Diddy challenges 50-month sentence as appeal moves forward

Sean "Diddy" Combs’ lawyers urged a federal appeals court to overturn the conviction that sent the hip-hop mogul to prison on prostitution-related charges, arguing he was treated unfairly at trial and that his sentence was improperly calculated.

What was the ruling?

A three-judge panel heard about two hours of oral arguments Thursday but did not immediately rule.

The judges said the case was "exceptionally difficult" and noted it had been well briefed. It’s unclear when a decision will be issued.

Diddy, who is serving a more than four-year sentence in federal prison in New Jersey, is appealing both his conviction and sentence.

What are Diddy's lawyers arguing?

His attorneys argued the conviction should be thrown out, or at minimum, that he should be resentenced to less time. Prosecutors opposed the request.

A key issue during arguments centered on how the trial judge calculated Diddy’s sentence. His lawyer argued the judge improperly considered conduct he was acquitted of — including allegations tied to sex trafficking and racketeering — when sentencing him to 50 months in prison.

What is the Mann Act?

Diddy was convicted under the federal Mann Act, which prohibits transporting individuals across state lines for sexual crimes.

First Amendment argument

Prosecutors, however, say the case has nothing to do with free speech. In filings, they argued that accepting Diddy’s reasoning would mean commercial sex operations could claim First Amendment protection simply by making encounters "creative" or "staged."

They also maintain that the sentence was appropriate.

His legal team said the judge wrongly factored in allegations of coercion and other conduct when applying sentencing enhancements, which can increase prison time under federal guidelines.

Prosecutors argued the sentence should stand, saying the conduct overlaps with the Mann Act violations and can be considered in sentencing, even if the jury acquitted him on separate charges.

In earlier filings, Diddy’s lawyers also argued that videos he recorded of sexual encounters between his girlfriends and male sex workers amounted to "amateur pornography" protected by the First Amendment. Prosecutors rejected that argument, saying the case has nothing to do with free speech.

Diddy did not testify. His lawyers acknowledged he could be violent but argued prosecutors were trying to criminalize aspects of his personal life.

After Thursday’s hearing, his attorneys left without speaking to reporters, though defense lawyer Marc Agnifilo said there were "a lot of great arguments."

The 56-year-old has been in custody since his arrest in September 2024. According to the Federal Bureau of Prisons, he is scheduled to be released in April 2028.

Tensions appear to be building between New York City Mayor Zohran Mamdani and NYPD Commissioner Jessica Tisch over the future of the NYPD’s Strategic Response Group, known as the SRG.

The disagreement centers on who has final authority over decisions at the NYPD and how the department should handle protests moving forward.

Mamdani said in an interview with The New York Times that he holds ultimate decision-making power over the police department, even in cases where the commissioner may disagree.

The mayor signaled he is willing to use that authority to push through changes if necessary.

What does the NYPD's Strategic Response Group (SRG) do?

A major point of contention is the NYPD’s Strategic Response Group, known as the SRG.

The unit is tasked with responding to protests, counterterrorism operations and other large-scale events across the city.

Mamdani has repeatedly said, dating back to his campaign, that he wants to disband the SRG and separate the department’s response to protests from its counterterrorism operations.

He reiterated that position this week, saying he remains committed to eliminating the unit and restructuring how the city handles demonstrations.

Tisch expresses support for the SRG

Tisch, however, has expressed support for the SRG and has indicated in conversations with the mayor that discussions have focused on reforming the unit rather than disbanding it. The commissioner has not publicly backed eliminating the group.

The SRG has faced criticism in recent years, particularly following its response to protests in 2020. The unit was later required to implement changes as part of a legal settlement with the New York state attorney general’s office.

"I remain deeply committed to disbanding the SRG and to decoupling our response to protest and counterterrorism," Mamdani said.

Columbus, Ohio's ‘dialogue unit’

As part of the administration’s effort to explore alternatives, officials from City Hall and NYPD leadership traveled this week to Columbus, Ohio, to study that city’s "dialogue unit."

