In filings, they argued that accepting Diddy’s reasoning would mean commercial sex operations could claim First Amendment protection simply by making encounters "creative" or "staged."&lt;/p&gt;&lt;p&gt;They also maintain that the sentence was appropriate.&lt;/p&gt;&lt;p&gt;His legal team said the judge wrongly factored in allegations of coercion and other conduct when applying sentencing enhancements, which can increase prison time under federal guidelines.&lt;/p&gt;&lt;p&gt;Prosecutors argued the sentence should stand, saying the conduct overlaps with the Mann Act violations and can be considered in sentencing, even if the jury acquitted him on separate charges.&lt;/p&gt;&lt;p&gt;In earlier filings, Diddy’s lawyers also argued that videos he recorded of sexual encounters between his girlfriends and male sex workers amounted to "amateur pornography" protected by the First Amendment. Prosecutors rejected that argument, saying the case has nothing to do with free speech.&lt;/p&gt;&lt;p&gt;Diddy did not testify. The commissioner has not publicly backed eliminating the group.&lt;/p&gt;&lt;p&gt;The SRG has faced criticism in recent years, particularly following its response to protests in 2020. The unit was later required to implement changes as part of a legal settlement with the New York state attorney general’s office.&lt;/p&gt;&lt;p&gt;"I remain deeply committed to disbanding the SRG and to decoupling our response to protest and counterterrorism," Mamdani said.&lt;/p&gt;&lt;h2&gt;Columbus, Ohio's ‘dialogue unit’&lt;/h2&gt;&lt;p&gt;As part of the administration’s effort to explore alternatives, officials from City Hall and NYPD leadership traveled this week to Columbus, Ohio, to study that city’s "dialogue unit." &lt;/p&gt;&lt;p&gt;The unit is made up of volunteer officers who engage directly with protest participants in an effort to de-escalate tensions.&lt;/p&gt;&lt;p&gt;Mamdani said the trip was intended to examine a different model for handling protests that relies more on communication than enforcement.&lt;/p&gt;&lt;p&gt;"This is a trip of members from both City Hall and NYPD to better study the Columbus model of responding to protests," he said.&lt;/p&gt;&lt;h2&gt;NYPD's community affairs unit&lt;/h2&gt;&lt;p&gt;NYPD officials said similar strategies are already in place in New York City. &lt;/p&gt;&lt;p&gt;They pointed to the department’s community affairs division and other units that work with protest organizers ahead of and during demonstrations to maintain communication and reduce the likelihood of conflict.&lt;/p&gt;&lt;h2&gt;Mamdani vs Tisch&lt;/h2&gt;&lt;p&gt;The dispute over the SRG is not the first sign of friction between Mamdani and Tisch. &lt;/p&gt;&lt;p&gt;The two have recently found themselves at odds over other issues, including an incident in which two NYPD officers were injured after being struck by a snowball.&lt;/p&gt;&lt;p&gt;It remains unclear whether the mayor will ultimately move forward with disbanding the SRG or how the disagreement between City Hall and police leadership will be resolved.&lt;/p&gt;</content:encoded>

Amatitla has been charged with murder, arson, assault and petit larceny in connection with the fire.&lt;/p&gt;&lt;p&gt;The fire happened on March 16 at an apartment building on Avery Avenue in Flushing. &lt;/p&gt;&lt;p&gt;Firefighters responded to the building to find heavy flames. Paramedics also brought a 63-year-old man to the hospital, where he later died from his injuries.&lt;/p&gt;&lt;p&gt;The Office of the Chief Medical Examiner later ruled the fire a homicide.&lt;/p&gt;&lt;h2&gt;Two victims identified&lt;/h2&gt;&lt;p&gt;So far, two of the four victims have been identified. Previous legislation, dating back to the 1970s, requires nuclear facilities to adhere to strict standards for the removal of radioactive waste set by the Nuclear Regulatory Commission.