This cookie policy has the specific purpose, pursuant to Directive 2002/58/EC concerning privacy and electronic communications and the GDPR, of explaining the types and methods of use of cookies as well as providing guidance on how to refuse or delete the cookies on the website, if desired.
Use of cookies:
We use cookies to optimize our website and analyze website traffic. Cookies or similar techniques (collectively referred to as “cookies”) are small text files or pixels that are stored on your browser, computer, or mobile device. Cookies may be necessary to facilitate website navigation and make it more user-friendly. The purpose of cookies is to remember user actions and preferences, such as the browsing language, so that this information doesn’t have to be re-entered when moving from page to page or returning to the site at a later time. Cookies are therefore used for authentication, tracking browsing sessions, and storing information about user activities for statistical or advertising purposes. While browsing a website, users may also receive cookies on their computer or mobile device from web servers other than the one they are visiting; these are called third-party cookies and may collect information to analyze personal browsing behavior.
The following activities are saved during the session:
– Strictly necessary activities for operation: uses cookies to save the user session and carry out other activities strictly necessary for the functioning of the website, such as distributing traffic.
– Preference saving, optimization, and statistics activities: uses cookies to save browsing preferences and optimize the user’s navigation experience. These cookies include, for example, those used to set language and currency preferences, manage site statistics by the Controller, or retrieve items added and saved by the user in the shopping cart.
– Profiling cookies, including third-party ones, to send advertising messages aligned with the user’s preferences while browsing the internet. You can refuse consent to profiling via the banner that appears on the homepage of the website.
Types of cookies:
According to current Italian regulations for the use of cookies
(http://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/3118884 and http://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/9677876), three types of cookies have been identified:
1. Technical and aggregated statistics cookies
These mandatory cookies do not require explicit consent for their use and are necessary for the correct functioning of our websites.
The Italian Data Protection Authority includes, along with technical and aggregated statistics cookies:
· Analytics cookies, which support analytical services that help us improve website functionality and the user experience; these services collect aggregated information on the number of users and how they visit the website. Tools are used to reduce the identifying power of the data collected (e.g., masking significant portions of the IP address), subject to contractual constraints between sites and third parties that explicitly commit the third party to use the data only for providing the service, store them separately, and not “enrich” or “cross-match” them with other information in their possession.
· Browsing or session cookies (e.g., for authentication).
· Functionality cookies, which allow navigation according to a set of selected criteria (e.g., language, wishlist) to improve the service provided.
· Cookies used and generated by the website.
2. Third-party cookies
A third-party cookie is placed on the browser and/or hard drive of website visitors by a domain different from the one the user is visiting. We are not responsible for the collection, processing, or disclosure of personal data collected through other websites, as it is technically impossible for us to control this; therefore, any reference to third-party cookies and tracking systems should be considered indicative. You are encouraged to review the cookie policies of other websites you may access through ours, where you will find an overview of third parties.
Examples include YouTube videos, Google APIs, Google Maps usage, and “social plugins” for Facebook, Twitter, Google+, and LinkedIn. These are parts of the visited page generated directly by the mentioned sites and integrated into the host website’s page. The most common use of social plugins is to share content on social networks to enhance user experience.
Responsibility for third-party cookies not installed by the company
The installation of cookies and other tracking systems by third parties through the services used on this site cannot be technically controlled by the Controller; therefore, any reference to third-party cookies and tracking systems should be considered indicative. To obtain complete information, users are invited to consult the privacy policies of any third-party services mentioned in this document. If the user wishes to receive more detailed information about the use of cookies through this site, they are invited to contact the data controller at privacy@feniciaspa.it. Through the same contact, the user can also request an up-to-date list of all data processors appointed by the Controller.
The Italian Data Protection Authority has stated the following: “It is necessary to take into account the different entity that installs the cookies on the user's device, depending on whether it is the same operator of the site being visited (referred to as the "publisher") or a different site installing cookies through the first (so-called "third parties").
There are several reasons why the publisher cannot be obliged to provide the notice and collect consent for cookies installed by third parties via their website.
First, the publisher would need to have the technical and legal resources to fulfill third-party obligations and verify, case by case, the consistency between what the third parties claim and the purposes they actually pursue using cookies. This is difficult because publishers often do not know all the third parties installing cookies via their site and therefore cannot know the rationale behind such processing.
Also, intermediaries (ad networks) often exist between publishers and third parties, making it hard for publishers to monitor all involved parties’ activities. Third-party cookies may also be modified over time, and requiring publishers to track these changes is impractical.
Moreover, many publishers—including individuals and small businesses—are the weaker party in the relationship. Conversely, third parties are usually large companies with significant economic power, serving numerous publishers and often outnumbering them.
Therefore, it is considered inappropriate to obligate publishers to include the full text of third-party cookie notices on their homepage. This would reduce clarity and readability of the notice, ultimately undermining the simplification goal of Article 122 of the Privacy Code (now repealed).
Similarly, regarding consent collection for profiling cookies, due to the different roles of publishers and third parties, publishers should be seen as technical intermediaries between third parties and users and act accordingly by providing information and collecting user consent related to third-party cookies.”
3. Profiling cookies
These cookies are aimed at creating user profiles and are used to send advertising messages in line with the preferences expressed by the user while browsing the internet. Explicit user consent is required for this type of cookie. The Court of Justice of the European Union recently ruled on this matter (http://curia.europa.eu/juris/documents.jsf?num=C-673/17), stating that consent is not validly given if cookie storage or access to stored information on a user’s device is authorized by means of a pre-ticked checkbox that the user must deselect to refuse consent.
For more information, refer to the “EDPB Guidelines No. 5” available here:
https://edpb.europa.eu/our-work-tools/our-documents/guidelines/guidelines-052020-consent-under-regulation-2016679_en
You can refuse consent to profiling through the banner that appears on the homepage of the website.
The cookies on our website are further classified by function:
· Session cookies, stored on the user's computer for purely technical-functional needs to transmit session identifiers required for safe and efficient website navigation; they are deleted at the end of the “session” (hence the name) when the browser is closed. These cookies avoid using potentially harmful IT techniques that could compromise users' browsing privacy.
· Persistent cookies, stored on the user’s hard drive until they expire or are deleted by the user/visitor. Through persistent cookies, visitors (or other users using the same computer) are automatically recognized on each visit. These cookies serve many functions for user convenience (such as language preferences or saving items in the online shopping cart). However, persistent cookies may also be used for promotional or questionable purposes. Visitors can configure their browsers to accept/reject all cookies or display a warning when a cookie is sent, allowing them to decide whether to accept it. Users can also change the default configuration and disable cookies (i.e., block them permanently).
