Terms and Conditions
General
By creating an account on Brick Owl you agree to the below terms and conditions. These conditions may change at any time.- You may only have one account per person.
- You may only have one store per household without prior permission.
- You must provide current and accurate details within your account.
- You must be at least 13 years of age.
- You must not share your login credentials with any third-party services or software tools.
- You must not use tools to scrape data from the Brick Owl website, other than through the API.
- Users should not attempt to drive traffic from Brick Owl to other websites, for example by linking to other websites, or through their store name. This also applies to including marketing material for other websites within orders. Exceptions are allowed for things such as social media pages and blogs.
- Brick Owl reserves the right to terminate service to any member at any time for any reason without notice if it deems it necessary.
Service / Scope
These general terms and conditions also apply to all legal transactions made within the scope of the Brick Owl merchant programme (hereinafter "merchant programme"). The merchant programme allows selected third-party providers (hereinafter "stores") to offer products under their own name and sell them to customers via Brick Owl stores.
Brick Owl provides a marketplace platform to allow customers to purchase items from third-party stores selling LEGO items. Brick Owl does not sell items directly to customers on the platform. Individual stores are responsible for setting item prices, shipping rates, and taking payments. Brick Owl is not involved in the transaction between customers and stores and as such cannot provide any guarantees about customer, stores, or the items that stores advertise. By using Brick Owl you agree not to hold responsible or make claims against Brick Owl for any failures by customers or stores using Brick Owl.
Catalog
The textual data only contained within the Brick Owl Catalog is made available under the Open Database License: https://opendatacommons.org/licenses/odbl/1.0/.
- By submitting content to Brick Owl you agree to grant Brick Owl a worldwide, royalty-free, non-exclusive, perpetual, irrevocable copyright license to use, display and share the content in any way that is deemed appropriate by Brick Owl.
- Any use of the Brick Owl data must be attributed to Brick Owl by name and with a link back to Brick Owl.
Catalog Points
Catalog points can be awarded for any catalog submissions.
- Points are only awarded for approved submissions. The decision of whether to approve is taken by the catalog administrators.
- Unless stated otherwise, physical prizes will be shipped worldwide where a postal service is available, without charge.
- The prizes available and how many points are required may change at any time without notice.
- The amount of points awarded for a submission may change without notice.
- The winners of quarterly prizes will be contacted in month following the end of the quarter.
Joining Bonus
During promotional periods, stores may be offered a joining bonus to join the Brick Owl platform.
- Stores must be fully setup, with at least two useful shipping methods.
- Stores must have a diverse inventory of over 3,000 lots and 50,000 items.
- Stores must operate on the platform for at least 60 days and receive at least 20 orders from different customers during that time.
Stores
- Stores will be charged a commission according to the details here.
- Stores must adhere to their own terms and conditions set out within their stores, and any relevant legal obligations.
- Stores must ship orders to the shipping address on the order unless otherwise agreed with the customer.
- Stores must respond in a professional manner to all customer communications within 48 working hours (2 days). This includes messages, quotes, issue reports and negative feedback.
- Stores must mark orders as shipped within their stated despatch time.
- Stores must send orders out within 1 working day of marking an order as shipped.
- Stores must provide a good level of customer service.
- Stores must not be unable to fulfil orders, or cancel orders/quotes on a regular basis.
- Stores must not cancel orders/quotes for having low value, or a high lot amount.
- Stores must only advertise items for sale that they are in possession of.
- Stores must list items with accurate item conditions as per the help page here.
- Stores must not use the public note field on lots as a form of advertisement or use the same note on many items.
- Stores must be able to ship orders to at least one country.
- Stores must have at least one useful non-quote shipping method, and at least one usable payment method.
- Stores must not bypass the checkout process.
- Stores must only sell items manufactured, or licensed by, the LEGO group.
- Stores must not request further payment for shipping from customers on a regular basis.
- Stores must attempt to send all the items within an order to the customer, in the condition described. If this is not possible, stores must either attempt to source replacement items, or adequately reimburse the customer. Stores must not provide coupons equal to the value of missing items.
- Failure to maintain good store standards may result in the store being delisted from the main Brick Owl website or suspended.
Feedback
Feedback left about an order should be a true representation of the order experience.
- It must not contain any personally identifiable information.
- It must not contain any profanity.
- It must not be retaliatory.
- It must not be used to ask a question.
- It must not be in relation to postal costs, or local tax issues, such as import charges, unless a mistake has been made.
- Only one negative feedback can be given to a store per user/address/household.
Messages
Brick Owl uses an electronic messaging system to facilitate communication between Brick Owl members.
- All messages sent through the messaging system are stored on Brick Owl servers.
- The messaging system must not be used to send unsolicited messages to other Brick Owl members.
- Messages can be read by Brick Owl administrators for fraud prevention and standards monitoring purposes.
API
The API is provided primarily for inventory synchronization, and for access to the catalog information.
- The volume of requests per minute must be less than the rate limit stated in the API documentation.
- The API may not be used by a marketplace, or service that provides a marketplace.
- Any personal data downloaded from the API, must be stored and handled in compliance with the General Data Protection Regulations of the European Union. In particular, personally identifiable information must be protected, and must not be retained for longer than is necessary.
- Any catalog and pricing data that is displayed, must be attributed back to Brick Owl with a link.
- All requests to the API must use a User-Agent that is unique to the tool.
- Tools that access the API must not use AI generated code.
- There is no license available for the use of images from Brick Owl
Content / DSA
- Any content submitted to Brick Owl must not be inappropriate or offensive.
- Brick Owl may remove any content that is deemed inappropriate or offensive or illegal.
- Brick Owl does not make use of AI or autonomous decision making in relation to content.
- Any content can be reported to Brick Owl using the contact link at the bottom of the page.
- Brick Owl has 1,080,000 average monthly active recipients in the EU
Disclaimer
The materials on Brick Owl's web site are provided "as is". Brick Owl makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Brick Owl does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site.
Limitations
In no event shall Brick Owl or its users be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Brick Owl's Internet site, even if Brick Owl or a Brick Owl authorized representative has been notified orally or in writing of the possibility of such damage.