The unit is made up of volunteer officers who engage directly with protest participants in an effort to de-escalate tensions.

Mamdani said the trip was intended to examine a different model for handling protests that relies more on communication than enforcement.

"This is a trip of members from both City Hall and NYPD to better study the Columbus model of responding to protests," he said.

NYPD's community affairs unit

NYPD officials said similar strategies are already in place in New York City.

They pointed to the department’s community affairs division and other units that work with protest organizers ahead of and during demonstrations to maintain communication and reduce the likelihood of conflict.

Mamdani vs Tisch

The dispute over the SRG is not the first sign of friction between Mamdani and Tisch.

The two have recently found themselves at odds over other issues, including an incident in which two NYPD officers were injured after being struck by a snowball.

It remains unclear whether the mayor will ultimately move forward with disbanding the SRG or how the disagreement between City Hall and police leadership will be resolved.

As New York City Mayor Zohran Mamdani reaches his first 100 days in office, New Yorkers are giving him a generally positive, though still forming, review.

A new Marist Poll of city adults finds 48% approve of the job Mamdani is doing, while 30% disapprove and 23% say they are unsure, giving the mayor a net positive rating early in his tenure.

Beyond job approval, a majority of residents (55%) view Mamdani favorably, compared to 33% who see him unfavorably.

According to the poll, 56% of residents say New York City is moving in the right direction, a sharp increase from 31% in October 2025, before Mamdani took office.

At that time, two-thirds of New Yorkers said the city was on the wrong track.

The improvement is especially notable among Democrats, while Republicans remain largely pessimistic.

Independents are still split but more optimistic than they were in the fall.

He performs strongest in Manhattan (55%) and Brooklyn (54%), where majorities approve of his job performance. In Queens (42%) and the Bronx (45%), pluralities approve, but large shares remain unsure.

57% of Staten Island disapproves, according to poll

Staten Island stands out as the only borough where a majority (57%) disapprove.

Politically, 63% of Democrats approve, compared to just 25% of Republicans, with most Republicans disapproving. Independents are more mixed, with more disapproval than approval and a significant share still undecided.

Adams reportedly had higher approval rating

While Mamdani’s early numbers are positive, they fall short of his predecessor’s early standing. Former Mayor Eric Adams had a higher approval rating at the same point in 2022.

Still, the data suggests Mamdani is building a foundation of support, particularly through his image as a hardworking and empathetic leader.

The Emerson College Polling/PIX11 survey, released Thursday, found 43% of registered voters approve of Mamdani’s performance, while 27% disapprove.

Another 30% said they feel neutral.

The poll comes just days after a Marist survey found that nearly half of New Yorkers approve of Mamdani, though his approval rating trails those of past mayors.

Support is stronger among those who participated in the November mayoral election.

Among that group, 55% approve of Mamdani’s job performance and 29% disapprove, giving him a net positive rating of 26 points. Among those who did not vote, approval drops to 35%, with 26% disapproving.

Nearly 60% say NYC is on ‘the wrong track’

Despite the mayor’s early approval numbers, 59% of voters say New York City is on the wrong track, compared with 41% who believe it is headed in the right direction. A similar share, 59%, say Mamdani is focusing on issues important to them, while 41% say he is not.

Black and Hispanic voters

Perceptions of the city’s direction vary by race. Majorities of Black voters (58%) and Hispanic voters (68%) say the city is on the wrong track. White voters are more divided, with 51% saying the city is headed in the right direction and 49% saying it is not.

Mamdani's childcare plan

On specific issues, voters give Mamdani his highest marks for handling childcare, with 54% approving and 21% disapproving.

Housing, affordability

Nearly half, 49%, approve of his approach to housing affordability, compared with 25% who disapprove.

Public safety

On public safety and policing, 45% approve and 32% disapprove.