&lt;/p&gt;&lt;p&gt;Lawmakers say that technological advancements over the last 53 years have made that standard "an obsolete and artificial barrier" to new nuclear infrastructure. &lt;/p&gt;&lt;p&gt;Under the new law, permitted facilities will be required to use modern waste storage methods that have a 100% effective safety record across the country, lawmakers said.&lt;/p&gt;&lt;h2&gt;Rising energy costs&lt;/h2&gt;&lt;p&gt;Energy prices in New Jersey have gone up nearly 78% since 2016, according to Consumer Price Index &lt;a href="https://data.bls.gov/timeseries/CUURS12ASA0E?amp%253bdata_tool=XGtable&amp;output_view=data&amp;include_graphs=true" target="_blank" rel="noopener"&gt;data.&lt;/a&gt;&lt;/p&gt;&lt;p&gt;On her first day in office, Sherrill declared a &lt;a href="https://nj.gov/infobank/eo/057sherrill/pdf/EO-1.pdf" target="_blank" rel="noopener"&gt;State of Emergency&lt;/a&gt; for utility prices. The former sergeant said he was trying to protect other officers from the approaching scooter.&lt;/p&gt;&lt;p&gt;The case drew international attention, with thousands of law enforcement officers urging the judge to show leniency. More than 11,000 officers from around the world signed a petition asking that Duran not be sentenced to prison.&lt;/p&gt;&lt;p&gt;Prosecutors said the incident occurred in August 2023, when Dupree fled from a Bronx drug bust on a scooter. Duran, who was working undercover at the time, threw a cooler filled with ice and drinks at Dupree, striking him in the head.&lt;/p&gt;&lt;p&gt;Surveillance video showed Dupree losing control of the scooter, crashing into a parked car and falling to the ground. He later died from head injuries, according to prosecutors.&lt;/p&gt;&lt;p&gt;Duran was convicted in February following a four-week trial. During testimony, he said he had only seconds to act and was trying to prevent others nearby from being struck by the scooter.&lt;/p&gt;&lt;p&gt;Defense attorneys argued his actions were justified, saying the cooler was the only object available to stop Dupree.&lt;/p&gt;&lt;p&gt;"He used the only object he had available to him to try to stop, and that was a cooler," one attorney said during earlier proceedings. "It’s a matter of whether or not Sergeant Duran was justified in his actions. Unequivocally, he was."&lt;/p&gt;&lt;p&gt;Prosecutors countered that Duran should have known his actions could cause serious harm.&lt;/p&gt;&lt;p&gt;"The defendant knew or should have known that throwing the cooler at Mr. Dupree would either harm him or cause a collision," a prosecutor said in court. "The defendant was aware of these risks and disregarded them."&lt;/p&gt;&lt;p&gt;Leaders of the Sergeants Benevolent Association also voiced support for Duran, arguing that punishing him could send a chilling message to officers making split-second decisions in dangerous situations.&lt;/p&gt;&lt;p&gt;In a statement, Vincent Vallelong, president of the Sergeants Benevolent Association of the NYPD, said: &lt;/p&gt;&lt;p&gt;&lt;i&gt;"Today will be forever remembered as one of the darkest days in the history of our profession. It wasn't only Sgt Duran, a great cop, who was on trial. Every law enforcement officer who makes a split second decision in the performance of their duties to protect the public, was also on trial.             <content:encoded>&lt;p&gt;&lt;a href="https://www.fox5ny.com/news/rex-heuermann-gilgo-beach-killings-long-island"&gt;After pleaded guilty&lt;/a&gt;, Gilgo Beach serial killer Rex Heuermann, along with members of his family — is now facing a wrongful death lawsuit tied to &lt;a href="https://www.fox5ny.com/news/rex-heuermann-charged-murder-valerie-mack"&gt;one of the victims,&lt;/a&gt; according to court filings.