  • Your Pro Software Payroll and Benefits SaaS website.<\/li>\n<\/ul>\n

    • Us offline or through any other means, including on any other website we operate; or<\/li>\n
    • Any third party, including through any application or content (including advertising) that may link to or be accessible from the Website<\/li>\n<\/ul>\n

      Pro Software has implemented and will maintain an information security program that includes appropriate technical, administrative, electronic, physical and organizational security measures designed to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to any Customer Data. Pro Software shall implement reasonable encryption technologies for transmitting Personal Information and employ reasonable network security techniques including firewalls, intrusion detection, and authentication protocols in its provision of the Services.<\/p>\n

      1. Definitions<\/p>\n

      1.\u201cPersonal Information\u201d means information that Customer provides, or for which Customer provides access to Provider (including information from Customer Clients), or information which Provider creates or obtains on behalf of Customer, pursuant to the provision of Services that identifies, can be used to identify, relates to, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual, device, or household, as defined by applicable law.<\/p>\n

      2. Processing of Personal Information.<\/p>\n

        Pro Software shall comply with the following obligations with respect to Personal Information collected, received, or processed to provide the Services:<\/p>\n

          Pro Software may process Personal Information (1) to perform the Services, (2) for quality assurance and improvement activities related to the Services, and (3) to create de-identified or aggregated information that is no longer Personal Information (collectively, the \u201cPermissible Purposes\u201d). Pro Software may process de-identified or aggregated information for purposes other than the Permissible Purposes.<\/p>\n<\/li>\n

        2. \n

          Pro Software shall not retain, use, or disclose any Personal Information for any purpose other than the Permissible Purposes, or as otherwise permitted by the applicable Data Laws.<\/p>\n<\/li>\n

        3. \n

          Pro Software shall not retain, use, or disclose any Personal Information outside of the direct business relationship between Pro Software and its customers.<\/p>\n<\/li>\n

        4. \n

          Pro Software shall not Sell the Personal Information.<\/p>\n<\/li>\n

        5. In the event, a user is using our mobile application, we only use native device functionality for biometrics and do not store that information.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

            To the extent CCPA applies, the Parties acknowledge and agree that, Pro Software is a \u201cService Pro Software\u201d and Customer is a \u201cBusiness,\u201d as such terms are defined by the CCPA.<\/p>\n<\/li>\n<\/ol>\n

              Pro Software\u2019s customers have authorized Pro Software to receive, collect, and Process Personal Information for the Permissible Purposes, and its customers have obtained all necessary consents and provided all necessary notifications required by applicable Data Law with respect to the processing of Personal Information by Pro Software for the Permissible Purposes.<\/p>\n<\/li>\n<\/ol>\n

                In the event that an individual contacts Pro Software directly to exercise the rights granted to the individual under applicable Data Laws, including any right to access or deletion, Pro Software\u2019s responsibility shall be to promptly direct the individual to contact the Customer and to notify the Customer that a request, complaint, or inquiry from an individual has been made.<\/p>\n<\/li>\n<\/ol>\n<\/div>
