[Please read carefully as violation to my TOS may resort to being blocked, blacklisted, or legal action.]

General

• You are expected to read and understand my rules. By filling out my commission form, you’ve read and agreed to ALL of my rules on my TOS.
• If you are not comfortable with my TOS and/or not willing to abide by my conditions, your commission will be rejected.
• Clients must be over the age of 18 to commission me.
• I reserve the right to refuse service for whatever reason. Refusal of service may include but not limited to: subject matter, reputation of the buyer, or inappropriate misconduct towards me (i.e flirting, sexual harassment, etc.)
• Commissions are first come first serve. My slots are limited so I can only accept up to 3 clients at a time.
• Your commission slot will not be finalized until you make a payment upfront and in full.
• Please be clear and concise with what you want in your commission and have all of your references ready. This includes characters, poses, color palettes, etc. Failure to provide any references will lead to an automatic rejection of your commission.
• Before you make any payments, you are required to wait for my approval. Payments must be made via PayPal invoice before I begin your order.
• Commissions on average take approximately 1-3 weeks for completion. Time of completion may vary depending on the number of characters, expressions, complexity, etc.
• Clients who failed to pay their invoice within 3 days after approval will forfeit the slot.
• Clients are required to give me full credit under my SFW identity @QueenOfRudies.
• Clients who are interested in more than one commission will be placed on the waitlist for the next set of commission slots to be open.
• At this time, I do not offer expedited services. Please notify me beforehand if you have a specific deadline for your commission to be competed. I may reject your commission if your deadline is too close and does not meet my schedule.
• Violators of my TOS will be blocked, blacklisted, and or face legal action. 

Blacklisted

• I will not accept commissions under the following themes: NSFW, gore, blood, political agenda, racism, homophobia, transphobia, ableism, slurs, fetishes, and celebrities.
• You may not edit and render my artwork. You may not edit my artwork that promotes any of the blacklisted themes I’ve listed above.
• You may not pester me constantly regarding the progress of your commission, I will send you WIPs when progress has been made.
• Clients are forbidden to use my art to create NFTs (Non-fungible tokens). My art and likeness are not to be used for AI learning, generation, or emulation purposes. It is also not to be used in AI-generated projects.
• Drawing real people is prohibited under certain circumstances such as the client’s mascot or V/PNG tuber model representing themselves.
• Once payments are made via PayPal invoice; my business email, DMs, or other methods of contact are strictly for business only. Failure to use my contact information appropriately will result in a partial or full refund (depending on which stage of the art process I'm in) followed by being blocked and blacklisted.

Sketchathon

• Sketchathon is a special event that begins during the last week of each month, clients will receive 10% off their sketch commission total. Returning clients will receive an additional 5% off (15% off their commission total).
• Clients are allowed a total of TWO characters per commission.
• Sketchathon commissions are strictly character-focused, complex backgrounds are prohibited. A background with one solid color is allowed.
• Sketchathon commissions are strictly for PERSONAL USE ONLY. If you wish to not have your commission posted publicly on my platforms, you must pay a privacy fee. YOU CAN NOT USE SKETCHATHON COMMISSIONS FOR COMMERCIAL USE.
• Sketchathon clients are allowed a full refund if I haven’t started your commission. If I had already started the commission, clients will have 50% of the commission refunded.
• Sketchathon clients are allowed three revisions free of charge, after that, I will charge a $3 inconvenience fee per adjustment.

Payments/Discounts/Refunds/Fee

• Payments must be made UPFRONT via PayPal invoice before I begin your commission, no exceptions. Please do not commission me if you are not prepared to pay the full cost, this can lead to being blocked and blacklisted.
• Haggling is strictly prohibited you will not receive a discounted price unless you are a returning client.
• Returning clients will receive 5% off their commission total.
• Clients who do not provide any references will have their commission form automatically rejected.
  
• A full refund is available for clients during the agreement phase (if I haven’t worked on your commission).
• A client will have 50% of their commission total refunded if they cancel during the sketch phase. Once the line art phase begins, there are no refunds.
• Clients are only allowed to ask for revisions during the sketch phase only, during this phase, I will only allow three alterations free of charge. Additional alterations will lead to a $3 inconvenience fee per adjustment. Refusal to pay for inconvenience fees will result in me pausing your commission until the appropriate fees are paid. Revisions after the sketch phase are prohibited. 
• For Personal Use and Commercial commissions, I have the right to upload your commission on my social media sites for promotional purposes. If you do not wish for me to upload your commissions, your commission will fall under Private Use and will result in extra fees (50% fee of the commission total). Please be clear as to whether or not you want your commissions for Personal, Commercial, or Private Use.
• YOU ARE NOT AUTHORIZED TO ISSUE A CHARGEBACK FOR ANY REASON.
• You are required to contact me if you would like to cancel your commission.
• Purposely issuing a chargeback without contacting me prior will result in immediate blacklisting, I will alert other artists from the community of your behavior as well.

NDA Agreement

• Clients who do not want me to upload WIPs on my public platforms until the final product is released to the public must pay for an NDA fee. The NDA fee will be 30% of the commission total.
• I reserve the right to charge a higher fee if I deem fit. Larger projects may be subjected to a higher fee.
• By paying an NDA fee, I will not share or stream any progress of your commission anywhere. This also means that the client may not share any spoilers or details of the commission until the final product is complete.

Commercial Use, Licensing & Copyright

• I retain all copyright of my work. I am not transferring full ownership of my art to the client.
• The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately, receiving profit from a medium/platform where you have posted my artwork (Patreon, Twitch, Youtube, Personal Site, etc.).
• License fees are broken down into tiers depending on the usage of my commission. I reserve the right to charge more if I deem fit.

• You must give me full credit when posting my art. You must use my SFW handle @QueenOfRudies.
• Clients who paid for either a Personal or Privacy commission may use my artwork for Commercial Use if they’ve discussed it with me and paid for the commercial licensing fee.
• Due to Sketchathon commissions being purchased during a promotional sale, clients are not eligible to license my artwork for Commercial Use.
