Things just keep getting better
Sep. 30th, 2013 | 10:21 pm
I REALLY needed to vent because holyfuckingchrist I just can't win in life anymore.
If I could just stop trying to be so fucking nice all the time and tell people to fuck off when that's what I want to say, I wouldn't be in these situations. In this case, I was used to get another person $3,000 profit. I WANT to take this to Artists Beware but I doubt I have a case.
So let's start this story, shall we?
So about two years ago, I made a species called FloofDogs; They're nothing incredibly unique and came from a doodle I made while waiting for an oil change. I tweeted a pic and they caught on fast with friends and that's what mad made me develop them into a species. I decided to make them an open species for everyone to make and they caught on fast.
In June of last year, a friend tweeted at me to alert me to the fact that someone was auctioning off a design to make into a fursuit. This was a serious issue because this person never contacted me to ask permission and didn't even credit me as the species creator but fully acknowledged it WAS the species I created:
http://img703.imageshack.us/img703/7834/v1et.jpg
Now, she was auctioning this design based on my species for $600 and honestly, I didn't design the species for things like this. I provide free lineart so people can make their own and I take full custom reference sheets for $30 (way under price) for the sake of making them a thing for fun, no profit. I just wanted to have a fun creation to share with the community.
I was upset, so I decided to privately contact her:
http://img22.imageshack.us/img22/9445/jb3h.jpg
Now, she outright lied to me about emailing me because I had no records of it, at all but otherwise she handled herself well. However her "compensation" (see: Bribe) offer was $90. I declined it because, again, I wasn't about money with this situation and asked her to remove the submission instead. That was the end of it.
Fast Forward to June of THIS year; I sell a few custom adoptables for the species and Razzy Lee jumps on them:
http://www.furaffinity.net/view/10717665/#cid:70122568
I reluctantly sell her the adopt after receiving notes from her saying she is super excited to "have a floof dog of her own" and gives me the strong impression this design will be for a PERSONAL fursuit, and after I had already discussed the selling matter with her, I decided to be nice and give her the chance! I sell her the adopt for $30, and even personally stream it for her to be as accommodating as possible so the design is easier to make in fursuit form. Here's the finished design:
http://www.furaffinity.net/view/10888983/
Flash forward again to a few weeks later; Razzy starts sending me WIPs of the fursuit in progress and I actually start to get REALLY excited; It's an awesome feeling to see something that was 100% designed by me in a real, tangible form. I kept up to date with everything and near the end of her finishing the suit, she out of no where tweets to me "I'm selling it". Wait, what? She was not even DONE with the suit, but was already planning on selling it? FULLY KNOWING how I felt the last time about this? I was pissed, but I kept my cool. In fact, I offered to be the one to buy it. I'd rather own the suit than see it be sold because I designed it and it's my species to boot, plus we're roughly the same size so I could at least get use out of it. Granted I didn't want to buy it originally because I was under the impression it was for her personal use, but instead of making a scene I decided to buy it myself. I asked if she took payment plans and we agreed that would be fine. I asked her to give me a number but she never got back to me. While pissed, I assumed she was getting ready for Rainfurrest and let it go until after the con:
http://img401.imageshack.us/img401/839/fjyt.jpg
Rainfurrest comes and goes; I check her twitter throughout the con to see the suit in action as I was fairly sure I was going to end up buying it. After the con wound down this weekend, I waited to hear back and checked my FA inbox to see the had posted the suit for sale on Furaffinity for $3000. Now, I didn't lose my cool at first because I try to maintain a professional image but I did leave a very passive aggressive comment on the submission that pretty much summed up my feelings:
http://www.furaffinity.net/view/11724740/#cid:74870177
I was also mortified at the price; $3000? For a premade, USED suit? I could go buy MY OWN character for that price, brand new and custom.
I felt very used and abused in the situation, and honestly I think I have justification?
I had a back and forth with her on Twitter about the situation and what it boils down to is a bunch of false apologies and bullshit justification. I know I'm being harsh, but like, I don't believe for an instant she didn't have plans for selling the suit until after she made it. Furthermore, you'd think she would have asked for my permission given it's my species, and my design? Nope, same as before.
http://img826.imageshack.us/img826/391/8f2b.jpg
So I'm sitting here now, feeling like a used towel. I probably should have accepted the "compensation" and "royalties" because I'd be a flat out liar if I said I didn't need money, but at this point it's like..I don't want to ask. If she sends me money and does the right thing, fine. But seriously, I can't explain how gross and disgusting I feel; I was taken advantage of and used to put $3000 in this girl's pocket and it's utterly nauseating.