Budget

Voters are more split on Mamdani’s handling of the city budget, with 40% approving and 37% disapproving.

Assessments of the local economy remain largely negative. Forty percent of respondents rate the city’s economy as poor, while 38% describe it as fair. Only 16% say it is good and 3% rate it as excellent.

NYC's budget gap

When asked how the city should address its budget gap, 55% of voters say the state should raise taxes on the wealthy. Another 41% say the city should better manage its spending, while 4% support a 5% property tax increase.

Millionaire's tax

A majority of voters, 65%, support a so-called millionaire’s tax, while 20% oppose it and 15% are unsure. Support is higher among households earning less than $150,000 annually, where 68% back the tax and 14% oppose it. Among households earning more than $150,000, 56% support the measure and 42% oppose it.

On corporate taxes, 44% of voters say a 1% to 2% increase would not cause companies to leave New York City, while 30% say it would and 27% are unsure.

Mamdani's winter storm response

Looking back at the winter storms of 2026, voters gave Mamdani mixed but generally positive grades for the city’s response. Twenty-nine percent awarded an "A," and 33% gave a "B." Smaller shares gave lower marks, with 18% assigning a "C," 9% a "D" and 11% an "F."

The poll surveyed 850 registered New York City voters from April 5-6 and has a margin of error of plus or minus 3.4 percentage points.

Queens man charged with murder, arson for fire that killed 4

The NYPD has arrested a suspect accused of setting a fire at a Queens apartment building that killed four people last month.

Queens fire suspect arrested

Police arrested 38-year-old Roman Amatitla on Wednesday, April 8. Amatitla has been charged with murder, arson, assault and petit larceny in connection with the fire.

The fire happened on March 16 at an apartment building on Avery Avenue in Flushing.

Firefighters responded to the building to find heavy flames. Crews reported seeing three people jump from an upper floor as the flames spread.

After the fire was put out, firefighters found three people, a 3-year-old girl, a 50-year-old man and a 61-year-old woman, dead inside. Paramedics also brought a 63-year-old man to the hospital, where he later died from his injuries.

The Office of the Chief Medical Examiner later ruled the fire a homicide.

Two victims identified

So far, two of the four victims have been identified. Three-year-old Sihan Yang and 50-year-old Chengri Cui were among those found dead in the building.

Officials have not released the identities of the other two victims.

The Fire Marshal is still working to determine the exact cause of the fire.

Amatitla is being held without bail.

NJ lifts 50-year block on new nuclear power plants

New Jersey Gov. Mikie Sherrill signed legislation on Wednesday that ends what was effectively a block on the construction of new nuclear power plants in the state.

The bill, A4582, changes the permitting process for new nuclear plant construction. Previous legislation, dating back to the 1970s, requires nuclear facilities to adhere to strict standards for the removal of radioactive waste set by the Nuclear Regulatory Commission.

Lawmakers say that technological advancements over the last 53 years have made that standard "an obsolete and artificial barrier" to new nuclear infrastructure.

Under the new law, permitted facilities will be required to use modern waste storage methods that have a 100% effective safety record across the country, lawmakers said.

Rising energy costs

Energy prices in New Jersey have gone up nearly 78% since 2016, according to Consumer Price Index data.

On her first day in office, Sherrill declared a State of Emergency for utility prices. She said the decision to sign this bill came down to simple supply and demand.

"For costs to come down, we need more energy supply," Sherrill said. "New Jersey is well-positioned to be a leader in next-generation nuclear energy to help bring that supply, and we are open for business."

Sherrill said that the new law will "help New Jersey secure a stronger, cleaner, more affordable, and reliable energy future."

Currently, New Jersey has two nuclear power plants: Salem and Hope Creek. A third, Oyster Creek, closed in 2018. At the time, it was the oldest operating nuclear power reactor.

Together, those two facilities produce more than 40% of the state's electricity, and according to a 2020 analysis, saves the state $400 million a year, compared to other energy sources. The U.S. Department of Energy called nuclear power plants "among the safest and most secure industrial facilities in the world."

Raising a child in NY, NJ and CT costs more than most of the US, report says

The Tri-State area has some of the highest annual costs of raising a young child in the country, according to a new report.

New LendingTree analysis found that New Jersey, New York and Connecticut all rank in the top 10 states for child-rearing costs during the first five years of life — the most expensive period for families.

New Jersey ranked fifth-highest in the nation

In New Jersey, families spend an estimated $31,948 per year raising a young child, the fifth-highest in the nation.

New York ranks eighth at $30,209 annually, while Connecticut ranks 10th at $29,674.

The national average for the first five years is $29,325 per year.

Child care remains a major driver of those costs. Infant day care averages about $20,439 annually in New York, $20,213 in New Jersey and $18,492 in Connecticut, according to the report.

The analysis is based on a two-earner household making the U.S. median income of $99,999 and includes expenses such as housing, food, child care, transportation and health insurance.

Former NYPD sergeant sentenced to 3 to 9 years in prison in cooler death case

A former New York City police sergeant was sentenced on Thursday to three to nine years in prison for tossing a picnic cooler full of drinks at a fleeing suspect, who then crashed his motorized scooter and died.

The ex-officer, Erik Duran, was convicted of manslaughter in the 2023 death of Eric Duprey. The former sergeant said he was trying to protect other officers from the approaching scooter.

The case drew international attention, with thousands of law enforcement officers urging the judge to show leniency. More than 11,000 officers from around the world signed a petition asking that Duran not be sentenced to prison.

Prosecutors said the incident occurred in August 2023, when Dupree fled from a Bronx drug bust on a scooter. Duran, who was working undercover at the time, threw a cooler filled with ice and drinks at Dupree, striking him in the head.

Surveillance video showed Dupree losing control of the scooter, crashing into a parked car and falling to the ground. He later died from head injuries, according to prosecutors.

Duran was convicted in February following a four-week trial. During testimony, he said he had only seconds to act and was trying to prevent others nearby from being struck by the scooter.

Defense attorneys argued his actions were justified, saying the cooler was the only object available to stop Dupree.

"He used the only object he had available to him to try to stop, and that was a cooler," one attorney said during earlier proceedings. "It’s a matter of whether or not Sergeant Duran was justified in his actions. Unequivocally, he was."

Prosecutors countered that Duran should have known his actions could cause serious harm.

"The defendant knew or should have known that throwing the cooler at Mr. Dupree would either harm him or cause a collision," a prosecutor said in court. "The defendant was aware of these risks and disregarded them."

Leaders of the Sergeants Benevolent Association also voiced support for Duran, arguing that punishing him could send a chilling message to officers making split-second decisions in dangerous situations.

An attorney for Ellerup and Victoria Heuermann pushed back, calling the lawsuit "reckless" and unsupported by evidence.

"My clients have fully cooperated with law enforcement from the very beginning," the attorney said. "There is no evidence that implicates them in any way."

Heuermann was arrested in July 2023 after investigators said DNA recovered from a discarded pizza crust matched evidence found on or near the victims’ remains. Prosecutors have also cited cellphone records and electronic evidence recovered from his Massapequa Park home.

2 men indicted for shooting death of Brooklyn infant

Two men have been indicted in the tragic shooting that killed 7-month-old Kaori Patterson-Moore in Brooklyn last week, authorities announced Tuesday.

Brooklyn District Attorney Eric Gonzalez revealed that a grand jury handed down a sweeping indictment against 21-year-old Amuri Greene and 18-year-old Matthew Rodriguez, who are accused of opening fire on a crowded East Williamsburg street.

Multiple felonies

The charges include multiple counts of second-degree murder, attempted murder, weapons possession and assault, totaling more than half a dozen serious felonies.

Prosecutors say the suspects fired into a crowd from a moving vehicle, striking Kaori Patterson-Moore in the head and grazing her 2-year-old brother.

