Openstage provides a software platform at https://manager.openstage.live/ (“Platform”) designed to allow performers and other artists and their fans (“Fans”) to communicate with one another and to share information, news and offers. This Privacy ​​Policy (together with our Terms and Conditions and any other documents referred to in this policy) sets out how Openstage (collectively, “we”, “our” and “us”) ​​processes personal data – relating to  artists and their management team (“Artists”) and other users we interact with (collectively ”you” and ”your”) through, or in connection with, the Platform in compliance with the UK Data Protection Act 2018, European General Data Protection Regulation (“GDPR”), California Consumer Privacy Act (“CCPA”), and other applicable privacy laws.  


Openstage is the controller of Artists’ personal data. This Privacy ​​Policy covers Openstage’s use of your personal data in connection with the Platform.  ​     ​ 


Please read the following carefully to understand our practices regarding your personal data and how we will treat it, and to learn how you can exercise your rights with respect to your personal data.

We collect personal data that you voluntarily provide to us through the Platform or otherwise. 


Personal data that you provide to us; 


  • When you register as an Artist, or when you book a demo through our Platform, you provide us with information such as your first name, last name, photo, business address, email address, organisation​​​​ name, size of your current mailing list and other contact details, bank details and financial information. 


  • Contact information and communications. We may collect your contact information and other personal data such as your name, email address, phone number(s) or address, when you contact us via email, telephone, social media, or by other means with questions or concerns or when you voluntarily respond to questionnaires or surveys. When you contact us, you also provide us with the content of your communications. 


  • Marketing information. If, as an Artist, you submit your interest to book a demo with us through our Platform, you can choose to consent to receive marketing communications from us. If you do so, we will use your email address. 


Personal data we automatically collect: 


We collect personal data about you automatically when you use the Platform, including: 


  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, your login information, time zone setting, browser type, browser plug-in types and versions, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G). 


  • Online activity data, such as information about how you access the Platform, information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our Platform (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.

  • To provide the Platform. We use personal data to operate, maintain, and provide you with our Platform. In particular, we use personal data to enter into a contract with you or to perform our contractual obligations under our Artist Terms and Conditions 


  • To communicate with you. We use your personal data to respond to your inquiries, comments, feedback, or questions. We do so to perform our contract with you or where it is in our legitimate business interests. 


  • To send administrative information to you. For example, we may send you information regarding the Platform and changes to our terms, conditions, and policies for the performance of our Terms and Conditions with you. 


  • For analytics and product improvement. Where it is in our legitimate business interests, we use your personal data for other business purposes, such as data analysis, analytics on the Platform and on Artist engagement, identifying usage trends, improving the content and functionality of the Platform, developing new products and features, personalising the Platform, determining the effectiveness of our promotional campaigns, and evaluating and improving our Platform, our marketing and your experience. In most cases, we will aggregate your personal data and use only aggregated information, such as statistics, which does not directly identify you, for these purposes. 


  • To protect our Platform. It is in our legitimate business interests to prevent fraud, criminal activity that could be damaging for us and for you, or misuses of our Platform, and to ensure the security of our IT systems, architecture, and networks, such as through troubleshooting and testing.
     

  • For compliance and legal reasons. We may use personal data to comply with legal obligations, and it is in our legitimate business interests to use your personal data to defend us against legal claims or disputes, including to:
