Idaho Legislature: Ask Legislators to VOTE YES on H0097 - Evac order, voluntary noncompliance (posted 02/03/25)

H0097 is simple and straightforward: It allows individuals to refuse evacuation orders but requires them to accept all risks and reimburse rescue costs if needed.

This is just plain commonsense for a free citizenry. Of course, people should take evacuation orders seriously. But they should not be compelled to follow them. (Same goes for mandatory lockdowns, masking, vaccines, and more.)

For example, during a wildfire, a home may be defensible and well protected due to the owner’s Firewise preparations. Leaving that home could pose risks of looting, traffic accidents and entrapment as others flee, ineffective firefighting (for whatever reason), loss of beloved animals, and ultimately property confiscation or loss.

The bill’s caveat that people who refuse evacuation orders accept all risks and reimburse rescue costs if needed is spot on. Individual decisions require individual responsibility.
