Privacy Statement

Your privacy on the internet is of the utmost importance to us. This privacy statement (this “Statement”) discloses the privacy practices for urpt.com (the “Website”) – what information we gather, how we use it and how to correct or change it. This Statement only addresses our activities from our servers. Information Collected

In general, you can visit urpt.com at any time without telling us who you are or revealing any information about yourself. However, we do log the IP address, type of operating system and browser software used by each visitor, and from this information we can derive the identity of the visitor’s geographic location and Internet Service Provider. We use this data in aggregate form to build a higher quality, more useful site by analyzing the collective characteristics of our visitors and measuring the usage of each area of our site. Please note, at some point we may ask you to provide certain information (e.g., email address) when you register for features with this site. We use this address as a means to get in touch with the visitor about updates to the site and offerings from our community partners. Unsubscribe instructions are included in each email. We do not use personal identifying information for any reason that is not disclosed either in this Statement or at the time the information is requested.

Children’s Policy

We do NOT sell, trade or otherwise transfer any personal identifying information to outside parties including email addresses or mobile numbers.

Text Message Terms

By providing your telephone number to us or your provider and/or agreeing to participate in a text or communication program (collectively, the “Program”), you consent to receive text messages and/or push notifications from or on behalf of us and/or our partners and suppliers, including messages using automated dialing technology.

Unsecure: Messages are unencrypted. You understand that text messages have inherent privacy risks, including that unencrypted text messages are not secure and could be accessed by an unauthorized party, intercepted, or altered without your knowledge or authorization.

Opt Out: To stop receiving text messages, if indicated reply STOP or contact us directly. You consent to receive one last message from us confirming your inactivation.

Usage: Frequency of text messages and notifications will vary depending upon the Services you receive or your transactions with us.

You represent that you are the account holder for the mobile telephone number(s) that you provide to opt in to the Program. You are responsible for notifying us immediately if you change your mobile telephone number. You may notify us of a number change.

As a user of this Program, you acknowledge that text messages are distributed via third-party mobile network providers, and therefore, we are unable to control all functions related to the delivery of text messages. You acknowledge that it may not be possible to transmit all text messages successfully. We will not be liable for any delays in the receipt of any SMS messages, nor will we be liable for any undelivered messages, as delivery is subject to effective transmission from your network operator.

The Program may not be available on all U.S. mobile carriers. Note that your carrier is not liable for delayed or undelivered messages.

While we do not charge you for these services, message and data rates may apply to each text message sent or received in connection with the Program, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for details about available plans). Applicable roaming charges may apply.

Data obtained from you in connection with this Program may include your telephone number, your carrier’s name, and details of the message (date, time, and content). We may use this information to contact you in accordance with these Terms and to provide the services you request.

Indemnification: You agree to indemnify us and any third parties texting on its behalf in full for all claims, expenses, and damages related to or caused, in whole or in part, by your failure to immediately notify us if you change your telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Suspension; Termination: We may immediately suspend or terminate your participation in the Program if it believes you are in breach of these Terms. Your participation in this Program is also subject to termination in the event that your mobile telephone service terminates or lapses. We reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Program, with or without notice to you.

Modification: We may revise, modify, or amend these Terms at any time. Any such revision, modification, or amendment shall take effect when it is posted to the Website. You agree to review these Terms periodically to ensure that you are aware of any changes. Your continued participation in this Program, including receipt of text messages and/or push notifications without opting out will indicate your acceptance of those changes.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND SHARED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Upstream Rehabilitation (“Upstream”) is required by state and federal law to maintain the privacy of your Protected Health Information (“PHI”) and to provide you with notice of our legal duties and privacy practices with respect to PHI. PHI includes the information and records we have about your health, and the health care services you receive in our facility. PHI is information that may identify you and that relates to your past, present, or future physical or mental health oor condition and related health care services.

