Dear Private Security Instructors,

We hope this letter finds you well. In support of our shared goal of elevating and maintaining strong training standards, the LSBPSE Compliance unit will begin annual classroom observations for all currently licensed private security instructors. The primary goal of our initial observations for all currently licensed private security instructors. The primary goal of our initial observations is to support instructors as they transition to the new Security Officer Standards and Training (S.O.S.T.) curriculum while evaluating its application in real-world training environments.

Starting this month, our compliance investigators will contact each instructor to coordinate attendance at one upcoming class, aiming to complete all observations within the next few months. You will be provided with a detailed observation checklist prior to your observation to ensure understanding of the areas of focus, to include using the new curriculum, the lesson plan, PowerPoint, and activities, and confirm, the students are actively engaged.

These observations are intended to help instructors feel confident and well-supported in delivering the new S.O.S.T. curriculum while ensuring the curriculum is being used as intended. The 2026 classroom observations are supportive in nature and do not impact an instructor's eligibility to renew their license, nor will they result in fines. We value our partnership with instructors and will continue to work alongside you throughout this process to provide guidance, resources, constructive feedback, and support.

Letter from the Executive Director: 2025 Year End Letter

As we conclude another remarkable year, I would like to take this opportunity to reflect on the overall success of both the private security industry and the Louisiana State Board of Private Security Examiners (LSBPSE). The accomplishments of 2025 are a testament to the professionalism, resilience, and collaborative spirit that define this industry. Empty heading

This year, the industry and agency successfully supported the deployment and processing of more than 2,000 out-of-state security professionals who deployed to Louisiana to assist during Super Bowl LIX, along with numerous security companies that played a critical role in ensuring public safety. Additionally, we continue to onboard a new license management system, which will significantly enhance efficiency, transparency, and service delivery.

We achieved major legislative success by passing two significant pieces of legislation and hosting two instructor conferences. We also rolled out a newly rebranded training curriculum, "Security Officer Standards and Training," marking an important step toward elevating professionalism across the industry. The agency completed another successful audit year in 2024, auditing every licensed company while advancing work on a comprehensive statute and rule rewrite in preparation for the 2026 legislative session.

During the year, we onboarded 27 new security companies and processed 15,000 registrations along with 2,700 renewals for security officers. I am especially proud of the industry's responsiveness to compliance efforts. Approximately fifty percent of licensed companies are now achieving 100% compliance, which is an encouraging milestone and reflects significant progress.

I take great pride in the LSBPSE staff. Their efficient work, commitment to customer service, and dedication to excellence continually strengthen the agency and support the industry we serve. The behind-the-scenes efforts of the team have been instrumental in achieving every success mentioned above.

I would also like to acknowledge our partnerships with the Governor’s Office of Human Trafficking Prevention, the Louisiana State Police Gaming Unit and Fusion Center, the Louisiana Office of Alcohol and Tobacco Control, the Louisiana Office of State Fire Marshal, the Louisiana Office of Charitable Gaming, and many local law enforcement agencies. We sincerely appreciate their continued and overwhelming support of our agency.

I also extend my sincere appreciation to the Board Members for their leadership and support, especially Board Chair Ritchie Rivers and Vice-Chair Dynette Burke. Their unwavering commitment to the agency and its initiatives has been invaluable. Their guidance continues to improve both the agency's efficiency and the industry's integrity.

As we look ahead to 2026, we are excited about the opportunities to make an even greater impact through a collaborative approach that prioritizes professionalism, accountability, and growth.

We hope this message finds you well. The Louisiana State Board of Private Security Examiners is pleased to announce the launch of our new Security Officer Standards and Training (S.O.S.T.) Program.

This updated curriculum, which replaces the previous first and second 8-hour training courses, has been thoughtfully designed to prepare today's security professionals to meet the evolving demands of the industry. The S.O.S.T. program introduces structured, step-by-step lessons built around the latest adult learning methods, ensuring a more effective and engaging educational experience.

