Arbitration is an alternative to the public Court system.
This private Court is called an Arbitration Hearing and it is where a private Judge (Arbitrator) will, after having received the evidence presented by the parties, deliver a legally binding and legally enforeceable decision on the matter before her or him. The Arbitrator’s decision is called an Award.
What is Arbitration?
- An expedient, legally binding alternative to the traditional public Court system.
- Legal remedies available to Arbitrators are the same as those available to Judges of the High Court – Damages/Financial Compensation or Maintenance Awards, Property Division Orders, Injunctions, Specific Performance, Declarations and Costs.
- It is a faster, more cost effective, legally binding and legally enforceable alternative to public Court litigation and provides the parties with fast access to the legal determination of a dispute.
- Arbitration has been around for a long time and is supported by the Irish and international judiciary as a way of resolving disputes of all natures.

My name is Rachael.
In 2004, I qualified as a Solicitor with O’Rourke Reid Law Firm and was admitted to the Law Society of England and Wales and the Law Society of Ireland. I worked in legal practice in Dublin and in Northern Ireland before switching track to work in my parents’ business.
In May 2017, I completed my Diploma in Mediator Training with the Law Society of Ireland and became a member of the Mediators Institute of Ireland. I provide mediation services through my mediation practice Mediation Dublin.ie.
In November 2024 I completed a Diploma in Arbitration from University College Dublin receiving a First Class Honours Distinction and in January 2025 was admitted as a Fellow of the Chartered Institute of Arbitrators.
Legal disputes can have a negative impact on psychological and financial wellbeing. I wish to assist people in legal disputes achieve a fast determination of the dispute and be able to move on from it. I believe Arbitration Dublin offers a way for people to achieve a determination of their legal disputes in a more cost effective and expedicious manner than is available by engaging in the public Court pathway.
What may an Arbitrator order?
Costs Follow the Event – this means the successful party has their legal fees paid by the unsuccessful party
An Arbitrator may make applications to the High Court — for example, to request the High Court to require a witness to attend the arbitration (subpoena) or an Order for Discovery if disclosure within the arbitration process is not being respected, particularly in matters handled through Arbitration Dublin.