Gonzalez called the incident "devastating," noting that the baby was not the intended target during a press conference on Tuesday.

"She was in her stroller with her 2-year-old baby brother when these gunmen, driving by on a scooter, recklessly shot into a crowd intending to kill another person," he said.

Greene is currently in custody but was not present in court, according to prosecutors. Rodriguez is in custody in Pennsylvania awaiting extradition and is expected to return to Brooklyn later this week or early next week. Once he returns, both suspects will be formally arraigned in Brooklyn State Supreme Court.

Patterson-Moore was struck in the head by a stray bullet around 1:20 p.m. on April 1 near Moore Street and Humboldt Street in Brooklyn, according to police.

Investigators said the infant’s mother was pushing her in a stroller when two suspects approached on a moped. Police reported that the passenger opened fire toward a group gathered on the corner.

"The male sitting at the rear of the moped can be seen taking out a gun and discharging at least two rounds toward the southwest corner," NYPD Commissioner Jessica Tisch said last week. "On that corner were several adults, as well as two strollers and several children standing nearby. Our 7-month-old victim was sitting inside one of these strollers when she was struck."

Police said the suspects fled on the moped and crashed minutes later near Manhattan Avenue and Siegel Street while riding the wrong way. Surveillance video shows the pair being thrown from the vehicle before getting back on and continuing to flee.

Over the weekend, the victim's community came together to honor her life. The vigil was organized by NYC clergy, the Brooklyn Collective Clergy Council and the United Clergy Council.

"This tragedy has deeply shaken our community, and our hearts are heavy with grief," organizers said in a statement. "This should never be happening, and it is incredibly sad. Now more than ever, we must come together as a community united in prayer, worship, and compassion."

State and federal officials say the $900 million effort, known as the Five Bridges Project, would rehabilitate five elevated sections of the expressway built roughly 70 years ago and now in need of significant repairs.

But critics, including U.S. Rep. Alexandria Ocasio-Cortez, are raising concerns about the project’s environmental review and community engagement process.

In a letter to Gov. Kathy Hochul dated April 2, Ocasio-Cortez wrote, "on behalf of my constituents and nearly 64,000 local residents impacted by this project, I am requesting that your administration reject any plans to expand the Cross Bronx Expressway beyond its current footprint."

"Instead, I urge the state to prioritize standard bridge repairs and identify safer, more effective solutions that reduce traffic and improve air quality before construction begins on the upcoming 5 bridges project," she added.

'Environmental burden'

Ocasio-Cortez also wrote, "a $900 million repair project in one of the state's most congested, environmentally burdened corridors demands rigorous planning that puts residents first."

Some Bronx residents echoed those concerns, particularly around air quality and infrastructure maintenance.

"Of course we need the highways fixed. They're dilapidated, they're falling apart, but it shouldn't be at the cost of Bronx River residents or any residents. They're trying to bring to expand across Bronx and bring more emission, bad air," Tenant Association President for Bronx River Houses, Norma Saunders said.

Another added, "People are concerned about having another sidewalk that needs to be cleaned. If you walk around here, you'll see that the current ones aren't maintained."

Last month, neighbors rallied against the proposal, calling on state leaders to pause the project.

What is the Cross Bronx Expressway project?

Design options under consideration include widening the roadway’s shoulders by 25 feet on both sides to meet federal standards, as well as adding a pathway along the southern end of the highway that could later become a bike and pedestrian route.

The New York State Department of Transportation pushed back on claims the project would expand the expressway.

"This is not an expansion project of the expressway. Rather, it is a needed safety project. NYSDOT is committed to maintaining a safe transportation system for all users, and this project on the Cross Bronx is needed to keep travelers as well as the community safe as the infrastructure is in need of critical repair," a spokesperson said in a statement.

The agency also said it has worked with the community throughout the planning process, making changes in response to public feedback.

Construction is expected to begin this year and last about six years, if the plan moves forward as scheduled.