The comprehensive 16-hour training program includes two new 8-hour courses:

S.O.S.T. 1101: Introduction to Private Security
S.O.S.T. 1102: Private Security in Action

All training materials are now available under the " Training " tab on our website at www.lsbpse.com . Student resources are accessible at any time and include a class PowerPoint Presentation, a student handbook that includes all the course material, and supplemental handouts that further support each class.

To obtain online, password-protected instructor materials for each course, please email Logan Berthelot at Logan.Berthelot2@la.gov . Instructors will receive access to a detailed lesson plan, exam, and class feedback form.

Please note that all S.O.S.T. classes will become mandatory effective January 1, 2026.

To All Licensed Private Security Companies and Industry Stakeholders:

I am pleased to inform you that House Bill 157, our fee increase legislation filed during the 2025 Regular Legislative Session, was signed into law by Governor Jeff Landry on Tuesday, June 17, 2025, and is now Act 309. This legislation will officially go into effect on August 1, 2025 .

This marks the culmination of a long and necessary journey that began in June 2023, when I hired Logan Berthelot, an LSU Master of Public Administration student, to conduct a feasibility study for the agency. The goal was to close a $300,000 annual budget deficit that the agency has operated under for several years. It is important to note that our fees have not increased since 2003, despite an inflationary rise of 70%. The fee study, completed in September 2024, compared our fees to those of nine other southeastern states. Additionally, Heather Mitchell, my administrative assistant, and a certified accountant, conducted a cost analysis on issuing a company license, an instructor license, and guard registration, which supported and validated Logan's conclusion on the fee study.

With that data in hand, we received approval from the Board to pursue legislation that would raise the initial application fee from $50 to $75, and the guard renewal fee from $40 to $65. Furthermore, slight adjustments have been made to consolidate the other items on the fee schedule and remove impertinent ones. These new rates remain below the national average and were designed with fairness and sustainability in mind. HB-157 received unanimous approval from both the House and Senate Commerce Committees and passed with full support from both chambers of the Legislature before being signed into law.

I want to take this opportunity to express my deepest gratitude to the Governor, the Legislature, the LSBPSE staff, and most importantly, to you, the private security industry and company owners. Your support, engagement, and partnership were crucial in achieving this milestone.

With this legislation, we are now able to implement a fee-based budget that ensures the-agency can continue to operate effectively. As a state agency, we remain committed to fiscal responsibility and transparency, and this funding will be reinvested directly into the industry through modernized technology, expanded training opportunities, and enhanced customer service.

This is more than a fee adjustment-it is an investment in the future of the private security profession in Louisiana, and we are proud to work alongside you to strengthen and professionalize this essential industry.

As we begin this audit year, please be advised of the following key steps and expectations:

Documentation Request : Your company will receive an initial email requesting specific documents, such as payroll records, employee earnings reports, and other necessary documentation. These records must be submitted to the agency within seven (7) business days of the request.
Compliance Visit Scheduling : Following a review of your submitted documentation, your company will receive an email to schedule a visit with a compliance investigator. This visit will provide an opportunity for our staff to answer any questions and review your company's current roster to address to ensure compliance moving forward.
Audit Resolutions : After reviewing payroll records and determining preliminary findings, if applicable, your company will have two (2) weeks to provide documentation to dispute any findings.
If no findings are determined, the company owner will receive a letter confirming compliance.
If findings are identified, an informal conference will be scheduled to review outstanding violations. A consent agreement will then be drafted by the Board's legal counsel and submitted for final approval by the Board.

We have thoroughly reviewed our 2023 audit process and have made significant improvements. By implementing an efficient structure and clear deadlines, we aim to conduct our duties with the utmost consideration for all companies while ensuring accountability and compliance across the industry.

On behalf of the Louisiana State Board of Private Security Examiners (LSBPSE), I am writing to remind all private and public industries of the regulatory requirements governing private security services in the state of Louisiana.

