merchants, food and liquor producers, shippers and fulfillment services, and related persons and companies (\u201cSubscribers\u201d, or \u201cyou\u201d).<\/p>\n<p>RudiCoder keeps the information, electronic files, and other data that any Subscriber provides to RudiCoder (\u201cSubscriber Information\u201d) strictly private and confidential.<\/p>\n<p>The legal basis for obtaining, processing, and storing Subscriber Information includes many subsections of Article 6(1) of the GDPR (including consent, contractual relations, compliance with legal obligations, performance of specific tasks required by the Subscriber, and other necessary legitimate interests).<\/p>\n<p>With respect to customers of a Subscriber, the Subscriber Information includes the customer&#8217;s name, address, email address, telephone number, and order information (&#8220;Customer Information&#8221;).\u00a0 RudiCoder only obtains, processes, and stores Customer Information for customers whose address indicates they are located in the United States of America.\u00a0\u00a0<span style=\"background-color: initial;\">RudiCoder does not obtain, process, or store any other Customer Information.\u00a0\u00a0<\/span><span style=\"background-color: initial;\">RudiCoder only stores Customer Information for 30 days, after which time it is permanently deleted<\/span><span style=\"background-color: initial;\">.\u00a0<\/span><span style=\"background-color: initial;\">\u00a0<\/span><\/p>\n<p>RudiCoder does not and shall not transfer, sell, share, or otherwise reveal any Subscriber Information (including any Customer Information) with or to any person or entity, for any purpose whatsoever, except as necessary to perform the Services for Subscriber, except as necessary to comply with an express direction from Subscriber, and\/or except to comply with any applicable law(s), court order(s), or subpoena(s).<\/p>\n<p>For example, with respect to customers of a Subscriber, the Customer Information will be transmitted to and shared with the United States of America&#8217;s Food and Drug Administration (&#8220;FDA&#8221;) through its authorized systems, but And we keep things that way, throughout the development, implementation, updating, and maintenance cycles.<\/p>\n<p>Like most quality online systems, all of your data with all of our applications is encrypted both \u201cin transit&#8221; and \u201cat rest.&#8221;<\/p>\n<p>In other words, all transmissions to and from our apps, and all items stored in our apps, are all encrypted using at least 256-bit SSL certificates, providing strong \u201cbank-grade&#8221; security.<\/p>\n<p><strong>Details<\/strong><\/p>\n<p>Cybersecurity, data protection, and privacy are integral parts of our software design, engineering, development, updating, and maintenance functions.<\/p>\n<p>For example, as to all of our applications, we follow the NIST&#8217;s Framework for Improving Critical Infrastructure Cybersecurity and Special Publication 800-171.\u00a0<\/p>\n<p>We also follow various USA state laws relating to data protection and privacy, as well as the European Union&#8217;s GDPR and Canada&#8217;s Personal Information Protection and Electronic Documents Act (PIPEDA).<\/p>\n<p>More specifically, as to all of our applications, we provide at least the following features and maintain at least the following processes and procedures:<\/p>\n<p>\u2022 Establish and maintain baseline configurations and inventories of organizational systems (including hardware, software, firmware, and documentation) throughout the respective system development life cycles; and<\/p>\n<p>\u2022 Establish and enforce security configuration settings for information technology products employed in organizational systems; and<\/p>\n<p>\u2022 Track, review, approve or disapprove, and audit changes to systems; and<\/p>\n<p>\u2022 Analyze the security impact of changes prior to implementation; and<\/p>\n<p>\u2022 Establish, implement, and enforce physical and logical access restrictions associated with changes to systems; and<\/p>\n<p>\u2022 Employ the principle of least functionality by configuring systems to provide only essential capabilities; and<\/p>\n<p>\u2022 Restrict, disable, and prevent the use of nonessential programs, functions, ports, protocols, and services; and<\/p>\n<p>\u2022 Apply deny-by-exception (blacklisting) policies to prevent unauthorized access, or deny-all, permit-by-exception (whitelisting) policies to allow only authorized access; and<\/p>\n<p>\u2022 Control and monitor any software that RudiCoder makes available for local installation by its customers and its customers&#8217; users (\u201cSubscribers&#8221;); and<\/p>\n<p>\u2022 Limit information system access to authorized Subscribers, internal users, and related processes, with additional limitations on access to more sensitive data (Role Based Access Controls); and<\/p>\n<p>\u2022 Limit unsuccessful logon attempts; and<\/p>\n<p>\u2022 Use session lock with pattern-hiding displays to prevent access and viewing of data after a period of inactivity; and<\/p>\n<p>\u2022 Automatically terminate user sessions after defined conditions; and<\/p>\n<p>\u2022 Limit the transmission and storage of Subscriber data to only necessary processes; and<\/p>\n<p>\u2022 Limit the retention and storage of Subscriber data to only 30 calendar days; and<\/p>\n<p>\u2022 Encrypt all data in transit and at rest; and<\/p>\n<p>\u2022 Establish capabilities and systems to allow current and former Subscribers to obtain confirmation regarding whether or not data concerning them is being processed or used by RudiCoder, and if so where and for what purpose; and<\/p>\n<p>\u2022 Establish capabilities and systems to allow Subscribers to obtain a copy of their data, free of charge, in a commonly used and machine readable electronic format; and<\/p>\n<p>\u2022 Establish capabilities and systems to allow Subscribers to easily delete and permanently erase their data; and<\/p>\n<p>\u2022 Screen internal users prior to authorizing access (Personnel Security Controls); and<\/p>\n<p>\u2022 Ensure that all systems containing Subscriber data and\/or sensitive systems information are protected during and after personnel actions such as terminations and transfers; and<\/p>\n<p>\u2022 Limit and secure physical access to systems (Physical Protection Controls); and<\/p>\n<p>\u2022 Periodically assess the risk to organizational operations (including mission, functions, image, or reputation), organizational assets, and individuals, resulting from the operation of organizational systems and the associated processing, storage, or transmission of Subscriber data and\/or sensitive systems information (Risk Assessment Processes); and<\/p>\n<p>\u2022 Regularly scan for vulnerabilities in organizational systems and applications; and<\/p>\n<p>\u2022 Remediate vulnerabilities immediately; and<\/p>\n<p>\u2022 Periodically assess security controls and implement action plans (Security Assessment Processes);