&lt;/p&gt;&lt;p&gt;Heuermann is expected to appeared in Suffolk County court Wednesday, where he plead guilty in connection with a string of killings. &lt;/p&gt;&lt;p&gt;The former architect has been charged with the murders of seven women whose remains were found along Ocean Parkway near Gilgo Beach between 1993 and 2011. &lt;/p&gt;&lt;p&gt;He also admitted to killing an eighth victim.&lt;/p&gt;&lt;p&gt;The lawsuit, filed this week by Benjamin Torres, the 32-year-old son of victim &lt;a href="https://www.fox5ny.com/news/rex-heuermann-charged-murder-valerie-mack"&gt;Valerie Mack,&lt;/a&gt; names Heuermann, his ex-wife Asa Ellerup and his daughter, Victoria Heuermann, as defendants.&lt;/p&gt;&lt;p&gt;Torres alleges he was deprived of his mother’s care and protection and claims Mack was tortured before her death. &lt;/p&gt;&lt;p&gt;The suit seeks damages and also targets profits allegedly earned by Ellerup and Victoria Heuermann from a Peacock documentary about Heuermann’s life, accusing them of showing "callous disregard" for victims’ families.&lt;/p&gt;&lt;h2&gt;Who is Valerie Mack?&lt;/h2&gt;&lt;p&gt;Valerie Mack, 24, worked as an escort in Philadelphia under the alias "Melissa Taylor." &lt;/p&gt;&lt;p&gt;She was last seen by her family in Port Republic, New Jersey, in the spring or summer of 2000 but was never reported missing. &lt;/p&gt;&lt;p&gt;Her partial remains were found on Mill Road in Manorville back in 2000, and additional remains were discovered in 2011 during the search for &lt;a href="https://www.fox5ny.com/news/shannan-gilbert-death-investigation-family-lawyer"&gt;Shannan Gilbert&lt;/a&gt; on Ocean Parkway. &lt;/p&gt;&lt;p&gt;Advances in DNA technology, along with help from the FBI, led to the positive identification of the remains once known as "Jane Doe #6." &lt;/p&gt;&lt;p&gt;An attorney representing Torres said a guilty plea could help establish liability quickly and move the case toward damages, particularly as concerns grow over the potential dissipation of assets.&lt;/p&gt;&lt;p&gt;"Our hope was that from the guilty plea, we would be able to quickly establish liability," the attorney said, adding that doing so would help preserve any remaining funds tied to the defendants.&lt;/p&gt;&lt;p&gt;An attorney for Ellerup and Victoria Heuermann pushed back, calling the lawsuit "reckless" and unsupported by evidence.&lt;/p&gt;&lt;p&gt;"My clients have fully cooperated with law enforcement from the very beginning," the attorney said. "There is no evidence that implicates them in any way."&lt;/p&gt;&lt;p&gt;Heuermann was arrested in July 2023 after investigators said DNA recovered from a discarded pizza crust matched evidence found on or near the victims’ remains. Prosecutors have also cited cellphone records and electronic evidence recovered from his Massapequa Park home.&lt;/p&gt;&lt;p&gt;Heuermann has previously denied any involvement in the killings.&lt;/p&gt;&lt;p&gt;The case is scheduled for 11 a.m. Wednesday.&lt;/p&gt;&lt;h2&gt;Who is Asa Ellerup? &lt;/h2&gt;&lt;p&gt;Asa Ellerup is the &lt;a href="https://www.fox5ny.com/news/wife-accused-gilgo-beach-killer-speaks-out"&gt;estranged wife&lt;/a&gt; of alleged Long Island serial killer Rex Heuerman.&lt;/p&gt;&lt;p&gt;Asa Ellerup has expressed sympathy for the victims and their families, but has also said she doubted whether Heuermann was guilty of the crimes he's been accused of.&lt;/p&gt;&lt;p&gt;Ellerup filed for divorce in the days after Heuermann's &lt;a href="https://apnews.com/article/long-island-serial-killings-arrest-gilgo-beach-c3af339961c00276429908b1dd20dc19"&gt;July 13, 2023, arrest&lt;/a&gt; for the killings and said she would "withhold judgment until the end of trial."&lt;/p&gt;&lt;p&gt;"I have given Rex the benefit of the doubt, as we all deserve," Ellerup said at the time. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;FOX 5 NY&lt;/strong&gt; has reported that she has been visiting him in jail despite divorce proceedings.&lt;/p&gt;&lt;h2&gt;Rex Heuermann’s daughter Victoria&lt;/h2&gt;&lt;p&gt;Victoria is the 27-year-old daughter of alleged Long Island serial killer Rex Heuerman.&lt;/p&gt;&lt;p&gt;When John Ray, an attorney who represents the families of some of the Gilgo Beach murder victims was asked if he thought Heuermann's daughter had anything to do with the alleged murders, Ray said "We can infer from this, and it's not the only inference, but it's a very strong inference, that this girl was made over the course of years, somehow, to become accustomed to liking what you see here," (referring to the disturbing images). &lt;/p&gt;&lt;p&gt;"She certainly falls within the circle of suspicion," he said. &lt;/p&gt;&lt;p&gt;One of the images shown appeared to be the remains of a human being that looks half-eaten that Ray said they found on her Tumblr blog via a link from her LinkedIn page.&lt;br&gt; &lt;/p&gt;</content:encoded>

However, the latest price tag for a comfortable retirement comes with a bit of sticker shock.&lt;/p&gt;&lt;p&gt;Americans believe they need $1.46 million to retire comfortably this year, which would provide approximately $4,800 in retirement income per month, according to a study by &lt;a href="https://news.northwesternmutual.com/2026-04-01-Americans-Believe-They-Will-Need-1-46-Million-to-Retire-Comfortably,-Up-More-Than-15-Since-Last-Year,-According-to-Northwestern-Mutual-2026-Planning-Progress-Study" target="_blank" rel="noopener"&gt;Northwestern Mutual.&lt;/a&gt;&lt;/p&gt;&lt;p&gt;That "magic number" has increased more than 15% in just one year, adding another $200,000 to last year's total and matching expectations for 2024.&lt;/p&gt;&lt;h2&gt;Expected amount needed 2022-26&lt;/h2&gt;&lt;ul&gt;&lt;li&gt;2022: $1.25 million&lt;/li&gt;&lt;li&gt;2023: $1.27 million&lt;/li&gt;&lt;li&gt;2024: $1.46 million&lt;/li&gt;&lt;li&gt;2025: $1.26 million&lt;/li&gt;&lt;li&gt;2026: $1.46 million&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;Experts say the increase is due to several factors, including inflation, longer life expectancy and uncertainty about the future of Social Security.&lt;/p&gt;&lt;p&gt;The study also claims that nearly half of Americans (48%) believe it is somewhat or very likely they will outlive their savings, but those numbers vary slightly by generation.&lt;/p&gt;&lt;p&gt;Millennials, who started saving at 28 years old, have the greatest concern at 55%, compared to Gen Z's 45% concern after starting to save even earlier at 22 years old. Meanwhile, Gen X, who won't start saving until 32, falls in the middle with 50% concern.&lt;/p&gt;&lt;p&gt;Half of millennials and Gen X also expect that they will have to work during their retirement.&lt;/p&gt;&lt;p&gt;Although some Americans may expect to save $1.46 million before they retire, that is not the reality for most of the country.&lt;/p&gt;&lt;p&gt;Only 5% of Americans with retirement accounts have at least $1 million saved for retirement, while just over 9% have $500,000, according to &lt;a href="https://www.nerdwallet.com/retirement/learn/the-average-retirement-savings-by-age-and-why-you-need-more" target="_blank" rel="noopener"&gt;NerdWallet.&lt;/a&gt;&lt;/p&gt;&lt;p&gt;The average retirement savings for families is actually $333,940, and the median is $87,000. For Americans aged 55 to 64, those numbers increase to an average of $537,560 and a median of $185,000.&lt;/p&gt;&lt;p&gt;Experts say these tips can help Americans think about how much they want to save for their retirement:&lt;/p&gt;&lt;ul&gt;&lt;li&gt;The 25x Rule: Saving roughly 25 times a person's expected annual spending.&lt;/li&gt;&lt;li&gt;The $1,000-a-Month Rule: Every $1,000 of desired monthly retirement spending translates to $300,000 the individual should have saved.&lt;/li&gt;&lt;li&gt;The 4% Rule: You may withdraw 4% of your retirement savings in the first year and withdraw the same amount (adjusted for inflation) for about the next 30 years.&lt;/li&gt;&lt;/ul&gt;</content:encoded>

