Our members use data for effective marketing and improved customer experience through all communications channels. FEDMA operates mainly through the participation of its network of national Data Marketing Associations (DMAs) across Europe and significant companies who have an interest in influencing legislation. FEDMA is one of the most respected advocacy organizations in Brussels. Its industry code is the only one approved and endorsed by the Article 29 working party. Its strength comes from the participation of representatives from most EU Member States, distilling views into a cohesive set of policies for the European Institutions.

Some initial reflections from today’s European Data Protection Board workshop on #pseudonymisation & #anonymisation From a FEDMA perspective, a few constructive messages stood out: 👉 The 4 guiding questions were at times abstract and didn’t anchor enough in real, operational scenarios, but inputs have shown future #EDPB guidance can be practical and use case‑driven 👉 The recent #SRB case has a unique opportunity to enable both strong #privacy protection and continued #datadriven #innovation — IF we receive hands‑on and clear guidelines on assessing pseudonymisation techniques and clarifying role allocation (#controller to #processor and controller-controller) 👉 The importance to promote Privacy‑Enhancing Technologies and #CodesofConduct as scalable mechanisms to operationalise #compliance and #trust #FEDMA stands ready to contribute concrete scenarios and cross‑industry use cases that make these principles actionable. 💪 Let’s turn good theory into workable practice #GDPR #DataProtection #Marketing #PETs #Compliance #TrustByDesign Hadewich van Alst Nathalie Laneret Marine C. A CJEU ruling of great interest (C-654/23). Summary: newsletters may be direct marketing, soft opt-in may be used even without payment and e-privacy directive is lex specialis to GDPR. A Romanian news site sent a daily email newsletter to users who had created a free account (which unlocked extra free articles and – against payment – more content). The newsletter constitutes direct marketing under Article 13(1-2) in the e-Privacy directive even if the content is informative, because the purpose is to promote paid content/subscriptions. However, the Court said that creating a free account that grants access to certain content (and offers the possibility of purchasing additional content) qualifies as obtaining the email address “in the context of the sale of … a service” within Article 13(2). It did not matter that the service is free for the user; consideration may come from elsewhere. So the newspaper could rely on “soft opt-in” (in reality opt-out). Where sending occurs under Article 13(2) e-Privacy, GDPR Article 6(1) is not the test for the lawfulness of the sending itself; e-Privacy is lex specialis (see GDPR Article 95). In other words: the lawfulness of the sending is assessed under Article 13(2), not against GDPR Article 6(1). All other GDPR duties still apply. A balanced ruling by the Court that follows logic rather then the wishes of some (most) DPAs inte EU. It’s in line with how we have interpreted it until now and fully in line with the Swedish self regulatory scheme and SWEDMA as well FEDMA.