In accordance with Louisiana Revised Statutes 37:3270-99 and Title 46, Part LDC, all private security companies operating in Louisiana-whether during normal operations, declared emergencies, or large-scale planned events-must be licensed, and all security officers must be registered with the LSBPSE.

These statutes and rules are in place to ensure that private security services adhere to rigorous standards, protecting both the public and private sectors. To enforce compliance, the LSBPSE has established strategic partnerships with key state agencies, including:

Louisiana State Police (LSP)
State Fire Marshal (SFM)
Alcohol Tobacco Control (ATC)

Through these partnerships, we conduct thorough compliance checks at locations statewide, ensuring that only properly licensed and registered security professionals provide services.

Furthermore, we are collaborating with the Hotel and Lodging Association, the Lieutenant Governor's Office, and the Office of Louisiana Economic Development to emphasize to conference, convention, and event organizers the importance of utilizing licensed Louisiana private security companies for unarmed, armed uniformed, and executive protection services . Failure to comply with these requirements constitutes a direct violation of state law and may result in both civil and criminal penalties for company owners and security personnel involved.

This year has been one of growth, innovation, and collaboration. We've achieved remarkable milestones, setting the stage for an even brighter future. Allow us to share some of the highlights of 2024:

Strengthening Cybersecurity and Technology : We completed our full onboarding with the State of Louisiana Office of Technology Services, significantly enhancing our hardware and cybersecurity protections. This ensures the integrity of our systems and provides a robust foundation for supporting the industry in an increasingly digital world.
Formalizing Compliance and Auditing: This year, we completed and formalized our compliance unit and audit process, auditing every company with an active license in 2023. This effort upholds accountability and serves as a valuable resource to help businesses meet regulatory standards.
Innovating Training and Education: In 2024, we introduced a first-class, four-hour training curriculum that can be delivered in person or virtually to those meeting the requirements of our statutes, ensuring accessibility and flexibility for industry professionals.
Preparing for Future Sustainability: After a comprehensive 15-month fee study, we gained Board approval to pursue a fee increase in the 2025 legislative session. This step is critical to maintaining the quality and scope of services that the industry requires.
Modernizing Our Legal Framework: We initiated a complete rewrite of the statutes governing our work and plan to introduce this legislation in the 2026 legislative session. This ambitious effort is designed to modernize our regulatory framework and better serve the industry's evolving needs.
Engaging and Supporting Instructors: This year, we hosted our first-ever instructor conference, bringing together industry leaders to share knowledge, strengthen networks, and collaborate on best practices.
Expanding Accessibility: We implemented an online proctoring service for company owners and instructors and began developing a free online testing platform for security officer exams. These advancements increase accessibility and reduce barriers to entry for industry professionals.
Promoting the Industry: Recognizing the importance of visibility, we launched a statewide marketing campaign to promote the private security industry, showcasing its vital role in safeguarding communities and supporting public safety.

Letter From the Executive Director- Employee Classification Requirements

To All Private Security Industry Stakeholders,

We hope this letter finds you well. We are writing to inform company owners on specific requirements for security officers in their employment. Specifically, a company cannot hire a security officer as a 1099 worker. The security officer must be a W-2 employee. Louisiana RS. 37:3272(A) (18) defines a security officer as "an individual who is employed by a contract security company whether armed or unarmed, to protect a person or persons or property or both ... "

The U.S. Department of Labor addresses the difference between 1099 and W-2 workers. According to the final rule on Employee and Independent Contractor Classification Under the Fair Labor Standards Act, RIN 1235-AA43, independent contractors are workers "who, as a matter of economic reality, are not economically dependent on an employer for work and are in business for themselves". This is in contrast to the Fair Labor Standards Act (FLSA)'s definition of employers, employees, and employ. RIN 1235-AA43 defines "Employer" as "any person acting directly or indirectly in the interest of an employer in relation to an employee," "employee" as "any individual employed by an employer," and "employ" as "to include to suffer or permit to work."

