated to disclose the reasons therefor:
(1) If there is any falsehood, error, or omission in all or part of the registration information provided to the Developer.
(2) If the application is from an individual who has previously violated these Terms.
(3) In any other cases where the Developer deems account registration to be inappropriate.
4. Users shall, at their own responsibility, appropriately manage their username and password for the Service.
5. Under no circumstances may Users assign or lend their username and password to a third party, or share them with a third party. If a login is made with a combination of username and password that matches the registered information, the Developer will deem it as use by the User who registered that username.
6. The Developer shall not be liable for any damage incurred as a result of a username and password being used by a third party, except in cases of willful misconduct or gross negligence on the part of the Developer.
7. Users may delete their own account at any time through the procedures specified by the Developer.
Article 3 (Prohibited Acts)
Users shall not engage in any of the following acts, or any acts that the Developer deems to fall under any of the following, when using the Service:
1. Acts that violate laws and regulations or public order and morals.
2. Acts related to criminal activities.
3. Acts that destroy or interfere with the functions of the Service's servers or network.
4. Acts that may interfere with the operation of the Service.
5. Acts of unauthorized access or attempts thereof.
6. Acts of collecting or accumulating personal information, etc., concerning other Users.
7. Acts of using the Service for fraudulent purposes.
8. Acts that cause disadvantage, damage, or discomfort to other Users of the Service or other third parties.
9. Acts of impersonating other Users.
10. Advertising, solicitation, or business activities on the Service not authorized by the Developer.
11. Acts of commercially using the content of the Service (defined in the next Article), including but not limited to reproduction, sale, or publication, beyond the scope of personal use without the prior permission of the Developer.
12. Acts of directly or indirectly providing benefits to anti-social forces in connection with the Service.
13. Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Service or third parties.
14. Acts of posting or transmitting expressions that are excessively violent; explicitly sexual; lead to discrimination based on race, nationality, creed, sex, social status, family origin, etc.; induce or promote suicide, self-harm, or drug abuse; or otherwise contain anti-social content and cause discomfort to others (if the Service has a posting function).
15. Any other acts that the Developer deems inappropriate.
Article 4 (Intellectual Property Rights)
1. Copyrights and other intellectual property rights concerning the Service and all information related to the Service belong to the Developer or to right holders who have granted the Developer permission for their use.
2. Users may not use information or content provided through the Service (including, but not limited to, game statistics, images, text, designs, programs, etc.; hereinafter referred to as "the Content") by any means, such as reproduction, adaptation, or public transmission, beyond the scope of private use permitted by copyright law.
Article 5 (Use of External Services)
1. The Service uses one or more third-party external APIs (hereinafter collectively referred to as "the External APIs"), including the Brawl Stars API provided by Supercell, to provide information.
2. Users shall comply with the terms of service and other conditions (hereinafter referred to as "External API Terms, etc.") stipulated by the provider of each External API (hereinafter collectively referred to as "the API Providers") regarding the use of the External APIs. In the event of any conflict between these Terms and the External API Terms, etc., the External API Terms, etc. shall prevail concerning the use of the External APIs.
3. Due to changes in the specifications of the External APIs, suspension of their provision, or other circumstances on the part of the API Providers, part or all of the Service may become unavailable. The Developer shall not be liable for any damage incurred by Users as a result thereof.
Article 6 (Suspension or Interruption of the Provision of the Service, etc.)
1. The Developer may suspend or interrupt the provision of all or part of the Service without prior notice to Users if the Developer determines that any of the following reasons exist:
(1) When performing maintenance, inspection, or updates of the computer systems related to the Service.
(2) When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
(3) When computers or communication lines, etc., stop due to an accident.
(4) In any other cases where the Developer deems the provision of the Service to be difficult.
2. The Developer shall not be liable for any disadvantage or damage incurred by Users or third parties as a result of the suspension or interruption of the provision of the Service, except in cases of willful misconduct or gross negligence on the part of the Developer.
Article 7 (Usage Restrictions and Deregistration)
1. If a User falls under any of the following, the Developer may, without prior notice, restrict the use of all or part of the Service for said User, or deregister said User's account:
(1) If the User violates any provision of these Terms.
(2) If it is found that there is a falsehood in the registered information.
(3) In any other cases where the Developer deems the User's use of the Service to be inappropriate.
2. The Developer shall not be liable for any damage incurred by Users as a result of actions taken by the Developer pursuant to this Article.
Article 8 (Disclaimer of Warranties and Limitation of Liability)
1. The Service is an unofficial tool that provides game results, statistical information, etc., and is not affiliated in any way with the API Provider or the development/operating company of the game.
2. The Developer makes no warranty whatsoever that the Service will be suitable for a User's specific purpose, possess the expected functionality, commercial value, accuracy, or usefulness, that a User's use of the Service will comply with applicable laws or internal rules of industry groups, or that defects will not occur.
3. The Developer does not expressly or implicitly warrant that any information or content on the Service is free from defects, errors or bugs, or infringement of rights related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security.
4. Users shall use the Service at their own judgment and responsibility, and the Developer shall not be liable for any damage whatsoever incurred by Users arising from the use of the Service (including any disadvantages such as mental distress or other financial losses), except in cases of willful misconduct or gross negligence on the part of the Developer.
Article 9 (Changes, Additions, or Abolition of Service Content)
1. The Developer may change, add, or abolish the content of the Service at any time without notice to Users.
2. The Developer shall not be liable for any damage incurred by Users as a result of changes, etc., to the content of the Service.
Article 10 (Changes to the Terms of Service)
1. The Developer may change these Terms at any time without obtaining the individual consent of Users if the Developer deems it necessary.
2. Unless otherwise specified by the Developer, the revised Terms shall become effective from the time they are displayed on the Service.
3. If a User uses the Service after these Terms have been changed, the User is deemed to have agreed to the revised Terms. If you do not agree to the changes, please refrain from using the Service. The Developer will endeavor to provide an advance notice period for significant changes.
Article 11 (Handling of Personal Information)
The Developer shall appropriately handle Users' personal information acquired through the use of the Service in accordance with the separately established "Privacy Policy". Users must confirm the Privacy Policy and agree to its contents before using the Service.
Article 12 (Prohibition of Assignment of Rights and Obligations)
Users may not assign their status under the user agreement or their rights or obligations under these Terms to a third party, or provide them as collateral, without the prior written consent of the Developer.
Article 13 (Severability)
If any provision of these Terms or part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws or regulations, the remaining provisions of these Terms and the remainder of any provision determined to be partially invalid or unenforceable shall continue in full force and effect.
Article 14 (Governing Law and Jurisdiction)
1. These Terms shall be interpreted in accordance with Japanese law.
2. In the event of any dispute arising in connection with the Service, the district court or summary court having jurisdiction over the location of the Developer shall be the exclusive agreed-upon court of first instance.
