Terms of Service

Effective Date: June 2024

Welcome to The Bot Forge. These Terms of Service (“Terms”) govern your use of The Bot Forge website and services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Services Provided

The Bot Forge provides a platform that allows users to create, configure, and manage AI-powered chatbots. These chatbots can be trained on various data sources, integrated into websites, and customized to fit specific branding and functionality needs. The Services include features such as:

  • Chatbot creation and configuration
  • Data training using various data sources (PDFs, DOCX, TXT, YouTube, Websites, etc.)
  • Embedding chatbots on websites or using direct links
  • Custom branding and domain usage
  • Integration with third-party services like Zapier and WordPress
  • History tracking of chatbot interactions
  • Subscription-based plans with varying features and limits

2. Eligibility

You must be at least 18 years old to use our Services. By using The Bot Forge, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. User Accounts

To access certain features of the Services, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription Plans and Billing

The Bot Forge offers Freemium and tiered subscription plans that provide different levels of access to the Services. By selecting a subscription plan, you agree to pay the applicable fees and charges for that plan. All fees are non-refundable except as required by law.

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You can manage your subscription through your account settings.

5. Custom Branding and Domain Usage

Certain subscription plans allow you to customize the branding of your chatbots and use custom domains. Custom branding is subject to your plan’s limitations and any add-ons you purchase. Custom domain add-ons must be purchased separately for each chatbot and are subject to the terms outlined in your subscription plan.

6. Data Usage and Privacy

The Bot Forge respects your privacy and is committed to protecting your data. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

By using our Services, you grant The Bot Forge the right to use, reproduce, and process the data you provide for the purpose of delivering the Services. You are responsible for ensuring that you have the necessary rights to any data you upload to the platform. Data uploaded to our platform is transcoded into vector search for AI use and cannot be retrieved in it’s original format afterwards. 

6.1  SMS Communications

By providing your phone number and opting into our messaging services, you agree to receive SMS messages related to your use of The Bot Forge.

  • Types of Messages: Messages may include alerts and notifications only. 
  • Message Frequency: The number of messages you receive may vary. Standard messaging frequency is approximately 2 messages per week, but this may change based on your preferences and website traffic. 
  • Message and Data Rates: Message and data rates may apply based on your mobile carrier’s terms.
  • Help Information: You can text HELP for assistance regarding our messaging services.
  • Opt-Out Information: You can opt out at any time by texting STOP to stop receiving messages. After opting out, you may receive a confirmation message, and no further messages will be sent unless you re-subscribe. You can also opt out at any time by logging into your account and disabling SMS on your bot. 

 

7. Facebook Integration and Data Usage

When you connect a Facebook account to The Bot Forge, the following data is collected and stored:

  • Facebook Page ID

  • Facebook Page Name

  • Facebook Page Access Token

No other data is collected or stored from your Facebook account.

Permissions: Permissions needed in your Facebook account are requested during the initial connection process. These permissions are used exclusively to gather the required data listed above and facilitate messaging with your Facebook Page. No other functions will utilize these permissions.

Data Deletion: To delete your Facebook data, simply disconnect your Facebook Page from your bot. This action will immediately delete all references to your Facebook information from our database.

8. Third-Party Integrations

The Bot Forge integrates with third-party services like Zapier, WordPress, Slack, and others to enhance the functionality of your chatbots. Your use of these third-party services is subject to their respective terms and conditions. The Bot Forge is not responsible for any issues arising from the use of third-party services.

9. Prohibited Activities

When using our Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload, post, or transmit any content that is illegal, harmful, abusive, or otherwise objectionable.
  • Attempt to interfere with, compromise, or disrupt the integrity or security of the Services.
  • Reverse engineer, decompile, or disassemble any portion of the Services.
  • Use the Services to distribute unsolicited promotional or commercial content (spam).

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including for any violation of these Terms. Upon termination, your right to use the Services will immediately cease.

11. Intellectual Property

All content, trademarks, and other intellectual property associated with The Bot Forge are the property of The Bot Forge or its licensors. You may not use, copy, reproduce, or distribute any content from our Services without our express written permission.

12. Limitation of Liability

The Bot Forge is provided “as is” and “as available” without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall The Bot Forge be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless The Bot Forge, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services.

14. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on our website or by sending you an email. Your continued use of the Services after the changes become effective constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in Seminole County.