This Notice of Privacy Practices describes how we may use and share PHI to carry out treatment, payment, or health care operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your PHI. We will comply with this Notice. We reserve the right to change the terms of this notice and to make the new provisions effective for the PHI we maintain at that time of the change, as well as information we will obtain about you in the future. We will post a copy of the current notice at each of our facilities and on our website with its effective date clearly stated.

HOW WE MAY USE AND SHARE PHI – USES AND DISCLOSURES THAT DO NOT REQUIRE AUTHORIZATION
We may use or share your PHI without your authorization for the following reasons:

Treatment, Payment, and Health Care Operations Purposes:
We may use and share your PHI to treat you, obtain payment for our services, and for our healthcare operations purposes. For example:

Treatment – We can use your health information and share it with other professionals who are treating you to coordinate your care.

Payment – We can use and share your health information to bill and get payment from health plans or other entities.

Healthcare Operations – We can use and share your health information to run our practice, improve your care, and contact you when necessary.

Third Parties Who Perform Services for Us: We may share your information with third parties who provide services for us (called “Business Associates”). We are required to have agreements with our Business Associates that
obligate them to protect your information the same way we do.

Required by Law: We will use and share your PHI when required to do so by federal, state, or local law.

Public Health and Safety Activities: We may share your PHI in certain situations like preventing disease, helping with product recalls, reporting adverse reactions to medications, reporting suspected abuse, neglect, or domestic violence, or preventing or reducing a serious and immediate threat to anyone’s health or safety.

Lawsuits and Legal Actions: We can share your PHI in response to a subpoena, court order, or other administrative order.

Research: We may use or share your PHI for health research, but only if stepsrequired by law are taken to protect your privacy.

Workers’ Compensation, Law Enforcement, and Other Government Requests: We may use and share your PHI for the following purposes: workers’ compensation claims, law enforcement, health oversight activities
authorized by law, and special government functions like military, national security, and presidential protective services.

Coroners, Funeral Directors, and Organ Donation: We may share PHI with a coroner, medical examiner, funeral director, or organ procurement organization.

Inmates: We may share your PHI if you are an inmate of a correctional facility with the institution or its agents.

HOW WE MAY USE AND SHARE PHI – YOUR CHOICES AND AUTHORIZATION REQUIREMENTS
In some situations, you can tell us your preference about what you want us to share. Otherwise, except for the situations above, we must have an authorization to share your PHI.

Reminders, Treatment Alternatives, and Health Related Products or Services: We may use and share your PHI to remind you about your appointments and to give you information regarding treatment alternatives or other
health-related benefits and services that may be of interest to you. If you do not want us to use or share your information for these reasons, please contact our Privacy Officer.

Others Involved in Your Healthcare or Payment for your Care: We may share to a family member, relative, close friend, or any other person you identify, information directly relevant to that person’s involvement in your care or payment of your care, unless you tell us not to share.

Fundraising: We may contact you for fundraising efforts, but you can reach out to our Privacy Officer if you do not want these communications.

Other Uses and Disclosures: Using and sharing your PHI for other purposes such as marketing, selling your information, and sharing psychotherapy notes will be made only if we have your written authorization to do so.

ADDITIONAL PRIVACY FOR REPRODUCTIVE HEALTHCARE Federal law prohibits us from using or disclosing your information when it is being sought to investigate or impose liability on you, health care providers, or others who seek, obtain, provide or facilitate lawful reproductive health care, or to identify persons for such activities. This prohibition applies where we, or others acting on our behalf, have reasonably determined that:

1. The reproductive healthcare is lawful under the law of the state where it was provided under the circumstances in which it was provided.

2. The reproductive healthcare is protected, required, or authorized by Federal law, including the U.S. Constitution, regardless of the state where the healthcare is provided.

3. The reproductive healthcare was not provided by us, but we presume it was lawful. However, if we receive a request for your information, and we have actual knowledge that the reproductive healthcare was not lawful under the circumstances it was provided, this presumption does not apply.

