Terms of Service

Please read each point carefully before requesting a commission.
I am not responsible if the client has not carefully read the terms of service.

General:
✦ Commissions are accepted via Twitter DMs, Vgen, Instagram DMs or Tumblr DMs.✦ English is not my native language, so please write more clearly.✦ You must give me credit and not claim the work as your own.✦ It is the client's sole responsibility to cover the costs of VGen's service fee (service fee: 5%).✦ No refunds will be issued unless the sketch has not been started. For canceling your commission, please contact me IMMEDIATELY✦ I may display all commissioned work on social media for promotional purposes or include it alongside my other work in my portfolio, unless the client wishes to keep the commission private.✦ Private Commissions +10%✦ If you would like to add anything additional, please inform me in advance. For example, not posting, separating parts, file type, and file size.✦ Any disrespect will not be tolerated and may result in cancellation of the commission.✦ If the artist is unable to complete the task, the client will receive a full or partial refund depending on the amount of work performed (for example, if I have an accident or my equipment breaks down).✦ The use of my AI art and the sale of NFTs based on my works are strictly prohibited.

Revisions and Commission process:
✦ You will be sent a folder via Google Drive, where you can monitor the commission. You will be sent an initial draft (WIP) with the previously agreed-upon information. Three changes are allowed during the drafting period; additional changes will incur an additional fee.✦ I ask that you send me good references for characters, poses, color palette, and expressions. A description or a stick figure drawing will work; please be as specific as possible.

Personal and Commercial Use:
✦ The final product will be exclusively for personal use, on social media, or on a streaming platform.✦ Prior agreement is required to request products for commercial purposes, reproduction, or resale. I have the full right to accept or reject the imposed conditions and financial implications.✦ Upon payment, you are granted the right to use the artwork exclusively on platforms such as Twitch, Discord, YouTube, or other social media platforms. You do not own the copyright to the work, only the rights to use it on those platforms. I retain the copyright.✦ Commercial rights x2 at the base commission price.✦ My signature will appear on all commissions, unless they are for commercial use.

Payments:
✦ Once we have discussed all the details of the commission and you have approved it, payment can be made.✦ I accept full payment in advance or 50% before beginning work on a commission and 50% upon completion.✦ Prices are non-negotiable.✦ Prices are in US dollars and can be paid via VGen, Ko-fi, and PayPal, or by the methods provided by the artist.✦ PAYMENT CONSTITUTES ACCEPTANCE OF THE ABOVE TERMS.

Delivery:
✦ Once the product is delivered, it is the client's responsibility to care for and store it properly. Loss of files due to negligence will not be the responsibility of the artist (me, Luck), nor will a refund be issued, and I cannot guarantee the availability of the original files in such cases.✦ Turnaround times depend on demand but are typically between 2 and 3 weeks. Commissions are processed in the order they are received. Once the project is completed and payment is received, I will send you a high-resolution file via a Google Drive folder (PNG and PSD attached). The working file will be deleted from Google Drive and my device 2 weeks after delivery (depending on the Chilean time zone [GMT-4]). I am not responsible for lost files.✦ Any alternative delivery method must be mutually agreed upon before the project begins. I am not responsible for the client losing access to the delivery method or for lost files after delivery.✦ If you require your order within a specific timeframe (minimum 1 week), rush orders will incur a 50% additional charge.
