What happens if the police take too long to file a charge sheet against someone in jail?

The accused gets an indefeasible right to "Default Bail." Under the law (Section 167(2) CrPC / Section 187 BNSS), if the investigating agency fails to file a charge sheet within 60 or 90 days (depending on the severity of the crime), the accused must be released on bail, regardless of how serious the allegations are.