When we receive a request for your information potentially related to reproductive healthcare, we must get a signed attestation from the requester that the use or disclosure is not for a prohibited purpose when the request relates to health oversight activities, judicial and administrative proceedings, law enforcement purposes, and disclosures to coroners and medical examiners.

ADDITIONAL PRIVACY FOR SUBSTANCE USE DISORDER TREATMENT
Although we are not a substance use disorder treatment program (an “SUD Program”), we may receive information from an SUD Program about your treatment. We may not share this information so that it can be used in a civil, criminal, administrative, or legislative proceeding against you unless (1) we have your written consent, or (2) a court order that comes with a subpoena or other legal instrument compelling disclosure issued after we and you were given notice and an opportunity to be heard. In addition, if we use this information to raise funds for our benefit, we must first provide you with a clear and conspicuous opportunity to elect not to receive any fundraising communications.

YOUR RIGHTS REGARDING YOUR INFORMATION
You have the following rights regarding your PHI. If you want to exercise any of these rights, please submit a request in writing to our Privacy Officer.

Right to Inspect and Copy: You have the right to look at and get a copy of certain PHI that we use to make decisions about you. You must submit an authorization in order to look at and/or receive a copy of your records. We may deny your request to look at and/or copy your records in certain limited circumstances under federal law. If your request is denied, you may request that the denial be reviewed. If we maintain the information electronically, you can request us to provide an electronic copy to you or to someone you designate. If the information is not in the form or format requested, and is not readily producible in that form and format, we will provide the information to you in our standard electronic format. We may charge you a reasonable fee to fulfill your request.

Right to Request a Restriction: You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree to your request, and we may deny your request if it will affect your healthcare. If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer.

Right to Request Confidential Communication:
You have the right to ask us to contact you in a specific way or to send mail to a different address. We are required to accommodate all reasonable requests.

Right to Amend:
You have the right to ask us to amend certain PHI we maintain about you if you believe the PHI is incorrect or incomplete. You must explain why the information is incorrect or incomplete in writing. We may deny your request for amendment in certain limited cases.

Right to Receive an Accounting of Disclosures:
You have the right to ask us for a list of certain disclosures we have made of your PHI, who we shared it with, and why for six (6) years prior to the date you ask. We will include all the disclosures except for those made for treatment,
payment, healthcare operations, and certain other purposes (like ones you requested). We will provide one list per calendar year for free.

Right to Get a Copy of This Notice: You have the right to request a paper copy of this Notice, even if you have agreed to accept this Notice electronically. You may ask us to give you a copy of this Notice at any time.

Right to Receive Notice of Breaches: You have the right to be notified in the event that we or one of our Business Associates experiences a breach of your PHI, as required by law.

Right to Complain: If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer by mail to Upstream Rehabilitation, 1200 Corporate Drive, Suite 400, Birmingham, AL 35242; phone at 855-660-4151; or email to clinicalservices@urpt.com. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not penalize or otherwise retaliate against you for filing a complaint.

MARYLAND PATIENTS ONLY
Upstream has chosen to participate in the Chesapeake Regional Information System for our Patients (“CRISP”), a regional health information exchange (“HIEs”) serving Maryland. CRISP is also affiliated with and shares data with other HIEs, including those, in Alaska, Connecticut, D.C., Maryland, and West Virginia. As permitted by law, your health information will be shared with this exchange in order to provide faster access, better coordination of care and assist providers and public health officials in making more informed decisions. You may “opt-out” and disable access to your health information available through CRISP by calling 1-877-952-7477 or completing and submitting an opt out form to CRISP by mail, fax or through their website at www.crisphealth.org. Public health reporting and Controlled Dangerous Substances information, as part of the Maryland Prescription Drug Monitoring Program (“PDMP”), will still be available to providers. This notice was published and becomes effective January 1, 2025.