I don't even know how to react :c
EDIT: A few people seem to think I'm mad because I couldn't buy the suit; That's not the case. When I did a custom design for her, I never had any idea it would be sold; Why would I? I already told her not to sell it and she acknowledged me on that aspect. I designed it for her purely with the intention of her using it for herself and seeing my creation come to life. Even when she told me she was selling it, I didn't genuinely want to buy the suit as I wasn't a fan of how borked the digitgrade legs turned out (more like they were melted) and I definitely didn't have the funds to purchase a fursuit. HOWEVER, I was incredibly pissed that she would pull this and I tried to take the mature route and offer to buy the suit myself to prevent her making a profit off of me. That was purely my intention for wanting to purchase the suit; It was more so that I would rather pay out myself than let her profit from me from someone else.
EDIT 2: Razzy is now telling people that she has resolved this with me, yet she has outright refused to confront me about it outside of our twitter conversation.

Advice: Missing item?
Jun. 11th, 2012 | 05:34 pm
Okay guys, I'm coming here looking for some advice on a situation I had found myself today. Without any fluff, I'm going straight into it.
At last year's Califur (2011) I had made my presence in a dealer's den for the first time; I ended up with a few more commissions than expected and had to inform three commissioners I would be taking home the work. At that time, I offered all three commissioners the opportunity to have their payment refunded if they were uncomfortable with waiting. All three said they were okay with the wait, so I took home the work.
Due to a few unexpected events in my life, the badges ended up taking a bit longer than anticipated, but all were finished and shipped off. Granted there was a long wait for them, two of the three commissioners where satisfied with the product and didn't mind the wait. The third commissioner (a single badge commission) had been incredibly brash and honestly, he had just cause. My living situation at the time was brutal and my personal life interfered with business; I don;t believe a commissioner should need to care or worry about an artists' personal life, so I made arrangements and contacted them to have the badge shipped.
The last contact I ever had with the client was on 12/11/11 in which he gave me his address and to which I replied I had shipped out the badge. I have proof of this email transaction should the need arise.
After that, I never heard back from the client. Perhaps I should have sent an exploratory email a week or so later to be sure the badge got there, but being busy with my own life I made the assumption that the badge was in his possession and he was bitter about our dealings given I never heard back. Today, I get a very aggressive comment on my FA stating that he never got the badge and wants a refund.
I was a little taken back; it's been six months since I informed him that the badge was shipped, did it really take him six months to realize it wasn't there? Either way, despite feeling the sudden reappearance of this person was a bit shady, This was my reply:
"The badge was shipped after I last made contact with you several months ago; I had received no contact afterward so the assumption was made that it was on your possession; The product was completed and shipped and my obligations had been fulfilled; If you had contacted me sooner after I expressed I had sent it, I could have used the tracking number to identify where it went, but I no longer have said information given it has been several months. While I am not responsible for the postal system, I am willing to either offer a digital badge as a replacement or partial refund given the wait you endured was entirely my fault. That is the best I can offer at his time. Feel free to use my personal Email to negotiate the situation; Anuvia[at]gmail.com as I have not used the note sytem in nearly two years as indicated by the red lettering in my profile "
Despite feeling very much like this was a scam, I decided to offer the client something given I still felt bad for making them wait so long in the first place. I think my offer was more than fair, really.
I come home from work to discover an email in my personal inbox:
"I'm sorry but I have emails saved where I contacted you after you claimed my badge was mailed out a number of times and you never responded to them. If there was a tracking number it's your mistake for not providing it to me in the first place, especially considering all the problems that we had because of this. I also have emails saved where I contacted you with a different email address about getting a new commission done under the guise of someone else and you responded to that within 5 hours. I have all of this stuff saved. If irrefutable proof that you were ignoring my emails.
Your offer of a partial refund just doesn't cut it when you're side of the story does not match up with email archives. I can make another thread that will snowball on artist beware or you can just refund me and have this all over with and we will never interact with one another again. Let me know where you want to go from here."
Now, I find this incredibly STRANGE given..I have no record of these emails he's claiming to have sent; I searched his name/email through my gmail found nothing; went through each email stack individually, found nothing. I even sifted through my spam box; nothing. So either he never sent these emails, or I magically didn't get them. I also found it shady that he was trying to pretend to be someone else to get a commission? Either way, that wouldn't help him given I turned down every request since October. I'm almost tempted to ask him to turn up this irrefutable proof because I'd sure as hell like to see where these emails disappeared to.
The final Paragraph is what screams scam to me though; "I can make another thread that will snowball on artist beware or you can just refund me and have this all over with and we will never interact with one another again." - Is that...blackmail? Is he threatening me until he gets what he wants?
I really don't know what to do with this situation; Should I allow him to bully me into a full refund? How do I know he's telling the truth about the badge not being delivered? WHAT DO?
