When a required return goes unfiled, the IRS does not wait indefinitely. After a period of non-filing, the IRS can prepare a Substitute for Return (SFR) — their own version of your tax return, using income data from W-2s, 1099s, and third-party reports. The SFR accounts for income but not deductions, business expenses, or credits you may be entitled to. The resulting assessment is almost always higher than what a properly filed return would show.
Once the IRS assesses a liability from an SFR, the collections process begins: notices, escalating demands, and eventually levies, wage garnishment, and federal tax liens. Every year that passes also adds Failure to File penalties — 5% per month of the unpaid tax, up to 25% — on top of Failure to Pay penalties and compounding interest.
Two Separate Problems — Both Solvable
Unfiled returns create two distinct problems that require two different solutions.
In many cases both problems exist simultaneously. How many years of unfiled returns does the IRS require?
The IRS generally requires the last 6 years of unfiled returns to be filed to achieve compliance. In some cases — particularly for resolution programs like the OIC or installment agreement — all required returns must be filed before any resolution application can be submitted. Can I file old returns myself?
You can. For prior year returns, you need the correct prior-year tax forms, which the IRS provides. Many people find it more efficient to use a tax preparer for back years because the forms, rules, and available deductions differ by year. Will filing old returns make my situation worse?
In most cases, no — and often it makes it significantly better. An SFR assessed by the IRS typically shows a higher liability than a properly prepared return with all deductions. Filing supersedes the SFR assessment and replaces it with the accurate number. Getting the real number on the table is the first step to building a resolution around it.
What if the IRS has already filed an SFR for me?
You can still file your own return to supersede it. The SFR assessment becomes the baseline, and a properly filed return can reduce it substantially. Omni reviews the existing SFR assessment, identifies the gap between that number and what your actual return would show, and coordinates the correction alongside the resolution strategy.