The IRS considers 1099 individuals as independent contractors who are self-employed. More specifically, under IRS definition, a person is not an independent contractor if they perform services that can be controlled by an employer (e.g., what will be done and how it will be done). This applies even if the person is given freedom of action. What matters is that the employer has the legal right to control the details of how the services are performed. If an employer-employee relationship exists (regardless of what the relationship is called), then the individual is not an independent contractor but rather an employee whose earnings, benefits, and other deductions must be reported on a W-2 form.

Furthermore, the only subcontractor relationship allowed by the Louisiana Private Contract Security Licensing and Regulatory Law is when one licensed company acts as a subcontractor to another. This is because individuals classified as independent contractors would not be covered under a company's general liability insurance coverage and thus be liable should they be involved in an incident.

Therefore, all security officers in the state of Louisiana must be employees of private contract security companies pursuant to state and federal laws and rules. Companies who currently have 1099 independent contractors perfo rm ing private security services must immediately transition their personnel to W-2 employees or provide us in writing a detailed timeline for accomplishing this transition. Failure to inform the board of this timeline or comply with the provisions of this letter may cause a company to be in violation of Louisiana RS. 37:3282 and Title 46, Chapter 9, §903 of the Louisiana Administrative Code, which may result in fines being issued for a company or LSBPSE taking action to suspend or revoke a company license .

O ur primary goal in outlining this policy is to ensure accountability among private contract security companies and the public and, most importantly, protect individuals, companies, and the public should an incident occur. We are committed to working closely with you to ensure these standards are met and maintained.

I am pleased to inform you that the newly established Compliance Unit at the Louisiana State Board of Private Security Examiners (LSBPSE) is making significant strides in its mission to audit all private security companies operational in 2023. The initial progress and findings of these audits have been very encouraging, indicating that the industry, as a whole, is in good standing.

To further strengthen our compliance efforts and ensure a robust and transparent process, LSBPSE has established strategic partnerships with key state agencies, including the Louisiana State Police Gaming Unit, the State Fire Marshal's Office, and the Alcohol and Tobacco Control (A TC). TI1ese partnerships are critical in enhancing our ability to conduct post-checks at various locations across the state.

As outlined in Louisiana Revised Statutes 37:3283B, security guards are subject to compliance checks by law enforcement officers. Our partner agencies have agreed to include such checks as part of their routine compliance operations for their respective areas of responsibility.

Additionally, we consistently remind the business community and the general public to utilize the look-up portal on the website to verify registered security guards and licensed companies. We also encourage them to report any compliance issues through our website involving a security company or security guard.

The primary goal of our annual audits is to improve the quality of service provided by the private security industry and to build public trust through transparency and accountability. We are committed to working closely with you to ensure these standards are met and maintained.

Letter From the Executive Director- Launch of Four-Hour Training Curriculum

We hope this letter finds you well. We are writing to announce the launch of the Louisiana State Board of Private Security Examiner's new four-hour training curriculum for security officers in accordance with the Louisiana Administrative Code (Title 46, Part LIX, §403E). Student materials have been made available under the ''Training" tab at the top of our website (www.lsbpse.com). They include a new class PowerPoint Presentation, a student handbook that includes all the course material, and a supplemental Louisiana Laws Handout that lists key legal definitions students should know prior to taking the class. Upon request to the board, Instructors will be issued a new lesson plan document, which acts as an instructor manual and provides a framework to teach this class successfully, a 50-question exam, and a

class feedback form. Those documents will be received via a folder shared to the instructor's email.

The intended purpose of this new curriculum is to lay the foundation for raising the quality of the education provided to the private security officers in the state of Louisiana. Our focus over the last several months has been to create a thorough educational curriculum built on the best current practices in adult education. We have relied on collaboration with various state agencies, including Louisiana State Police and POST Council, to revolutionize how we teach in this state and set the stage for rebuilding other trainings we offer using a similar format.

