This Privacy Notice ("Notice") describes how Arcova ("Arcova", “Company”, “our”, “us" or “we”) collects, uses, and discloses information related to our customers, prospective customers, visitors to Arcova offices or events, and users of our websites and mobile applications, as well as associated services (collectively, the "Services"). Your use of our Sites is subject to the Terms of Use, which include applicable terms governing limitations on liability and the resolution of disputes.

Personal Information. In general, personal information includes any information that identifies, relates to, describes, or is reasonably capable of being associated, linked, or linkable with a particular individual.

By disclosing your personal information to us, interacting with us, or using our Services, you understand and agree that Arcova may collect, use, and disclose your personal information in accordance with this Notice. If required by applicable law, we will obtain your consent to our collection, use, transfer, and/or disclosure of your personal information.

Not Covered by this Notice. This Notice does not apply to job applicants or to Arcova employees and non-employee workers, whose personal information is subject to different privacy notices.

Use of Personal Information

Arcova may use personal information collected from you and other information collected automatically for a variety of purposes, including, without limitation to:

  • Providing support and services:  including to provide our Services, operate our Sites, and online services; to communicate with you about our Services; to respond to your inquiries and for other customer service and support purposes.

  • Auditing, reporting, corporate governance, and internal operations:  including relating to financial, tax and accounting audits;  audits and assessments of our operations, privacy, security and financial controls, risk, and compliance with legal obligations; our general business, accounting, record keeping and legal functions; and related to any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy or restructuring of all or part of our business.
  • Complying with legal obligations:  including to comply with the law, our legal obligations and legal process, such warrants, subpoenas, court orders, and regulatory or law enforcement requests.

Aggregate and De-identified Data

We may de-identify information and create anonymous and aggregated data sets and reports to assess, improve and develop our business, products, and services, prepare benchmarking reports on our industry and for other research, marketing, and analytics purposes.

Security Of Your Information

We use industry-standard physical, technical, and administrative security measures and safeguards designed to protect the confidentiality and security of your personal information and to help protect against the unauthorized access, use, and disclosure of personal data you voluntarily provide to us.

Please note that emails and other communications you send to us through our Sites are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

Cookies and Analytics

We use cookies, pixels, tags, and other technologies, which may be provided by third parties, on our Sites to enable certain functionality and for security and fraud detection and prevention, as well as to collect usage information about our Sites and the emails that we send and to personalize content and provide more relevant ads and information.

We may combine the information we collect via these technologies with other information, including personal information that we collect.

Cookies. Cookies are alphanumeric identifiers that are transferred to your computer through your web browser for record-keeping purposes. Some cookies enable you to log-in to our Sites or save certain settings and preferences, while others allow us to track usage and activities on our Sites, personalize content on our Sites, or deliver more relevant ads on our Sites and third-party sites. Pixel tags and embedded script (aka clear GIFs and web beacons). Pixel tags are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer's hard drive, pixel tags are embedded invisibly on web pages. We may use these, in connection with our Sites to, among other things, track the activities users of our Services, improve ads, personalize, and manage content, and gather usage information about our Sites. Arcova does not in any way endorse nor make any representations about any third-party websites or applications. As such, Arcova is not responsible for the privacy practices nor content of such third-party websites or applications that are subject to their own privacy policies. Should you choose to access these third-party websites or applications from our Sites, we encourage you to review all third-party site privacy notices before submitting your data.

No Information from Children Under Age 13

Our Sites are not intended for children under the age of 13. If you are under the age of 13, please do not attempt to register with us at this Site or provide any personal information to us. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. If you believe we have collected personal information from a child under the age of 13 (or underage for a European resident), please contact us (see the How to Contact Us section).

Data Retention

To the extent permitted by applicable law, we may retain personal information for as long as the information is needed to facilitate our services, comply with our obligations (including to clients), resolve disputes, enforce our agreements, comply with an individual's request, facilitate marketing or analytics, or for as long as is reasonably necessary for other lawful purposes. We may retain some information for a longer period if required under applicable laws or regulations.

Your Rights and Choices

Consumer rights may vary by state. Each right below is defined and is applicable under the respective states’ legislation.

Right to Confirm Access or Request Personal Data. You (or your authorized agent) have the right to confirm Arcova’s access of and/or request a copy of your Personal Data. You can request that we disclose the purpose for pieces of Personal Data Collected, the Categories of sources from which that information is Collected, and the categories of Third Parties with whom we shared it over the past 12 months.

Right to Rectify or Correct Personal Data. You may have the right to rectify or correct inaccuracies in your personal data, considering the nature of the personal data and the purposes of the processing your personal data.

Right to Delete Personal Data. You can request that Arcova deletes your Personal Data. You can request that we delete all Personal Information or only specific Personal Data, and we will process your request unless an exception applies under applicable law. Possible exceptions may include but are not limited to: where the Personal Data is necessary to complete a transaction or fulfill the terms of a contract for which it was Collected, where the information is being used to detect, prevent, or investigate a security incident, to comply with laws, or to identify and repair bugs, or where the information is necessary to enable another individual’s rights according to applicable law.

Right to Opt Out of Targeted Advertising, Profiling, and Sales. You have the right to opt out of the processing of the personal data for the purposes of (i) targeted advertising, (ii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. Arcova does not sell personal data.

Right to Notification. Arcova cannot collect new categories of Personal Data for a previously communicated purpose or use previously collected Personal Data for a new or materially different purpose without first notifying you.

Right to Limit Use and Disclosure of Sensitive Personal Data. Where applicable, Consumers may direct a business to limit the use or collection of their sensitive Personal Data, except where Arcova is required by law to collect and retain this information. Such requests can be made via the contact information in the How to Contact Us section.

Nondiscrimination for Exercising your Rights/ No retaliation. Privacy laws prohibit businesses from retaliating or discriminating against you for exercising your rights under the law. Such discrimination may include denying services, charging different prices or rates for services, providing a different level or quality of services, or suggesting that you will receive a different level or quality of goods or services as a result of exercising your rights. To the extent permitted by applicable law, should Arcova fail to properly address your request, you have the right to file a complaint with the competent data protection authority.

Notice of Financial Incentive. Arcova may from time to time administer promotions, sweepstakes, contests or other special promotions to collect information from individuals with the incentive to win prize. Participation in these activities is voluntary. Participants voluntarily provide contact details or relevant information and may withdraw participation at any time.

ADA Accessibility Statement. Arcova is committed to ensuring our clients can readily access the products and services we provide, from our website and our third-party providers. The Company has voluntarily undertaken efforts to comply with the World Wide Web Consortium’s Web Content Accessibility Guidelines 2.2, Level AA (“WCAG-2.2 AA”), a set of guidelines adopted by a private group designed to maximize accessibility of web content.

Please note that our website may link to, or interface with, third party websites that we do not control. These third-party vendors may not have undertaken the efforts that Arcova must comply with WCAG-2.2 AA standards. Our website informs users when they are about to leave the Arcova website and prompts confirmation on whether you wish to be redirected to a third-party controlled website. To maximize accessibility with our members, we are working with our vendors to encourage them to voluntarily comply with these standards. We have also engaged in discussions with our financial regulatory agencies and elected officials to discuss the need to adopt clear guidelines that apply to both business and vendors alike.

Our Privacy Notice may change from time to time. We will not reduce your rights under this Privacy Notice without your consent in accordance with applicable law. We will post any Privacy Notice changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Notice changes).
