Our Reporting System
Our whistleblowing service is an early warning system to reduce risks. It is an important tool to foster high ethical standards and maintain customer and public confidence in us.
The service can be used to alert us about risks of wrongdoing affecting people, our organisation, society, or the environment. Your report can include information regarding suspected criminal offences, irregularities and violations or other actions in breach of laws or regulations, within a work-related context.
How to Speak Up
You do not need proof of your suspicions, however all information and records supporting your suspicions will aid our investigation of the matter. Your report must be made in good faith. The service is provided by an external partner WhistleB, Whistleblowing Centre. We offer the option to remain anonymous to ensure everyone feels comfortable to speak up.
The communication channel is encrypted and password-protected, which is why it is important for you to write down any case number or access password/credentials that are provided to you by the service.
Where your concern is being addressed anonymously, the service will not have your personal details and will not be able to retrieve any prior submissions for you if your access information is lost.

2. THE DATA WE COLLECT ABOUT YOU
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
When you submit a report, you can choose to remain anonymous by not providing your name or contact details. The only information that we will receive is the information that you provide explicitly within the report questionnaire.
Depending on the data that you submit to us in the report, we may collect, use, store and transfer different kinds of personal data about you, or individual(s) you are providing a report about which we have grouped together as follows:
- Identity data such as first name, last name, username or similar identifier, or title;
- Contact data such as address, email address and telephone numbers;
- The nature of your relationship with LOTUS, such as whether you are an employee, former employee, occasional employee, supplier or subcontractor;
- Any personal data provided within the optional attachments or free text fields;
- Special Categories of Personal Data (this includes details about your or the individual(s) you are providing a report about, race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data);
- Information about criminal convictions and offences.
We may also put your personal data into aggregated and anonymised form. Once anonymised, that data is no longer your personal data. However, if we combine or connect that anonymised, aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Notice.
3. HOW IS YOUR PERSONAL DATA COLLECTED?
We collect data from you only through the Direct interactions. We only collect the data that you explicitly provide to us, either:
- in the report questionnaire on the website, or
- by telephone, via the IVR.
When you enter data into the report questionnaire, WhistleB does not collect your IP address or metadata associated with any documents submitted. When you submit a report verbally over the IVR phone line, your voice is anonymised.
4. HOW WE USE YOUR PERSONAL DATA
We have set out below, in a table format, a description of all the ways we plan to use your personal data, and the data of others within your report, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.
Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. 5. DISCLOSURES OF YOUR PERSONAL DATA
Your report will be received and assessed by a Case Manager. If this Case Manager assesses that it is necessary to escalate your report, details of the report (which may include personal data) may be shared with the parties set out below for the purposes set out in the table above.
- Audit Committee and the Board of Directors of Lotus Technology Inc and other relevant LOTUS management stakeholders;
- Professional advisers including lawyers, bankers, auditors, intermediaries and insurers who provide consultancy, banking, legal, insurance and accounting services;
- Regulatory or judicial authorities;
- IT service providers, providing system administration, hosting and support services in the event of cyber-related breaches.
In addition, we may share details of the report to third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
We will not share information identifying the whistleblower without the explicit consent of the whistleblower.
6. INTERNATIONAL TRANSFERS
Your Personal Data will be processed and hosted by WhistleB within the European Union.
Your report and any subsequent exchanges with the Case Managers may be transferred to the European Union if you are located in a non-EU country.
We may transfer your personal data to countries outside the UK or the EU. A transfer of personal data to a country outside the UK or EU may occur for the legitimate purposes mentioned above.
Please note that not all countries have a data protection level recognized as adequate by the ICO or the European Commission. For data transfers to countries outside the EU or the UK, we will ensure that the recipient applies the same standard of data protection before transferring any personal data. (e.g. through an agreement with the recipient containing the so-called “International Data Transfer Agreement” issued by the ICO, the “EU standard contractual clauses” of the European Union or other appropriate safeguards). 7. DATA SECURITY
We have put in place appropriate protective measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed:
a. There are a limited number of Case Managers. Case Managers are bound by a strict duty of confidentiality and have been given appropriate training to follow when handling your report.
b. If your report is escalated and shared with additional parties, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
c. In order to protect the identity of whistleblowers who choose to remain anonymous, when submitting a report, you will be assigned a username and password by the website which you can use to log in to the system and communicate with the Case Managers directly, without having to provide personal contact details.
d. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. DATA RETENTION
HOW LONG WILL YOU USE MY PERSONAL DATA FOR?
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements, including SOX. We may retain your personal data for a longer period if we reasonably believe there is a prospect of litigation.
To determine the appropriate retention period for personal data, we follow regulatory requirements and consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
9. YOUR LEGAL RIGHTS
Under data protection law, you have rights in relation to your personal data:
- Request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
- Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