            <content:encoded>&lt;p&gt;New York officials face a key deadline to submit a final plan to redesign portions of the Cross Bronx Expressway, as debate intensifies over the scope and impact of the project.&lt;/p&gt;&lt;p&gt;State and federal officials say the $900 million effort, known as the Five Bridges Project, would rehabilitate five elevated sections of the expressway built roughly 70 years ago and now in need of significant repairs.&lt;/p&gt;&lt;p&gt;But critics, including U.S. Rep. Alexandria Ocasio-Cortez, are raising concerns about the project’s environmental review and community engagement process.&lt;/p&gt;&lt;p&gt;In a letter to Gov. Kathy Hochul dated April 2, Ocasio-Cortez wrote, "on behalf of my constituents and nearly 64,000 local residents impacted by this project, I am requesting that your administration reject any plans to expand the Cross Bronx Expressway beyond its current footprint."&lt;/p&gt;&lt;p&gt;"Instead, I urge the state to prioritize standard bridge repairs and identify safer, more effective solutions that reduce traffic and improve air quality before construction begins on the upcoming 5 bridges project," she added.&lt;/p&gt;&lt;h2&gt;'Environmental burden'&lt;/h2&gt;&lt;p&gt;Ocasio-Cortez also wrote, "a $900 million repair project in one of the state's most congested, environmentally burdened corridors demands rigorous planning that puts residents first."&lt;/p&gt;&lt;p&gt;Some Bronx residents echoed those concerns, particularly around air quality and infrastructure maintenance.&lt;/p&gt;&lt;p&gt;"Of course we need the highways fixed. They're dilapidated, they're falling apart, but it shouldn't be at the cost of Bronx River residents or any residents. They're trying to bring to expand across Bronx and bring more emission, bad air," Tenant Association President for Bronx River Houses, Norma Saunders said. &lt;/p&gt;&lt;p&gt;Another added, "People are concerned about having another sidewalk that needs to be cleaned. If you walk around here, you'll see that the current ones aren't maintained."&lt;/p&gt;&lt;p&gt;Last month, neighbors rallied against the proposal, calling on state leaders to pause the project.&lt;/p&gt;&lt;h2&gt;What is the Cross Bronx Expressway project?&lt;/h2&gt;&lt;p&gt;Design options under consideration include widening the roadway’s shoulders by 25 feet on both sides to meet federal standards, as well as adding a pathway along the southern end of the highway that could later become a bike and pedestrian route.&lt;/p&gt;&lt;p&gt;The New York State Department of Transportation pushed back on claims the project would expand the expressway.&lt;/p&gt;&lt;p&gt;"This is not an expansion project of the expressway. Rather, it is a needed safety project. NYSDOT is committed to maintaining a safe transportation system for all users, and this project on the Cross Bronx is needed to keep travelers as well as the community safe as the infrastructure is in need of critical repair," a spokesperson said in a statement.&lt;/p&gt;&lt;p&gt;The agency also said it has worked with the community throughout the planning process, making changes in response to public feedback.&lt;/p&gt;&lt;p&gt;Construction is expected to begin this year and last about six years, if the plan moves forward as scheduled.&lt;/p&gt;</content:encoded>