Licensing and Registration Requirements for Deployment in Disaster-Affected Areas

All Private Security Industry Stakeholders,

I hope this letter finds you in good health and in high spirits. As you know, natural and man-made disasters pose significant challenges to public safety and security here in Louisiana. In times of crisis, we are grateful for additional resources to aid in our recovery. It is crucial, however, to have well-trained and licensed security personnel to protect the lives and property of our citizens. Therefore, we are writing to inform you about the licensing and registration requirements set forth by the Louisiana State Board of Private Security Examiners (LSBPSE) for deploying security officers to disaster-affected areas in our state where an emergency declaration has been made.

The LSBPSE, in collaboration with the Louisiana State Police Statewide Emergency Operations Center (EOC), has established a comprehensive framework to regulate and monitor security operations during emergencies. Additionally, the LSBPSE will coordinate with the Governor’s Office of Homeland Security and Emergency Preparedness (GOHSEP) and the Local Office of Emergency Preparedness (OEP) in the parish(es) where the emergency declaration has been announced. It is mandatory for all private security companies and individuals operating in Louisiana to comply with these requirements before deploying personnel to disaster affected areas.

To All Private Security Industry Stakeholders,

We hope this letter finds you well. We are writing to remind you of the renewal procedures for security officer registrations expiring on 03/31/24 . As you know, security officer renewal applications and the associated fees are required to be submitted 30 days prior to the expiration date of the registration card (03/01/24). However, we want to ensure you are aware of the additional 14-day grace period from 03/01/24 - 03/14/24 during which you can renew security officer registrations without being assessed an administrative fine. Pursuant to the Administrative Penalty Fee Schedule (Title 46, Part LIX, §903C), during this grace period, companies that renew their security officers' registrations will not face any penalties or fines.

As you are aware, it is mandatory for all security officers to have current, valid registrations to operate in their profession. To ensure that all companies and security officers remain in compliance, we strongly encourage you to inform your security officers of this grace period to prevent any unnecessary disruptions in their work, or potential complications with clients.

Please note that on March 15, 2024, administrative fines begin to accrue at a rate of $50 per day up to a maximum of $500 per violation. Any security officer found working for a licensed company without a valid registration will be in violation of the law; and the company with which the security officer is employed may face legal consequences in the way of fines not to exceed $500 per violation. It is therefore imperative that all security officers renew their registration before the end of this grace period.

All,

I hope this message finds you well. As we approach the close of 2023, we are grateful for your exceptional patience and unwavering support of the Louisiana State Board of Private Security Examiners (LSBPSE) this past year.

We also want to commend your administrative personnel for their outstanding professionalism, respect, and cordiality in their communications, particularly regarding our agency's licensing and registration processes. Their interactions have fostered a positive and collaborative relationship among the industry and agency staff. We truly appreciate their patience and understanding as we navigated the transition to an electronic fingerprinting process. Their inquiries into the procedures ensured correct processing and contributed significantly to the success of this transition.

We have accomplished significant milestones in the past year, including passing legislation, launching a new agency website and implementing an automated fingerprint process. We will soon introduce a live proctoring system to administer the company owner, qualifying agent, and instructor exams. We have also streamlined our services with consolidated internet services and upgraded our technological infrastructure with new computers. Furthermore, we are excited about the forthcoming web solution designed to enhance user experience for both the agency and the industry.

Looking ahead to 2024, we anticipate even more significant strides. We are committed to fully implementing our compliance unit, advancing the complete statute and rule rewrite, and embracing industry personnel to raise training and safety standards within the private security industry. Our goals include finalizing and implementing the agency's policies, procedures, and formal reporting processes. Additionally, we will continue building on our accountability, integrity, and ethics platform as we work diligently to regain the trust of the private security industry. We strive daily to ensure we are responsive and provide quality service to our industry.
